    Abstract: Constituent power is the power to create new constitutions. Since it is frequently exercised during or after political revolutions, it has been historically associated with extra-legality and violations of the established legal order. This book examines the relationship between constituent power and the law and the place of constituent power in constitutional history, focusing on the legal and institutional implications that theorists, politicians, and judges havederived from it. 0Since the 18th and 19th centuries, commentators and citizens have relied on the concept of constituent power to defend the idea that electors have the right to instruct representatives, and that the creation of new constitutions must take place through extra-legislative entities, such as primary assemblies open to all citizens. More recently, several Latin American constitutions explicitly incorporate the theory of constituent power and allow citizens, acting through popular initiative, totrigger constitution-making episodes that may result in the replacement of the entire constitutional order.0Constitutional courts have employed constituent power to justify their jurisdiction to invalidate constitutional amendments that alter the fundamental structure of the constitution and thus amount to a constitution-making exercise. Some governments have reverted to it to defend the legality of transforming the constitutional order through procedures not contemplated in the constitution's amendment rule, but considered participatory enough to be equivalent to 'the people in action', and these0attempts have sometimes been sanctioned by courts. 0

    Abstract: Why have social spending levels and social policy trajectories diverged so drastically across labour-abundant Middle Eastern and North African regimes? And how can we explain the marked persistence of spending levels after divergence? Using historical institutionalism and a mix of qualitative and quantitative methods Social Dictatorships: The Political Economy of the Welfare State in the Middle East and North Africa develops an explanation of social spending in authoritarian regimes. It emphasizes the importance of early elite conflict and attempts to form a durable support coalition under the constraints imposed by external threats and scarce resources. Social Dictatorships utilizes two in-depth case studies of the political origins of the Tunisian and Egyptian welfare state to provide an empirical overview of how social policies have developed in the region, and to explain the marked differences in social policy trajectories. It follows a multi-level approach tested comparatively at the cross-country level and process-traced at micro-level by these case studies.

    Abstract: The very concept of human rights implies governmental accountability. To ensure that governments are indeed held accountable for their treatment of citizens and others the United Nations has established a wide range of mechanisms to monitor compliance, and to seek to prevent as well as respond to violations. The panoply of implementation measures that the UN has taken since 1945 has resulted in a diverse and complex set of institutional arrangements, the effectiveness of which varies widely. Indeed, there is much doubt as to the effectiveness of much of the UN's human rights efforts but also about what direction it should take. Inevitable instances of politicization and the hostile, or at best ambivalent, attitude of most governments, has at times endangered the fragile progress made on the more technical fronts. At the same time, technical efforts cannot dispense with the complex politics of actualizing the promise of human rights at and through the UN. In addition to significant actual and potential problems of duplication, overlapping and inconsistent approaches, there are major problems of under-funding and insufficient expertise. The complexity of these arrangements and the difficulty in evaluating their impact makes a comprehensive guide of the type provided here all the more indispensable. These essays critically examine the functions, procedures, and performance of each of the major UN organs dealing with human rights, including the Security Council and the International Court of Justice as well as the more specialized bodies monitoring the implementation of human rights treaties. Significant attention is devoted to the considerable efforts at reforming the UN's human rights machinery, as illustrated most notably by the creation of the Human Rights Council to replace the Commission on Human Rights. The book also looks at the relationship between the various bodies and the potential for major reforms and restructuring.

    Abstract: Anthropological theory can radically transform our understanding of human experience and offer theologians an introduction to the interdisciplinary nature between anthropology and Christianity.     Abstract: Deliberative democracy has challenged two widely-accepted nostrums about democratic politics: that people lack the capacities for effective self-government; and that democratic procedures are arbitrary and do not reflect popular will; indeed, that the idea of popular will is itself illusory. On the contrary, deliberative democrats have shown that people are capable of being sophisticated, creative problem solvers, given the right opportunities in the right kinds of democratic institutions. But deliberative empirical research has its own problems. In this book two leading deliberative scholars review decades of that research and reveal three important issues. First, the concept 'deliberation' has been inflated so much as to lose empirical bite; second, deliberation has been equated with entire processes of which it is just one feature; and third, such processes are confused with democracy in a deliberative mode more generally. In other words, studies frequently apply micro-level tools and concepts to make macro- and meso-level judgements, and vice versa. Instead, Bächtiger and Parkinson argue that deliberation must be understood as contingent, performative, and distributed. They argue that deliberation needs to be disentangled from other communicative modes; that appropriate tools need to be deployed at the right level of analysis; and that scholars need to be clear about whether they are making additive judgements or summative ones. They then apply that understanding to set out a new agenda and new empirical tools for deliberative empirical scholarship at the micro, meso, and macro levels.

