    Abstract: The Croatian-born Matthias Flacius Illyricus (1520–1575) was a Lutheran theologian and reformer who spent most of his adult life in the German-speaking territories of the Holy Roman Empire, playing an important role within the Evangelical churches and in the confessionalization of his day. Luka Ili? establishes that Flacius’ theology became increasingly radicalized with time and examines aspects of this process through following two parallel tracks. One trajectory focuses on the development of Flacius’ theological thought, while the other one discusses the pivotal influences and major turning points in his life, such as being exiled from different cities. Although Flacius did enjoy some measure of success and even attracted a considerable number of followers for shorter periods of time, his radicalized theology ultimately led to his public downfall and marred his legacy. Flacius’ relationships with the most important Wittenberg figures, Luther and Melanchthon, are also explored, along with the vast personal and professional networks Flacius built up in imperial cities, all of which shaped his theological development. One of the dominant claims is that Flacius’ understanding of original sin and of grace were the lynchpin for much of his opus. At the same time, the findings demonstrate that Flacius was a multifaceted individual with interest and competences in a number of different academic fields.

    Abstract: With Faithful Translators Jaime Goodrich offers the first in-depth examination of women’s devotional translations and of religious translations in general within early modern England. Placing female translators such as Queen Elizabeth I and Mary Sidney Herbert, Countess of Pembroke, alongside their male counterparts, such as Sir Thomas More and Sir Philip Sidney, Goodrich argues that both male and female translators constructed authorial poses that allowed their works to serve four distinct cultural functions: creating privacy, spreading propaganda, providing counsel, and representing religious groups. Ultimately, Faithful Translators calls for a reconsideration of the apparent simplicity of "faithful" translations and aims to reconfigure perceptions of early modern authorship, translation, and women writers.

    Abstract: This book is available as open access through the Bloomsbury Open Access programme and is available on www.bloomsburycollections.com. In order to think theoretically about our global age it is important to understand how the global has been conceived historically. 'Eurafrica' was an intellectual endeavor and political project that from the 1920s saw Europe's future survival - its continued role in history - as completely bound up with Europe's successful merger with Africa. In its time the concept of Eurafrica was tremendously influential in the process of European integration. Today the project is largely forgotten, yet the idea continues to influence EU policy towards its African 'partner'. The book will recover a critical conception of the nexus between Europe and Africa - a relationship of significance across the humanities and social sciences. In assessing this historical concept the authors shed light on the process of European integration, African decolonization and the current conflictual relationship between Europe and Africa.

    Abstract: English in Europe is not one language but many, and substantial differences in the way people from different countries communicate using it may cause misunderstandings. This book shows that, through research into the pragmatic behavior of non-native speakers of English from across Europe, it is possible to uncover the core shared strategies, which are proposed as the basis of a reference guide for learners who wish to successfully communicate in English in Europe. The content is based on the analysis of the speech act of apologizing as realized by 466 respondents from 8 European countries, all proficient users of English involved in teacher-training programs. The results provide a basis for practical teaching and in-class research ideas are included in the book

    Abstract: Language and the Right to Fair Hearing in International Criminal Trials explores the influence of the dynamic factor of language on trial fairness in international criminal proceedings. By means of empirical research and jurisprudential analysis, this book explores the implications that conducting a trial in more than one language can have for the right to fair trial. It reveals that the language debate is as old as international criminal justice, but due to misrepresentation of the status of language fair trial rights in international law, the debate has not yielded concrete reforms. Language is the core foundation for justice. It is the means through which the rights of the accused are secured and exercised. Linguistic complexities such as misunderstandings, translation errors and cultural distance among participants in international criminal trials affect courtroom communication, the presentation and the perception of the evidence, hence jeopardizing the foundations of a fair trial. The author concludes that language fair trial rights are priority rights situated in the minimum guarantees of fair criminal trial; the obligation of the court to ensure fair trial or accord the accused person a fair hearing also includes the duty to ensure they can understand and be understood

