    Abstract: Borders, democratic legitimacy, multiscale statehood, governance : the covid crisis has shaken things up and emphasized both the contradictions and the central salience of territories. In this sharp volume Oscar Mazzoleni critically reviews the main debates about territories that have unfold over the last two decades, in particular in geography and political sociology. He makes a powerful insight for a critical territorial approach aiming to analyze democratic politics. Patrick Le Galès, CNRS research professor at Sciences Po, Paris, France Mazzoleni has contributed a brief but encompassing study of the concept of territory in social sciences. This well-written piece analyzes the concept of territory as multidimensional and interdisciplinary. His is a rigorous attempt to offer a systematic framework to make territorial politics part of the contemporary research agenda. In developing a territorial approach, he adds to the field by addressing essential gaps in the literature. Margarita Gomez-Reino Cachafeiro, full professor at the UNED University, Madrid, Spain The book provides a comprehensive and up-to-date introduction to the uses of the concept of territory in the study of democratic politics. The author tests the limits of a literature which avoid territorial dimensions, and reasserts the relevance of the concepts of territory and territorial space in the understanding of contemporary politics. With a political sociological perspective, but engaging in an interdisciplinary dialogue, the book draws a new conceptual framework focusing on both traditional and innovative topics: state-building and the transformation of nation-states, the changes in democratic citizenship, the relevance of territory for voting behaviour, the territorial dimensions of populism and the experience of the pandemic, taken as a global territorial crisis. Exposing the initial agenda of this paradigm and revealing its fundamental contradictions, The Nomadic Leviathan debunks it as a myth. Resurrecting the conquest theory, and reinforcing it with the idea of extrahuman transportation, this book places pastoralism at the origin of the state and civilization, and the Eurasian steppe at the center of human history; the political emerges as the primary and fundamental order defining the social and economic.

    Abstract: Political shocks have come to be considered highly salient for explaining major changes to international politics and to the foreign policies of states. Such shocks can occur at all levels of analysis: domestically, dyadically, regionally, or globally. They range from political phenomena such as coups and wars to ecological catastrophes. These shocks are sufficiently disruptive to cause foreign policy makers to reconsider their foreign policy orientations and to contemplate major changes to their policies. In fact, some have argued that it is mostly through political shocks that fundamental policy change occurs in most states. No wonder then that political shocks are now increasingly part of the toolbox of considerations used by foreign policy and international relations scholars as they focus on understanding patterns of conflict and cooperation between states. Given the salience of political shocks to understand foreign policy change, this book brings together a group of both senior and more junior scholars whose previous work has shown substantial promise for moving forward theory and empirical analysis. Their combined efforts in this book highlight the value of multiple theoretical and empirical approaches to a clearer understanding of the nature of political shocks and their consequences for foreign policy and international politics.

    Abstract: This book addresses the links between war, state and sovereignty using an interdisciplinary approach.     Abstract: This book analyzes major contemporary political and security problems in Central and Eastern Europe (CEE). Presenting case studies on various CEE countries, it highlights the persistence of non-democratic political trends in the region, with particular emphasis on authoritarianism in Belarus and the illiberal shift in the politics of Hungary and Poland. Also, the book examines the growing geopolitical and military rivalry between the West and Russia in the CEE region, which led to Russia's invasion of Ukraine. After addressing the increasing involvement of external entities such as NATO, the EU, the USA, Germany, France, and China, it highlights serious internal and external challenges to the democratic institutions and international security of CEE that call for new formats of multilateral cooperation to be established by the region’s countries.     Abstract: This open access book contributes to thriving debates in academic as well as professional circles about the role of civil society in shrinking civic spaces, rising authoritarianism and right-wing populism, conflicts, fragile states, and most lately, the global COVID-19 pandemic. This is one of the first books to address the implications of changing civic spaces for civil society organizations worldwide. It offers a unique overview of how social movements and civil society groups in very different settings are responding to state-imposed restrictions of basic civic freedoms. The authors are all experts in the field, and their analyses are based on original and onsite research. This unique book also contributes to a better understanding of the conceptualizations and practices of civil society. Kees Biekart is Associate Professor at the International Institute of Social Studies (ISS) of Erasmus University (The Netherlands). Tiina Kontinen is Associate Professor in International Development Studies at the University of Jyväskylä (Finland), where she leads a research group on Citizenship and Civil Society in Development. She has published on civil society, NGOs, and North-South partnership and has led various projects with global research teams. Marianne Millstein is Senior Researcher at the Norwegian Institute of Urban and Regional Research (NIBR), Oslo Metropolitan University (Norway). She has published on urban politics, governance and planning, civil society, and citizenship. .