    Abstract: This book offers a major new theory of global governance, explaining both its rise and what many see as its current crisis. The author suggests that world politics is now embedded in a normative and institutional structure dominated by hierarchies and power inequalities and therefore inherently creates contestation, resistance, and distributional struggles. Within an ambitious and systematic new conceptual framework, the theory makes four key contributions. Firstly, it reconstructs global governance as a political system which builds on normative principles and reflexive authorities. Second, it identifies the central legitimation problems of the global governance system with a constitutionalist setting in mind. Third, it explains the rise of state and societal contestation by identifying key endogenous dynamics and probing the causal mechanisms that produced them. Finally, it identifies the conditions under which struggles in the global governance system lead to decline or deepening. Rich with propositions, insights, and evidence, the book promises to be the most important and comprehensive theoretical argument about world politics of the 21st century.

    Abstract: Whether inspired by the Frankfurt School or Antonio Gramsci, the impact of critical theory on the study of international relations has grown considerably since its advent in the early 1980s. This book offers the first intellectual history of critical international theory. Richard Devetak approaches this history by locating its emergence in the rising prestige of theory and the theoretical persona. As theory's prestige rose in the discipline of international relations it opened the way for normative and metatheoretical reconsiderations of the discipline and the world. The book traces the lines of intellectual inheritance through the Frankfurt School to the Enlightenment, German idealism, and historical materialism, to reveal the construction of a particular kind of intellectual persona: the critical international theorist who has mastered reflexive, dialectical forms of social philosophy. . In addition to the extensive treatment of critical theory's reception and development in international relations, the book recovers a rival form of theory that originates outside the usual inheritance of critical international theory in Renaissance humanism and the civil Enlightenment. This historical mode of theorising was intended to combat metaphysical encroachments on politics and international relations and to prioritise the mundane demands of civil government over the self-reflective demands of dialectical social philosophies. By proposing contextualist intellectual history as a form of critical theory, Critical International Theory defends a mode of historical critique that refuses the normative temptations to project present conceptions onto an alien past, and to abstract from the offices of civil government.

Counter Revolution is a bold attempt to make sense of the extraordinary events taking place in Europe today. It examines the counter-revolution developing in Europe, exploring its roots and implications. The book takes the form of a series of heartfelt letters to the late European guru Ralf Dahrendorf. Several months after the fall of the Berlin Wall, Dahrendorf wrote a book fashioned on Edmund Burke's Reflections on the Revolution in France. Like Burke, he chose to put his analysis in the form of a letter, reflecting on the implications of the turbulent period around 1989. Thirty years' later, and faced with an equally turbulent period, Jan Zielonka asks: what next? This is not a book on populism, however: it is a book about liberalism. Populism has become a favourite topic within liberal circles and few have exposed populist deceptions and dangers better than liberal writers. Yet, liberals have shown themselves better at finger-pointing than at self-reflection. This book addresses the imbalance; it is a self-critical book by a life-time liberal. Counter-Revolution suggests that Europe and its liberal project need to be reinvented and recreated. There is no simple way back. Emmanuel Macron and Angela Merkel will not produce wonders. Europe failed to adjust to enormous geopolitical, economic, and technological changes that swept the continent over the past three decades. European models of democracy, capitalism, and integration are not in sync with new complex networks of cities, bankers, terrorists, or migrants. Liberal values that made Europe thrive for many decades have been betrayed. The escalation of emotions, myths, and ordinary lies left little space for reason, deliberation, and conciliation. This book examines these different aspects, proposing a way out of the labyrinth.

