    Abstract: Neben der Gerechtigkeit ist die Rechtssicherheit einer der Hauptzwecke des Rechts. Bei der Gestaltung von Rechtsregeln spielt sie die Rolle eines Fluchtpunkts. Aus dem rechtlichen Diskurs einer institutionalisierten Rechtsordnung, zumal der deutschen, aber auch einer gemeineuropäischen, ist sie nicht wegzudenken. Andreas von Arnauld verdeutlicht und rekonstruiert eine idée directrice des Rechts, die gerade wegen ihrer Allgegenwart im juristischen Diskurs Gefahr läuft, verschüttet zu werden. Er legt dabei einen primär induktiv-phänomenologischen Ansatz zu Grunde. Aus verschiedenen Blickwinkeln heraus (begriffsgeschichtlich, genealogisch, topologisch, antinomisch) leuchtet er die Teleologie der Rechtssicherheit, ihre wesentlichen normativen Strukturen sowie Erscheinungsformen und Verwendungen des Rechtssicherheitsarguments aus. Ein Schwerpunkt liegt dabei auf einer Darstellung der Vielschichtigkeit, mit welcher die Forderung nach Rechtssicherheit im deutschen öffentlichen Recht der Gegenwart umgesetzt wird. Der kritisch-wertende Vergleich mit anderen europäischen Rechtsordnungen trägt dazu bei, Einseitigkeiten der nationalen Perspektive zu korrigieren und einen differenzierten Blick auf Inhalt und Funktionsweise eines Verfassungsprinzips Rechtssicherheit zu werfen, welches vom Bundesverfassungsgericht seit langem dem Grundgesetz entnommen wird.
    Abstract: In addition to justice, legal certainty is one of the main objectives of the law. We cannot imagine the legal discourse of an institutionalized legal order, particularly the German legal order, without it. Andreas von Arnauld explains and reconstructs an idée directrice of the law, which precisely because of its omnipresence in the legal discourse is in danger of being consigned to oblivion. The author examines teleology, normative structures and manifestations of legal certainty from different perspectives, i.e. genealogical, topological and comparative, in order to give a differentiated picture of this general principle of law. The comparison with other European legal systems contributes to a correction of the one-sidedness in the national perspective.

    Abstract: "Liberal theories have long insisted that cultural diversity in democratic societies can be accommodated through classical liberal tools, in particular through individual rights, and they have often rejected the claims of cultural minorities for group rights as illiberal. Group Rights as Human Rights argues that such a rejection is misguided. Based on a thorough analysis of the concept of group rights, it proposes to overcome the dominant dichotomy between ""individual"" human rights and ""collective"" group rights by recognizing that group rights also serve individual interests. It also challenges the claim that group rights, so understood, conflict with the liberal principle of neutrality, on the contrary, these rights help realize the neutrality ideal as they counter cultural biases that exist in Western states. Group rights deserve to be classified as human rights because they respond to fundamental, and morally important, human interests. Reading the theories of Will Kymlicka and Charles Taylor as complementary rather than opposed, Group Rights as Human Rights sees group rights as anchored both in the value of cultural belonging for the development of individual autonomy and in each person's need for a recognition of her identity. This double foundation has important consequences for the scope of group rights: it highlights their potential not only in dealing with national minorities but also with immigrant groups, and it allows to determine how far such rights should also benefit illiberal groups. Participation, not intervention, should here be the guiding principle if group rights are to realize the liberal promise."

    Abstract: Under U.S. domestic law and treaty practice, all international agreements concluded by the United States, regardless of their form, designation or title are divided into treaties, which are submitted to the Senate for its advice and consent to ratification, and other international agreements. Treaties which are submitted to the Senate are similar to federal laws, and their legislative history is much the same as the one followed by legislation, except that it is confined to proceedings in the Senate only. This legislative history follows the procedures established by the Senate, and it is based on primary legislative sources. The main part is arranged chronologically by the date of conclusion of the treaty. Each treaty contains the following components: it provides general information about the treaty; it lists chronologically steps taken by the Senate during the treaty approval process; legislative implementation, executive action, following Senate approval; entry into force, and annotations, such as references to related treaties, amendments, and present status. The use of the legislative history is facilitated by appendices and a detailed general index which includes: parties, regional subdivisions, and subjects
