    Abstract: Über Religion wird seit jeher und offenbar unermüdlich gestritten. Auch in Deutschland geben aktuell religiöse Symbole im öffentlichen Raum, Missbrauchsskandale in den christlichen Kirchen und auch religiöser Fundamentalismus Anlass für leidenschaftlich geführte Debatten über den angemessenen Umgang mit Religion in liberalen Demokratien. Das gesetzliche Fundament dieses Umgangs bildet in Deutschland das Religionsverfassungsrecht, das vor über 100 Jahren in der Weimarer Reichsverfassung erstmals festgeschrieben wurde und seit Gründung der Bundesrepublik Deutschland im Jahr 1949 auch Bestandteil des Grundgesetzes ist. Es verankert die Religionsfreiheit und definiert das Verhältnis zwischen Staat und Religionsgemeinschaften.

    Abstract: "Why should we care about religious liberty? Leading commentators, United Kingdom courts, and the European Court of Human Rights have de-emphasised the special importance of religious liberty. They frequently contend it falls within a more general concern for personal autonomy. In this liberal egalitarian account, religious liberty claims are often rejected when faced with competing individual interests - the neutral secular state must protect us against the liberty-constraining acts of religions. Joel Harrison challenges this account. He argues that it is rooted in a theologically derived narrative of secularisation: rather than being neutral, it rests on a specific construction of 'secular' and 'religious' spheres. This challenge makes space for an alternative theological, political, and legal vision. Drawing from Christian thought, from St Augustine to John Milbank, Harrison develops a post-liberal focus on association. Religious liberty, he argues, facilitates creating communities seeking solidarity, fraternity, and charity - goals that are central to our common good"--

    Abstract: "This book concerns a set of problems that arise from the distinctive conceptual and practical tension in the first period after a new constitution has been adopted. We shall argue that at a very general level, a new constitution must manage a balance or tension between two forces. These are aspirations for transformation and demands for preservation through entrenchment. The first period, as we will elaborate, is the conceptual, temporal, and institutional bridge between the past and future. It is the moment when the transformative and the preservative vectors of constitutional design can come into the sharpest conflict.     Abstract: "Thirty years ago the Indian law community was small enough that it was possible for even a new scholar to the field to keep up with most of the Indian law scholarship published annually. However, as our field has proliferated, it has also fragmented, and today more than two-hundred pieces of new legal scholarship are published annually in law reviews alone. These law reviews are not just ivory tower musings; there are now some scholarly contributions which are as fundamental for the study of Indian law as many cases or statutes. These articles help to contextualize the changing doctrines announced by the court, reconcile contradictory authority, challenge assumptions of race/place/power, and push for courts, tribal leaders, legislators, lawyers, educators, and students to adopt new ways of thinking about our fundamental doctrine.     Abstract: This collection explores some of the many ways in which constitutional orders engage with, and are shaped by, their exteriors. Constitutional and legal theory often marginalize 'foreign' elements, such as norms originating in other legal systems, the movement of individuals across borders, or the application of domestic law to foreign affairs. In The Double-Facing Constitution, these instances of boundary crossing lie at the heart of an alternative understanding of constitutions as permeable membranes, through which norms can and sometimes must travel. Constitutional orders are facing both inwards and outwards - and the outside world influences their interiors just as much as their internal orders help shape their surroundings. Different essays discuss the theoretical and historical foundations of this view (grounded in Kelsen, Hobbes, Locke, Rousseau and others), and its contemporary relevance for areas as diverse as migration law, the conflict of laws, and foreign relations law.

    Abstract: "This book has been brought to life in a period where transnational solidarity and cooperation seemed to be moving backwards rather than forwards. This was among others reflected in the so called refugee crisis in Europe in 2015. After the Brexit referendum in the United Kingdom in June 2016, and presidential elections in the US later the same year, the political agenda took a turn towards focusing primarily on the internal national perspective in relation to areas such as environmental protection, aid to countries in the Third World and trade with the outside world. It still remains to be seen when and how the United Kingdom will be leaving the European Union. In general, the EU has experienced a number of crises, among others an economic and financial crisis and later the refugee crisis, during the past years. These crises have challenged transnational solidarity in Europe. This development in Europe and the World stresses the question, whether and how transnational solidarity is possible. This book is motivated by these developments and discusses and attempts to answer this question. Our main presumption is that solidarity can create stability and sustainability (social, economic, environmental, peace etc.), within states, regions and globally, why it is crucial to gain more knowledge about it. Realization of the UN Sustainability Goals 2017 and 2030 go hand in hand with solidarity at both local, regional and global levels. In this work, we do of course build on earlier discussions and investigations of solidarity"--

    Abstract: The very concept of human rights implies governmental accountability. To ensure that governments are indeed held accountable for their treatment of citizens and others the United Nations has established a wide range of mechanisms to monitor compliance, and to seek to prevent as well as respond to violations. The panoply of implementation measures that the UN has taken since 1945 has resulted in a diverse and complex set of institutional arrangements, the effectiveness of which varies widely. Indeed, there is much doubt as to the effectiveness of much of the UN's human rights efforts but also about what direction it should take. Inevitable instances of politicization and the hostile, or at best ambivalent, attitude of most governments, has at times endangered the fragile progress made on the more technical fronts. At the same time, technical efforts cannot dispense with the complex politics of actualizing the promise of human rights at and through the UN. In addition to significant actual and potential problems of duplication, overlapping and inconsistent approaches, there are major problems of under-funding and insufficient expertise. The complexity of these arrangements and the difficulty in evaluating their impact makes a comprehensive guide of the type provided here all the more indispensable. These essays critically examine the functions, procedures, and performance of each of the major UN organs dealing with human rights, including the Security Council and the International Court of Justice as well as the more specialized bodies monitoring the implementation of human rights treaties. Significant attention is devoted to the considerable efforts at reforming the UN's human rights machinery, as illustrated most notably by the creation of the Human Rights Council to replace the Commission on Human Rights. The book also looks at the relationship between the various bodies and the potential for major reforms and restructuring.

    Abstract: "Human rights have a rich life in the world around us. Political rhetoric pays tribute to them, or scorns them. Citizens and activists strive for them. The law enshrines them. And they live inside us too. For many of us, human rights form part of how we understand the world and what must (or must not) be done within it. The ubiquity of human rights raises questions for the philosopher. If we want to understand these rights, where do we look? As a set of moral norms, it is tempting to think they can be grasped strictly from the armchair, say, by appeal to moral intuition.
