Abstract: Throughout the world, ‘3.11’ and ‘Fukushima’ are used as synonyms for catastrophe, despair and insecurity. In a search for sociocultural meaning in the catastrophic events of ‘3.11’, Wiebke Grimmig examines the role of contemporary Japanese artists in the process by which Japanese society has handled the effects of this triple disaster (earthquake, tsunami and atomic disaster) in Fukushima. She focuses on the emotional processing of these events by her respondents, including their biographical background, their economic concerns and the role of contemporary art in Japanese society. This anthropological research involves the analysis of in-depth interviews with contemporary artists from Tokyo, as well as from other locations along the east coast of Japan. This research was conducted over a 12-month period to elucidate the catastrophic events and effects of the ‘3.11’ disaster. In this work, Wiebke Grimmig examines how contemporary Japanese artists portray catastrophic events in terms of emotion, individuality, power, resilience, politics, economics and communication in their biographical narrative and their work. This doctoral thesis provides an important contribution to the socio-scientific field of disaster research

Abstract: It is predicted that church membership in the Protestant church in Germany will be cut in half by 2060. Church tax liability plays a central role in church resignations. Therefore, reform proposals of the church tax law are discussed to prevent church resignations, such as the exemption of young professionals from church tax liability. However, the right to tax is not a purely ecclesiastical matter but has implications for the state sector. Therefore, the collection of church taxes entails framework conditions imposed by the Constitution, which limits the church's freedom of organization. This thesis examines the reform proposals of church tax law regarding their legal feasibility and, in doing so, sheds light on the limits of the tax autonomy of religious communities. Central questions are: How flexible is the taxation right of religious communities? What is the church allowed to do? And what can it implement?

Abstract: It is common practice for patients in a hospital to be treated by the on-duty physician. If patients want to be treated by a certain physician, then they are subject to additional charges. This is referred to as ‘chief physician treatment’ because it is often chief physicians who are selected to carry out treatment. Commonly, chief physicians are considered to be particularly experienced and competent. But even if a chief physician treatment is contractually agreed with the patient, in many cases it is not the chief physicians who provide the individual treatment services. Sometimes they do not even participate in the treatment at all but nevertheless all the services are billed as chief physician treatment. Whether and the extent to which the law allows this kind of practice, is the subject of this dissertation

Abstract: Although the school class is highly relevant for the school organization of instruction, it is predominantly addressed in empirical school research as an explanandum. The sociality of the school class, on the other hand, has hardly been focused on as an empirical object of research. The aim of this paper is to address this desideratum by considering the school class as an object that is constituted in a variety of ways in different discourses. It also asks how classroom teachers construct the school class in everyday-based discourse and relate themselves to it. Different types of data are used to examine how which normative conceptions of school classes are produced in educational, programmatic, and everyday-based discourse. Contributions in scholarly and contemporary practice-instructional literature, as well as specially collected interviews with classroom teachers in secondary schools, serve as data materials. The interviews, as well as the idea for this study, were developed within the framework of the project on making school classes at the Department of Empirical Research on Teaching and School Development at the Institute of Educational Science at the University of Göttingen. Abstract: Questions of digitization and the increasing heterogeneity of learners are just two of the central challenges that schools and universities currently face. Educational institutions are therefore undergoing constant change in order to ensure and develop the quality of education. The resulting innovation processes can be very diverse and relate to both structural conditions and social interactions in the teaching situation. This book deals with these changes (innovations) in teaching and learning in a variety of ways and addresses structural development measures as well as individual conditions of learning. Reference is made to both the school and the university context

Abstract: The "Concise Dictionary of Old Uyghur" is the first inventory of the entire vocabulary of Old Uyghur texts (manuscripts, block prints, inscriptions) found in the oasis cities of the ancient Silk Road (Turfan, Dunhuang and others). Also included is the rich loan vocabulary of Buddhist, Manichaean and Christian texts. With the help of the dictionary, editions of all text genres (religious, medical, astrological and divinatory texts, letters, deeds, contracts, inscriptions) can now be used for the first time without further lexicographic aids. The "Handwörterbuch des Altuigurischen" (Concise Dictionary of Old Uyghur) is particularly suitable for university teaching in the subject of Turkology, since even complex terms and collocations are covered. Because Old Uyghur is the best attested indigenous language of Central Asia in pre-Islamic times and at the same time the first extensively documented Turkic literary language, this variant of Old Turkic is of great importance not only for Turkology and general linguistics, but also for the diverse and still fascinating cultural history of the Silk Road. Abstract: Scientific research in educational science is not a novelty - at the latest since the 1980s, it has become established through the Commission for Scientific Research of the German Society for Educational Science. Even outside this institutionalized place, one encounters a not inconsiderable number of corresponding studies and publications under this keyword, which affect the disciplinary self-image on different levels and thereby not infrequently attest to a (supposed) peculiarity of the university discipline of educational science in comparison to other disciplines. The empirical investigation of the 'reality' of educational science, as (also) tested in this volume, focuses on different 'problem areas' of the measurement of educational science knowledge and its production. Characteristic for all contributions gathered here is an access to the source material by means of methods of distanced observation, through which semantics, discourse (excerpts), receptions, and reference spaces of educational science are examined exemplarily and in a comparatively abstract perspective, thus allowing conclusions to be drawn about one's own history of knowledge and science. In short: What do we know about educational science when we look at it from a distance? Translated with www.DeepL.com/Translator (free version)