    Abstract: Despite the large amounts of human and financial resources invested to foster democratic governance in developing countries, statistics show that the majority of these countries have not yet achieved significant improvements in living standards. While some regions make strides towards improving the living conditions of their citizens, Sub-Saharan Africa, for instance, is still trapped in poverty with more than 40% of its 600 million people living below the internationally recognized absolute poverty line of one US dollar per day. Poor governance and corruption should be highlighted as the most important systemic factors contributing to poverty in developing countries. As a result the institutional foundations of these countries are weakened, public funds are misappropriated, and policies and programs aimed at reducing poverty and fostering sustainable economic growth are undermined. It is therefore not surprising that a 2008 Transparency International report found a direct link between corruption and the failure of the societal institutions designed to achieve the Millennium Development Goals in the majority of developing countries. This book investigates the problems of democratic governance, particularly as they relate to corruption, and also whether democracy should be based on universal principles or local context and historical factors. It also analyses the rule of law, in promoting democratic governance and curbing corruption and if governmental, non-governmental organizations, and civil societies are effective in promoting democratic governance and curbing corruption. This book will go beyond identifying the challenges and offer plausible solutions that could be adapted to various developing countries. It is premised on the importance of bridging theory and practice, which has been lacking in most local and international development publications, making of interest to scholars and policy-makers alike concerned with public administration in developing countries.

    Abstract: This book examines the conception of the person at work in John Rawls’s writings from Theory of Justice to Justice as Fairness: A Restatement. The book aims to show that objections to Rawls’s political conception of the person fail and that a Rawlsian conception of political identity is defensible. The book shows that the debate between liberals and communitarians is relevant to the current debate regarding perfectionism and neutrality in politics, and clarifies the debate between Rawls and communitarians in a way that will promote fruitful discussion on the issue of political identity. It does this by providing a clearer account of a conception of personal identity according to which persons are socially constituted, including the intuitions and assumptions underlying the communitarians’ conception of persons as “socially constituted.” It examines the communitarian objections to liberal political theory and to the liberal conception of persons, the “unencumbered self.” The book differentiates between two types of objection to the liberal conception of persons: the metaphysical and normative. It explains Rawls's political conception of persons, and the metaphysical and normative commitments Rawls incurs-and does not incur-in virtue of that conception. It shows that both kind of objection to Rawls's political conception of the person fail. Finally, modifying Rawls’s political conception of the person, a Rawlsian conception of political identity is explained and defended.

    Abstract: This book examines in detail both historical and current legal concepts of ‘religious cultural heritage’ within the context of the European continent. The latter group is primarily based on the variety of sacred cultural elements emanating from the different religious traditions of the peoples of Europe, which are deemed worthy of protection and preservation due to their outstanding value, in terms of their social, cultural and religious significance. In view of this, the study provides evidence of the European States’ active involvement with their sacred/cultural treasures, on the basis of the political and legal foundations of neutrality and pluralism. Furthermore, the book analyzes all relevant international legislative instruments (i.e. the plethora of EU, CoE and UNESCO norms), as well as all major European legislative patterns, in light of their significance for the aforementioned aspects of pluralism and neutrality. The interdisciplinary references listed at the end of each chapter provide an additional incentive for further reading on the subject matter. The most important finding to emerge from the study is that there is a shared legal ethos in Europe that imposes a duty of appropriate care concerning the vast variety of sacred cultural goods, and the religious cultural heritage in general, as an invaluable repository of European cultural capital. It also considers the sui generis nature of this capital: like any other type of asset, it may deteriorate or fade over time, necessitating investment in its preservation or refurbishment; nevertheless, like no other, this particular capital maintains a distinct cultural value, as it contains an additional characteristic of ‘sacredness’ expressed in the form of its ‘religious character,’ the latter being analyzed as a triptych of religious memory, religious aesthetics and religious beliefs

    Abstract: The book provides in depth studies of two epistemological aspects of Jewish Law (Halakhah) as the?Word of God?? the question of legal reasoning and the problem of knowing and remembering. - How different are the epistemological concerns of religious-law in comparison to other legal systems? - In what ways are jurisprudential attitudes prescribed and dependent on theological presumptions? - What specifies legal reasoning and legal knowledge in a religious framework? The author outlines the rabbinic jurisprudential thought rooted in Talmudic literature which underwent systemization and enhancement by the Babylonian Geonim and the Andalusian Rabbis up until the twelfth century. The book develops a synoptic view on the growth of rabbinic legal thought against the background of Christian theological motifs on the one hand, and Karaite and Islamic systemized jurisprudence on the other hand. It advances a perspective of legal-theology that combines analysis of jurisprudential reflections and theological views within a broad historical and intellectual framework. The book advocates two approaches to the study of the legal history of the Halakhah: comparative jurisprudence and legal-theology, based on the understanding that jurisprudence and theology are indispensable and inseparable pillars of legal praxis

