Damit rücken die Texte in II Sam 1-5 verstärkt in den Blick, denen eine Schlüsselstellung für die literarische Genese der Davidüberlieferung zukommt. Die vorliegende Studie ermittelt einen ersten durchlaufenden und noch vorexilischen Darstellungszusammenhang, der im 7. Jh. v. Chr. entstanden ist. Entsprechend erklärt sie das Doppelkönigtum Davids über Israel und Juda als eine protodeuteronomistische Gründungsgeschichte der späten Königszeit. Die Untersuchung schließt mit einer redaktionsgeschichtlichen Skizze der Daviderzählungen im zweiten Samuelbuch und einer Revision der geschichtlichen Zeugnisse , Main description: Recent research has led to a weakening of the two classical hypotheses on the story of David's rise and a succession narrative. Instead, attention has focussed on the texts in II Samuel 1-5, which are seen as being of crucial importance for the literary genesis of the story of David. The present study reveals a first continuous account from before the time of exile, which was produced in the 7th century BC. Thus it explains David's double kingship of Israel and Juda as a proto-deuteronomistic foundation narrative from the late Age of Kings.     Kurzfassung: Limiting Institutions examines the security threats in Eurasia and the role of institutions in the post-Cold War international environment. It looks at both the crucial aspect of foreign policy as well as a theoretical area of security studies and its impact in the former Soviet States including Russia, Belarus, Armenia, the Ukraine and Moldova. The first section addresses the important and varied range of security threats to this area of the world, and examines the range of responses open to European countries and to the United States. Threats such as ethnic conflict, transnational crime, and environmental and energy security issues are examined in depth. The second section addresses an important theoretical issue, namely the role that international institutions can perhaps play as arbiters of conflict and facilitators of cooperation in a region abutting the European political space. The role of the OSCE, NATO, the European Union, the Commonwealth of Independent States and the Black Sea Economic Cooperation Council are consequently examined closely. The contributors are scholars with solid international reputations, and the book will be of benefit to students of international relations and conflict analysis

    Kurzfassung: Die Medien repräsentieren den älteren türkischen Migranten oft als traditionalistischen "Islam-Macho", der die Integration seiner Frau und seiner Töchter in die Gastgesellschaft bremst oder aktiv behindert. Diese weit verbreitete Stereotype beruht überwiegend auf "Bildern aus zweiter Hand". Im Unterschied dazu rückt die Publikation von Margret Spohn die türkischen Männer der ersten Migrantengeneration explizit in den Mittelpunkt der Analysen, wo sie als "Experten ihrer eigenen Geschichte" ausführlich selbst zu Wort kommen. Das feine Geflecht der hier erzählten und sensibel interpretierten Lebensgeschichten gibt Raum für die Reflexionen der Befragten über ihr Verhältnis zu den eigenen Eltern, zur Ehefrau, zu den Kindern und zu ihrem Leben in "zwei Heimaten".     Kurzfassung: Begegnungen mit dem Fremden sind uns vertraut, auch wenn wir den Anderen dabei häufig als unvertraut wahrnehmen. Doch es sind weniger die fremden, als vielmehr die eigenen Wirklichkeitsvorstellungen und Umgangspraktiken, die den »Einen« zum »Anderen« machen. Die Autorin analysiert diese Praktiken der Fremdsetzung, die sich von der alltäglichen Etikettierung und Stigmatisierung bis hin zu wissenschaftlichen Praktiken des »Othering« erstrecken: Rekonstruiert werden sowohl Simmels »Händler«, Parks »Mulatte«, Schütz' »Emigrant«, Meads »signifikanter/verallgemeinerter Andere« als auch ethnografische Praktiken der »Ver-Anderung« des Fremden. Dabei wird der Blick immer wieder von den vertrauten Bildern des Fremden hin zu ihren subtilen Herstellungsprozessen und Resonanzen gelenkt, was es möglich macht, von den Konstruktionen des Fremden auf die Konstruktionen des Eigenen zurückzuschließen.

