    Abstract: Constituent power is the power to create new constitutions. Since it is frequently exercised during or after political revolutions, it has been historically associated with extra-legality and violations of the established legal order. This book examines the relationship between constituent power and the law and the place of constituent power in constitutional history, focusing on the legal and institutional implications that theorists, politicians, and judges havederived from it. 0Since the 18th and 19th centuries, commentators and citizens have relied on the concept of constituent power to defend the idea that electors have the right to instruct representatives, and that the creation of new constitutions must take place through extra-legislative entities, such as primary assemblies open to all citizens. More recently, several Latin American constitutions explicitly incorporate the theory of constituent power and allow citizens, acting through popular initiative, totrigger constitution-making episodes that may result in the replacement of the entire constitutional order.0Constitutional courts have employed constituent power to justify their jurisdiction to invalidate constitutional amendments that alter the fundamental structure of the constitution and thus amount to a constitution-making exercise. Some governments have reverted to it to defend the legality of transforming the constitutional order through procedures not contemplated in the constitution's amendment rule, but considered participatory enough to be equivalent to 'the people in action', and these0attempts have sometimes been sanctioned by courts. 0

Chronicling the history of the struggle for religious freedom from the early Christian movement through the seventeenth century, Robert Louis Wilken shows that the origins of religious freedom and liberty of conscience are religious, not political, in origin. Through vivid histories drawn from virtually every continent, A World Divided describes how, since the eighteenth century, nationalists have struggled to establish their own states that grant human rights to some people. At the same time, they have excluded others through forced assimilation, ethnic cleansing, or even genocide. From Greek rebels, American settlers, and Brazilian abolitionists in the nineteenth century to anticolonial Africans and Zionists in the twentieth, nationalists have confronted a crucial question: Who has the “right to have rights?” A World Divided tells these stories in colorful accounts focusing on people who were at the center of events. And it shows that rights are dynamic. Proclaimed originally for propertied white men, rights were quickly demanded by others, including women, American Indians, and black slaves. A World Divided also explains the origins of many of today’s crises, from the existence of more than 65 million refugees and migrants worldwide to the growth of right-wing nationalism.     Abstract: Comparative constitutional law has a long pedigree, but the comparative study of constitution-making has emerged and taken form only in the last quarter-century. While much of the initial impetus came from the study of the American and French constituent assemblies in the late eighteenth century, this volume exemplifies the large comparative scope of current research. The contributors discuss constituent assemblies in South East Asia, North Africa and the Middle East, Latin America, and in Nordic countries. Among the new insights they provide is a better understanding of how constituent assemblies may fail, either by not producing a document at all or by adopting a constitution that fails to serve as a neutral framework for ordinary politics. In a theoretical afterword, Jon Elster, an inspirational thinker on the current topic, offers an analysis of the micro-foundations of constitution-making, with special emphasis on the role of crises-generated passions.

Brinks and Abby Blass use case studies drawn from nineteen Latin American countries over forty years to reveal the ideas behind the new systems of constitutional justice. They show how constitutional designers entrust their hopes and fears to dynamic governance systems, in hopes of directing the development of constitutional meaning over time"--
    Abstract: "This project started many years ago, as an article-length project on the apparent diffusion of new models of courts throughout Latin America. A paper Dan Brinks was writing for APSA dovetailed with a paper Abby Blass was writing for a graduate seminar, and the project evolved through conversations between the two authors after that. Both Abby and Dan had other projects to attend to, so the collaboration moved slowly, but we both felt it was intellectually productive. In its early stages in particular, each of the authors contributed important elements and carried out a mutual back and forth that makes it difficult to separate each author's contributions to the initial conceptualization and measurement exercises. Similarly, the basic argument evolved out of conversations between the authors, with each pushing the other to clarify and specify the argument further. Through conceiving and writing the pieces we have called "Conceptualization" (now an article in the International Journal of Constitutional Law, and largely contained in chapter 2 and the Appendix) and "Determinants" (the theory and quantitative analysis that underpins chapters 3 and 4), we collaborated fully. This is the core of the intellectual contribution of the book, and our joint work on these pieces is the principal, though not the only, reason Abby is credited as a co-author"--

Das gilt auch für die angebliche Unvereinbarkeit von Demokratie und Islam oder die vorgebliche Neigung des Islam zur Gewalt. Rudolf Steinberg unterzieht diese Annahmen einer kritischen Betrachtung und fragt nach der institutionellen Verortung eines deutschen Islam. Er führt in einer tour d'horizon sachlich und differenziert durch die aktuellen juristischen und politischen Diskussionen. Denn "die" Scharia gibt es ebenso wenig wie "den" Islam.