    Abstract: ?Marc Schmid untersucht die widerspruchlichen Teilnahmemuster italienischstammiger Migranten in Deutschland in unterschiedlichen gesellschaftlichen Teilbereichen.     Abstract: Trauma has become a hotly contested topic in literary studies. But interest in trauma is not new; its roots extend to the Romantic period, when novelists and the first psychiatrists influenced each others' investigations of the 'wounded mind'. This book looks back to these early attempts to understand trauma, reading a selection of Romantic novels in dialogue with Romantic and contemporary psychiatry. It then carries that dialogue forward to postmodern fiction, examining further how empirical approaches can deepen our theorizations of trauma.     Abstract: The Politics of Security tells the story of how people experienced the cold war as a war. It is about the impact of the cold war on political cultures. This crucial issue is often forgotten in historical memory. In particular, the book follows British and West German anti-nuclear-weapons activists in their attempts to campaign for and create security after the destruction of the Second World War, and how their own version of security clashed with concepts advanced by their own governments. But the book also demonstrates how, as part of the protests against nuclear weapons, activists and their societies learned to live with the Bomb: it recounts how activists first discovered the dangers of nuclear weapons, but how a different generation of activists came to focus on other issues as the Vietnam War became their primary concern. And it makes comprehensible how activists in two societies who had fought each other fiercely in the battle of dictatorships and democracies of the Second World War could now come to see each other as part of a common campaign. Fundamentally, with its transnational approach, the book highlights how these two societies drew on very similar arguments when they came to understand the cold war through the prism of the previous world war. The book is the first to capture in a transnational fashion what activists did on the marches and what it meant to them and to others. The book thus reminds us that threats are not merely out there, but that they need to be created in a political process that involves struggles for power and contestation.

Sie zeigt, dass die Begründungsmuster entgegen gängiger Vermutungen nicht die Ursache für die Konversion abbilden, sondern vielmehr von den aktiven islamischen Missionsbewegungen beeinflusst sind. Im multireligiösen Ostafrika führt dies dazu, dass das Element der religiösen Abgrenzung eine große Rolle in den Narrativen einnimmt.     Abstract: Die Akkreditierung von Studiengängen bietet auch fast 15 Jahre nach ihrer Einführung politisch wie juristisch beträchtlichen Anlass zur Diskussion. Die stetige Fortentwicklung des Akkreditierungsverfahrens, die zunehmende Bedeutung von Qualitätssicherung sowie die immer wieder aufflammende Debatte um den Bologna-Prozess sorgen dafür, dass das Thema aktuell und lebendig bleibt. Die vorliegende Dissertation widmet sich neben der hochschulpolitischen Entwicklung den vielfältigen verwaltungs- und verfassungsrechtlichen Problemen des Akkreditierungswesens an deutschen Hochschulen. Dabei kommen zum einen altbekannte Fragen zur Rechtsnatur der Akkreditierung oder dem Grundrechtseingriff durch die Akkreditierungspflicht zur Sprache. Des Weiteren geht es aber auch um neue Herausforderungen wie die Systemakkreditierung und um bisher nur wenig erörterte Themen wie die Vertragsverhältnisse der Beteiligten, die demokratische Legitimation der Akkreditierungsverwaltung sowie die Rechtsnatur ihrer Beschlüsse. Außerdem zieht die Arbeit systematische Vergleiche zu Rechtsgebieten mit ähnlichen Strukturen; dabei nimmt sie u.a. Stellung zu weiteren Fragen der Hochschulmodernisierung, der Privatisierungsdebatte und des Verwaltungsorganisationsrechts.

    Abstract: The present dissertation addresses the manifold legal aspects of the administrative and constitutional problems of accreditation in german institutions of higher education. Issues are raised in respect to well-known questions concerning the legal nature of accreditation, as well as to the related encroachment upon fundamental rights. Furthermore, new challenges such as system accreditation and the seldom debated issues concerning the contractual relationships of the involved parties, or the democratic legitimation of the accreditation administration and the legal nature of its decisions are discussed. The study also draws comparisons to similarly structured areas of law - in so doing, further questions of modernisation in higher education, the debate surrounding privatisation and legal aspects of the administrative organisation are commented on