Abstract: The well-known artist Georg Daniel Heumann (1691-1759), who came from Nuremberg, had been appointed as a university copper engraver at the Georgia Augusta in Göttingen in 1740. Because of his interest in itinerant street traders, he became the creator of the Göttingischen Ausruff, a series of prints of 30 artistic etchings. They are a valuable documentation of itinerant trade in a Lower Saxon agrarian town that was becoming a university town and where the traditional rural range of goods competed with the needs of a more sophisticated section of the population. With his excellent powers of observation and delight in detail, Heumann authentically captured the reality of life in Göttingen's street trading and the new ambience of the city. He did not depict types of street vendors, but individuals in their dress, body language, range of goods or services, Low German exclamations, and the way they transported and offered their wares. In the commentary, the editor presents the status of street trading within the Göttingen market regulations and the established guild system, which goods were desired and which were undesirable. Abstract: Knowing the history and context of a piece of landscape is an unfortunately often neglected necessity for planning disciplines (including conservation and forestry). Just as a doctor can only suggest an appropriate therapy if he knows the antecedents of the disease, the possible or appropriate changes to, for example, a forest can only be seriously considered if the historical, economic and social causes for its creation and current state are described and understood. The present work undertakes this comprehensive description for the remaining oak-hornbeam forest relicts, and widespread beech forests near Göttingen. Since vegetation science is understood here as an art of telling the story(s) and current background of an object, the vegetation study of these forests, however, only forms the basis for telling a multifaceted story. This story focuses on the historical coppice with standards forests, the struggle for their conversion into beech high forests, and the underlying sustainability views of various actors. Methodically, the author draws on current, archival and historical-contemporary literature from over 400 years. The result is a closely interwoven web consisting of: the perfect integration of coppice with standards into the historical economy, numerous competing notions of sustainability and their implementation in the context of sovereign power claims, as well as the resulting silvicultural change and the defamation of the coppice with standards forest. In the process, the creation and aftermath of myths that have never been questioned internally in forestry to this day, and the short-sightedness of current nature conservation are also uncovered. The overall result is not only the "disenchantment" of the "beautiful oak-hornbeam forest", but also that of the currently predominant beech forest on limestone - a forest type that, thanks to its abundance of colourful spring geophytes, has been called not only pretty, but also "natural". However, interdisciplinary observation suggests that the species richness of these forests is in part the consequence of the historical, formerly widespread coppice with standards forestry, which "persists" in the herb layer for a long time, but will also disappear in the future

Abstract: The essays by Klaus Düwel on German studies collected in this volume have been published for a period of around 40 years. They reveal that Düwel - in addition to Runology and Nordic studies - has also made German studies in its entirety his object of research. Philological accuracy, comparative readings and the question of the function characterize the analysis of the Middle High German texts from the 'Merseburger Zaubersprüche' to 'Reynke de Vos' and Luther. In addition, contributions to the history of reception in the Middle Ages have been included in this volume, which show quotations, discussions or reinterpretations of medieval artifacts, motifs, texts or heroic figures in modern times

Abstract: In recent years, the areas of German as a Foreign Language (GFL) and German as a Second Language (GSL) have taken quite different developmental paths. To unify these contrasts was the purpose of the 46th Annual Convention of the Association for German as a Foreign and a Second Language (FaDaF e.V.) in Chemnitz from 28 to 30 March 2019. The proceedings of this conference comprise contributions from both academic research and practice in the area of teaching German as a Foreign or Second Language as well as the Associations’ resolution concerning the recent German Immigration Act for Skilled Workers. Thematically, the contributions focus on didactics and methodology of German language teaching, transnational networking and the many facets of understanding – from language comprehension to (intercultural) hermeneutics. Opening with contributions from the young academics’ conference held prior to the annual convention, the volume Teaching – Networking – Understanding attempts to unify the many interfaces of research and practice

Abstract: It is rare for a physician to be disbarred; it is even rarer for the disbarment to have a retroactive effect back to the time of granting. The prerequisite for this effect is that the license to practice medicine should not have been granted in the first place, either because the requirements for the training of the future physician were not met or because character defects (unworthiness, unreliability) prevented the person concerned from working as a physician. Although practically rare, the revocation of a license to practice medicine is of particular academic interest because it ultimately results in the entire medical activity of the person affected being subsequently deprived of its legal basis. Strictly speaking, in consequence, each medical intervention becomes unlawful, thus (under certain circumstances) constituting a bodily injury under criminal law as well as giving rise to liability for damages under civil law. However, neither the criminal nor the civil law consequences of such retroactivity have yet been examined in a scientifically sound manner, even to a rudimentary degree. The present dissertation is intended to close this gap, at least in the area of civil law

Abstract: Between 1714 and 1837, the German Chancellery in London was the central administrative institution of the Electors of Brunswick-Lüneburg, and from 1814 Kings of Hanover during their time as British kings to organise their rule in absentia. Such personal unions were widespread in early modern Europe. This book is the first to focus paradigmatically on this most important institution of the personal union between Great Britain and the Electorate of Hanover. It examines the personal union as a space of communication and the functioning of a composite state under George I and George II from 1714 to 1760, focusing on the communication processes between the centres of government as well as their infrastructural, social and legal contexts. The so-called English Chancery in Hanover, which British politics and administration established in return during the kings' numerous extended journeys to their ancestral lands, is used as a level of comparison

