    Abstract: The subprime crisis and the general crisis of the global financial system in 2008 not only put the globalization process and all that it involves under extreme pressure, but, at least for some, it called the entire system into question. What in spring had seemed unthinkable, at least for those who had ignored Paul Krugman's blogs, suddenly and without warning became hard reality. A credo of today's prominent leaders is that thoroughly considered and internationally effective regulation is needed to address almost all current global challenges, whether they concern global warming, human rights and migration, or international finance. Such regulatory systems will have to pay attention to ethics and morals, which is something that the present collapsed system has failed to do. This book provides insight into the functioning of the global economy, the roots of the present international financial crisis and the responses of highly distinguished politicians, industrialists and academics.

    Abstract: This report covers a broad range of SME taxation issues, including possible effects of taxation on the creation and growth of SMEs, and considerations arising from a relatively high compliance burden. Differing income tax and social security contribution burdens of unincorporated and incorporated SMEs are considered in detail, with analysis of average statutory tax rates carried out to investigate possible tax distortions to business creation and business structure decisions of a single worker/owner of an SME.     Abstract: With the growing literature on the subject of punitive damages, the consensus is that it seems worthwhile and even necessary to discuss, thoroughly and on a comparative basis, the nature, role and suitability of such damages in tort law and private law in general. This book contains reports from selected jurisdictions that explicitly allow the award of punitive damages as well as from jurisdictions which purport (sometimes emphatically) to deny their existence (although a number covertly incorporate such damages into the framework of their tort systems). It benefits from an economic analysis of punitive damages, a report from a private international law perspective, one on their insurability and one on aggravated damages. The book's comparative report and conclusion critically evaluates the material in the above reports and advances a thorough analysis of the nature of punitive damages, the cases for and against them, and their suitability in the field of tort law.     Abstract: The book suggests that it is reasonable to ask why we should try to give a general description of law. It analyses the theories of Jeremy Bentham, John Austin, H.L.A. Hart, Joseph Raz and Ronald Dworkin. It then attempts to turn our attention away from general descriptions of the law, to the approach that has made us present and use such descriptions. This shift of attention is suggested by the difficulties encountered in our attempts to agree upon any of the proposed descriptions. The book presents an alternative approach to law. With the alternative approach we must question the use of assuming that law is something we can describe in general terms. The alternative approach is also supported by a critique of some widely spread conceptions of meaning, truth and reality. By showing how a pragmatic conception of truth and reality can be consistent and how it helps us focus on the most relevant matters, these arguments offer additional reasons for the change of approach. This change can liberate practise of law from the grip of theorists trying to force law into a mould more appropriate in natural science. The use of philosophy and theory of law in legal practice is strongly questioned and the frequent need for profoundly difficult judgements is acknowledged.

