    Kurzfassung: Also available in paperback as "Modernist and Fundamentalist Debates in Islam"During the second half of the nineteenth century, a group of prominent Muslim theologians began to critically examine classical conceptions and methods of jurisprudence and devised a new approach to Islamic theology. This new approach was nothing short of an outright rebellion against Islamic orthodoxy, displaying an astonishing compatibility with nineteenth century Enlightenment-era thought. In the 20th century this modernist movement declined, to be replaced by another cultural episode, characterized by the growing power of Islamic fundamentalism. This volume looks at these two very different approaches to Islam. The editors have selected the most prominent Islamic thinkers of modernist and fundamentalist viewpoints, diverse nationalities, and from both the late decades of the nineteenth century and the early decades of the 20th century.     Kurzfassung: Class action lawsuits--allowing one or a few plaintiffs to represent many who seek redress--have long been controversial. The current controversy, centered on lawsuits for money damages, is characterized by sharp disagreement among stakeholders about the kinds of suits being filed, whether plaintiffs' claims are meritorious, and whether resolutions to class actions are fair or socially desirable. Ultimately, these concerns lead many to wonder, "Are class actions worth their costs to society and to business? Do they do more harm than good?" To describe the landscape of current damage class action litigation, elucidate problems, and identify solutions, the RAND Institute for Civil Justice conducted a study using qualitative and quantitative research methods. The researchers concluded that the controversy over damage class actions has proven intractable because it implicates deeply held but sharply contested ideological views among stakeholders. Nevertheless, many of the political antagonists agree that class action practices merit improvement. The authors argue that both practices and outcomes could be substantially improved if more judges would supervise class action litigation more actively and scrutinize proposed settlements and fee awards more carefully. Educating and empowering judges to take more responsibility for case outcomes--and ensuring that they have the resources to do so--can help the civil justice system achieve a better balance between the public goals of class actions and the private interests that drive them

    Kurzfassung: Main description: On the basis of a study of reproach activities ('in situ reproaches', 'mock reproaches' and reconstructions of previous reproach interactions in 'complaint stories') the monograph examines prosodic, grammatical, rhetorical/stylistic processes and their functions in everyday usage. Following an analysis of the constitution of these reproach genres the study charts the consequences for a theory of communicative practice and discusses aspects such as the genre-specific function of grammatical structures, the interaction between prosodic and syntactic procedures in the production of communicative meaning, and the role of indexical signs in the negotiation of meaning.