    Abstract: This descriptive and comprehensive study on the discursive struggle over interpersonal relations in online message boards is located at the fascinating interface of pragmatics and computer-mediated discourse - a research area which has so far not attracted much scientific interest. It sets out to shed light on the question how interpersonal relations are established, managed and negotiated in online message boards by giving a valid overview of the entire panoply of interpersonal relations (and their interrelations), including both positively and negatively marked behavior.     Abstract: Verse and transmutation: a corpus of Middle English alchemical poetry' identifies and investigates a corpus of twenty-one anonymous recipes for the philosophers' stone dating from the fifteenth century. These were circulated and received in association with each other until the mid-seventeenth century, when a number of them appeared in Elias Ashmole's 'Theatrum Chemicum Britannicum'. These editions are the first to make this previously unidentified corpus available to researchers. The accompanying studies discover the complex histories of these "alchemica", in plain and illuminated manuscripts, "asanonyma" and in attribution to famous authors, and in private and institutional, medical and academic book collections. Together, they offer novel insights into the role of alchemy and poetry in late medieval and early modern England. Also part of series Medieval and Early Modern Science

    Abstract: In response to the ongoing economic crisis, Italy is undertaking a series of critically important reforms, combining pro-growth policies with severe austerity measures to achieve fiscal consolidation. The success of these structural reforms will rely heavily on the capacity of the government to restore trust in its ability and commitment to guide the country towards sustainable economic growth. At the time of this publication, however, less than a quarter of Italian citizens trusted the quality of government decision-making. Concerns over public integrity and corruption stand out as key elements underlying this prevailing lack of trust. To restore the deficit of trust in the Italian government, the public sector needs to be embedded within a comprehensive integrity framework. Law 190 of November 6, 2012 (the Anti-Corruption Law) enshrines public sector integrity management and strengthens existing corruption prevention provisions through the designation of a new anti-corruption authority, a detailed framework for the adoption of a national anti-corruption plan, and new provisions regarding the conduct and prevention of conflict of interests in the public sector. This OECD Integrity Review provides guidance on the implementation of key integrity and corruption prevention elements of the Law, most notably those concerning institutional coordination, the regulation of conduct and whistleblower protection, and management of integrity risks in public sector activities. The review concludes each chapter with proposals for action, with OECD member countries’ best practices in mind, with the ultimate goal of supporting Italy in its efforts to enhance integrity in the public sector and restore trust.

    Abstract: When trying to measure fiscal decentralisation, the OECD Network on Fiscal Relations Across Government Levels has made significant progress in the last years, especially on tax autonomy of sub-central governments. But in many respects, real-world fiscal decentralisation still escapes the measuring tools, especially when it comes to measure the spending power of sub-central governments or the various regulations attached to intergovernmental grants. This book deals with two interrelated issues. The first concerns the various measurement of fiscal decentralization in general and their usefulness for policy analysis. The second and more specific issue concerns the taxonomy of intergovernmental grants and the limits of the current classifications, and how policy changes to the intergovernmental grants framework may require that measurement devices be adapted.

    Abstract: "Erik J. Engstrom offers a historical perspective on the effects of gerrymandering on elections and party control of the U.S. national legislature. Aside from the requirements that districts be continuous and, after 1842, that each select only one representative, there were few restrictions on congressional districting. Unrestrained, state legislators drew and redrew districts to suit their own partisan agendas. With the rise of the "one-person, one-vote" doctrine and the implementation of the Voting Rights Act of 1965, however, redistricting became subject to court oversight. Engstrom evaluates the abundant cross-sectional and temporal variation in redistricting plans and their electoral results from all the states, from 1789 through the 1960s, to identify the causes and consequences of partisan redistricting. His analysis reveals that districting practices across states and over time systematically affected the competitiveness of congressional elections; shaped the partisan composition of congressional delegations; and, on occasion, determined party control of the House of Representatives"--

    Abstract: This study provides an in-depth analysis of the Hong Kong Ship Recycling Convention as adopted in May 2009 and a thorough analysis of the overall status quo of ship recycling regulations. It investigates the lack of sufficient ratifications of the Convention from both a legal and an economic perspective. The first part of the study focuses on the history of the Convention’s entry-into-force provision and the rationale behind it. Due to the fact that this provision provides a considerable additional obstacle to the Convention’s becoming legally binding, in the second part the focus of the work shifts to unilateral action in this field. An overview of the legal environment of European ship recycling legislation is followed by an analysis and evaluation of a number of proposals by the European Commission attempting to tackle the problems of current ship recycling procedures. With a particular emphasis on (planned) European measures in this regard, the analysis’ overall message is one of cautious optimism