    Abstract: "The Frame of Legal Customs" ("Der Rahmen der Rechtsgewohnheiten") attempts to interchange results from two scientific disciplines, legal theory and legal history for the middle ages.The first part describes the present and in the sphere of legal theory not unypical view of law as a system of norms as introduced by theorists like Hans Kelsen ore H.L.A. Hart. Main target of criticism is the concept of law as provided by legal positivism, pointing out the problems of the logic of norms and the speech-act-theoretical background of this concept.The second part shows the inadequacy of the modern concept of law – which faces law as system of norms – for the situation of the early middle ages, when law was practiced in judicial assemblies in a strict oral manner without the common use of written texts. Results of German legal history which assume a more differentiated structure of legal thinking (based on incompatible categories of law: "recht", "Gebot", "Willkür") instead of one comprehensive notion of law, are discussed.The third part is dedicated to the close examination of the concept of law of three of the most important legal historians in Germany (Karl Kroeschell, Gerhard Dilcher, Jürgen Weitzel).The fourth and last part offers an alternative approach to the problem, how legal thinking and legal practice can be understood in premodern societies. It starts at the fundamental criticism of legal positivism, which can be found in the work of Ronald Dworkin ("law as integrity") and earlier at Carl Schmitts concept of concrete order ("Konkretes Ordnungsdenken"). The correlation between the role of legal rules, decisions and orders is discussed within the proposed theoretical frame. Finally the notion of order-configurations ("Ordnungskonfigurationen"), which has been brought into discussion by Stefan Weinfurter, is compared to the concept of law as a form of concrete order as developed in the text. A text of Adalbero of Laon and the letters of pope Gregory VII are interpreted as an illustrating example (and implicit criticism on Weinfurter's specific use of sociological functionalism) using the proposed alternative categories
    Abstract: Der "Rahmen der Rechtsgewohnheiten" ist eine Auseinandersetzung mit der gegenwärtigen Entwicklung des Rechtsbegriffs der Rechtsgeschichte des Mittelalters. Konkret wird dabei versucht, rechtstheoretische Einsichten für diesen Begriff fruchtbar zu machen und zu einem, von rechtshistorischer Seite geforderten Brückenschlag zwischen den Diziplinen beizutragen.Der I. Abschnitt (aus rechtstheoretischer Perspektive für den Rechtshistoriker verfaßt) soll insoferne zeigen, mit welchen Konsequenzen zu rechnen ist, wenn Recht als Normensystem konzipiert wird. Gegenstad ist also der Rechtsbgriff des Positivismus, wie er typisch von Hans Kelsen oder H.L.A. Hart konzipiert wurde. Der Abschnitt vereint eine historische Herleitung mit einer systematischen Kritik der normenlogischen wie sprechakttheoretischen Grundlagen.Im II. Abschnitt (umgekehrt aus rechtgeschichtlicher Perspektive für den Rechtstheoretiker formuliert) wird gezeigt, was passiert, wenn ein derartig konzipierter positivistischer Rechtsbegriff auf (früh)mittelalterliche Verhältnisse angewandt wird. Damit soll einerseits die Unzulänglichkeit des Normsystembegriffs für das Mittelalter plausibel gemacht und andererseits eine Strukturaufklärung des mittelalterlichen Rechts vorangetrieben werden, mit dem Ergebnis, daß auch aus rechttheoretischer Sicht an die Stelle eines einheitlichen, alle Phänomene umgreifenden Rechtsbegriffs eine begriffliche Vielfalt an Rechtsbegriffen treten muß, wie sie z.B. in der Lehre Ebels mit ihrer Differenzierung in "recht", "Gebot" und "Willkür" vorgeschlagen wurde.Der III. Abschnitt ist der eingehenden Analyse der Rechtsbegriffe von drei der bedeutendsten deutschsprachigen Rechtshistoriker gewidmet (Kroeschell, Dilcher, Weitzel); Leitfaden ist der Begriff der "Rechtsgewohnheiten".     Abstract: Human trafficking is one of the most extreme forms of exploitation in the 21st century. It, therefore, is one of the most urgent political challenges of our global age. Christal Morehouse evaluates the anti-human trafficking policy in the United States of America and the Federal Republic of Germany. The author uncovers policy gaps and hidden policy agendas which weaken the German and American governments’ ability to combat human trafficking. She provides recommendations for policy and research which are designed to amend disparities in the anti-human trafficking policy in both countries. Finally, she examines the larger societal implications for the U.S. and German societies which could arise from failing to deal with this issue.

    Abstract: Substate nationalism, especially in the past fifteen years, has noticeably affected the political and territorial stability of many countries, both democratic and democratizing. Norms exist to limit the behavior of collective agents in relation to individuals, the set of universally accepted human rights provides a basic framework. There is a lacuna in international law, however, in the regulation of the behavior of groups toward other groups, with the exception of relations among states. The book offers a normative approach to moderate minority nationalism that treats minorities and majorities in multinational states justly and argues for the differentiation of group rights based on how group agents are constituted. It argues that group agency requires a shared set of beliefs concerning membership and the social ontology it offers ensures that group rights can be aligned with individual rights. It formulates a set of principles that, if adopted, would aid conflict resolution in multinational states. The book pays special attention to national self-determination in transitional societies. The book is intended for everyone in political philosophy and political science interested in global justice and international law and legal practitioners interested in normative issues and group rights