    Abstract: This book presents a new organizing framework for studying democratic recession and autocratization in Southeast Asia. By introducing a new concept, “democratic backlash,” the book details how democratic recession inevitably provokes resistance that often forms the nucleus of new democratic movements, and in doing so, argues that it is important to identify these reverse trends that may eventually become dominant. The book contributes to current literature which thus far has sought to understand the causes and consequences of the decline in democracy around the world. Previous literature has focused primarily on advanced democracies, or alternatively, on large scale quantitative comparison. As such, this book helps fill a research gap with its focus on Southeast Asia, employing a comparative case study approach. Chapter authors are experts on Southeast Asia, a region that has experienced democratic recession and autocratization in a variety of ways, from rising populism to military coups. Dr. James Ockey lectures in the Department of Political Science and International Relations, University of Canterbury, Christchurch, New Zealand. He has published widely on democratization and autocratization in Thailand. He is a co-founder and director of the Southeast Asia Research Initiative (SEARI) at the University of Canterbury. Dr. Naimah S. Talib is an adjunct senior fellow in the Department of Political Science and International Relations, University of Canterbury. Her research focuses on democratization and the role of Islam in politics in Southeast Asia. She has done extensive research on the history and politics of Malaysia and Brunei. .

    Abstract: This book analyses the historical sociology of state formation in the Horn of Africa. It examines the genesis, trajectories, processes, routes and consequences of the evolution of state formation. Three analytical and explanatory models explain the process of state formation in the HOA: proto-state, colonial and national liberation. The models, heuristically and innovatively, provide understanding, interpretation and analysis of state formation. While the proto-state model explicates an indigenous historical process of state formation, the colonial model refers to an externally designed and imposed process of state formation. The national liberation model concern state formation conducted under liberation movement and ideology. The distinct significance of these models is that collectively they generate sufficient analysis of state formation. They are also unique in that they have never been employed as aggregate analytical and explicative instruments to address the predicament of state formation in the Horn of Africa.     Abstract: This book project studies the variation of sovereignty in international order by analysing how the general model of sovereignty is localised in the political practice of two major non-Western rising powers, namely China and India. It aims to investigate how the sovereignty of these states is constituted, which includes the question of how sovereignty works and becomes constituted in specific contexts and cases that fall outside the discourses and positions of the so-called Westphalian (conservative, absolutist) sovereignty that is dominantly advocated by these two states on a global level. The core of this project explores specific contested cases and situates them vis-à-vis the broader approaches of China and India to sovereignty. I specifically analyse four particular cases: China’s approach to sovereignty in relation to Hong Kong and Taiwan and India’s approach to sovereignty in relation to Bhutan and Kashmir. In doing so, I will illustrate that sovereignty is a flexible and plastic phenomenon which can be intertwined with principles, models or practices that are usually seen as divergent from or contradicting sovereignty; for example, those that derive from China’s and India’s imperial and colonial history. Aleš Karmazin is Lecturer at the Metropolitan University Prague and Researcher at Charles University, Prague, Czech Republic. He has received his Master’s degrees in China studies from LSE and IR from Aberystwyth and PhD in IR from Charles University.

    Abstract: This book focuses on three main subjects: the DPRK's inability to survive as a nuclear state; the importance of China’s role in encouraging denuclearization of the Korean Peninsula; and the possibility of an alternative political organization for the DPRK including a transition to a market-economy in exchange for giving up its nuclear weapons. The book approaches North Korean issues from the perspective that the regime cannot survive without nuclear weapons which, rather than being a genuine danger to other states, are bargaining chips for security and survival. The book includes views from prominent academics and practitioners, including a former British ambassador to North Korea, putting forward an ambitious set of recommendations and analyses based on hands-on experience in the region. Chan Young Bang, PhD, is president of KIMEP University in Almaty, Kazakhstan, Principal Investigator of its DPRK Strategic Research Center, and a former economic adviser to Nursultan Nazarbayev, first president of Kazakhstan. He has published numerous articles and books on the prospects for a peaceful settlement of the North Korean nuclear conflict.