    Abstract: International organizations (IOs) matter. This book uncovers the regular working world of IOs, examining whether, to what extent, and how these 'global governing bodies' can act independently of the will of states. This book explores this issue by asking who or what shapes their decisions; how and when decisions are made; how players interact within an IO; and how the interactions vary across IOs. The Working World of International Organizations examines three working groups in the higher echelons of IOs - state representatives, as proxy of states, serving in the Executive Boards or General Councils, chief officers of IOs, and the staff of the permanent secretariat. The book demonstrates that none of them are unified; in each there are contested ideas about strategy and appropriate projects, and analyses their interactions to explain who is able to shape or influence decisions. Six representative IOs are studied to identify the relevant critical determinants that shape the behaviour of players. The volume explores how these players have an impact over three dilemmas that are common to all IOs: priority and agenda setting, financing, and the centralization or decentralization of operations.

Building on a model of contextual effects on individual-level voter behaviour, the chapters of this volume explore contextual effects in Germany in the early twenty-first century. The volume draws upon manifold combinations of individual and contextual information gathered in the German Longitudinal Election Study (GLES) framework and employ advanced methods.     Abstract: "There is a mounting body of evidence pointing towards rising levels of public dissatisfaction with the formal political process. Depoliticization refers to a more discrete range of contemporary strategies that add to this growing trend towards anti-politics by either removing or displacing the potential for choice, collective agency, and deliberation. This book examines the relationship between these two trends as understood within the broader shift towards governance. It brings together a number of contributions from scholars who have a varied range of concerns but who nevertheless share a common interest in developing the concept of depoliticization through their engagement with a set of theoretical, conceptual, methodological, and empirical questions.     Abstract: The question of toleration matters more than ever. The politics of the twenty-first century is replete with both the successes and, all too often, the failures of toleration. Yet a growing number of thinkers and practitioners have argued against toleration. Some believe that liberal democracies are better served by different principles, such as respect of, or recognition for, people's ways of life. Others argue that because the liberal state should be entirely neutral or indifferent towards people's ways of life, it can no longer be tolerant - it has no grounds on which it can object, and so there is nothing left to tolerate. Respecting Toleration provides a new, original, and provocative take on the question of toleration and its application to the politics of contemporary diversity. Peter Balint argues for both the conceptual coherence and normative desirability of toleration and neutrality. He argues that it is these principles which best realise the basic liberal good of people living their lives as they see fit, rather than appealing to principles of recognition or respect for difference. While those who criticised liberalism's failings in dealing with the claims of diversity had justification, it is the tenets of traditional liberalism that hold the answer. Respecting Toleration argues that if one cares about people living divergent lives, then it is liberal toleration that should be respected by legislators and policy makers, and not people's differences

    Abstract: The book explores how international organizations (IOs) have expanded their powers over time without formally amending their founding treaties. IOs intervene in military, financial, economic, political, social, and cultural affairs, and increasingly take on roles not explicitly assigned to them by law. The proposed book will contend that this 'mission creep' has allowed IOs to intervene internationally, most often in the Global South, in a way that has allowed them to recast institutions within and interactions among states, societies, and peoples on a broadly Western, liberal model. Adopting a historical and interdisciplinary, socio-legal approach, it supports this claim through detailed investigations of historical episodes involving three very different organizations: the International Labour Organization in the interwar period; the United Nations in the two decades following the Second World War; and the World Bank from the 1950s through to the 1990s. The book draws on a wide range of original institutional and archival materials, bringing to light little-known aspects of each organization's activities, identifying continuities in the ideas and practices of international governance across the twentieth century, and speaking to a range of pressing theoretical questions in present-day international law and international relations --Front flap of the book

    Abstract: Europe is currently experiencing a "refugee crisis", demonstrated by millions of displaced people unseen since World War II. This book examines the interface between the EU's response to irregular flows, in particular the main extraterritorial border and migration controls taken by the Member States, and the rights asylum seekers acquire from EU law. "Remote control" techniques, such as the imposition of visas, fines on carriers transporting unsatisfactorily documented third-country nationals, and interception at sea are investigated in detail in a bid to assess the impact these measures have on access to asylum in the EU. The book also thoroughly analyses the rights recognised by the EU Charter of Fundamental Rights to persons in need of international protection, inclusive of the principle of non-refoulement, the right to leave any country including one's own, the right to asylum, and the right to remedies and effective judicial protection. The fundamental focus of the book is the relationship between the aforementioned border and migration controls and the rights of asylum seekers and, most importantly, how these rights (should) limit the scope of such measures and the ways in which they are implemented. The ultimate goal is to conclude whether the current series of extraterritorial mechanisms of pre-entry vetting is compatible in EU law with the EU rights of forced migrants.--

