    Abstract: Limiting Institutions examines the security threats in Eurasia and the role of institutions in the post-Cold War international environment. It looks at both the crucial aspect of foreign policy as well as a theoretical area of security studies and its impact in the former Soviet States including Russia, Belarus, Armenia, the Ukraine and Moldova. The first section addresses the important and varied range of security threats to this area of the world, and examines the range of responses open to European countries and to the United States. Threats such as ethnic conflict, transnational crime, and environmental and energy security issues are examined in depth. The second section addresses an important theoretical issue, namely the role that international institutions can perhaps play as arbiters of conflict and facilitators of cooperation in a region abutting the European political space. The role of the OSCE, NATO, the European Union, the Commonwealth of Independent States and the Black Sea Economic Cooperation Council are consequently examined closely. The contributors are scholars with solid international reputations, and the book will be of benefit to students of international relations and conflict analysis

    Abstract: Privatisierung ist ein Zeichen tiefreichender Wandlungsprozesse im Verhältnis von Staat und Gesellschaft sowie in den Bereichen des öffentlichen und des Privatrechts. Verbreitet ist die Hoffnung, der unter seinen Kompetenz- und Finanzlasten schwerfällig gewordene Staatskoloß könne wieder 'schlank' werden, wenn er sich zugunsten gesellschaftlicher Kräfte aus Tätigkeitsbereichen zurückziehe. Wichtige Privatisierungsimpulse gehen nach wie vor von den Wettbewerbsbestimmungen des Europäischen Gemeinschaftsrechts aus. Auf kommunaler Ebene ist die 'Organisationsprivatisierung' verbreitet. Mit der Novellierung der Kommunalverfassungen versuchen die Landesgesetzgeber, dem Trend zur kommunalen Eigengesellschaft Einhalt zu gebieten, verletzen jedoch mitunter die Vorgaben des Gesellschaftsrechts. Jörn Axel Kämmerer weist nach, daß sich der Staat im Zuge des Privatisierungsprozesses keineswegs ganz zurückzieht. Vielmehr nimmt der Staat seine grundlegenden verfassungsrechtlichen Aufgaben auch in der 'Privatisierungsfolgenphase' weiterhin wahr – wenn auch nicht mehr durch eigene Leistungen, sondern als Garant und Regulator. Dabei wächst der Spielraum für 'private Grundrechtseingriffe', und die Grundrechte selbst wandeln sich zu Schutzpflichten. Zugleich bringt 'Organisationsprivatisierung', die Begründung privatrechtlich organisierter Wirtschaftsunternehmen der öffentlichen Hand ohne öffentlich-rechtliche Befugnisse, die Grenzen zwischen Staat und Gesellschaft zum Verschwimmen. Letztlich hat der Staat eine Gratwanderung vor sich, bei der er weiterhin als ausgleichende Instanz für eine komplexe, zur Selbstregulierung unfähige, aber in den transnationalen Bereich ausgreifende Gesellschaft agieren können muß, ohne in ihr aufzugehen.

    Abstract: Class action lawsuits--allowing one or a few plaintiffs to represent many who seek redress--have long been controversial. The current controversy, centered on lawsuits for money damages, is characterized by sharp disagreement among stakeholders about the kinds of suits being filed, whether plaintiffs' claims are meritorious, and whether resolutions to class actions are fair or socially desirable. Ultimately, these concerns lead many to wonder, "Are class actions worth their costs to society and to business? Do they do more harm than good?" To describe the landscape of current damage class action litigation, elucidate problems, and identify solutions, the RAND Institute for Civil Justice conducted a study using qualitative and quantitative research methods. The researchers concluded that the controversy over damage class actions has proven intractable because it implicates deeply held but sharply contested ideological views among stakeholders. Nevertheless, many of the political antagonists agree that class action practices merit improvement. The authors argue that both practices and outcomes could be substantially improved if more judges would supervise class action litigation more actively and scrutinize proposed settlements and fee awards more carefully. Educating and empowering judges to take more responsibility for case outcomes--and ensuring that they have the resources to do so--can help the civil justice system achieve a better balance between the public goals of class actions and the private interests that drive them