Abstract: All over the world, borders are places of separation, distinction and violence on the one hand, and of encounter, mobility and everyday practices on the other. This is particularly true of the external borders of the European Union. When Spain joined the European Communities in 1986, Ceuta and Melilla, two cities in North Africa, became such an external border and the six-metre-high fences surrounding them became a symbol of “Fortress Europe”. But what does this mean for the people who live in such a place? How do they experience everyday life in a “caged city”, and how do they interpret their experiences? This sociological study focuses on figurations between old-established groupings in the border space between Spain and Morocco, and reconstructs a post-colonial border space in the light of transformation processes and slowly changing power balances, in which belongings and views of history are constantly being renegotiated. Different actors in the border space are studied from the perspective of figurational sociology, the sociology of memory and biographical research. Four detailed case analyses serve to illustrate the complexity of local social realities. These are embedded in historical and present-day social constellations in this border space between Spain and Morocco, and it is made clear that constructions of belonging and power relations in Ceuta and Melilla can only be understood in the context of colonial and post-colonial processes and events

Abstract: Burglary offenses, especially domestic burglaries, have increasingly been the focus of public interest in recent years. This area of crime is essential for the public's sense of security and thus also for crime policy. The tightening of penalties for domestic burglary enacted by the legislature in 2017 has been the subject of widespread discussion in criminal policy and criminal law dogmatics. This study addresses the offense area of burglary from an empirical perspective, the sanctioning of offenders as well as their criminal history and recidivism by evaluating a nationwide dataset from the Federal Central Register. Using the underlying data material, the criminal careers of burglars are also analyzed prospectively over a nine-year recidivism period and - if no redemptions were made - retrospectively over an indefinite period

Abstract: The subject of the dissertation is church asylum under the 2015 agreement of the Federal Office for Migration and Refugees (BAMF) and the Christian churches. The main legal, as well as actual differences to the granting of church asylum since the end of the 1980s are elaborated. The effects of the BAMF-church agreement and the subsequently implemented dossier procedure on the "legal problems" of church asylum are analyzed. This makes it possible to answer whether a legalization of church asylum - already feared 30 years ago - has occurred. In the result no legalization can be recognized, but a so far unknown degree of formalization. The state-provided hardship procedure for refugees in church asylum restricts the legitimacy of any sanctions or eliminates them altogether and shifts the burden of justification in other ways as well. This leads to new or changed consequences of church asylum under simple law

Abstract: With the introduction of the diploma graduate program ‘educational science’ in 1989 began a story of success, which continues up until now. Concurrently began the ongoing criticism of the structure, goals and content of the graduate program. The reforms initiated with the Bologna Process, in particular the modularization of study programs, were also and especially observed with concern by educational scientists; In the current state of research the Bologna Process often assumed to be a central reason for the increasing differentiation processes of disciplinary structure. The study takes the thesis of this increasing differentiation and the associated empirical observations on heterogeneity and plurality of educational studies as its starting point. The competency goals and content of examination regulations and other central documents of the program design will be described and analyzed. The study enables insights into the shape of current educational graduate programs, the changing process from diploma to bachelor studies and the effectiveness of constitutive framework documents

Abstract: In the period between the 16th and the 18th century, there was an unprecedented increase in statements criticising lawyers. They characterised judges and advocates in particular as greedy, corruptible and perverting the course of justice. In parallel, the image of an ideal jurist was drawn in the sources in the sense of a counter-draft. At the same time, in the early modern period not only did the field of activity of the legal experts change in the legal system itself, but also their role in the social structure. The development, use and content of both ideal concepts and patterns of criticism are closely related to these changes. The negotiation of professional legal ethics that took place in the early modern period is thus a component of the professional history of judges and lawyers

Abstract: The present paper analyzes the emergence of the modern artistic field as an indicator for the formation of the modern state. The work traces this development by looking at various fields that build on each other both thematically and chronologically. London, as the center of the British Empire, and Berlin, as the emerging metropolis of Prussia, represent two ideal areas for comparison. On the basis of seven selected formations of practice - the art academies, the artist's journey, the exhibition system, art criticism, private art collections, the emergence of the modern art museum, and the funeral ceremonies of famous artists - a comparative cultural history of the emergence of the figure of the artist and the artistic field is sketched

Abstract: "Our Faculty of Theology is really and truly the only Faculty of Theology from which something great and effective in the sense of the new state can be made if the Ministry is determined to rebuild. Dean Emanuel Hirsch to Rector Friedrich Neumann on June 16, 1934On a broad source basis, Hansjörg Buss deals with the theological faculty of the State University of Göttingen in the first half of the 20th century. The significance and influence of the new theological approaches of the interwar period as well as the social and political challenges on institutional action, research, teaching, administration, and journalism are examined, with the situation of the student body also being considered for the first time. It is shown that the faculty at no time found a positive relationship to the Weimar Republic. During the National Socialist dictatorship, the 'church struggle' and ideological competitive pressure from the Nazi state narrowed its scope. Plans to create a German-Christian flagship faculty fell through, hopes and disillusionment, loyalty to the state and opposition to church policy, academic continuity and institutional struggle for existence determined its further path. The collapse of the German Reich in May 1945 ushered in a far greater caesura: The personnel reorganization was connected with a theological reorientation that left a lasting mark on the faculty. The author: Dr. Hansjörg Buss, born in 1971, studied history, political science and law (public law). The present work was made possible by a three-year research fellowship from the Göttingen Faculty of Theology. Translated with www.DeepL.com/Translator (free version)

