    Abstract: Book, written in Slovene, discusses the legal content and scope of the concept of discriminatory harassment, which is deemed to be an unlawful discrimination under modern EU non-discrimination law, in the context of implementation of provisions of relevant EU directives in legal systems of the United Kingdom and Ireland. the two most important EU non-discrimination directives, adopted under Article 13 of the Treaty Establishing the European Community (now Article 19 of the treaty on the Functioning of the European union) - Racial Equality Directive (Directive 2000/43/EC) and Employment Framework Directive (Directive 2000/78/EC) - explicity mention harassment as prohibited form of discrimination. Legal definitions contained in these two directives define harassment as discriminationdiscrimination itself. Prior to the transposition of the EU non-discrimination directives into their laws, while few member states tackled this issue either within the context of the law on equal treatment (e.g. Denmark, the United Kingdom and Ireland) or outside this context (e.g. France), that is in the framework of criminal, civil, health and safety or employment legislation. As a result of the implementation of relevant provisions of the two main non-discrimination directives (Directives 200/43/EC and 200/78/EC) a definition of harassment has been included in legislations of all EU member states. In most member states such legislative definition is a literal copy of the definition of harrasment that can be found in the Directives 2000/43/EC and 2000/78/EC. The approach to the definition of harassment that appears to be the most "generous" from the perspective of victims of discriminatory harrasment is the one that was taken by British legislator. Such legal position in respect of the prohibition of discrimination has been developed in British case law and is based on the extensive interpretation of non-discrimination laws

    Abstract: Papua New Guinea’s general election in 2007 attracted particular interest for several reasons. Not only did it follow what was widely acknowledged as the country’s worst election ever, in 2002 (in which elections in six of the country’s 109 electorates were declared to be ‘failed elections’), it was the first general election to be held under a new limited preferential voting system. It also followed the first full parliamentary term under the Organic Law on the Integrity of Political Parties and Candidates, which had been introduced in 2001 in an attempt to strengthen political parties and create a greater degree of stability in the national parliament, and was the first to embrace a ‘whole-of-government’ approach to electoral administration, through an Interdepartmental Electoral Committee. This volume provides an analysis of the 2007 election, drawing on the work of a domestic monitoring team organized through the National Research Institute, and several visiting scholars. It addresses key issues such as voter education, electoral administration, election security, the role of political parties, women as candidates and voters, the shift to limited preferential voting, and HIV transmission, and provides detailed accounts of the election in a number of open and provincial electorates. It is generally agreed that the election of 2007 was an improvement on that of 2002. But problems of electoral administration and voting behaviour remain.     Abstract: For several centuries Cape Town has accommodated a great variety of musical genres which have usually been associated with specific population groups living in and around the city. Musical styles and genres produced in Cape Town have therefore been assigned an ìidentityî which is first and foremost social. This volume tries to question the relationship established between musical styles and genres, and social --in this case pseudo-racial --identities. In Sounding the Cape, Denis-Constant Martin recomposes and examines through the theoretical prism of creolisation the history of music in Cape Town, deploying analytical tools borrowed from the most recent studies of identity configurations. He demonstrates that musical creation in the Mother City, and in South Africa, has always been nurtured by contacts, exchanges and innovations whatever the efforts made by racist powers to separate and divide people according to their origin. Musicians interviewed at the dawn of the 21st century confirm that mixture and blending characterise all Cape Town's musics. They also emphasise the importance of a rhythmic pattern particular to Cape Town, the ghoema beat, whose origins are obviously mixed. The study of music demonstrates that the history of Cape Town, and of South Africa as a whole, undeniably fostered creole societies. Yet, twenty years after the collapse of apartheid, these societies are still divided along lines that combine economic factors and 'racial'categorisations. Martin concludes that, were music given a greater importance in educational and cultural policies, it could contribute to fighting these divisions and promote the notion of a nation that, in spite of the violence of racism and apartheid, has managed to invent a unique common culture

They contend that most poor countries lack the administrative and financial capacity to achieve these reforms or institutions - so donor conditionality often becomes a recipe for failure. There is little clarity on what is working, what is not, and why. This SSR Paper seeks to address this gap by mapping relevant approaches and methodologies to measuring impact. It examines how international actors have approached these questions in relation to support to rule of law and security institutions in complex peacebuilding environments. Most significantly, the paper demonstrates that measuring impact is not only feasible but necessary in order to maximise the effectiveness of major international investments in this field

    Abstract: This book examines how inter- and intra-party coalition-building affects governability in South Korea. Focusing on the Kim Dae-jung administration (1998-2003) as a case study in the failure of a government to turn electoral success into stable governability, or ability to implement reform policies, the book’s research draws on two bodies of literature which, though focusing on the same dependent variable (cabinet or government stability), have rarely been used in tandem: coalition research on parliamentary systems and studies of divided government in presidential systems. Youngmi Kim argues that a weak institutionalization of the ruling party and the party-system accounts for political instability and inefficient governability in Korea and in doing so her study makes a number of key contributions to the field. Theoretically it proposes a framework which integrates a rationalist approach with one that acknowledges the role of political culture. It further enhances the understanding of factors affecting governability after coalition-building across regime types and aims to build on recent demands for broader cross-regime analysis of minority/divided government and of the determinants of governability. This has important comparative implications as coalition-building within (semi-) presidential systems has occurred in other post-authoritarian contexts. The book finally provides a new dataset which fills a gap in a field where Western cases constitute the main focus of research. The Politics of Coalition in Korea will be of interest to students and scholars of Korean studies, Korean politics, Asian studies and Asian politics. In 1919 the government of the fledgling Republic of Austria was confronting revolutionary turmoil in the streets of Vienna, a near-total collapse of the agricultural and industrial economies, and the fallout of a crushing military defeat. In addition, the government was overburdened by the sheer number of new veterans, including the over 100,000 wounded soldiers returning from the frontlines. The redrawn Austrian borders produced a loss of German ethnics and major demographic shifts. Austrians—no longer dominant in a vast empire—were uncertain of their standing. In spite of ideological conflict between the major political camps, Austria experienced a cultural and educational revival—one that proved essential to forging a new national identity

