After thirteen years of presence in Haiti, the highly controversial United Nations Stabilization Mission in Haiti has now withdrawn. The UN's legacy in Haiti is not all negative, but it does include sexual scandals, the divisive use of force to 'clean up' difficult neighbourhoods as well as a cholera epidemic, brought inadvertently by Nepalese peacekeepers that killed more than 8,000 Haitians and infected more than 600,000. This book presents a unique multi-disciplinary analysis of the legacy of the mission for Haiti. It presents an innovative account of contemporary international peacekeeping law and practice, arguing for a new model of accountability, going beyond the outdated immunity mechanisms to foreground human rights.

    Abstract: Über »Rasse« im Grundgesetz wird derzeit viel gestritten. Ist es ein rassistisches Wort, das es zu ersetzen gilt, oder eine für die Bekämpfung von Diskriminierung notwendige Kategorie? Doris Liebscher geht der Frage historisch, rassismustheoretisch und rechtsdogmatisch auf den Grund. Sie rekonstruiert, wie der Begriff ins Grundgesetz kam, und untersucht, wie Gerichte und Rechtswissenschaft heute das auf »Rasse« bezogene Diskriminierungsverbot aus Artikel 3 GG auslegen. Auch das Recht der DDR sowie europäische, US-amerikanische und weitere internationale Rechtsdebatten unterzieht sie einer kritischen Analyse, um schließlich für ein postkategoriales Antidiskriminierungsrecht zu plädieren: die Ersetzung des Rechtsbegriffs »Rasse« durch »rassistisch«

    Abstract: "Should an employee be allowed to wear a religious symbol at work? Should a religious employer be allowed to impose constraints on employees' private lives for the sake of enforcing a religious work ethos? Should an employee or service provider be allowed, on religious grounds, to refuse to work with customers of the opposite sex or of a same-sex sexual orientation? This book explores how judges decide these issues and defends a democratic approach, which is conducive to a more democratic understanding of our vivre ensemble. The normative democratic approach proposed in this book is grounded on a sociological and historical analysis of two national stories of the relationships between law, religion, diversity and the State, the British (mainly English) and the French stories. The book then puts the democratic paradigm to the test, by looking at cases involving clashes between religious freedoms and competing rights in the workplace. Contrary to the current alternative between the "accommodationist view", which defers to religious requests, and the "analogous" view, which undermines the importance of religious freedom for pluralism, this book offers a third way. It fills a gap in the literature on the relationships between law and religious freedoms and provides guidelines for judges confronted with difficult cases"--

    Abstract: "Why should we care about religious liberty? Leading commentators, United Kingdom courts, and the European Court of Human Rights have de-emphasised the special importance of religious liberty. They frequently contend it falls within a more general concern for personal autonomy. In this liberal egalitarian account, religious liberty claims are often rejected when faced with competing individual interests - the neutral secular state must protect us against the liberty-constraining acts of religions. Joel Harrison challenges this account. He argues that it is rooted in a theologically derived narrative of secularisation: rather than being neutral, it rests on a specific construction of 'secular' and 'religious' spheres. This challenge makes space for an alternative theological, political, and legal vision. Drawing from Christian thought, from St Augustine to John Milbank, Harrison develops a post-liberal focus on association.     Abstract: Constituent power is the power to create new constitutions. Since it is frequently exercised during or after political revolutions, it has been historically associated with extra-legality and violations of the established legal order. This book examines the relationship between constituent power and the law and the place of constituent power in constitutional history, focusing on the legal and institutional implications that theorists, politicians, and judges havederived from it. 0Since the 18th and 19th centuries, commentators and citizens have relied on the concept of constituent power to defend the idea that electors have the right to instruct representatives, and that the creation of new constitutions must take place through extra-legislative entities, such as primary assemblies open to all citizens. More recently, several Latin American constitutions explicitly incorporate the theory of constituent power and allow citizens, acting through popular initiative, totrigger constitution-making episodes that may result in the replacement of the entire constitutional order.0Constitutional courts have employed constituent power to justify their jurisdiction to invalidate constitutional amendments that alter the fundamental structure of the constitution and thus amount to a constitution-making exercise. Some governments have reverted to it to defend the legality of transforming the constitutional order through procedures not contemplated in the constitution's amendment rule, but considered participatory enough to be equivalent to 'the people in action', and these0attempts have sometimes been sanctioned by courts. 0

    Abstract: "To survive, let alone flourish, we need to be sure of - securely tied to - at least one other person. We also need to be sure of our general acceptance within the wider social world. This book explores the normative implications of taking our core social needs seriously. Chapter 1 sketches out what those needs are, and Chapter 2 shows that they ground a fundamental, but largely neglected human right against social deprivation. Chapter 3 then argues that this human right includes a right to sustain the people we care about, and that often, when we are denied the resources to sustain others, we endure social contribution injustice. Chapters 4 - 6 explore the tension between our needs for social inclusion and our needs for interactive and associative freedom, showing that social inclusion must take priority. While Chapters 5 and 6 defend a narrow account of freedom of association, Chapter 7 shows that the moral ballgame changes once we have made morally messy associative decisions. Sometimes we have rights remain in associations that we had no right to form. Finally, Chapter 8 exposes the distinct social injustices that we do to people whom we deem to be socially threatening. Overall, the book identifies ways to change our social and political practices, and our personal perspectives, to better honour the fact that we are fundamentally social beings."