Abstract: Latin America and the German-speaking countries of Central Europe have for a long time maintained multifaceted and dynamic relations. This close interaction has also had a significant impact on the history and present of institutional Germanic studies in Latin America. There are, however, country-specific differences: while in the case of some locations there is only a rudimentary area of Germanic Studies, in others it is quite broadly established. The main purpose of this volume is to trace the existing diversity. The idea for the publication emerged during the 16th Congress of the Latin American Association of Germanists (ALEG) in Buenos Aires in December 2017. Within the framework of the section "History of Germanic Studies", the need for an anthology with contributions in German became evident, in which the developments and perspectives of Germanic studies in the various Latin American countries and regions are reviewed and discussed. Academics from across Latin America agreed to share insights and findings on the aims and foci of Germanic studies for the book project to be realized. Since the institutional framework of the discipline varies widely in Latin America, the initiators assume a broad concept of Germanic studies that encompasses the teaching and research of literary and cultural studies, as well as linguistic and translation studies, teacher training and the teaching of the German language itself. The anthology combines a total of 22 articles from eleven countries, written by 39 authors, and thus provides a broad and diverse view of the situation of Germanistic studies in Latin America. It includes overviews and analyses from Argentina, Bolivia, Brazil, Chile, the Dominican Republic, Ecuador, Colombia, Mexico, Paraguay, Uruguay and Venezuela

Abstract: In its aftermath, the bad outcome of the 2020 Arzakh/Mountain Karabakh war for Armenia also prompted German theologians to launch an initiative to draw attention to the cultural heritage of the region. In doing so, they tied in with the histo rically grown connection between German science and Armenia, which is related to the interest in the richness and beauty of this culture, whose heritage has been repeatedly endangered by wars and foreign rule. In the shadow of the war of 2020, this documentary takes a first look at the rescued treasures from Arzakh/Mountain Karabakh and introduces initiatives and personalities who were and are committed to the country and its people. Abstract: In the field of foreign-language teaching and learning, action-orientation is a didactic key principle. However, at present, empirical findings on how action-orientation can be pursued as a goal or put into practice as a teaching method in schools and at universities are scarce. Likewise, only little research has been conducted on the potentials and challenges of action-orientation from an academic perspective and from the perspective of teachers and learners so far. This volume provides an empirical contribution to the academic discourse on action-oriented approaches to foreign-language teaching and learning. While the volume's introduction gives an overview of the theoretical basis and empirical findings on action-orientation to date, the different contributions present individual studies in three areas: action-orientation in the teaching of foreign-language literature, action-oriented learning in global simulations and in school laboratories, and action-orientation in drama-/theatre-based foreign-language education

Abstract: Johann Friedrich von Uffenbach was a wealthy scion of a Frankfurt patrician family, of hereditary nobility, and the younger brother of Zacharias Conrad (1683-1734), one of the greatest book collectors and manuscript specialists of his time. He first studied under the mathematical rationalist Enlightenment philosopher Christian Wolff (1679-1754) in Halle before earning a law degree from the University of Strasbourg in 1714. As a European traveler, he kept detailed travel diaries and lived in Frankfurt as a private scholar with technical, natural history and artistic interests, a collector of books, instruments, paintings, drawings and prints. His enthusiasm for everything technical, measurable and newly invented led to experimental learning in a wide variety of fields, but - since there was no compulsion to earn a living - rarely to long-term employment. Practical evidence of Uffenbach's activities are, for example, a renovated bridge over the Main, various large fireworks, diverse music and an opera as well as some copperplate engravings. His scientific activities are documented in handwritten records, such as more than 8,000 pages of travel diaries, five volumes of minutes of meetings of his learned society founded in Frankfurt, numerous letters and manuscripts of unpublished writings: Uffenbach enjoyed traveling, learning, reading and testing, but the breadth of his studies was more important to him than their depth. Uffenbach's own handwritten catalogs and inventories of the collections correlated manuscripts with printed books in the library, instruments, models, drawings, and copper engravings. The result was a complex, multi-part working tool that he bequeathed in 1736 to the newly founded University of Göttingen, which received it after his death in 1770. Abstract: In recent years, the number of international students and researchers in Germany has been continually increasing. Based on ethnographic fieldwork in the university city of Göttingen, Antonie Fuhse asks how early career researchers from India navigate multiple modes of belonging during their master and doctoral studies. The book focuses on the role of mobility in negotiating normative ideas about one’s life course and the future. With the concept of ‘regimes of academic mobility’, Fuhse seeks to highlight the multiple actors, discourses and structures involved in academic mobility and how these create inequalities in access to international mobility. The study shows how age, class, and gender – and the interaction between the three – impact on students’ and researchers’ decisions to go to Germany, their experiences there, and their aspirations for the future. In investigating the multiple ways in which mobility is connected to marriage, Fuhse brings into focus a topic which has been largely neglected in studies of academic mobility

Abstract: The expansion of all-day schools should lead, among other things, to a changed teaching and learning culture that promotes motivational-affective competencies in students. But even after 20 years, all-day elementary schools do not seem to fulfill this. Scientific quality criteria are too rarely implemented in elementary schools. The aim of this dissertation was to investigate the effect of an (interlocked) extracurricular science program on elementary school students regarding their motivational-affective characteristics. For this purpose, an (interlocked) offer was implemented in the intervention study, whereby this was linked to physical education in half of the schools. The analysis of the questionnaires of 236 pupils showed that participation in a science offer can be profitable, but that the interlocking is not as highly effective as expected. The study suggests changing the intra-school structure and revising the understanding of interlocking

