    Abstract: "Based on legal-philosophical research informed by insights gleaned from empirical case studies, this book sets out three central claims about integration requirements as conditions for attaining increased rights (ie family migration, permanent residency and citizenship) in Europe: (1) That the recent proliferation of these (mandatory) integration requirements is rooted in a shift towards 'individualised' conceptions of integration. (2) That this shift is, on the one side, counterproductive as it puts barriers to participation and inclusion of newcomers (who will most likely permanently settle) and on the other, normatively problematic, insofar as it produces status hierarchies between native-born and immigrant citizens. (3) That the remedy for this situation is a firewall that disconnects integration policy from access to rights. The book draws on perspectives on immigrant integration in multiple EU Member States and includes legal and political reactions to the refugee/migrant crisis"--

After thirteen years of presence in Haiti, the highly controversial United Nations Stabilization Mission in Haiti has now withdrawn. The UN's legacy in Haiti is not all negative, but it does include sexual scandals, the divisive use of force to 'clean up' difficult neighbourhoods as well as a cholera epidemic, brought inadvertently by Nepalese peacekeepers that killed more than 8,000 Haitians and infected more than 600,000. This book presents a unique multi-disciplinary analysis of the legacy of the mission for Haiti. It presents an innovative account of contemporary international peacekeeping law and practice, arguing for a new model of accountability, going beyond the outdated immunity mechanisms to foreground human rights.

    Abstract: "This book proposes that late Ḥanafī legal scholarship in the early modern period secured a role for the Ottoman sultanic authority in the process of lawmaking. It finds the reigning arguments for an epistemic divorce between the domain of Islamic law and the authority of the Ottoman state untenable. This study demonstrates that Ḥanafī jurists sustained and expanded Ottoman sultanic authority through careful reformulations of their own school and their engagement with new notions of governance embraced by the Ottomans. This late articulation of the Ḥanafī legal tradition is not only essential to the understanding of the movement to codify Islamic jurisprudence in the late 19th century CE, and the role of the sultan in these transformations, but also to the sketching of looming contentious issues with regard to legitimate governance, lawmaking, and the future of the in modern sari'ah legal jurisdictions in majority Muslim countries"--

    Abstract: The very concept of human rights implies governmental accountability. To ensure that governments are indeed held accountable for their treatment of citizens and others the United Nations has established a wide range of mechanisms to monitor compliance, and to seek to prevent as well as respond to violations. The panoply of implementation measures that the UN has taken since 1945 has resulted in a diverse and complex set of institutional arrangements, the effectiveness of which varies widely. Indeed, there is much doubt as to the effectiveness of much of the UN's human rights efforts but also about what direction it should take. Inevitable instances of politicization and the hostile, or at best ambivalent, attitude of most governments, has at times endangered the fragile progress made on the more technical fronts. At the same time, technical efforts cannot dispense with the complex politics of actualizing the promise of human rights at and through the UN. In addition to significant actual and potential problems of duplication, overlapping and inconsistent approaches, there are major problems of under-funding and insufficient expertise. The complexity of these arrangements and the difficulty in evaluating their impact makes a comprehensive guide of the type provided here all the more indispensable. These essays critically examine the functions, procedures, and performance of each of the major UN organs dealing with human rights, including the Security Council and the International Court of Justice as well as the more specialized bodies monitoring the implementation of human rights treaties. Significant attention is devoted to the considerable efforts at reforming the UN's human rights machinery, as illustrated most notably by the creation of the Human Rights Council to replace the Commission on Human Rights. The book also looks at the relationship between the various bodies and the potential for major reforms and restructuring.

    Abstract: "This book has been brought to life in a period where transnational solidarity and cooperation seemed to be moving backwards rather than forwards. This was among others reflected in the so called refugee crisis in Europe in 2015. After the Brexit referendum in the United Kingdom in June 2016, and presidential elections in the US later the same year, the political agenda took a turn towards focusing primarily on the internal national perspective in relation to areas such as environmental protection, aid to countries in the Third World and trade with the outside world. It still remains to be seen when and how the United Kingdom will be leaving the European Union. In general, the EU has experienced a number of crises, among others an economic and financial crisis and later the refugee crisis, during the past years. These crises have challenged transnational solidarity in Europe. This development in Europe and the World stresses the question, whether and how transnational solidarity is possible. This book is motivated by these developments and discusses and attempts to answer this question.     Abstract: "America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. Courts cannot save the country from constitutional rot; only political mobilization can"--

    Abstract: "To survive, let alone flourish, we need to be sure of - securely tied to - at least one other person. We also need to be sure of our general acceptance within the wider social world. This book explores the normative implications of taking our core social needs seriously. Chapter 1 sketches out what those needs are, and Chapter 2 shows that they ground a fundamental, but largely neglected human right against social deprivation. Chapter 3 then argues that this human right includes a right to sustain the people we care about, and that often, when we are denied the resources to sustain others, we endure social contribution injustice. Chapters 4 - 6 explore the tension between our needs for social inclusion and our needs for interactive and associative freedom, showing that social inclusion must take priority. While Chapters 5 and 6 defend a narrow account of freedom of association, Chapter 7 shows that the moral ballgame changes once we have made morally messy associative decisions. Sometimes we have rights remain in associations that we had no right to form. Finally, Chapter 8 exposes the distinct social injustices that we do to people whom we deem to be socially threatening. Overall, the book identifies ways to change our social and political practices, and our personal perspectives, to better honour the fact that we are fundamentally social beings."

The spread of populism poses dangers for human rights within each country, and also threatens the international system for protecting human rights.     Abstract: Constituent power is the power to create new constitutions. Since it is frequently exercised during or after political revolutions, it has been historically associated with extra-legality and violations of the established legal order. This book examines the relationship between constituent power and the law and the place of constituent power in constitutional history, focusing on the legal and institutional implications that theorists, politicians, and judges havederived from it. 0Since the 18th and 19th centuries, commentators and citizens have relied on the concept of constituent power to defend the idea that electors have the right to instruct representatives, and that the creation of new constitutions must take place through extra-legislative entities, such as primary assemblies open to all citizens. More recently, several Latin American constitutions explicitly incorporate the theory of constituent power and allow citizens, acting through popular initiative, totrigger constitution-making episodes that may result in the replacement of the entire constitutional order.0Constitutional courts have employed constituent power to justify their jurisdiction to invalidate constitutional amendments that alter the fundamental structure of the constitution and thus amount to a constitution-making exercise. Some governments have reverted to it to defend the legality of transforming the constitutional order through procedures not contemplated in the constitution's amendment rule, but considered participatory enough to be equivalent to 'the people in action', and these0attempts have sometimes been sanctioned by courts. 0

    Abstract: This book critically examines the relationship between protecting human rights and building peace in post-violence societies. It explores the conditions that must be present, and strategies that should be adopted, for the former to contribute to the latter. The author argues that human rights can aid peacebuilding efforts by helping victims of past violence to articulate their grievance, and by encouraging the state to respond to and provide them with a meaningful remedy. This usually happens either through a process of adjudication, whereby human rights can offer guidance to the judiciary as to the best way to address such grievances, or through the passing and implementation of human rights laws and policies that seek to promote peace. However, this positive relationship between human rights and peace is both qualified and context specific. Through an interdisciplinary and comparative analysis of four case studies, the book identifies the conditions that can support the effective use of human rights as peacebuilding tools. Developing these, the book recommends a series of strategies that peacebuilders should adopt and rely on.