    Abstract: "This book proposes that late Ḥanafī legal scholarship in the early modern period secured a role for the Ottoman sultanic authority in the process of lawmaking. It finds the reigning arguments for an epistemic divorce between the domain of Islamic law and the authority of the Ottoman state untenable. This study demonstrates that Ḥanafī jurists sustained and expanded Ottoman sultanic authority through careful reformulations of their own school and their engagement with new notions of governance embraced by the Ottomans. This late articulation of the Ḥanafī legal tradition is not only essential to the understanding of the movement to codify Islamic jurisprudence in the late 19th century CE, and the role of the sultan in these transformations, but also to the sketching of looming contentious issues with regard to legitimate governance, lawmaking, and the future of the in modern sari'ah legal jurisdictions in majority Muslim countries"--

    Abstract: "This book has been brought to life in a period where transnational solidarity and cooperation seemed to be moving backwards rather than forwards. This was among others reflected in the so called refugee crisis in Europe in 2015. After the Brexit referendum in the United Kingdom in June 2016, and presidential elections in the US later the same year, the political agenda took a turn towards focusing primarily on the internal national perspective in relation to areas such as environmental protection, aid to countries in the Third World and trade with the outside world. It still remains to be seen when and how the United Kingdom will be leaving the European Union. In general, the EU has experienced a number of crises, among others an economic and financial crisis and later the refugee crisis, during the past years. These crises have challenged transnational solidarity in Europe. This development in Europe and the World stresses the question, whether and how transnational solidarity is possible. This book is motivated by these developments and discusses and attempts to answer this question. Our main presumption is that solidarity can create stability and sustainability (social, economic, environmental, peace etc.), within states, regions and globally, why it is crucial to gain more knowledge about it. Realization of the UN Sustainability Goals 2017 and 2030 go hand in hand with solidarity at both local, regional and global levels.     Abstract: "America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. Courts cannot save the country from constitutional rot; only political mobilization can"--

    Abstract: The very concept of human rights implies governmental accountability. To ensure that governments are indeed held accountable for their treatment of citizens and others the United Nations has established a wide range of mechanisms to monitor compliance, and to seek to prevent as well as respond to violations. The panoply of implementation measures that the UN has taken since 1945 has resulted in a diverse and complex set of institutional arrangements, the effectiveness of which varies widely. Indeed, there is much doubt as to the effectiveness of much of the UN's human rights efforts but also about what direction it should take. Inevitable instances of politicization and the hostile, or at best ambivalent, attitude of most governments, has at times endangered the fragile progress made on the more technical fronts. At the same time, technical efforts cannot dispense with the complex politics of actualizing the promise of human rights at and through the UN. In addition to significant actual and potential problems of duplication, overlapping and inconsistent approaches, there are major problems of under-funding and insufficient expertise. The complexity of these arrangements and the difficulty in evaluating their impact makes a comprehensive guide of the type provided here all the more indispensable. These essays critically examine the functions, procedures, and performance of each of the major UN organs dealing with human rights, including the Security Council and the International Court of Justice as well as the more specialized bodies monitoring the implementation of human rights treaties. Significant attention is devoted to the considerable efforts at reforming the UN's human rights machinery, as illustrated most notably by the creation of the Human Rights Council to replace the Commission on Human Rights. The book also looks at the relationship between the various bodies and the potential for major reforms and restructuring.

    Abstract: "This book explores whether constitutionalizing rights improves respect for those rights in practice. Drawing on global statistical analyses, survey experiments in Turkey and the U.S, and case studies in Colombia, Myanmar, Poland, Russia, and Tunisia, the book advances three claims. First, enshrining rights in constitutions does not automatically ensure that those rights will be respected. For rights to matter, rights violations need to be politically costly, which is the case when citizens punish the government for rights violations. Doing so, however, is often difficult to accomplish for unconnected groups of citizens. Second, some rights are easier to enforce than others. Specifically, some rights come with natural constituencies that can mobilize for their enforcement. This is the case for rights that are practiced by and within organizations, or "organizational rights," such as the rights to religious freedom, unionize, and form political parties. Because religious groups, trade unions and parties are highly organized, they are well-equipped to use the constitution to resist rights violations. As a result, these rights are systematically associated with better practices. By contrast, rights that are practiced on an individual basis, such as free speech or the prohibition of torture, often lack natural constituencies to enforce them, which makes it easier for governments to violate these rights. Third, even highly organized groups armed with the constitution may not be able to stop governments dedicated to rights-repression. When constitutional rights are enforced by dedicated organizations, they are thus best understood as speed bumps that slow down attempts at repression"--

    Abstract: "In 1956, ICJ judge Philip Jessup highlighted the gaps between private and public international law and the need to adapt the law to border-crossing problems. Today, sixty years later, we still ask what role transnational law can play in a deeply divided, post-colonial world, where multinationals hold more power and more assets than many Nation States. In searching for suitable answers to pressing legal problems such as climate change law, security, poverty and inequality, questions of representation, enforcement, accountability and legitimacy become newly entangled. As public and private, domestic and international actors compete for regulatory authority, spaces for political legitimacy have become fragmented and the state's exclusivist claim to be law's harbinger and place of origin under attack. Against this background, transnational law emerges as a conceptual framework and method laboratory for a critical reflection on the forms, fora and processes of law making and law contestation today"--