However, like most political buzzwords, the term often floats from one meaning to another, and both social scientists and journalists use it to denote diverse phenomena. What is populism really? Who are the populist leaders? And what is the relationship between populism and democracy? This book answers these questions in a simple and persuasive way, offering a swift guide to populism in theory and practice. Cas Mudde and Cristóbal Rovera Kaltwasser present populism as an ideology that divides society into two antagonistic camps, the "pure people" versus the "corrupt elite," and that privileges the general will of the people above all else. They illustrate the practical power of this ideology through a survey of representative populist movements of the modern era: European right-wing parties, left-wing presidents in Latin America, and the Tea Party movement in the United States. The authors delve into the ambivalent personalities of charismatic populist leaders such as Juan Domingo Péron, H. Ross Perot, Jean-Marie le Pen, Silvio Berlusconi, and Hugo Chávez. If the strong male leader embodies the mainstream form of populism, many resolute women, such as Eva Péron, Pauline Hanson, and Sarah Palin, have also succeeded in building a populist status, often by exploiting gendered notions of society.     Abstract: Until now, there has been no direct and extensive engagement with the category of religion from liberal political philosophy. Over the last thirty years or so, liberals have tended to analyze religion under proximate categories such as 'conceptions of the good' (in debates about neutrality) or 'culture' (in debates about multiculturalism). US constitutional lawyers and French political theorists both tackled the category of religion head-on (under First Amendment jurisprudence and the political tradition of laicite, respectively) but neither of these specialized national discourses found their way into mainstream liberal political philosophy. This is somewhat paradoxical because key liberal notions (state sovereignty, toleration, individual freedom, the rights of conscience, public reason) were elaborated as a response to 17th Century European Wars of Religion, and the fundamental structure of liberalism is rooted in the western experience of politico-religious conflict. So a reappraisal of this tradition - and of its validity in the light of contemporary challenges - is well overdue. This book offers the first extensive engagement with religion from liberal political philosophers. The volume analyzes, from within the liberal philosophical tradition itself, the key notions of conscience, public reason, non-establishment, and neutrality. Insofar as the contemporary religious revival is seen as posing a challenge to liberalism, it seems more crucial than ever to explore the specific resources that the liberal tradition has to answer it

    Abstract: Emotional Cities' offers an innovative account of the history of cities in the second half of the nineteenth century. Analyzing debates about emotions and urban change, it questions the assumed dissimilarity of the history of European and Middle Eastern cities during this period. The author shows that between 1860 and 1910, contemporaries in both Berlin and Cairo began to negotiate the transformation of the urban realm in terms of emotions. Looking at the ways in which a variety of urban dwellers, from psychologists to bar maids, framed recent changes in terms of their effect on love, honor, or disgust, the book reveals striking parallels between the histories of the two cities. By combining urban history and the history of emotions, Prestel proposes a new perspective on the emergence of different, yet comparable cities at the end of the nineteenth century.

    Abstract: Since its publication in 1993, John Rawls's Political Liberalism has been central to debates concerning political legitimacy, democratic theory, toleration, and multiculturalism in contemporary political theory. Yet, despite the immense body of literature which has been produced since Rawls's work was published, very little has been said or written regarding the place of political parties and partisanship within political liberalism. This book aims to fill this gap in the literature. Its central argument is that political liberalism needs and nourishes political parties, and that political parties are therefore not hostile but vital to it. First, partisanship generates its own distinctive kind of political obligations, additional to any political obligations people may have qua ordinary citizens. Second, contrary to what many critics argue, and despite its admittedly restrictive features, Rawls's conception of public reason allows significant scope for partisan advocacy and partisan pluralism, and in fact the very normative demands of partisanship are in sympathy with those of public reason. Third, parties contribute to the overlapping consensus that for Rawls guarantees stability in diverse societies. Fourth, political liberalism nourishes political parties, by leaving many issues, including religious and socio-economic ones, open to democratic contestation. In summary, parties contribute both to the legitimacy and to the stability of political liberalism