    Kurzfassung: The years 1989/1990 saw the fall of the Iron Curtain. Following forty years of significant restrictions, legal and non-bureaucratic travel from East-Central and Eastern European countries was once again possible and travelling and returning to those countries became just as easy. Immediately following the end of the East-West conflict, people from East-Central and Eastern European countries took advantage of their new freedom of travel. Many sought to emigrate to Western countries. However, when faced with such immigration, the euphoria which met the end of the political divisions in the West evaporated quickly. Several polls and surveys, projections and prognoses served to unsettle people more than the reality of immigration. This gave rise to a sometimes blind and specious – yet nevertheless politically effective – fear of a new mass migration of peoples. Now, more than ten years after the fall of the Iron Curtain, the actual scale and development of the East-West migration in Europe be clearly evaluated. This book attempts to do just that, including a comprehensive overview and eleven country-specific chapters. Each chapter includes a historical review, an account of the most important changes since 1989/1990 and a forecast of future migration developments. 1989/90 fiel der Eiserne Vorhang. Nach mehr als 40 Jahren erheblicher Einschränkungen wurde die legale und unbürokratische Anreise aus den Staaten Ostmittel- und Osteuropas wieder möglich. Genauso leicht wurde die Ein- und Rückreise dorthin. Unmittelbar nach Ende des Ost-West-Konflikts begannen die Bürger Ostmittel- und Osteuropas, von dieser neuen Reisefreiheit Gebrauch zu machen. Etliche versuchten, in ein westliches Land auszuwandern. Angesichts solcher Zuwanderung verflog die Euphorie über das Ende der politischen Spaltung Europas im Westen relativ rasch. Mehr noch als die tatsächliche Migration beunruhigten aber diverse Umfragen, Hochrechnungen und Prognosen die öffentliche Meinung. Es entstand eine teilweise unreflektierte und vordergründige, aber politisch höchst wirksame Angst vor einer neuen Völkerwanderung in Europa. Mehr als zehn Jahre nach dem Fall des Eisernen Vorhangs können nun tatsächliche Größe und Entwicklung der Ost-West-Wanderung in Europa klar abgeschätzt werden. Damit befasst sich dieses Buch. These differences are related to differences in resource levels and in how resources are spent. States with high spending per pupil, lower pupil-teacher ratios, higher participation in public prekindergarten and higher reported teacher resources have higher achievement. Disadvantaged children are the most sensitive to low resource, and additional resources could substantially their scores. Between-state, rather than within-state, differences in resources appear to be the main reason for inequitable resource levels for students of lower socioeconomic status. The conclusion is that significant math gains are occurring across most states that cannot be traced to resource changes, that the rate of gain varies significantly by state, and that reform efforts are the likely cause of these gains.     Kurzfassung: This study focuses in detail on the environmental compliance/competitiveness relationship with respect to the regulation of packaging waste. An important and innovative feature of the study is its emphasis on backward and forward linkages. An entire supply chain is considered: packaging manufacturers and suppliers, food processors and the food retail sector, to study the competitive effects of environmental standards on manufacturing companies and the vertical links and supply responses. A variety of regulatory regimes is represented by including within the study companies from Germany, Italy, the Republic of Ireland and the United Kingdom. While it is of note that the relatively strong regulation in Germany has indeed had effects on company behaviour, there is no evidence that environmental regulations hindered companies from achieving competitive performance. Analyses consider: the response of individual firms to different levels of regulation; the cost of compliance; impact on employment; the influence of the supply chain on environmental and competitive performance; the importance of firm size and ownership; and the impact of regulation on competitiveness, and firm competitiveness on the efficiency of adjustment to regulation

    Kurzfassung: The role of the stock market in the recent global financial crisis has led many to question the way in which the modern international financial system operates. This highly topical book offers important insights into the stock market, contrasting the speculative explanation of stock market fluctuations with the conventional efficient markets hypothesis. After summarising economists' views on stock market behavior from the classical period to the present day, the authors focus on two particular explanations of stock price fluctuations. They examine in detail the mainstream neo-classical theory with its emphasis on the efficient markets hypothesis. They then compare this with the theories of Veblen, Galbraith and Keynes who consider markets as being inherently prone to speculation and crisis, in contrast to the neo-classical approach which largely ignores the instability of stock markets and particularly the crashes that have recently occurred. The authors go on to develop a speculative model to account for stock market fluctuations which provides a useful and realistic explanation of how stock price expectations are formed. In a "post-modern" culture, criminal law serves more and more as a focal point in public morality.     Kurzfassung: This book offers an original and distinct analysis of NATO's post-Cold War evolution. Unlike so much of the available literature, it is not focused on what in the author's opinion NATO should be doing now that the Cold War is over. Rather, the author offers a comprehensive analysis and overview of the extent to which NATO can undertake new roles, tasks and missions in light of the extent to which it has retained significance and vitality as an international institution. The book's originality also lies in the way in which the author discusses NATO's adaptation within a framework provided by international relations theory, and in particular concepts which stress the role and importance of transnational political processes and international regimes. So far these have been little used in the analysis of military security relations and institutions.     Kurzfassung: The chapters of this volume apply the tools of public choice theory to the types of questions which economic historians have traditionally addressed. By adding the insights of public choice economists to the traditional tools used to understand economic actors and institutions, the authors are able to provide fresh insights about many important issues of American history. Each contribution analyzes an episode in American economic history within a public choice framework of rational maximization. Agents or interest groups are interpreted as either responding in predictable ways to economic incentives put in play by government policy or attempting to influence government policy. Public Choice Interpretations of American Economic History includes eight essays that examine: Why states contributed to the national government under the Articles of Confederation. The major nineteenth-century transitions in the source of state revenues away from fees and investments and toward the property tax, and from state to local government funding of infrastructure. Three economic failures from the American West in the late nineteenth and early twentieth century: overgrazing of the northern plains, despoliation of the Yellowstone Basin, and low productivity of Indian communal lands. The impact on trusts of state-level anti-trust activities and the passage of the Sherman Antitrust Act. The economic and political determinants of state-level WPA spending by the federal government during the New Deal. Why New Deal agricultural policies under the AAA were politically successful, while industrial policies under the NRA were scrapped. The Interaction between Fed policies and banks' decisions about membership in the Federal Reserve System in the period 1921-79. The influence of diversity among voters on states' decisions about how to regulate alcohol consumption in the decades after the end of prohibition