Abstract: What does the discipline of educational science ‚know‘ about ‚education‘ - the term that stands unchallenged at the core of educational knowledge? The present study asks, on the one hand, about the bodies of knowledge on education that has been handed down in disciplinary lexicons from almost a hundred years and, on the other hand, about the discipline that becomes visible in this stored knowledge. The knowledge stocks contouring educational knowledge are examined serially on three levels. (1.) that of the framing lexicon, (2.) that of the lemma titles associated with ‚education‘, and (3.) that of the explications‘ texts which specifically are devoted to the object of ‚education‘. In addition, (4.) the personal, textual and thematic reference spaces spanned in the explications are analyzed. The quantifying evaluation of the bodies of knowledge - such as lexical data and metadata, data in front of editors and authors, words, references, names, citations, and bibliographical references - is combined with a qualitative content-analytical reconstruction of knowledge configurations as they appear in prefaces and epilogues as well as in the explications of the educational lemmas. The project will elaborate the conjunctures, (dis)continuities, appropriations, and boundary markings of disciplinary knowledge on ‚education‘ from 1895 to 1989 - a period in which German-language educational science institutionalized, established, specialized, and diversified itself as a university-based, researching discipline

Abstract: In public discourses in Germany, the police as an institution is presented on the one hand as our “friend and helper” and the guarantor of law and order, and on the other hand as an organization with a monopoly on violence that (illegally) practices violence. Police officers are presented correspondingly as actors in the sphere of security and prevention of violence, and as victims or perpetrators of illegitimate violence. Beyond reflecting on these complementary images, this sociological study looks at the everyday work of the police and reconstructs this complex field of action. Using a combination of theoretical approaches from biographical research, social constructivism and figurational sociology, this empirical study of the work of uniformed police officers in Lower Saxony shows how their actions are processed in the context of specific organizational conditions and the biographical experiences of the individuals concerned. It is found that the structural features of police actions and interpretations are located at the interface between organization and biography: organizational orientations for police action and their interactive implementation in concrete situations and in the daily routines of the organization are closely intertwined with the biographies of the police officers concerned. The study shows that concrete police practices are not only influenced by socialization within the organization, but are also linked to biographical experiences and stocks of knowledge. This study thus contributes to our understanding of careers in the police, police work and everyday practice. Beyond this it provides general insights into the interrelationship between organizations and biographies

Abstract: The name DGGTB (Deutsche Gesellschaft für Geschichte und Theorie der Biologie; German Society for the History and Philosophy of Biology) reflects recent history as well as German tradition. The Society is a relatively late addition to a series of German societies of science and medicine that began with the “Deutsche Gesellschaft für Geschichte der Medizin und der Naturwissenschaften”, founded in 1910 by Leipzig University’s Karl Sudhoff (1853-1938), who wrote: “We want to establish a ‘German’ society in order to gather German-speaking historians together in our special disciplines so that they form the core of an international society…”. Yet Sudhoff, at this time of burgeoning academic internationalism, was “quite willing” to accommodate the wishes of a number of founding members and “drop the word German in the title of the Society and have it merge with an international society”. The founding and naming of the Society at that time derived from a specifi c set of historical circumstances, and the same was true some 80 years later when in 1991, in the wake of German reunification, the “Deutsche Gesellschaft für Geschichte und Theorie der Biologie” was founded. From the start, the Society has been committed to bringing studies in the history and philosophy of biology to a wide audience, using for this purpose its Jahrbuch für Geschichte und Theorie der Biologie. Parallel to the Jahrbuch, the Verhandlungen zur Geschichte und Theorie der Biologie has become the by now traditional medium for the publication of papers delivered at the Society’s annual meetings. In 2005 the Jahrbuch was renamed Annals of the History and Philosophy of Biology, reflecting the Society’s internationalist aspirations in addressing comparative biology as a subject of historical and philosophical studies

Abstract: Collecting societies are central players in copyright law in Germany with an annual turnover of currently almost two billion euros. Hundreds of thousands of cultural workers are directly dependent on the exploitation of their rights by collecting societies. Critics are of the opinion that these rights owners have only insufficient influence on the supposedly intransparent distribution of funds by the collecting societies. The criticism culminated in accusations of "mafia-like structures". This paper examines the internal structure and corporate governance of collecting societies. While their activities and state supervision are partially harmonized throughout Europe and regulated in the German VGG, the internal structure of the societies as a hybrid between private and public law has hardly been investigated. With the help of interviews with stakeholders, it is possible to evaluate the status quo and to make suggestions for improvement that are suitable for raising the standard of co-determination

Abstract: The subject of the work is the ancillary provisions for the licensing of waste management facilities, which on the one hand restrict the requested permission, but on the other hand often make it possible to issue it in the first place. The main focus of the work is a detailed examination of the security aspects, which play a special role in the structure of collateral clauses. It will be examined to what extent the regulations on security in the licensing of waste management facilities in the BImSchG and KrWG allow an appropriate balance of conflicting interests in the tension between economy and environmental protection. In this context, the history, the scope for action in the official order of the security aspects and the constitutional implications are also examined in more detail. In addition, the specifics of waste management facilities are shown which justify the fact that the regulations of security for the other types of facilities of the BImSchG are generally not applicable

Abstract: Temporary releases from prison and open prisons are elementary components of a rehabilitation-oriented prison system. This statement has remained unchanged after the federalism reform, with which the legislative competence for the prison system was transferred from the federal government to the states. The reform provides an opportunity to compare the 16 new state laws with each other and to examine the legal regulations on temporary releases from prisons and open prisons from admission to the penal institution through to discharge, taking into account normative administrative practice. In doing so, this is explored whether the federal states have maintained the standard established by the Federal German Prison Act of 1976, legitimized restorative tendencies or established innovations. The present work also makes a contribution to a constitutionally determined understanding of temporary releases from prison and open prisons