    Abstract: Regional governance is a topical public policy issue and is receiving increased attention from scholars, government officials and civic leaders. As countries continue to urbanize and centralize economic functions and population in metropolitan regions, the traditional governing system is not equipped to handle policy issues that spill over local government boundaries. Governments have utilized four basic approaches to address the regional governing problem: consolidating governments, adding a regional tier, creating regional special districts, and functional cooperative approaches. The first two are structural approaches that require major (radical) changes to the governing system. The latter two are governance approaches that contemplate marginal changes to the existing governance structure and rely generally on cooperation with other governments and collaboration with the nongovernmental sector. Canada and the United States have experimented with these basic forms of regional governance. This book is a systematic analysis of these basic forms as they have been experienced by North American cities. Utilizing cases from Canada and the United States, the book provides an in-depth analysis of the pros and cons of each approach to regional governance. This research provides an additional perspective on Canadian and U.S. regional governance and adds to the knowledge of Canadian and United States governing systems. This study contributes to the literature on the various approaches to regional governance as well as bringing together the most current literature on regional governance. The author develops a framework of the values that a regional governing system should provide and measures to assess how well each basic approach achieves these values. Based on this assessment, he suggests an approach to regional governance for North American metropolitan areas that best achieves these values.

    Abstract: Following in the footsteps of the book Fish for Life - Interactive Governance for Fisheries (Kooiman et al., 2005), and the interdisciplinary approach it presents, this volume illustrates the contribution of interactive governance theory to understanding core fisheries and aquaculture challenges. These challenges are invariably linked to broader concerns such as ecosystem health, social justice, sustainable livelihoods and food security. The central concept in this perspective is governability - the varied capacity to govern fisheries and aquaculture systems sustainably. Many of these systems are characterized by problems that are inherently 'wicked' and therefore difficult to address. The authors of this edited volume argue that responses to such problems must consider context; specifically the character of the fisheries and aquaculture systems themselves, their institutional conditions, and the internal and external interactions that affect them. Drawing on a diverse set of international experiences, the volume offers a new lens and systematic approach to analysing the nature of governance problems and opportunities in fisheries and aquaculture, exploring pressing challenges and identifying potential solutions. ”It now seems clear that the crisis in the world’s fisheries [is] a much larger and more complex problem than many had imagined.     Abstract: This book discusses all critical privacy and data protection aspects of biometric systems from a legal perspective. It contains a systematic and complete analysis of the many issues raised by these systems based on examples worldwide and provides several recommendations for a transnational regulatory framework. An appropriate legal framework is in most countries not yet in place. Biometric systems use facial images, fingerprints, iris and/or voice in an automated way to identify or to verify (identity) claims of persons. The treatise which has an interdisciplinary approach starts with explaining the functioning of biometric systems in general terms for non-specialists. It continues with a description of the legal nature of biometric data and makes a comparison with DNA and biological material and the regulation thereof. After describing the risks, the work further reviews the opinions of data protection authorities in relation to biometric systems and current and future (EU) law. A detailed legal comparative analysis is made of the situation in Belgium, France and the Netherlands. The author concludes with an evaluation of the proportionality principle and the application of data protection law to biometric data processing operations, mainly in the private sector. Pleading for more safeguards in legislation, the author makes several suggestions for a regulatory framework aiming at reducing the risks of biometric systems. They include limitations to the collection and storage of biometric data as well as technical measures, which could influence the proportionality of the processing. The text is supported by several figures and tables providing a summary of particular points of the discussion. The book also uses the 2012 biometric vocabulary adopted by ISO and contains an extensive bibliography and literature sources

    Abstract: This Inventory is concerned with direct budgetary transfers and tax expenditures that relate to fossil fuels, regardless of their impact or of the purpose for which the measures were first put in place. It has been undertaken as an exercise in transparency, and to inform the international dialogue on fossil-fuel subsidy reform. For each of the 34 OECD countries covered, the Inventory provides a succinct summary of its energy economy, and of the budgetary and tax-related measures provided at the central-government level (and, in the case of federal countries, for selected sub-national units of government) relating to fossil-fuel production or consumption. The transfers associated with these measures are reported for recent years using the Producer Support Estimate (PSE) and Consumer Support Estimate (CSE) as organising frameworks. These frameworks have already been used extensively by the OECD, most notably in respect of agriculture. The Inventory covers a wide range of measures that provide a benefit or preference for a particular activity or a particular product, either in absolute terms or relative to other activities or products, against a specified baseline. Many measures listed in this inventory are relative preferences within a particular country’s tax system rather than absolute support that can be readily compared across countries, and for that reason no national totals are provided.