Prior to 1995, five regional and/or national evaluation organizations existed; today, there are more than twenty-five. With chapters from Africa, Asia, Australasia, Eastern and Western Europe, Latin America and the Caribbean, the Middle East, and North America, this bibliography is an attempt to tap into this rapid growth. Each chapter contains a short introduction describing the state of the art of evaluation in the region. References in each chapter contain information about authors, title, source, keywords, and description. Where possible, the keywords indicate country, sector, and evaluation approach. A useful feature of the bibliography is the index of authors and keywords. One look at the index and the reader will see how much evaluators from different regions have to learn from each other. This bibliography will help disseminate innovations in evaluation found in one region to other regions of the world. In this way, this book will enrich the theory and practice of evaluation worldwide

    Kurzfassung: Most Asian countries have shown a strong commitment to rapid economic development. Economists have argued that the fruits from economic development will be spread equitably throughout the population. In the absence of a strong tradition of social rights, social development in Asia has long been taken for granted. This collection documents social development in the Asian countries of China, Hong Kong, Taiwan, South Korea, Thailand and India and concludes that social development has lagged behind economic development. This has given rise to `distorted development' in many countries. Serious development problems of poverty and inequalities have lingered even in these economically advanced countries of Hong Kong, Taiwan, and Singapore. These problems have been exacerbated in the wake of the Asian economic crisis. In order to harmonize social development with economic growth, Asian states ought to be more proactive in their development agendas. As a text on social development in Asia, this book is primarily intended for practitioners and students of social work, social administration, and social policy. It is also relevant for students and practitioners of sociology, economics, and public policy

    Kurzfassung: This work analyzes the implementation of controversial public policy. A single, overarching model provides the framework for testing competing theories, ranging from Max Weber's bureaucracy theory and Woodrow Wilson's theory of administration to more recent ideas on how the legislature controls the bureaucracy. The model combines ideas about policy implementation drawn from different disciplines: political science, public administration, sociology and economics. The author uses a novel empirical test design to measure agency performance and deviations from political decisions taken in three Dutch local authorities. In contrast to more conventional implementation studies, this work adopts a `few variables, many cases' approach. The model and empirical tests, which are fully clarified in the book, together offer a novel framework for the analysis of complex implementation processes. A previous version of the book (written in Dutch) was awarded the prestigious Van Poelje prize of the Dutch Association for Public Administration and the 1996 annual award of the Dutch Political Science Association

    Kurzfassung: Volume 4 of the series "The Man in the Ice” contains the latest scientific results about the Iceman. By means of different methods - e.g. AMS-radiocarbon dating, bryology, dendrology, etc. - the reader gets information about several aspects of the Iceman’s lifestyle and his natural environment. His artefacts give insight into prehistoric craftsmenship. Even the potential location of his settlement is reconstructed by several different approaches. The good preservation of the pollen in his food residue allowed to identify the season when the Iceman died. Detailed pollenanalyses of mire deposits in the alpine region of the Ötztal gave insight into the genesis of the alpine grass heath and early pastoral farming of a time long before the Iceman lived. Radiocarbondating of a piece of wood from the Iceman’s finding spot demonstrates the early interest of prehistoric people in these highland zones. But also perspectives of future research activities are given