Abstract: The extensive collection of correspondences of Elisabeth Charlotte, Duchesse d’Orléans (known as Liselotte von der Pfalz), sister-in law of Louis XIV, is one of the few remaining sources with exceptional insight into the life at the court of the Sun King. Her letters contain numerous lively and witty descriptions of the appearances and bodily practices of the contemporaries she met there – descriptions that range from subtle anecdotes to scatological jokes. Especially the latter, sometimes paired with strong language, have led various scholars to believe that her writing style was not in accordance with the refined communication culture at the court. The perception of Liselotte’s writing style, characterized by literary and theatrical allusions, repartee, and a tendency towards detailed description of courtly life, seems to be dominated by a stereotypical classification of Liselotte as a “unrefined German” contrasted with the gallantry of the French. This study contradicts this assumption by analysing whether and to what extent the writing about the body in Liselotte’s letters follows the rules described in the handbooks on courtly communication of the Early Modern Period

Abstract: In this cultural anthropological examination Frauke Johanna Ahrens enquires into the scientific significance of the herbarium sheets of the Herbarium Göttingen in the period from 1832 to 1852. Based on a historical, object-focused ethnography and praxeology she itemizes how during the establishing phase of the collection institutionalized in 1832 the scientific practices and epistemic interests mutually influenced one another and found expression in the botanical specimens themselves. Each of the five chapters is dedicated to one practice – opening up the collection, ascribing values, acquiring plant material, doing research on herbarium sheets and teaching with herbarium sheets. Together with detailed object descriptions, the analysis emphasizes the materiality of knowledge in this way

Abstract: The dissertation deals with perspectives on Religious Education at German comprehensive schools which were created during the 2010s. It searches for conditions and potentials of Religious Education at the referred types of school. It especially focuses on models for Religious Education as a school subject, successful activities regarding ‘Religion and school life’ as well as on characteristics of new comprehensive schools. It combines both questions on Religious Education as a subject and on school development. The empirical study is based on 17 interviews with teachers and school principals at so-called ‘Oberschulen’ and ‘Integrierte Gesamtschulen’, which were analyzed by qualitative content analysis. The study provides results to a neglected area of research: many studies on Religious Education or Educational Science look at grammar schools. The study creates starting points for diverse discourses and target groups. It demonstrates that Religious Education makes an important contribution to school education, but that it is time to modify some approaches and activities

Abstract: The case studies in this volume illustrate the global dimension of flight and migration movements with a special focus on South-South migration. Thirteen chapters shed light on transcontinental or regional migration processes, as well as on long-term processes of arrival and questions of belonging. Flight and migration are social phenomena. They are embedded in individual, familial and collective histories on the level of nation states, regions, cities or we-groups. They are also closely tied up with changing border regimes and migration policies. The explanatory power of case studies stems from analyzing these complex interrelations. Case studies allow us to look at both “common” and “rare” migration phenomena, and to make systematic comparisons. On the basis of in-depth fieldwork, the authors in this volume challenge dichotomous distinctions between flight and migration, look at changing perspectives during processes of migration, consider those who stay, and counter political and media discourses which assume that Europe, or the Global North in general, is the pivot of international migration

Abstract: In recent years, the topic of "academic success" has gained enormous importance in both higher education policy and the sciences. The 4th volume of the series 'University Sports: Education and Science' takes up this development from a sports science perspective and examines possible connections between sporting activity and academic success with an interdisciplinary focus. In order to record and expand the scientific knowledge on the relevance of sporting activity in the university setting, scientists from various disciplines present their thoughts, observations and findings on the topic. Based on a broad understanding of the concept of academic success, the significance of sporting activity is analyzed in terms of institutional criteria (e.g. final grade, length of study or dropout) as well as individual factors (e.g. study satisfaction, health skills, social skills, psychosocial health)

Abstract: Hermann Hesse erlangte von Beginn seines literarischen Schaffens an viel Beachtung.

Abstract: Inclusive teaching and school development is currently a central topic of educational research on schools, teaching, and professionalization. However, the German school type of Gymnasium (grammar school) is rarely taken into account. Nevertheless, changes in the general conditions and the associated reform expectations of the last decades are also reflected in studies on Gymnasium. With the three exploratory studies contained in this volume, we ask how inclusion at respectively for the Gymnasium is addressed by teachers at that type of school and by students in a Gymnasium teacher training program. The state of research on the perspectives of teachers as well as students in teacher training programs on inclusion is presented in a separate article. The discussion will be introduced with a contribution on the position of Gymnasium in the structured school system in Germany and the resulting challenges for an inclusive school development that includes the Gymnasium

Abstract: Few crimes capture the interest and attention of the public as sexual driven crime. Relapsing sex offenders especially spark debates on how best to deal with this particular group. Incidents of serious sexual crimes are, fortunately, rare in Germany which partly complicates empirical research into sexual criminality. This study aims to contribute to an understanding of sexual crimes by providing an overview of such offences in Germany by nature of the offence, offender-types, penalties and (partially) criminal careers from the perspective of judicial oversight of sexual crime. The study examines 9,430 sexual offenders from all over Germany based on data from the Federal Central Criminal Register where either custodial sentences were served or non-custodial sanctions imposed in the base year. It tracks the sample group over six years comparing their outcomes with other non-sexual offender types

Abstract: The liberal professions are subject to an ever changing legal basis and thus constantly undergo minor or major amendments. A fundamental innovation in the current law governing the liberal professions of tax consultants is the authorization to work as in-house tax consultants. Since 2008, the Tax Consultancy Act has made possible to pursue the profession of in-house tax advisor, while lawyers were allowed to work in-house for decades already, with the last amendment of the legal regulations from 2016. This paper deals with the various legal and practical implications of the interactions between the freelance activity as a tax consultant and the activity of in-house tax consultants in an employment relationship. A detailed comparison of the legal basis for tax consultants with that of in-house lawyers is of special interest in light of the current ambiguous legal situation. Special focus is a thorough analysis of the legal question whether or not an in-house tax adviser can be exempted from the obligatory pension insurance

