    Abstract: Providing a detailed introduction to the thought of Carl Schmitt that incorporates insights from law, the social sciences, and the humanities, this Oxford handbook is also an intervention in its own right, seeking to decenter the study of this most hyped thinker of the twentieth century by advancing two interconnected arguments: that the motif of order is a powerful yet insufficiently utilised heuristic device for making sense of Schmitt's thought, and that a trinity of thought is discernable in Schmitt's writings comprising his political, legal, and cultural thought. We establish intellectual connections across these three bodies of thought and trace the mutually constitutive relationships that exist among them. Schmitt's thought, we find, amounted to a network of ideas about the sources of social order, the cement of society.

    Abstract: This book addresses the problem of justifying the institution of criminal punishment. It examines the "paradox of retribution: the fact that we cannot seem to reject the intuition that punishment is morally required, and yet we cannot (even after two thousand years of philosophical debate) find a morally legitimate basis for inflicting harm on wrongdoers. The book comes at a time when a new "abolitionist movement has arisen, a movement that argues that we should give up the search for justification and accept that punishment is morally unjustifiable and should be discontinued immediately. This book, however, proposes a new approach to the retributive theory of punishment, arguing that it should be understood in its traditional formulation that has been long forgotten or dismissed: that punishment is essentially a defense of the honor of the victim. Properly understood, this can give us the possibility of a legitimate moral justification for the institution of punishment.?

    Abstract: This volume presents two Leibnizian writings, the Specimen of Philosophical Questions Collected from the Law and the Dissertation on Perplexing Cases. These works, originally published in 1664 and 1666, constitute, respectively, Leibniz’s thesis for the title of Master of Philosophy and his doctoral dissertation in law. Besides providing evidence of the earliest development of Leibniz’s thought and amazing anticipations of his mature views, they present a genuine intellectual interest, for the freshness and originality of Leibniz’s reflections on a striking variety of logico-philosophical puzzles drawn from the law. The Specimen addresses puzzling issues resulting from apparent conflicts between law and philosophy (the latter broadly understood as comprising also mathematics, as well as empirical sciences). The Dissertation addresses cases whose solution is puzzling because of the convoluted logical form of legal dispositions and contractual clauses, or because of conflicting priorities between concurring parties. In each case, Leibniz dissects the problems with the greatest ingenuity, disentangling their different aspects, and proposing solutions always reasonable and sometimes surprising.     Abstract: The notion of “natural law” has repeatedly furnished human beings with a shared grammar in times of moral and cultural crisis. Stoic natural law, for example, emerged precisely when the Ancient World lost the Greek polis, which had been the point of reference for Plato's and Aristotle's political philosophy. In key moments such as this, natural law has enabled moral and legal dialogue between peoples and traditions holding apparently clashing world-views. This volume revisits some of these key moments in intellectual and social history, partly with an eye to extracting valuable lessons for ideological conflicts in the present and perhaps near future. The contributions to this volume discuss both historical and contemporary schools of natural law. Topics on historical schools of natural law include: how Aristotelian theory of rules paved the way for the birth of the idea of "natural law"; the idea's first mature account in Cicero's work; the tension between two rival meanings of “man’s rational nature” in Aquinas’ natural law theory; and the scope of Kant’s allusions to “natural law”. Topics on contemporary natural law schools include: John Finnis's and Germain Grisez's “new natural law theory”; natural law theories in a "broader" sense, such as Adolf Reinach’s legal phenomenology; Ortega y Gasset’s and Scheler’s “ethical perspectivism”; the natural law response to Kelsen’s conflation of democracy and moral relativism; natural law's role in 20th century international law doctrine; Ronald Dworkin’s understanding of law as “a branch of political morality”; and Alasdair Macintyre’s "virtue"-based approach to natural law.​

    Abstract: 1797 erscheint mit den Metaphysischen Anfangsgründen der Rechtslehre Immanuel Kants rechtsphilosophisches Hauptwerk. Nicht selten begegnet man daher der Auffassung, Kants Rechtsphilosophie entstamme im Wesentlichen seiner Spätphase und sei überdies nur schwer mit der kritischen Moralphilosophie der 1780er Jahre in Einklang zu bringen. Vor diesem Hintergrund widmet sich die vorliegende Untersuchung dem Vergleich des kantischen Rechtsbegriffs, wie er 1797 in der Einleitung in die Rechtslehre vorgestellt wird, mit Kants Ausführungen in den Vorlesungsnachschriften Moral-Mrongovius II und Naturrecht-Feyerabend aus dem Jahre 1784. Dabei kann nachgewiesen werden, dass der Rechtsbegriff von 1797 bereits 1784 ausgearbeitet war. Mehr noch: Es zeigt sich, dass Kants Rechtsbegriff nicht nur bereits in der Phase seiner kritischen Moralphilosophie vorlag, sondern vielmehr in einem Guss mit ihr konzipiert wurde und wie diese auf dem kritischen Freiheitsbegriff basiert.