    Abstract: The historical development of tonnage, ship registration, classification societies and national and international law for flag State responsibility is recounted, along with the large increase in numbers of non-traditional flag States and classification societies over the past fifty years. The Law of the Sea Convention provides for a State to grant its nationality to ships, for those ships to be surveyed before registration, and for a flag State to effectively exercise its jurisdiction and control in administrative, technical and social matters over ships flying its flag. A State has the sovereign right to determine conditions for grant of its nationality and this can lead to derogation of flag State responsibility with implications for safety of ships. These issues are analysed and remedies proposed for effective flag State implementation of mandatory instruments.

    Abstract: Located within wider debates about ‘security versus liberty’ in our post 9/11 world, the book analyses the new landscape of UK counter terrorism powers and offences and focuses upon the deleterious consequences of the so-called ‘war on terror’ on freedom of political expression and association. Questioning the compatibility of recent speech-limiting measures with liberalism’s established commitment to free speech and international human rights norms, the book takes a critical look at new powers to proscribe ‘extremist’ political parties, possession offences and other criminal controls (eg. Official Secrets Act prosecutions) as well as new offences such as ‘glorification’ of terrorism. Less visible, extra-legal forms of censorship are also evaluated. The monograph concludes by asking how a more vigorous defence of unorthodox and unpopular forms of expression might be safeguarded in the UK.

    Abstract: During the last decades, legal theory has focused almost completely on norms, rules and arguments as the constitutive elements of law. Concepts were mostly neglected. The contributions to this volume try to remedy this neglect by elucidating the role concepts play in law from different perspectives. A main aim of this volume is to initiate a debate about concepts in law. Åke Frändberg gives an overview of the many different uses of concepts in law and shows amongst others that concepts in the law should not be confused with the role of concepts in descriptions of the law. Dietmar von der Pfordten criticizes the restriction to norms as parts of the law in contemporary legal theory by questioning what concepts are and what their function is, both in general and in legal conceptual schemes. Giovanni Sartor assumes the inferential analysis of meaning proposed by Alf Ross in his ground breaking paper Tû-tû and addresses the question how possession of a concept, including the rules defining it, is possible without endorsing these rules. Jaap Hage argues that 1. legal status words such as 'owner' have a meaning because they denote things or relations in institutional reality, 2. the meaning of these words consists in this denotation relation, 3. knowledge of this meaning presupposes knowledge of the rules governing these words. Torben Spaak contributes to this volume with an exemplary analysis of one of the most central concepts of the law, namely that of a legal power. Lorenz Kähler discusses the role of concepts in determining the scope of application of legal rules and raises from this perspective the question to what extent legal concept formation can be arbitrary. Ralf Poscher argues that as soon as a concept is used in stating the law, the precise scope of application of this concept has become a legal matter.