    Kurzfassung: Youth unemployment has become one of the most crucial social problems in many EU countries. In the 90s it can be observed that in most Western countries, the rate of youth unemployment have risen dramatically, in some of these countries the unemployment problem can be considered primarily a problem of refused entry to the labour market for members of the younger generation. This development increases the risk of psychosocial impairment to the individuals affected as well as to the social fabric in general. The present volume draws attention to the health effects of long-term youth unemployment in six European countries. It is based upon the results of an international research project (Youth Unemployment and Social Exclusion: Dimensions, Subjective Experiences, and Innovative Institutional Responses in Six Countries of the EU) (YUSEDER) conducted in the framework of the research programme Targeted Socio-Economic Research (TSER) of the European Commission. Partners with different scientific backgrounds (health psychology, public health research, psychiatry, industrial sociology, medical sociology) from six European countries participated in this project. The contributions in this volume illustrate an initial approach to analysing and comparing empirical evidence on youth unemployment and health from a comparative perspective for three Northern European countries (Sweden, Germany, Belgium) and for three Southern European countries (Spain, Italy, Greece). For each country a specific national report is presented. The comparative section describes and attempts to explain the similarities and dissimilarities between countries having rather diverse historical and social understandings of being in and out of work for young people

    Kurzfassung: Scare Tactics, the first book on the subject, provides a theory of the structure of reasoning used in fear and threat appeal argumentation. Such arguments come under the heading of the argumentum ad baculum, the `argument to the stick/club', traditionally treated as a fallacy in the logic textbooks. The new dialectical theory is based on case studies of many interesting examples of the use of these arguments in advertising, public relations, politics, international negotiations, and everyday argumentation on all kinds of subjects. Many of these arguments are amusing, once you see the clever tactic used; others are scary. Some of the arguments appear to be quite reasonable, while others are highly suspicious, or even outrageously fraudulent. In addition to the examples taken from logic textbooks, other cases treated come from a variety of sources, including political debates, legal arguments, and arguments from media sources, like magazine articles and television ads. The purpose of this book is to explain how such arguments work as devices of persuasion, and to develop a method for analyzing and evaluating their reasonable and fallacious uses in particular cases. The book shows how such arguments share a common structure, revealing several distinctive forms of argument nested within each other. Based on its account of this cognitive structure, the new dialectical theory presents methods for identifying, analyzing, and evaluating these arguments, as they are used in specific cases. The book is a scholarly contribution to argumentation theory. It is written in an accessible style, and uses many colorful and provocative examples of fear and threat appeal arguments that are suitable for classroom discussions. The matters treated will be of interest to professionals and students in law, critical thinking, advertising, speech communication, informal logic, cognitive science, rhetoric, and media studies

    Kurzfassung: The aim of Diversity in Family Formation is to examine changes in the start of the family formation process. Rather than giving a rough overview of demographic changes in many countries, a comparison of differences in changes in family formation and fertility behaviour between Belgium and The Netherlands is interesting for various reasons. First, even though the economic and cultural differences between these countries are relatively small there is one important difference: Belgium is predominantly Catholic, whereas The Netherlands has about equal proportions of Catholics and Protestants. Second, if the Second Demographic Transition implies that there is one common pattern of change in different European countries and that differences across countries are due to the fact that countries are in a different stage of the transition process, and if it is assumed that the transition process started earlier in Protestant countries than in Catholic countries, one would expect The Netherlands to be in a further stage of the transition process than Belgium. Thus an in-depth comparison of changes in family formation and fertility behaviour between both countries may give us more insight in the question of whether there is one common transition process. The comparison of fertility and family survey-data in both countries brings us to the core question of whether there is one common explanation for differences between countries in various types of fertility and family behaviour under consideration, namely fertility regulation, the choice of living arrangement after leaving the parental home, and the labour force participation of mothers

    Kurzfassung: How do small states approach their security problems? What types of strategic instruments exist for small states, and when and why are certain strategies chosen rather than others? The security of `weak' states is problematic, demanding trade-offs in the decisions made. Using 19th century Swedish security policy as an example, it is argued here that small states, in their pursuit of security and autonomy, face a dilemma between abandonment and entrapment, leading to a choice between balancing between great powers or making an approach to one of them. This hard choice confronts both non-aligned and allied states. It is also argued that a focus on the images of decision makers is required as a complement to traditional realist theory in order to gain an in-depth understanding of small state security decisions. This book is special in its focus on small, non-aligned states. Most studies on balance-of-power behaviour limit their analysis to alignment decisions. The study also expands the domain of image constructs by introducing perceived regime characteristics into the analysis, besides images of power and intentions. Audience: Scholars and students interested in foreign policy analysis, particularly small-state behaviour. The book points to the importance of beliefs and ideas in security policy