    Abstract: Why do certain parts of the state in Africa work so effectively despite operating in difficult governance contexts? How do 'pockets of bureaucratic effectiveness' emerge and become sustained over time? And what does this tell us about the prospects for state-building and development in Africa? Repeated economic and social crises have demanded that development thinkers and policy actors have had to engage with the critical role that states play in delivering development. Pockets of Effectiveness and the Politics of State-building and Development in Africa shows that politics is the driving factor that shapes how well state agencies perform their roles. It deploys a new conceptual framework – the power domains approach – to explore the shifting fortunes of key state agencies in five countries – Ghana, Kenya, Rwanda, Uganda, and Zambia – over the past three decades. Our original research reveals when, how and why political rulers decide to build effective state agencies and enable them to deliver certain forms of economic development – often through forming strategic coalitions with senior bureaucrats and with international support – and also when this support falters and gives way to a politics of survival. Comparative analysis identifies two potential trajectories towards state-building in Africa, each shaped by different configurations of social and political power. The book critiques the role that international development agencies have played in (mis)shaping the state in Africa and suggests a new strategic agenda for building the state capacities required to deliver sustained development at the current juncture. The book closes with critical commentaries from two leading scholars in the field, to help place our work in context and establish the next steps for research and strategy in this increasingly important area of development theory and practice

    Abstract: In state formation research, princely houses have been a blind spot. The development of states has been discussed from many perspectives, like interstate competition, internal social conflicts, fiscal-military developments, etc., but at the centre of most European states, there was a princely house. These ruling houses have been overlooked in studies about state formation. What's more, when discussing such dynasties, the vertical chronological perspective (grandfather-father-son) is all dominating, for instance in the focus on dynastic continuity, dynastic culture and representation, and the like. This collection of essays highlights the horizontal perspective (ruler, all children, siblings, cousins), in asking how the members of a princely family acted as a power network. They focus on how security and governmental actors often failed to align with the formal scripts that were specifically designed for crisis-management, resulting in the wavering application of professional discretion and coercive powers. Their different approaches were evident: in some regions police were less dominantly visible compared to other regions, where the police used a top-down visible and repressive stance vis-à-vis public alignment with COVID rules, including the imposition of lockdown and curfews. Some contributors draw on data from the COROPOL (Corona Policing) Monitor which collated data on crime, plural policing and public order in Europe and around the world during the early phases of the COVID crisis. Overall, this book seeks to provide comparative critical insights and commentary as well as a practical and operational understanding of security governance during the COVID-19 crisis and the lessons learned to improve future preparedness. Monica den Boer is Professor of Military Policing Operations at the Netherlands Defence Academy. Her primary research focus is on the evolution of military policing, as well as border policing, international policing, urban policing and the policing of organised crime and terrorism. She served as member of the Dutch national parliament from 2017 to 2020. Prior to this she worked in several academic and professional environments, including the Police Academy of the Netherlands and the VU University Amsterdam. Eric Bervoets is a police scientist and criminologist. He has been active as a researcher since 1997. After a master's degree in public administration at Rotterdam Erasmus University, the Netherlands, Bervoets obtained his PhD in 2006 with a dissertation on policing troubled neighbourhoods. In 2020, he was appointed Research Fellow at the Netherlands Defence Academy. Linda Hak obtained her BSc in Criminology at Erasmus University and a master’s degree in Legal Psychology at Maastricht University, the Netherlands. She served as a research intern at Bureau Bervoets and is employed as a detective assistant for the National Police of the Netherlands.

    Abstract: This book analyses securitization processes outside of the West, with a focus on Africa. The aim of the volume is to develop an original analytical framework to explain the securitization-neo-patrimonialism dynamics in West Africa, drawing upon insights from securitization theory, sociology and psychology. Among critical voices, securitization has become the gold standard for analysing emerging challenges, such as migration, terrorism, and human security. Yet, despite its broadening agenda, the framework has also been accused of bias, with a Western political context and democratic governance structure at its heart. This book aims to re-conceptualise the framework in a way that suits non-Western contexts better, notably by re-conceptualising the securitization-neopatrimonialism nexus in Africa, which gives us significant new insights into non-Western political contexts. It analyses the securitization processes among the political elites under neo-patrimonial statehood, and further stretches the conceptualisation of securitization into African statehood, which is characterised by a blurred line between the leader and the state. The volume explores the processes of securitizing threats in Liberia, Sierra Leone and wider West Africa, as well as the neo-patrimonial regimes of these states. In doing so, it explores the influence these states' neo-patrimonial regimes have on the processes of threat securitization.