    Abstract: What changed in the United States with Hurricane Katrina was a feeling that we have entered a period of consequences. - Al Gore On February 05, 2007, the Intergovernmental Panel on Climate Change (IPCC) published the executive summary of its fourth assessment report (to be published April 06, 2007). In the summary, it not only acknowledged that climate change is happening at an accelerated rate, but also that its consequences would be dreary: changes in precipitation and in wind patterns, a rise of the sea levels, and desert- cation will globally impact the frequency of disasters and impair living standards. Whether or not we believe climate change is happening, over the past two years, we have witnessed a rise of the topic from oblivion to ubiquity and have experienced a growing emphasis on ?nding measures to prevent climate change. There is an unprecedented agreement among environmentalists, politicians, the public, and industry that we have to take effective action. Politicians are putting their creative plans to action unusually fast: Australia bans the light bulb, B- gium switches off lamps along lighted highways, and the US introduces daylight savings time two weeks earlier than in previous years. Industry, the most unlikely candidate for support, is rallying together in action groups like US-Cap or 2 Grad, and more and more consumers are offsetting their emissions through websites like myclimate.     Abstract: Die Untersuchung befasst sich mit einer empirischen Analyse der Strafrechtspraxis und des Erfolges von Verurteilungen zu ausgesetzten Freiheits- und Jugendstrafen, den sog. Bewährungsstrafen. Sie widmet sich damit einem Kernstück des modernen Strafrechts. Auf der Grundlage von Datensätzen aus dem Bundeszentral- und Erziehungsregister werden rund 120.000 zu aussetzungsfähigen Freiheits- oder Jugendstrafen Verurteilte aus dem gesamten Bundesgebiet hinsichtlich ihrer konkreten Sanktionierung im Bezugsjahr und einer etwaigen erneuten Straffälligkeit in einem vierjährigen Folgezeitraum untersucht. Besonderheiten hinsichtlich des Alters, des Geschlechts, der Nationalität und der im Register abgebildeten strafrechtlichen Vorgeschichte der Täter werden analysiert, ebenso eine etwaige Unterstellung unter Bewährungshilfe. Vortaten, Bezugstaten und Rückfalltaten werden delikts- und sanktionsspezifisch ausgewertet. Auch nach etwaigen Zusammenhängen zwischen Rückfall und Widerruf der Strafaussetzung wird gefragt. Überblicksartig werden Ergebnisse für einzelne Bundesländer mitgeteilt. Ein weiteres Kapitel befasst sich mit dem Erfolg der Bewährungsstrafen im Vergleich zu anderen, alternativ verhängbaren Sanktionen: den Geldstrafen und nicht ausgesetzten Freiheits- und Jugendstrafen bis zu zwei Jahren. Dabei wird auch problematisiert, ob ein derartiger Vergleich unter alleiniger Heranziehung von Bundeszentralregisterdaten sinnvoll ist.
    Abstract: This research/analysis focuses on an empirical analysis of the practical criminal law and the success of suspended sentence. The foundation of the research form data sets from the Bundeszentralregister and the Erziehungsregister. About 120.000 German data sets of stayed prison sentences and stayed young offender sentences are analyzed under the following aspects: the sentence received and if the delinquent reoffends in a period of four years after their sanction. Characteristics of age, gender, nationality and perhaps an existing penal background as well as possible probation service are part of the analysis. Also discussed are connections between relapse and the revocation of the parole. Another chapter deals with the success of the suspended sentences compared to other penalties, i.e. fines and prison sentences up to two years