    Abstract: Die Indigenenbewegung ist trotz ihrer enormen Diversität ein wichtiger sozialer Akteur in der ecuadorianischen Gesellschaft. Seit einer Sattelzeit zwischen Mitte der 1970er und Mitte der 1980er Jahre hat sie einen Diskurs herausgebildet, der identitäre mit klassistischen Positionen verbindet und um die politischen Begriffe indigene Nationalität, Territorialität, Plurinationalität, Interkulturalität und Gutes Leben herum aufgebaut ist. Philipp Altmann zeigt, wie sich dieser Diskurs gegen die koloniale Strukturierung der Gesellschaft und ihre Auswirkungen - wie etwa Diskriminierung und Ungleichheit - wendet und daher dekolonial zu verstehen ist.
    Abstract: The Indigenous Peoples Movement, despite its enormous diversity, is an important social player in Ecuadorian Society. Since the transitional period between the mid-1970s and mid-1980s, it has established a discourse which combines identity with class position and is structured around the political terms indigenous sovereignty, nationality, territoriality, plural nationality, interculturality, and »the good life«.Philipp Altmann shows how this discourse stands in opposition to the colonial structuring of society and its effects - such as discrimination and inequality - and is therefore to be understood as decolonial.

Sie schildert die sukzessive Entstehung des Systems, nimmt eine aktuelle Bestandsaufnahme vor und geht dem Verhältnis der Subsidiaritätsklauseln zum Grundsatz der Verhältnismäßigkeit nach. Die Arbeit untersucht weiterhin den Bedeutungsgehalt der verschiedenen Subsidiaritätsklauseln sowie ihre Kollision bei Anwendung mehrerer subsidiärer Ermittlungsmaßnahmen. Am Ende fragt die Arbeit nach der Konsistenz des Systems und setzt sich in den Schlussfolgerungen mit der Praktikabilität und der Frage, ob das System seinem Anspruch gerecht geworden ist, kritisch auseinander.

    Abstract: Das Phänomen des Mißbrauchs von Amtsbefugnissen ist in sämtlichen Gesellschaften verbreitet. Im Gegensatz zum deutschen hat der italienische Gesetzgeber den Amtsmißbrauch in Artikel 323 codice penale unter Strafe gestellt. Das Delikt hat durch die Anklage hochgestellter Politiker in Italien aktuell auch in Deutschland Bekanntheit erlangt. Die Bestimmung weist eine bewegte Geschichte auf und war in Italien Gegenstand heftiger wissenschaftlicher Auseinandersetzungen. Darauf geht die vorliegende Abhandlung anhand der Erläuterung der Tatbestandsmerkmale ein. Darüber hinaus wird untersucht, worin die Gründe für das Fehlen einer entsprechenden Norm im deutschen Recht zu sehen sind und inwiefern eine Inkriminierung der Zweckentfremdung von Amtskompetenzen hierzulande unter den Gesichtspunkten der Strafwürdigkeit und Strafbedürftigkeit in Betracht käme.

    Abstract: Anknüpfend an die Tradition umfragedatenbasierter Werteforschung untersucht Marian Krawietz Ähnlichkeit und Veränderung von Wertorientierungen zu „Freiheit“ und „Gleichheit“ im Kontext liberal-ökonomischer „Westernisierung“, post-sozialistischer Transformation und europäischer Integration zwischen 1981-2006 in Tschechien, Polen und Deutschland. Im Fokus steht die Suche nach einer jungen „Generation-Transformation“, die einerseits ähnlichere Werthaltungen, andererseits aufgrund der Sozialisation in die Umbruchsphase hinein, kritischere Einstellungen zu den liberal-ökonomischen Werten aufweisen sollte.     Abstract: Until recently, economists studying economic development have tended to consider it a universal process, or focussed their attention on common aspects. This book originates from the growing recognition of significant sectoral differences in economic development and examines the catching-up process in five different economic sectors: pharmaceuticals, telecommunications equipment, semiconductors, software, and agro-food industries. Each of these sector studies explore the learning and catch-up processes in various developing countries, in order to identify both the common features, and those which differ significantly across sectors and nations. The authors pay particular attention to China, India, Brazil, Korea and Taiwan.