    Abstract: Wie entwickelt sich der Staat im Rahmen von Transitionsprozessen des Regimes? Lassen sich Gruppen von Entwicklungspfaden der Staatlichkeit erkennen? Welche Gemeinsamkeiten und Unterschiede hinsichtlich der Entwicklung von Staatlichkeit zeigen sich im Rahmen von Demokratisierungs- und Autokratisierungsprozessen? Welche Ursachen liegen den Entwicklungsmustern zugrunde? Mithilfe eines Mixed-Methods-Designs werden Transitionsprozesse auf Regimeebene zwischen 1970 und 2018 in Relation zur Entwicklung von Staatlichkeit analysiert und Ursachen divergenter Entwicklungspfade geprüft. Zudem thematisiert die Forschungsarbeit die Messung von Staatlichkeit sowie die Relevanz informeller Staatlichkeit. Die quantitativen und qualitativen Analysen weisen auf einen multifaktoriellen Wirkungskomplex aus Regimetransition in Kombination mit sozial-strukturellen, institutionellen, transitorischen und akteurabhängingen Ursachen zur Erklärung der Entwicklung von Staatlichkeit hin. Somit ist die Regimetransition Bestandteil einer komplexen Wirkungsbedingung, die nur in Verbindung mit weiteren Erklärungsfaktoren eine Veränderung der Staatlichkeit verursacht.     Abstract: "This collection seeks to illustrate the state of the art in territoriological research, both empirical and theoretical. The volume gathers together a series of original, previously unpublished essays exploring the newly emerging territorial formations in culture, politics and society. While the globalisation debate of the 1990s largely pivoted around a 'general deterritorialisation' hypothesis, since the 2000s it has become apparent that, rather than effacing territories, global connections are added to them, and represent a further factor in the increase of territorial complexity.     Abstract: "How do the worlds that state administrators manage become the feelings publics embody? In Administering Affect, Daniel White addresses this question by documenting the rise of a new national figure he calls "Pop-Culture Japan." Emerging in the wake of Japan's dramatic economic decline in the early 1990s, Pop-Culture Japan reflected the hopes of Japanese state bureaucrats and political elites seeking to recover their country's standing on the global stage. White argues that due to growing regional competitiveness and geopolitical tension in East Asia in recent decades, Japan's state bureaucrats increasingly targeted political anxiety as a national problem and built a new national image based on pop-culture branding as a remedy. Based on 16 months of ethnographic fieldwork among rarely accessible government bureaucrats, Administering Affect examines the fascinating connection between state administration and public sentiment. White analyzes various creative policy figures of Pop-Culture Japan, such as anime diplomats, "Cool Japan" branding campaigns, and the so-called "Ambassadors of Cute," in order to illustrate a powerful link between practices of managing national culture and the circulation of anxiety among Japanese publics.     Abstract: This volume analyzes the development of the reactions to Covid-19 by governments, the public and the crime patterns in 16 European countries. In manchen Weltregionen brechen heute immer mehr Menschen auf, um ihr Glück dauerhaft woanders zu suchen. Was macht das mit ihrer Heimat – und was folgt daraus für die reichen Zielländer im globalen Norden? Der Soziologe Thomas Faist bringt Licht ins Dunkel – und räumt mit einigen grassierenden Mythen zur globalen Migration im 21. Jahrhundert auf. Der Begriff «Exit» bezeichnet die Entscheidung, die eigene Heimat zu verlassen, weil es dort schlichtweg keine Perspektiven mehr gibt. Sie ist zum politischen Massenphänomen unserer Zeit und vor allem im globalen Süden zu einer Alternative zum sozialen Protest geworden. Die massenhafte Abwanderung aus verarmten Regionen etwa auf dem afrikanischen Kontinent verschärft sich nicht zuletzt infolge des Klimawandels, der den globalen Süden ungleich härter trifft als den globalen Norden. Dadurch entstehen sowohl in den Immigrations- als auch in den Emigrationsländern neue politische Konfliktkonstellationen. Die Fragmentierung der europäischen Parteienlandschaft etwa wäre ohne die neuen Formen globaler Migration im 21. Jahrhundert undenkbar. Auf der anderen Seite wird die weltweite soziale Ungleichheit, die Schere zwischen Nord und Süd, durch immer rigidere Migrationsregime zementiert statt abgemildert. Es bedarf folglich einer neuen, fairen Migrationspolitik, um den Exit im globalen Süden in eine für alle Beteiligten gewinnbringende Mobilität zulenken. Thomas Faist, einer der führenden Migrationsexperten in Europa, legt in seinem Buch die Summe seiner Forschung zum Thema vor.