    Abstract: Following a bloody civil war, peace consolidated slowly and sequentially in Bougainville. That sequence was of both a top-down architecture of credible commitment in a formal peace process and layer upon layer of bottom-up reconciliation. Reconciliation was based on indigenous traditions of peacemaking. It also drew on Christian traditions of reconciliation, on training in restorative justice principles and on innovation in womens' peacebuilding. Peacekeepers opened safe spaces for reconciliation, but it was locals who shaped and owned the peace. There is much to learn from this distinctively indigenous peace architecture. It is a far cry from the norms of a 'liberal peace' or a 'realist peace'. The authors describe it as a hybrid 'restorative peace' in which 'mothers of the land' and then male combatants linked arms in creative ways. A danger to Bougainville's peace is weakness of international commitment to honour the result of a forthcoming independence referendum that is one central plank of the peace deal

    Abstract: Constitutional considerations of protective laws for women were the analytical battlefield on which the legal community reworked the balance between private liberty and the state's authority to regulate. Julie Novkov focuses on the importance of gender as an analytical category for the legal system. During the Progressive Era and New Deal, courts often invalidated generalized protective legislation, but frequently upheld measures that limited women's terms and conditions of labor. The book explores the reasoning in such cases that were decided between 1873 and 1937. By analyzing all reported opinion on the state and federal level, as well as materials from the women's movement and briefs filed in the U.S. Supreme Court, the study demonstrates that considerations of cases involving women's measures ultimately came to drive the development of doctrine. The study combines historical institutionalism and feminism to address constitutional interpretation, showing that an analysis of conflict over the meaning of legal categories provides a deeper understanding of constitutional development. In doing so, it rejects purely political interpretations of the so-called Lochner era, in which the courts invalidated many legislative efforts to ameliorate the worst effects of capitalism. By addressing the dynamic interactions among interested laypersons, attorneys, and judges, it demonstrates that no individuals or institutions have complete control over the generation of constitutional meaning.     Abstract: Under a Memorandum of Understanding between Indonesia and Australia, traditional Indonesian fishermen are permitted access to fish in a designated area inside the 200 nautical mile Australian Fishing Zone (AFZ). However, crew and vessels are regularly apprehended for illegal fishing activity outside the permitted areas and, after prosecution in Australian courts, their boats and equipment are destroyed and the fishermen repatriated to Indonesia. This is an ethnographic study of one group of Indonesian maritime people who operate in the AFZ. It concerns Bajo people who originate from villages in the Tukang Besi Islands, Southeast Sulawesi. It explores the social, cultural, economic and historic conditions which underpin Bajo sailing and fishing voyages in the AFZ. It also examines issues concerning Australian maritime expansion and Australian government policies, treatment and understanding of Bajo fishing. The study considers the concept of “traditional” fishing regulating access to the MOU area based on use of unchanging technology, and consequences arising from adherence to such a view of “traditional”; the effect of Australian maritime expansion on Bajo fishing activity; the effectiveness of policy in providing for fishing rights and stopping illegal activity, and why Bajo continue to fish in the AFZ despite a range of ongoing restrictions on their activity

    Abstract: Peace operations became the core focus of many Western armed forces after the Cold War. The wish amongst political and military leaders during the 1990s to hold on to the classical identity of the armed forces as an instrument of force made them pursue a strict separation between military operations and the civilian aspects of peacekeeping, such as policing, administrative functions, and political and societal reconstruction. In his book Soldiers and Civil Power, Thijs Brocades Zaalberg argues that this policy failed to match up to reality. Supporting civil authorities, and at times even substituting them (de facto military governance), became the key to reaching any level of success in Cambodia, Somalia, Bosnia and Kosovo. As a result of the false segregation between the civilian and the military domain, this was accomplished mostly by improvisation and creativity of commanders who probed for the limiting boundaries of their original mandate by reaching ever further into the civilian sphere. In Reformation of Islamic Thought, the prominent Egyptian scholar Nasr Abû Zayd examines the positive, liberal, and inclusive reaction embedded in the writings of Muslim thinkers. He takes the reader on a critical journey across the Muslim World, where Muslim thinkers from Egypt and Iran to Indonesia seek to divest Islam of traditionalistic and legalistic interpretation. Instead, these thinkers stress the value of a cultural, enlightened Islam, and an individualistic faith.     Abstract: Traditionally, the Netherlands has enjoyed being a test market for many ideas in the media. But over the last decade, progress has been severely hampered by lengthy discussions on the future structure of just one sector of media, namely public broadcasting via radio and television. The narrow approach results in a lot of paper, speeches and theories, but little in the way of definitive policy making. In a report to the government, published in February 2005, the Scientific Council for Government Policy (WRR) argued for very different approaches to policy making. The recommendations are not only much broader than "broadcasting"; they tackle the challenges of making robust policy from new angles. Instead of trying to repair the old compass, the approach has been to find new instruments to help policymakers navigate the stormy and often confusing waters ahead. Perhaps the problem in the Netherlands is not accepting the new media, but rather accepting that the role "old" media has undergone a paradigm shift.