Das Herstellungsverfahren von Tissue Engineering-Produkten unterliegt einer Vielzahl rechtlicher Vorschriften, wobei es sich um ein Zusammenspiel von nationalen und europarechtlichen Normen handelt. Trotz zahlreicher Änderungen im Laufe der letzten Jahre sind manche Rechtsfragen nicht eindeutig geklärt, was auch der Besonderheit der Produkte ihrer Herstellung aus lebenden menschlichen Zellen geschuldet ist. Diese Arbeit zeigt die Schwierigkeiten auf, die durch das Ineinandergreifen verschiedener nationaler und europarechtlicher Rechtsvorschriften entstehen und gibt einen Überblick über die rechtliche Einordnung einzelner Schritte des Verarbeitungsprozesses sowie über Fragen bzgl. der Anwendung und Kommerzialisierung von Tissue Engineering- Produkten.
    Abstract: Das Tissue Engineering, die biotechnologische Heranzüchtung menschlichen Gewebes im Labor aus zuvor entnommenen Zellen, unterliegt einer Vielzahl rechtlicher Vorschriften, bei denen es sich um ein Zusammenspiel verschiedener nationaler und europarechtlicher Regelungen handelt. Trotz zahlreicher Änderungen im Laufe der letzten Jahre sind noch nicht alle Rechtsfragen im Zusammenhang mit dem Tissue Engineering und den hergestellten Produkten eindeutig geklärt, was auch der Besonderheit der Produkte – ihrer Herstellung aus lebenden menschlichen Zellen – geschuldet ist.     Abstract: 1797 erscheint mit den Metaphysischen Anfangsgründen der Rechtslehre Immanuel Kants rechtsphilosophisches Hauptwerk. Nicht selten begegnet man daher der Auffassung, Kants Rechtsphilosophie entstamme im Wesentlichen seiner Spätphase und sei überdies nur schwer mit der kritischen Moralphilosophie der 1780er Jahre in Einklang zu bringen. Vor diesem Hintergrund widmet sich die vorliegende Untersuchung dem Vergleich des kantischen Rechtsbegriffs, wie er 1797 in der Einleitung in die Rechtslehre vorgestellt wird, mit Kants Ausführungen in den Vorlesungsnachschriften Moral-Mrongovius II und Naturrecht-Feyerabend aus dem Jahre 1784. Dabei kann nachgewiesen werden, dass der Rechtsbegriff von 1797 bereits 1784 ausgearbeitet war. Mehr noch: Es zeigt sich, dass Kants Rechtsbegriff nicht nur bereits in der Phase seiner kritischen Moralphilosophie vorlag, sondern vielmehr in einem Guss mit ihr konzipiert wurde und wie diese auf dem kritischen Freiheitsbegriff basiert.

    Abstract: Das Zeitalter der immer weiter fortschreitenden Digitalisierung und die stetige Verbesserung der technischen Rahmenbedingungen bieten Forschungseinrichtung neue Mittel und Wege, ihre gewonnenen Daten zu archivieren und öffentlich zugänglich zu machen. Nicht selten gehen damit rechtliche Problematiken einher. Angefangen bei der Frage, wem denn diese Daten gehören bis hin zu der Problematik, ob bestimmte Daten überhaupt archiviert werden dürfen und wer für einen eventuellen Datenverlust haften muss. Das vorliegende Werk legt dabei besonderes Augenmerk auf die urheberrechtlichen, datenschutzrechtlichen sowie haftungsrechtlichen Problematiken, welche eine digitale Archivierung mit sich bringen kann. Des Weiteren wird beleuchtet, welche Überlegungen im Vorfeld einer Archivierung angestellt werden müssen und welche Maßnahmen getroffen werden sollten, um rechtlichen Schwierigkeiten vorzubeugen. Die Arbeit soll daher auch als rechtlicher Leitfaden für Archivierungsprojekte dienen, weshalb unter anderem auch Vorschläge für die Formulierung entsprechender Vertragsklauseln enthalten sind. Aus diesem Grund wird außerdem ausführlich auf die rechtlichen Konsequenzen von Verstößen gegen urheber- und datenschutzrechtliche Vorschriften eingegangen.