Since the late 18th century major revolutions across the world have further challenged the idea of the state as a final arbiter of international order.     Abstract: First Nationalism Then Identity focuses on the case of Bosnian Muslims, a rare historic instance of a new nation emerging. Although for Bosnian Muslims the process of national emergence and the assertion of a new salient identity have been going on for over two decades, Mirsad Kriještorac is the first to explain the significance of the whole process and how the adoption of their new Bosniak identity occurred. He provides a historical overview of Yugoslav and Bosnian Slavic Muslims' transformation into a full-fledged distinct and independent national group as well as addresses the important question in the field of nationalism studies about the relationship between and workings of nationalism and identity. While this book is noteworthy for ordinary readers interested in the case of Bosnian Muslims, it is an important contribution to the scholarly debate on the role of nationalism in the political life of a group and adds an interdisciplinary perspective to comparative politics scholarship by drawing from anthropology, history, geography, and sociology.

The emergence of big tech firms has transformed the approach to the concepts of national security, information management and access to new technologies among nation-states. The principles and fundamentals of cyber sovereignty have become one of the bases of states in the contemporary system of international relations. Today, the influence of big tech firms in different societies in the contemporary world is one of the main forms of power. This book tries to collect and present the recent state of the art in studies on the relationship between big tech firms and nation-states in the literature. It also addresses how governments such as those of the US, China and the EU are changing their legislation, creating control and data security mechanisms, imposing entry restrictions on foreign companies, and regulating the actions beyond the cloud of big tech firms inside and outside their borders.

    Abstract: This book examines the COVID-19 pandemic through socioeconomic lens that draw on history, approaches to state-market relations, and public policy perspectives In 2020, the world experienced the worst pandemic since the outbreak of the Spanish Flu of 1918, which continues to have far[1]reaching implications for the global economy and triggered macro-economic dislocations that severely affected the most vulnerable countries and segments of society. This book was conceived as a response to the disruptive shifts induced by the pandemic, with a particular focus on South Africa. International experience has shown that countries and societies that have gone through tough economic times, either as a consequence of wars or economic depressions, have responded to crises by enacting unpopular policy measures based on difficult tradeoffs, which often made way for innovation. The authors outline policy responses to the COVID-19 crisis and propose several interventions to mitigate its effects. These include developing innovative approaches to fiscal and monetary policies, labour market policies, industrial policies, as well as social policies. Building state capabilities, improving the governance and performance of state institutions, and managing digital change are some of the clear policy interventions that are laid out in this book.     Abstract: This book explores the role of agriculture in long-term economic growth. With a particular focus on Ethiopia, the role of the state in igniting agricultural growth and in sustaining economic growth is highlighted as essential for low-income countries.     Abstract: "In Rage and Carnage in the Name of God Abiodun Alao interrogates how Nigeria's three main religions (Christianity, Islam and traditional religions) have been associated with violence in post-independence Nigeria, and how the violence has affected the inter-group relations in the country. While most recent books on the subject focus on Boko Haram, Rage and Carnage in the Name of God avoids concentrating on a phenomenon-specific subject or quasi-ethnographic cases in order to look at broader themes on religion's connection with violence in post-independence Nigeria. Alao traces the evolution of the religions and their connections with the Nigerian society. There are also discussions on how the various conflicts generated by religion have intertwined with national politics, the economic ramifications of the violence, and the ways through which global politics has keyed into the various manifestations"--
    Abstract: In Rage and Carnage in the Name of God, Abiodun Alao examines the emergence of a culture of religious violence in postindependence Nigeria, where Christianity, Islam, and traditional religions have all been associated with violence. He investigates the root causes and historical evolution of Nigeria's religious violence, locating it in the forced coming together of disparate ethnic groups under colonial rule, which planted the seeds of discord that religion, elites, and domestic politics exploit. Alao discusses the histories of Christianity, Islam, and traditional religions in the territory that became Nigeria, the effects of colonization on the role of religion, the development of Islamic radicalization and its relation to Christian violence, the activities of Boko Haram, and how religious violence intermixes with politics and governance. In so doing, he uses religious violence as a way to more fully understand intergroup relations in contemporary Nigeria