    Kurzfassung: In October 1999, some fifteen academic experts and government practitio­ ners from Germany and North America gathered for two days at the Uni ver­ sity of Augsburg to discuss the topic of "Constitutional Reform and Consti­ tutional Jurisprudence in Canada and the United States." The present volume documents the results of that conference, a collaborative effort of the De­ partment of Political Science, University of Erlangen-Nuremberg, and the Institute for Canadian Studies, University of Augsburg. In organizing this workshop, we were guided by two basic sets of ideas and assumptions: First, all "established" democracies are regularly confron­ ted with the need to adjust their constitutional order to changes in their envi­ ronment lest democratic stability be transformed into rigidity; in many wes­ tern nations, including Canada and the United States, developments such as the crisis of the Keynesian welfare-state or the emergence of increasingly heterogeneous, postmodern societies have ushered in an era of heightened, yet not always successful constitutional reform activity. Secondly, however, there is no unique path towards, or model of, an "optimal" constitutional order, however defined; rather, constitutional reform processes, their under­ Iying normative principles and their outcomes are strongly path and context­ dependent. Therefore, the participants of the workshop and authors of this volume were asked to examine the specific preconditions, context, nature and impact of recent constitutional reform processes in the Uni ted States and Canada.

    Kurzfassung: The use of dynamic models to address the problem of environmental degradation is central to environmental policy because decisions taken now affect not only the current generation but have a profound impact on the future. In this innovative book, Frank Hettich uses dynamic modelling to study the interactions between economic growth, environmental policy and tax reform. He incorporates pollution and abatement technologies into different endogenous growth models that take into account consumer preferences and physical and human capital accumulation.     Kurzfassung: NGOs have moved out of the "amateur" world in which they were once confined into, in many cases, highly professional activities. This statistical analysis demonstrates that there are thousands of development NGOs in European countries with as much as 7.3 billion at their disposal. Supported by a large number of tables and graphs, as well as detailed, individual country surveys, the author provides the first-ever such study of what has become a late-twentieth, early twenty-first century phenomenon.     Kurzfassung: Depuis un quart de siècle, les États-Unis jouent un rôle de pionnier dans le domaine de la réforme de la réglementation à l'échelle mondiale. Contrairement à l'opinion courante, les États-Unis ne sont pas moins réglementés que les autres pays mais ils sont réglementés différemment eu égard à l'orientation favorable à la concurrence des régimes réglementaires fédéraux, et à l'ouverture et à la contestabilité des processus de réglementation. Une déréglementation économique de grande envergure associée à des efforts pour améliorer la qualité de la réglementation sociale ont contribué à l'édification de l'une des économies les plus innovantes, les plus flexibles et les plus ouvertes de la zone OCDE, tout en maintenant des normes relativement élevées dans les domaines de la santé, de la sécurité et de l'environnement. Pourtant, d'importants problèmes liés à la réglementation persistent aux États-Unis. Un défi fondamental pour assurer sa qualité consiste à améliorer le rapport coût-efficacité et la performance de réglementations sociales et de formalités publiques coûteuses. En un mot, il s'agit moins de réglementer plus que de bien réglementer. Les États-Unis sont un des premiers pays à avoir demander à l'OCDE de procéder à un examen général de ses pratiques réglementaires et des réformes de la réglementation menées à l'échelon national. Cet ouvrage est le fruit de l'évaluation approfondie menée par l'OCDE et d'un examen par ses pays Membres. Il présente une évaluation sans équivalent de la réforme de la réglementation dans des domaines aussi essentiels que le contexte macro-économique, la qualité du secteur public, la politique de la concurrence et sa mise en oeuvre, ainsi que l'intégration des principes d'ouverture du marché dans les processus réglementaires et dans des secteurs tels que l'électricité et les télécommunications. Les politiques recommandées offrent un plan d'action équilibré à court et à plus long terme fondé sur les meilleures pratiques réglementaires à l'échelon international.     Kurzfassung: In 1997 the U.S. Federal Communications Commission ordered sharp reductions in international settlement rates (bilaterally negotiated rates for telecom traffic between pairs of countries) for telecom traffic between the United States and the rest of the world. Even the very poorest countries, with the least developed telecommunications networks, must slash rates for traffic to the United States by 2003. Will this, by reducing telecom revenues in developing countries, reduce investments in those countries' telecom sectors?