    Abstract: Die Art und Weise wie dem Missbrauch des Internets als Verbreitungsmedium für Kinderpornographie Einhalt geboten werden kann, wird auf nationaler wie auch europäischer Ebene stark diskutiert. Im Mittelpunkt steht die Frage, ob auch unmittelbare Eingriffe in die Internetstruktur zwecks Unterbindung des Zugriffs auf kinderpornographische Webinhalte gerechtfertigt sind. Damit sind in erster Linie die Internetsperren von Access-Providern angesprochen und die Problematik, ob diese tatsächlich eine effektive Maßnahme in der Bekämpfung von Kinderpornographie verheißen. Die Autorin untersucht dieses Thema primär anhand einer verfassungsrechtlichen Würdigung eines legislatorischen Sperransatzes zur Verhinderung des Zugriffs auf diese kinderpornographischen Webinhalte, bezieht aber auch die europäische Entwicklung mit ein. Neben der Herleitung allgemeiner verfassungsrechtlicher Anforderungen wird auch ein Überblick über das Zugangserschwerungsgesetz gegeben, das in den Jahren 2009/2010 als erster ernstzunehmender gesetzlicher Ansatz zur Inhaltsregulierung galt, letztlich jedoch praktisch nicht angewandt wurde.

Systematically applying a comparative perspective, this book addresses the question of why the headscarf tantalises and causes such controversy over issues about religious pluralism, secularism, neutrality of the state, gender oppression, citizenship, migration, and multiculturalism.Seeking also to establish why the issue has become part of the disciplinary practices of some European countries but not of others, this work brings together an important collection of interpretative research regarding the current debates on the veil in Europe, offering an interdisciplinary scope and European-wide setting. Brought together through a common research methodology, the contributors focus on the different religious, political and cultural meanings of the veiling issue across eight countries and develop a comparative explanation of veiling regimes.     Abstract: Die Medien berichten regelmäßig über Selbstmordattentate im Irak, in Pakistan und Afghanistan. Eine geringere mediale Aufmerksamkeit erhalten gewaltfreie Formen des Selbstopfers wie die Selbstverbrennung und das Todesfasten. Jenseits von Spekulationen, Kulturalisierungen und Pathologisierungen nähert sich der Autor diesem keineswegs seltenen Phänomen auf empirischer Basis. Anhand einer Analyse ausgewählter Abschiedsnachrichten und Märtyrervideos wird herausgearbeitet, wer die Adressaten eines solchen Aktes sind, welche Handlungserwartungen an diese gestellt werden und unter welchen Bedingungen der eigene Tod zu einer „Medienwaffe“ werden kann

    Abstract: Wie Themen in Medien und Politik behandelt werden ist unter gesellschafts- und demokratietheoretischen Gesichtspunkten relevant, da ein sinnvoller Diskurs zwischen Bevölkerung, Medien und Politik nur dann stattfinden kann, wenn es zumindest gewisse inhaltliche Überschneidungen gibt. Hannah Schmid-Petri vergleicht Verarbeitungs-Prozesse (Framing) für Medien und Politik auf der Grundlage system- und akteurstheoretischer Annahmen, an die Erkenntnisse aus dem Bereich der Nachrichtenwerttheorie, des Agenda-Settings und des Framings angebunden werden. Die Verarbeitung eines Issues wird verstanden als die Selektion von einzelnen inhaltlichen Aspekten, die sich zu Mustern verdichten, sowie die Auswahl von Akteuren, die sich zu einem Thema äußern. Kenntnisse über die Selektion von Issues werden dabei auf die Verarbeitung übertragen („Selektion zweiter Ordnung“) und somit Nachrichtenwerttheorie und Framing-Ansatz integriert

    Abstract: "Since the January 25 Revolution of 2011 that ousted Hosni Mubarak, the Muslim Brotherhood (MB) has emerged as a legal entity operating the Freedom and Justice Party (FJP). That party won a strong plurality in the 2011-2012 parliamentary elections as well as claiming the presidency. But while the group was one of the primary beneficiaries of the revolution, its future is clouded by serious generational divides within the organization. The MB is led by an aged leadership whose formative experience was the mihna (ordeal) of the 1960's when the state tried to stamp out the Islamist movement. This hardened the group's leaders and put a premium on secrecy and organizational security. Although individuals under the age of 35 make up a large share of the MB's membership, their participation is modeled on the principle of "listen and obey." This overbearing hierarchy has already led to splits within the MB and will continue to present challenges going forward. These youth merit attention not only as a challenge to the Brotherhood's organizational cohesion, but also as a potential conduit for expanding U.S. engagement with the group. This study presents several recommendations on how the United States can incorporate MB youth into engagement efforts, including understanding but not gaming divisions in the organization, expanding engagement beyond a handful of MB senior leaders, leveraging existing outreach programs to include MB youth, and cultivating leadership buy-in for youth engagement efforts."