Abstract: In this dissertation, Paul Christensen examines the significant roles played by spirits in Cambodian society. In particular, he focuses on the handling of the traumatic past, the religious identification of Cambodians, the political empowerment of elites through spiritual legitimation strategies, and the living ritual practice of spirit mediums in Cambodia. Based on 13 months of ethnographic field research and an innovative methodology utilizing actor-network theory, the research provides an emic understanding of these religious phenomena in terms of a ‘(re-)enchanted modernity’ that is manifesting itself across Southeast Asia. The dissertation makes a seminal contribution to the scholarly understanding of spirits. It is compelling not only because of the novel connections provided by its methodology; its ethnographic descriptions of social topics such as power, existence, religion, healing, love or mourning provide new insights into religious life in a rapidly changing country

Abstract: The tenth volume of the yearbook Turkish-German Studies examines the question of how German-Turkish relations have changed as a result of the growing popularity of right-wing populist parties in Germany, the attempted coup in Turkey in 2016 and the refugee agreement between the EU and Turkey. The contributions deal with right-wing populism and right-wing radicalism, values and the scientific subject position in intercultural research activities

Abstract: In 2020, the Institute for Educational Science celebrated its 100-year anniversary – in 1920 Herman Nohl became the first professor for Pedagogy and subsequently founded the Pedagogic Seminar in July 1920. In celebration of this jubilee, the contributions to this edition bring forward various aspects of the history of educational science at the University of Göttingen. The book includes two lectures, which were given during the ceremonial act on 29 January 2020 and discuss the development of pedagogy as a discipline before its institutionalization. Additionally, it sheds light onto names, places and programs, which played an important part in the Institute’s history. Finally, the research methods are discussed from a reflexive point of view, including questions regarding data collection and the presentation of results

Abstract: In September 2018 the criminal law section of the 72nd Deutscher Juristentag (DJT, “German Assembly of Jurists”) debated the question “Sentencing Guidelines vs. Free Judicial Discretion – Is German Sentencing Law in Need of Reform?” Despite the expert opinion provided by Johannes Kaspar and the accompanying scholarly commentaries, ensuing proposals for fundamental reform met with rejection. The comparative perspective was limited to the US Federal sentencing guidelines. The intention of this volume is therefore, on the one hand, to draw a more nuanced picture of Anglo-American sentencing law focusing on three legal systems (England/Wales, USA and Canada) accompanied by commentaries from a German perspective; on the other hand, we want to make the German perspective (better) known within the Anglo-American legal world by reproducing important DJT documents in English language. To ensure the widest possible distribution we opted for a bilingual open access publication

Abstract: The past fifty years have seen far-reaching changes in Palestinian society in the West Bank. The Israeli occupation which began in 1967, the political mobilization of the 1970s and 1980s, and the so-called peace process in the 1990s went together with deep social transformations, which not only changed the dynamics of the Israeli-Palestinian conflict, but also altered the figurations and conflict lines between different social groups within Palestinian society. This book is a sociological study of these transformation processes, based on a combination of Norbert Elias’ figurational sociology, social-constructivist biographical research, and Karl Mannheim’s sociology of knowledge and generational sociology. In addition to conflicts and tensions between inhabitants of the old refugee camps and the (new) urban middle class in the West Bank, the author focuses in particular on a latent Palestinian generational conflict: it is clear that members of the ‘Oslo Generation’ – meaning those who grew up during the Oslo peace process in the 1990s – have fewer power and life chances, and in particular fewer opportunities for meaning, than their predecessors in the generation of fighters and activists of the 1970s and 1980s

Abstract: The use of resources is the precondition of all life. This is foremost true for natural resources such as water, food and fuels but also for immaterial resources like information and efficient social networks. In this book authors from different disciplines try to understand the dealing with resources in a historical perspective. Thereby they analyse topics such as the supply of food in classical Greece, the forest management in the Austrian Alps provinces of the nineteenth century, libraries as stores of knowledge and the present landscape as resource for a better understanding of the past. Together, the papers which are the result of a 2019 workshop of the Göttingen based research project “Nachhaltigkeit als Argument / Sustainability as an Argument” show the diversity and potentials of historical research in the field of resources

Abstract: In Italy, Solidarity Villages are state-provided places of accommodation for Romani people. In Rome, they are typically fenced off areas equipped with low-quality portable housing. In the media, these halting sites are often represented as a culturally appropriate housing solution. Yet, these camps are neither temporary halting places nor cultural forms of housing. Rather, they are places of segregation, conflict and negotiation—sites where racism, sexism and a particular way of dealing with poverty and migration condense. Beginning with the declaration of a Nomad Emergency in 2008, Simona Pagano documents the emergence of the spatial logic of the camp and offers an intersectional analysis of the complex power relations that shape the lives of its female residents. Drawing on ethnographic engagement, as well as interviews with institutional actors and civil society organizations, Pagano shows that the camps are often places of segregation and control, of profit generation and violence, but also, spaces of solidarity, homemaking and friendship