    Kurzfassung: In many industries, competition is far from perfect and managerial efficiency (or a fixed cost) varies among firms. However, traditional measurement of technological progress assumes perfect competition and no fixed cost. This paper incorporates these two factors in the technological-progress measurement and investigates the biases caused by their omission. We show that if capital growth exceeds non-capital-input growth and that firms earn a positive pure profit, then traditional measurement underestimates the true technological progress. We apply this methodology to Japanese and US industries, and find that imperfect competition and managerial efficiency are important. However, the magnitude of the bias is not large ...

Diese Frage wird anhand eines umfangreichen Korpus authentischer Gesprächsaufzeichnungen aus den Jahren nach der deutschen Wiedervereinigung beantwortet. "Ost-" und "Westdeutsch" sind dabei die sozialen Kategorien, anhand derer empirisch erarbeitet wird, wie Personen zu Gruppen zugeordnet und wie damit und darüber hinaus gruppenspezifische Eigenschaften und Verhaltensweisen zugeschrieben und bewertet werden. Das Hauptergebnis der Studie ist ein linguistischer Beschreibungsrahmen für soziale Kategorisierungen in Gesprächen und Texten , Main description: The study proceeds from an inquiry into the way in which affiliation to social groups is signalized communicatively. The question is examined on the basis of a large corpus of authentic verbal exchanges (conversations) recorded in the years following German reunification. 'East German' and 'West German' are the social categories forming the basis for the empirical elaboration of how individuals are allocated to group(ing)s and how - both on the basis of that allocation and beyond it - group-specific characteristics and behaviours are ascribed and evaluated.     Kurzfassung: This conference proceedings defines transport benchmarking, analyzes its usefulness to policy makers and discusses what lessons can be drawn at the national and international level for policy makers. The first part examines the different methodological aspects raised by benchmarking methods. The conference clarified the multiple concepts included in this type of mechanism and identified different practices which range from the simple statistical tool to a genuine policy lever. The second part describes several concrete examples of benchmarking applications in the transport sector. These examples relate in particular to topics such as road safety, rail transport, the environment, public and urban transport, seaports and air cargo, etc. Each chapter of this publication may be read independently. A fundamental message, common to all the examples presented, emerges: it is essential to improve the quality of statistics in order to ensure more reliable transport benchmarking results.

It then examines the pan-European process of legal harmonisation and adjustment of transport systems and analyses emerging trade and transport links between Europe and Asia.     Kurzfassung: China's remarkable growth in recent years has been often rather arbitrarily ascribed to a number of politico-economic factors. In this volume, the specific effect of foreign direct investment (FDI) inflows is measured quantitatively and estimated on a regional basis. The authors find that there is a much more complex relationship between such flows and growth overall than had hitherto been supposed.     Kurzfassung: Environmental impact assessments are an essential component of making decisions on transport infrastructure investments. Traditional procedures have proved ineffective for impacts that go beyond the scope of projects in isolation. Strategic environmental assessment has emerged in response, to address large scale effects including impacts on traffic across networks, impacts on climate change and biodiversity and the impacts of policy decisions as opposed simply to individual projects. This report examines recent experience in developing environmental assessment internationally and makes recommendations on maximising the effectiveness of this new tool.

    Kurzfassung: Pollution from transport is being cut substantially through exhaust emissions regulations and vehicle manufacturers’ investments in cleaner technologies. The benefits of these improvements, however, are delayed as car fleet renewal takes a decade on average in Europe. Car scrappage schemes can be used to accelerate the uptake of new, cleaner vehicles. This publication analyses the effectiveness of these programmes in protecting the environment and reviews the schemes introduced to date in Europe and North America. Three complementary issues are addressed to help make pragmatic recommendations:- What are the effects of scrapping schemes on the car market and the national economy?- What are the effects of these programmes on the environment?- And can scrappage schemes be useful in former socialist countries?