    Kurzfassung: Privatisierung ist ein Zeichen tiefreichender Wandlungsprozesse im Verhältnis von Staat und Gesellschaft sowie in den Bereichen des öffentlichen und des Privatrechts. Verbreitet ist die Hoffnung, der unter seinen Kompetenz- und Finanzlasten schwerfällig gewordene Staatskoloß könne wieder 'schlank' werden, wenn er sich zugunsten gesellschaftlicher Kräfte aus Tätigkeitsbereichen zurückziehe. Wichtige Privatisierungsimpulse gehen nach wie vor von den Wettbewerbsbestimmungen des Europäischen Gemeinschaftsrechts aus. Auf kommunaler Ebene ist die 'Organisationsprivatisierung' verbreitet. Mit der Novellierung der Kommunalverfassungen versuchen die Landesgesetzgeber, dem Trend zur kommunalen Eigengesellschaft Einhalt zu gebieten, verletzen jedoch mitunter die Vorgaben des Gesellschaftsrechts. Jörn Axel Kämmerer weist nach, daß sich der Staat im Zuge des Privatisierungsprozesses keineswegs ganz zurückzieht. Vielmehr nimmt der Staat seine grundlegenden verfassungsrechtlichen Aufgaben auch in der 'Privatisierungsfolgenphase' weiterhin wahr – wenn auch nicht mehr durch eigene Leistungen, sondern als Garant und Regulator. Dabei wächst der Spielraum für 'private Grundrechtseingriffe', und die Grundrechte selbst wandeln sich zu Schutzpflichten. Zugleich bringt 'Organisationsprivatisierung', die Begründung privatrechtlich organisierter Wirtschaftsunternehmen der öffentlichen Hand ohne öffentlich-rechtliche Befugnisse, die Grenzen zwischen Staat und Gesellschaft zum Verschwimmen. Letztlich hat der Staat eine Gratwanderung vor sich, bei der er weiterhin als ausgleichende Instanz für eine komplexe, zur Selbstregulierung unfähige, aber in den transnationalen Bereich ausgreifende Gesellschaft agieren können muß, ohne in ihr aufzugehen.

    Kurzfassung: Class action lawsuits--allowing one or a few plaintiffs to represent many who seek redress--have long been controversial. The current controversy, centered on lawsuits for money damages, is characterized by sharp disagreement among stakeholders about the kinds of suits being filed, whether plaintiffs' claims are meritorious, and whether resolutions to class actions are fair or socially desirable. Ultimately, these concerns lead many to wonder, "Are class actions worth their costs to society and to business? Do they do more harm than good?" To describe the landscape of current damage class action litigation, elucidate problems, and identify solutions, the RAND Institute for Civil Justice conducted a study using qualitative and quantitative research methods. The researchers concluded that the controversy over damage class actions has proven intractable because it implicates deeply held but sharply contested ideological views among stakeholders. Nevertheless, many of the political antagonists agree that class action practices merit improvement. The authors argue that both practices and outcomes could be substantially improved if more judges would supervise class action litigation more actively and scrutinize proposed settlements and fee awards more carefully. Educating and empowering judges to take more responsibility for case outcomes--and ensuring that they have the resources to do so--can help the civil justice system achieve a better balance between the public goals of class actions and the private interests that drive them

    Kurzfassung: The years 1989/1990 saw the fall of the Iron Curtain. Following forty years of significant restrictions, legal and non-bureaucratic travel from East-Central and Eastern European countries was once again possible and travelling and returning to those countries became just as easy. Immediately following the end of the East-West conflict, people from East-Central and Eastern European countries took advantage of their new freedom of travel. Many sought to emigrate to Western countries. However, when faced with such immigration, the euphoria which met the end of the political divisions in the West evaporated quickly. Several polls and surveys, projections and prognoses served to unsettle people more than the reality of immigration. This gave rise to a sometimes blind and specious – yet nevertheless politically effective – fear of a new mass migration of peoples. Now, more than ten years after the fall of the Iron Curtain, the actual scale and development of the East-West migration in Europe be clearly evaluated. This book attempts to do just that, including a comprehensive overview and eleven country-specific chapters. Each chapter includes a historical review, an account of the most important changes since 1989/1990 and a forecast of future migration developments. 1989/90 fiel der Eiserne Vorhang. Nach mehr als 40 Jahren erheblicher Einschränkungen wurde die legale und unbürokratische Anreise aus den Staaten Ostmittel- und Osteuropas wieder möglich. Genauso leicht wurde die Ein- und Rückreise dorthin. Unmittelbar nach Ende des Ost-West-Konflikts begannen die Bürger Ostmittel- und Osteuropas, von dieser neuen Reisefreiheit Gebrauch zu machen. Etliche versuchten, in ein westliches Land auszuwandern. Angesichts solcher Zuwanderung verflog die Euphorie über das Ende der politischen Spaltung Europas im Westen relativ rasch. Mehr noch als die tatsächliche Migration beunruhigten aber diverse Umfragen, Hochrechnungen und Prognosen die öffentliche Meinung. Es entstand eine teilweise unreflektierte und vordergründige, aber politisch höchst wirksame Angst vor einer neuen Völkerwanderung in Europa. Mehr als zehn Jahre nach dem Fall des Eisernen Vorhangs können nun tatsächliche Größe und Entwicklung der Ost-West-Wanderung in Europa klar abgeschätzt werden. Damit befasst sich dieses Buch.