    Abstract: Why is the Horn such a distinctive part of Africa? This book, by one of the foremost scholars of the region, traces this question through its exceptional history and also probes the wildly divergent fates of the Horn's contemporary nation-states, despite the striking regional particularity inherited from the colonial past. Christopher Clapham explores how the Horn's peculiar topography gave rise to the Ethiopian empire, the sole African state not only to survive European colonialism, but also to participate in a colonial enterprise of its own. Its impact on its neighbours, present-day Djibouti, Eritrea, Somalia and Somaliland, created a region very different from that of post-colonial Africa. This dynamic has become all the more distinct since 1991, when Eritrea and Somaliland emerged from the break-up of both Ethiopia and Somalia. Yet this evolution has produced highly varied outcomes in the region's constituent countries, from state collapse (and deeply flawed reconstruction) in Somalia, through militarised isolation in Eritrea, to a still fragile 'developmental state' in Ethiopia.     Abstract: Building and sustaining solidarity is a compelling challenge, especially in ethnically and religiously diverse societies. Recent research has concentrated on forces that trigger backlash and exclusion. The Strains of Commitment examines the politics of diversity in the opposite direction, exploring the potential sources of support for an inclusive solidarity, in particular political sources of solidarity. The volume asks three questions: Is solidarity really necessary for successful modern societies? Is diversity really a threat to solidarity? And what types of political communities, political agents, and political institutions and policies help sustain solidarity in contexts of diversity? To answer these questions, the volume brings together leading scholars in both normative political theory and empirical social science. Drawing on in-depth case studies, historical and comparative research, and quantitative cross-national studies, the research suggests that solidarity does not emerge spontaneously or naturally from economic and social processes but is inherently built or eroded though political action. The politics that builds inclusive solidarity may be conflicting in the first instance, but the resulting solidarity is sustained over time when it becomes incorporated into collective (typically national) identities and narratives, when it is reinforced on a recurring basis by political agents, and - most importantly - when it becomes embedded in political institutions and policy regimes. While some of the traditional political sources of solidarity are being challenged or weakened in an era of increased globalization and mobility, the authors explore the potential for new political narratives, coalitions, and policy regimes to sustain inclusive solidarity.--

    Abstract: What explains differences in the lobbying behaviour of interest groups? And what consequences do these differences have for the access that interest groups can gain to decision-makers and the influence that they can exert on policy outcomes? Building on an unprecedented amount of empirical evidence on lobbying in Europe, this book puts forward a distinction between lobbying insiders and lobbying outsiders. Lobbying insiders, most prominently business interests, try to establish direct contacts with decision-makers, enjoy good access to executive institutions, and manage to shape policy outcomes when mobilizing the public on an issue is difficult. Lobbying outsiders, in particular citizen groups such as consumer, environmental or health non-governmental organizations, put greater emphasis on mobilizing the public or changing public attitudes, find it easier to gain access to legislative decision-makers, and have the greatest impact on outcomes on issues that are amenable to an outside lobbying campaign. The book shows that a single argument, building on group types as the main variable, can explain variation across interest groups in their choice of strategy, their access to decision-makers, and the conditions under which they can exert influence

Do we have to relate past texts of political thought to the contexts in which ideas were composed and in which the aims of past thinkers were formulated?     Abstract: Virtually every important question of public policy today involves an international organization. From trade to intellectual property to health policy and beyond, governments interact with international organizations in almost everything they do. Increasingly, individual citizens are directly affected by the work of international organizations. Aimed at academics, students, practitioners, and lawyers, this book gives a comprehensive overview of the world of international organizations today. It emphasizes both the practical aspects of their organization and operation, and the conceptual issues that arise at the junctures between nation-states and international authority, and between law and politics. While the focus is on inter-governmental organizations, the book also encompasses non-governmental organizations and public policy networks. With essays by the leading scholars and practitioners, the book first considers the main international organizations and the kinds of problems they address. This includes chapters on the organizations that relate to trade, humanitarian aid, peace operations, and more, as well as chapters on the history of international organizations. The book then looks at the constituent parts and internal functioning of international organizations. This addresses the internal management of the organization, and includes chapters on the distribution of decision-making power within the organizations, the structure of their assemblies, the role of Secretaries-General and other heads, budgets and finance, and other elements of complex bureaucracies at the international level.