    Abstract: This collection of essays investigates the obligations we have in respect of future persons, from our own future offspring to distant future generations. Can we harm them? Can we wrong them? Can the fact that our choice brings a worse off person into existence in place of a better off but 'nonidentical' person make that choice wrong? We intuitively think we are obligated to treat future persons in accordance with certain stringent standardsroughly those we think apply to our treatment of existing persons. We think we ought to create better lives for at least some future persons when we can do so without making things worse for too many existing or other future persons. We think it would be wrong to engage in risky behaviors today that will have clearly adverse effects for the children we intend one day to conceive. And we think it would be wrong to act today in a way that would turn the Earth of the future into a miserable place. Each of these intuitive points is, however, challenged by the nonidentity problem. That problem arises from the observation that future persons often owe their very existence to choices that appear to make things worse for those same persons. New reproductive technologies, for example, can be both risky and essential to one persons coming into existence in place of a 'nonidentical' other or no one at all. But so can a myriad of other choices, whether made just prior to conception or centuries beforechoices that seem to have nothing to do with procreation but in fact help to determine the timing and manner of conception of any particular future person and thus the identity of that person. Where the persons life is worth living, it is difficult to see how he or she has been harmed, or made worse off, or wronged, by such an identity-determining choice. We then face the full power of the nonidentity problem: if the choice is not bad for the future person it seems most adversely to affect, then on what

    Abstract: "Foucault's Law is the first book in almost fifteen years to address the question of Foucault's position on law. Many readings of Foucault's conception of law start from the proposition that he failed to consider the role of law in modernity, or indeed that he deliberately marginalized it. In canvassing a wealth of primary and secondary sources, Ben Golder and Peter Fitzpatrick rebut this argument. They argue that rather than marginalize law, Foucault develops a much more radical, nuanced and coherent theory of law than his critics have acknowledged. For Golder and Fitzpatrick, Foucault's law is not the contained creature of conventional accounts, but is uncontainable and illimitable. Dieses Werk gehört zweifelsohne zu den rechtstheoretischen Schlüsselschriften des 20. Jahrhunderts. In ihm entwickelt Kelsen erstmals im systematischen Zusammenhang seine einerseits das Recht von der Moral, andererseits die Norm vom Faktum konsequent scheidende Rechtstheorie. Wer auf der Höhe der Zeit über Struktur und Geltung von Recht und die Eigenart von Rechtswissenschaft, kurz: wer über das Rechtliche am Recht nachdenken will, kommt an der »Reine[n] Rechtslehre« nicht vorbei.     Abstract: Hans Kelsen's »Pure Theory of Law«, which was published in 1934, is one of the key works on legal theory in the 20th century. In it, Kelsen presents a theory in which he separates the law from morality on the one hand and on the other hand from proven fact, a theory which was also critical of ideologies. Anyone wanting to think about the structure and the validity of the law and the characteristics of jurisprudence, in short, anyone wanting to think about the normativity of the law, will inevitably have to deal with the »Pure Theory of Law.« The first edition of this work, which has been translated into approximately a dozen languages, was reprinted several times in German, but is currently out of print. It is now available as a student edition, which is intended to encourage those interested in the law to read through it and to give it their careful and critical consideration.

    Abstract: Rights language is a fundamental feature of the modern world. Virtually all significant social and political struggles are waged, and have been waged for over a century now, in terms of rights claims. In some ways, it is precisely the birth of modern rights language that ushers in modernity in terms of moral and political thought, and the struggle for a modern way of life seems for many synonymous with the fight for a universal recognition of equal, individual human rights. Where did modern rights language come from? What kinds of rights discourses is it rooted in? What is the specific nature of modern rights discourse, when and where were medieval and ancient notions of rights transformed into it? Can one in fact find any single such transformation of medieval into modern rights discourse? Der Geist der Rationalität, der die Moderne durchwaltet, steht Erscheinungen irrationaler Provenienz verständnislos, sprachlos und feindlich gegenüber: er misstraut dem Spiel, wehrt dem Zufall und verachtet den Humor. Auch das Tabu gilt rationalem Geist als Ausfluss noch zu überwindender Restbestände der Irrationalität in der modernen Gesellschaft, ist jedem Aufklärer ein fortwährendes Skandalon, darf im rationalen Rechtsstaat nicht "im Recht" sein. Doch das Vertrauen in eine rationale Gestaltung der Welt ist tief verunsichert, der naive Vernunftoptimismus der Aufklärung verflogen. Rationalität muß reflexiv werden, die irrationalen Faktoren des Lebens anerkennen, ihre Versuchungen und Gefahren erkennen, die Grenzen der Rationalität bestimmen und daraus rational Konsequenzen ziehen. Die Frage nach dem Verhältnis von Recht und Tabu, die in diesem Band aus verschiedener Perspektive beleuchtet wird, zielt auf Funktion wie Inhalt des Tabus im Recht und zeigt die identitätsstiftende Notwendigkeit und rationalitätskompensatorische Funktion der Tabus auf. Das Tabu markiert die Grenze der Rationalität, hindert den Totalitätsanspruch des Rationalismus und ermöglicht gerade dadurch Rationalität.

    Abstract: Verlagsinfo: How can we distinguish between injustice and misfortune? What can we learn from the victims of calamity about the sense of injustice they harbor? In this book a distinguished political theorist ponders these and other questions and formulates a new political and moral theory of injustice that encompasses not only deliberate acts of cruelty or unfairness but also indifference to such acts. Judith N. Shklar draws on the writings of Plato, Augustine, and Montaigne, three skeptics who gave the theory of injustice its main structure and intellectual force, as well as on political theory, history, social psychology, and literature from sources as diverse as Rosseau, Dickens, Hardy, and E. L. Doctorow. Shklar argues that we cannot set rigid rules to distinguish instances of misfortune from injustice, as most theories of justice would have us do, for such definitions would not take into account historical variability and differences in perception and interest between the victims and spectators. From the victim's point of view - whether it be one who suffered in an earthquake or as a result of social discrimination - the full definition of injustice must include not only the immediate cause of disaster but also our refusal to prevent and then to mitigate the damage, or what Shklar calls passive injustice. With this broader definition comes a call for greater responsibility from both citizens and public servants. When we attempt to make political decisions about what to do in specific instances of injustice, says Shklar, we must give the victim's voice its full weight. This is in keeping with the best impulses of democracy and is our only alternative to a complacency that is bound to favor the unjust.