Abstract: The armed conflict in Syria which began in 2011, caused one of the largest refugee movements in the context of collective violence and war since World War II. Those who fled during the complex, increasingly violent and militarized Syrian civil war – in total about half of the pre-conflict population – have predominantly looked for a place of refuge, security and participation chances in other regions within Syria or in neighboring countries. Relatively few people had the resources to migrate to comparatively distant countries (such as countries in the “European Union”). This sociological study focuses on the processes of “refuge migration” and the experiences of refugees who migrated in the context of the armed conflict in Syria via the Spanish-Moroccan border zone surrounding the enclaves of Ceuta and Melilla. Based on a combination of biographical and figurational approaches and the concept of belonging, I empirically reconstruct the migration, social situations and self-presentations of Syrian refugees in the Spanish-Moroccan border zone. My ethnographic research in the Spanish enclaves shows differences and similarities in the way Syrian refugees experience, deal with and present their social situation in these transit spaces of migration. A central finding of my study highlights that the refugees’ presentation of their life stories and their escape from violence are heavily overlaid by their present preoccupations in the refugee camp and the presentation of shared – or supposedly shared – experiences of fleeing from war. The focus of their biographical self-presentations lay on their precarious and heteronomous current situation and the presentation of a homogenizing we-image as “Syrian refugees”. These patterns of self-presentation obstructed speaking about their “individual” courses of flight from a war. This tended to cover up differences and social conflicts that existed in Syria before the war as well as diverging “individual” experiences of the war. Drawing on biographical case reconstructions, I contrast these findings by showing how war and armed conflict are processes of social transformation that have different meanings and different consequences for individuals and social collectives. The cases of a Syrian-Kurdish refugee, a Syrian-Algerian-Palestinian family and a Syrian-Turkmen married couple show how processes of “refugee migration” are interrelated with diverging life and collective histories. The interviewees’ experiences during the armed conflict, as well as the courses of “forced migration” are inherently related to changing positions within networks of interdependency. This explains why the conflict has very different consequences for the refugees’ present perspectives and constructions of belonging. My empirical results are discussed in the light of the state of the art in the field of refugee-studies and forced migration research. Drawing on perspectives from sociology and anthropology of violence and armed conflict, I conceptualize “refugee migration” as a certain type of migration: “Refugee migration” is a type of migration that is constituted in the context of social transformations and changes in the social order caused by, and causing, collective violence. Violence-based transformations are an integral part of the genesis and the overall trajectories of these processes of migration. These transformations affect social boundaries and figurations between individuals and groupings, constructions of belonging and patterns of biographical (re-)orientation. “Refugee migration” is not only a reaction to collective violence, but must be seen in its ongoing embeddedness in the dynamics of violence which structure the whole migration process

Abstract: How is the handling of contested “objects” from the German colonial era shaped in ethnological Museums in Germany and Cameroon? This ethnographic study connects, for the first time, approaches from ethnology, (international) law, (art) history and museology which constitute the multidisciplinary field of “return” to deal with this question. Two current return claims of things from Cameroon at ethnological museums in Munich and Berlin take centre stage: Tange/Schiffschnabel and Ngonnso’/Schalenträgerfigur. The reconstruction of the cultural biographies of the contested items documents their part as points of intersection in complex networks of relations and stakeholders from the 19th century to this day. These networks connect people and institutions in Cameroon and Germany and their diverse conceptions and claims on these things in a versatile manner. Return claims, according to the thesis, appear as a magnifying lens which discloses diverging conceptions of things and ontologies

Abstract: Racism as a historically grown power relation varies in its complex configurations, depending on social-political as well as local-historical contexts. This study examines how students deal with racism, with a particular focus on the contexts and institutions of academia. Due to the adaptive potential of current forms of racism, paradox spheres (of negotiation) open up to those affected by it: On the one hand, as academics, they are included, however, in a limited way, while on the other hand they remain excluded due to their ongoing experiences of being othered. The analyses show that the social and institutional handling of racism and experiences of racism are mostly tabooed or de-thematized. These structural circumstances fundamentally affect the students’ handling of racism

Abstract: This volume brings together the presentations of the 16th Göttingen Workshop on Family Law held on 19 October 2018, which dealt with the latest proposals of the Federal Ministry of Justice and Consumer Protection on the reform of guardianship law (2nd draft discussion section). At the beginning, the main changes were presented (Thomas Meyer, Heike Wunderlich) before the basic concept of guardianship responsibility in the area of personal care was examined from the perspective of science (Dieter Schwab), child and youth welfare (Helga Oberloskamp) and family jurisdiction (Werner Dürbeck). This was followed by a closer look at the basic principles of the guardian’s asset care (Tobias Fröschle) as well as the guardian's obligation to obtain approval for dispositions of claims and securities (Dagmar Zorn)

Abstract: Nachhaltigkeit ist allgegenwärtig.

Abstract: W National Park lies in the border triangle of Benin, Burkina Faso and Niger in West Africa. Established under French colonial rule in 1927, it was designated as the first African transborder biosphere reserve in 2002. Although the Benin part of the reserve was given a participatory management approach in 2002, illegal hunting, logging, transborder mobile herding and cash cropping continue to pose important threats to the reserve. The whole area, especially the buffer zone, is a source of conflicts between the different adjacent communities and between communities and park administration. The book analyses how the surveillance teams operate in this context. It describes encounters between park surveillance staff and local stakeholders in three different arenas: the park’s core area, adjacent villages and public political forums. It shows how, in a setting dominated largely by cash crop production, the abstract idea „national park“ is being translated by park staff and how in the process local meanings of the idea emerge. Drawing on 14 months of ethnographic research between 2008 and 2010, this book contributes to the current state of research on participatory natural resources management. Moreover, it provides insights into the working of state administration in a context of contradictory policies of conservation and rural development
Abstract: Der grenzüberschreitende Nationalpark W liegt in Westafrika im Dreiländereck von Benin, Burkina Faso und Niger.