    Abstract: Der Zugang zu einem Asylverfahren in der EU ist ein umkämpftes soziales Gut. Die Studie zeichnet ein komplexes Bild von Ausschließungs- und Usurpationsstrategien im Feld der europäischen und speziell der italienischen und deutschen Asylverwaltung zwischen 2015 und 2018. (Supra-)nationale Verwaltungs- und Vollzugsorganisationen versuchen Flüchtende von dem Verwaltungsakt abzuhalten und entwickeln territoriale und administrative Exklusionsstrategien, um Fluchtmobilität und Asyl zu verwehren. Gleichzeitig erkämpfen Seenotrettungs- und Kirchenorganisationen den Zugang zum Asylverfahren, indem sie sich mit Flüchtenden solidarisieren und diesen eine Partizipation an öffentlichen Gütern und Rechten der Aufnahmegesellschaft ermöglichen. Für Flüchtende wird der formale Zugang zu und die temporäre Mitgliedschaft in einer Aufnahmegesellschaft in konfliktreichen und inter-organisationalen Entscheidungen ausgehandelt. Die formale Organisation wird zum Ort der Schließungskämpfe, indem sie als Schließungsakteur und zwischengesellschaftliches Schließungssystem formale Interaktionen zwischen Geflüchteten und Aufnahmegesellschaft ermöglicht oder verhindert. Die Synthese von schließungs- und organisationstheoretischen Perspektiven trägt dazu bei, dass gesellschaftliche Ordnungsbildung organisationssoziologisch erklärbar wird. Der Autor Max Oliver Schmidt ist wissenschaftlicher Mitarbeiter am Centre for Citizenship, Social Pluralism and Religious Diversity an der Universität Potsdam.

    Abstract: This book examines how the interplay between globalization and the assertion of local identities is reshaping the political landscape of Africa. While defending their values against external forces, people simultaneously - and paradoxically - use the interconnectivity of global networks to maximize their particular interests. Focusing on the relation between national identity and state formation, the authors explore the far-reaching consequences of these contradictory dynamics. Although Africa shares many common trends with other parts of the world, it also displays distinctive features. A region characterized by the increased mobility of people, goods and ideas challenges some conventional assumptions of statecraft and also highlights the advantages of federalism - not merely as a constitutional option, but as a pragmatic device for managing diversity and holding fragile states together.     Abstract: Nach einem jahrzehntelangen Bürgerkrieg erlangt die Republik Südsudan am 9. Juli 2011 ihre Unabhängigkeit. Doch trotz aller Bemühungen um einen friedlichen Staatsaufbau nimmt die erste Dekade der Eigenstaatlichkeit einen gewaltsamen Verlauf: Im Dezember 2013 schlittert der Südsudan in einen blutig geführten Bürgerkrieg, der sich nicht als einheitlicher Konflikt mit klar definierbaren Parteien, sondern zu einem Amalgam komplex verschachtelter Konfliktlandschaften entwickelt. In analytischen Vignetten, die verschiedene Regionen sowie die nationale und internationale Dimension des Bürgerkrieges untersuchen, gibt Jan Pospisil einen Einblick in die südsudanesische Konfliktrealität.

    Abstract: Das Open-Access-Buch untersucht am Beispiel des Europäischen Gerichtshofs für Menschenrechte (EGMR) und des Interamerikanischen Menschenrechtsgerichtshofs (IAGMR), welche Rolle innerstaatliche Gerichte bei der Umsetzung internationaler Entscheidungen wahrnehmen. Wann sind sie bereit ihre Pendants in Straßburg bzw. San José bei der Umsetzung ihrer Entscheidungen zu unterstützen und diese gleichsam unmittelbar „anzuwenden“, und wo ziehen sie Grenzen und rote Linien? Was sind die Probleme, die ihnen begegnen, und befinden sich Gerichte tatsächlich im Wandel hin zu einer defensiveren und weniger völkerrechtsfreundlichen Haltung, wie einige jüngere Beispiele vermuten lassen? Das Werk widmet sich der Frage, welche Wirkungen innerstaatliche Gerichte bereit sind, den Entscheidungen der Menschenrechtsgerichte zukommen zu lassen – und zwar genau dann, wenn sich das innerstaatliche Recht nicht dazu äußert. Es zeigt auf, dass hinter der vermeintlich technischen Ausgangsfrage fundamentale Fragen verfassungsrechtlicher Natur stehen und sich am Beispiel der Menschenrechtsgerichte einige der zentralen Schwierigkeiten und Probleme zeigen, wie sie beim Zusammenspiel von Rechtsordnungen in Zeiten globalen Regierens entstehen.