    Abstract: The book explores how international organizations (IOs) have expanded their powers over time without formally amending their founding treaties. IOs intervene in military, financial, economic, political, social, and cultural affairs, and increasingly take on roles not explicitly assigned to them by law. The proposed book will contend that this 'mission creep' has allowed IOs to intervene internationally, most often in the Global South, in a way that has allowed them to recast institutions within and interactions among states, societies, and peoples on a broadly Western, liberal model. Adopting a historical and interdisciplinary, socio-legal approach, it supports this claim through detailed investigations of historical episodes involving three very different organizations: the International Labour Organization in the interwar period; the United Nations in the two decades following the Second World War; and the World Bank from the 1950s through to the 1990s. The book draws on a wide range of original institutional and archival materials, bringing to light little-known aspects of each organization's activities, identifying continuities in the ideas and practices of international governance across the twentieth century, and speaking to a range of pressing theoretical questions in present-day international law and international relations --Front flap of the book

    Abstract: This books maps out the territory of international law and religion challenging receiving traditions in fundamental aspects. On the one hand, the connection of international law and religion has been little explored. On the other, most of current research on international legal thought presents international law as the very victory of secularization. By questioning that narrative of secularization this book approaches these traditions from a new perspective. From the Middle Ages' early conceptualizations of rights and law to contemporary political theory, the chapters bring to life debates concerning the interaction of the meaning of the legal and the sacred. The contributors approach their chapters from an array of different backgrounds and perspectives but with the common objective of investigating the mutually shaping relationship of religion and law.     Abstract: The Beginnings of Islamic Law is a major and innovative contribution to our understanding of the historical unfolding of Islamic law. Scrutinizing its historical contexts, the book proposes that Islamic law is a continuous intermingling of innovation and tradition.     Abstract: "In some religious countries, churches have drafted constitutions, restricted abortion, and controlled education. In others, church influence on public policy is far weaker. Why? Nations under God argues that where religious and national identities have historically fused, churches gain enormous moral authority--and covert institutional access. These powerful churches then shape policy in backrooms and secret meetings instead of through open democratic channels such as political parties or the ballot box. Through an in-depth historical analysis of six Christian democracies that share similar religious profiles yet differ in their policy outcomes--Ireland and Italy, Poland and Croatia, and the United States and Canada--Anna Grzymała-Busse examines how churches influenced education, abortion, divorce, stem cell research, and same-sex marriage. She argues that churches gain the greatest political advantage when they appear to be above politics. Because institutional access is covert, they retain their moral authority and their reputation as defenders of the national interest and the common good. Nations under God shows how powerful church officials in Ireland, Canada, and Poland have directly written legislation, vetoed policies, and vetted high-ranking officials. It demonstrates that religiosity itself is not enough for churches to influence politics--churches in Italy and Croatia, for example, are not as influential as we might think--and that churches allied to political parties, such as in the United States, have less influence than their notoriety suggests"--

    Abstract: German constitutionalism has gained a central place in the global comparative debate, but what underpins it remains imperfectly understood. Its distinctive understanding of the rule of law and the widespread support for its powerful Constitutional Court are typically explains in one of two ways: either as a story of change in a reaction to National Socialism or as the continuation of an older nineteenth-century line of constitutional thought that emphasizes the function of constitutional law as a constraint on state power. But while both narratives account for some important features, their explanatory value is ultimately overrated. This book adopts a broader comparative perspective to understand the rise of the German Constitutional Court. It interprets the particular features of German constitutional jurisprudence and the Court's strength as a reconciliation of two different legal paradigms: first, a hierarchical legal culture, as opposed to a more co-coordinated understanding of legal authority such as prevails in the United States; and, secondly, a more recent paradigm of transformative constitutionalism, which is most often associated with countries like South Africa and India. -- From book jacket