    Abstract: Die vorliegende Arbeit behandelt im Wesentlichen vier Fragen: 1) Was und wer sind die "nahen Angehörigen"? (Begriffsklärung)2) Warum kommt der "Angehörigeneigenschaft" Bedeutung zu? (Grund und Höhe des Schmerzengeldanspruches)3) Müssen sich die "nahen Angehörigen" das Mitverschulden des Erstgeschädigten entgegenhalten lassen?4) Besitzen die "nahen Angehörigen" einen selbstständigen oder einen abhängigen Schmerzengeldanspruch?Der Rechtsvergleich des österreichischen, deutschen, schweizerischen, englischen und französischen Rechts unter Einbeziehung der Grundsätze des europäischen Schadenersatzrechts (PETL) ergab die nachfolgenden Ergebnisse.Ad 1) Die Grundsätze des europäischen Schadenersatzrechts und alle zu untersuchenden Rechtsordnungen bestimmen den Begriff der "nahen Angehörigen" nach der faktischen Nahebeziehung zwischen dem Erst- und Zweitgeschädigten: die formale Familienzugehörigkeit ist nicht entscheidend, sondern eine intensive Gefühlsgemeinschaft (enge Nahebeziehung). Dabei wird auf eine enge familiäre Beziehung abgestellt, wie sie gewöhnlich zwischen Eltern und ihren Kindern sowie zwischen Ehegatten besteht. Deshalb können auch weit entfernt Verwandte oder nicht verwandte Personen zu den "nahen Angehörigen" zählen. Bisher wurde das jedoch selten für Freunde ins Auge gefasst, obwohl auch für sie nichts anderes gelten kann. Denn das Verständnis der "Familie" hat sich insofern gewandelt, als auch faktische Naheverhältnisse zu berücksichtigen sind. Auf dieser Grundlage wird versucht, für den Begriff der "nahen Angehörigen" eine allgemeine Definition zu finden. Diese lautet wie folgt. Es handelt sich um einen eigenständigen Begriff, der einen bestimmten Personenkreis umschreibt. Dieser Personenkreis erleidet einen Schock- oder Trauerschaden aufgrund seiner engen Nahebeziehung zum Erstgeschädigten. Der Begriff "nahe Angehörige" ist von jenem der Familienangehörigen (Verwandten) deutlich abzugrenzen, weil auch zwischen Familienangehörigen nicht immer eine enge Nahebeziehung besteht. Der Begriff "Angehörige" ist also nicht im rechtlichen Sinn zu verstehen, sondern nach den tatsächlichen Lebensverhältnissen. Der Zusatz "nahe" drückt aus, dass nur ein kleiner Personenkreis dafür in Frage kommt. Durch das Abstellen auf die enge Nahebeziehung wird sichergestellt, dass nur jene Personen dazu zählen, die durch die Tötung oder Verletzung des Erstgeschädigten schweres seelisches Leid erfahren.     Abstract: This report covers a broad range of SME taxation issues, including possible effects of taxation on the creation and growth of SMEs, and considerations arising from a relatively high compliance burden. Differing income tax and social security contribution burdens of unincorporated and incorporated SMEs are considered in detail, with analysis of average statutory tax rates carried out to investigate possible tax distortions to business creation and business structure decisions of a single worker/owner of an SME. Various arguments are presented for and against the targeting of tax incentives at SMEs. Country examples of SME tax incentives and compliance cost reduction measures are provided in the report.

    Abstract: All societies must deal with the possibility of violence, and they do so in different ways. This book integrates the problem of violence into a larger social science and historical framework, showing how economic and political behavior are closely linked. Most societies, which we call natural states, limit violence by political manipulation of the economy to create privileged interests. These privileges limit the use of violence by powerful individuals, but doing so hinders both economic and political development. In contrast, modern societies create open access to economic and political organizations, fostering political and economic competition. The book provides a framework for understanding the two types of social orders, why open access societies are both politically and economically more developed, and how some 25 countries have made the transition between the two types

    Abstract: Economic sanctions are increasingly being used to combat rogue states, international terrorists and economic criminals. This book offers a new assessment of economic sanctions as a public policy tool and identifies the key legal and regulatory issues in the design of economic sanctions policy in the post 9-11 environment. Kern Alexander places the use of economic sanctions in a broad international context to highlight the gaps in existing international sanctions programmes and the need to develop more effective and efficient multilateral institutions in this area. Moreover, this book identifies weaknesses of US unilateral and extraterritorial sanctions and the legal framework which supports their application. This perspective is especially important given the growing concern with states such as Iran and North Korea and the ongoing interest in how to combat weapons of mass destruction, transnational economic crime and terrorist financing. Kern suggests that although multilateral institutions have a role to play in monitoring the implementation of sanctions, the impetus for effective economic sanctions policy must come from national policymakers and regulators

    Abstract: International anti-corruption treaties, including the UN Convention against Corruption, require member states to establish two types of anti-corruption institutions – one to prevent corruption and the other to combat corruption through law enforcement. The treaties also establish standards for such anti-corruption institutions – they should be independent, specialised and have sufficient resources to meet their challenging tasks. This book analyses the main functions of prevention and combating corruption and discusses practical ways to ensure the independence, specialisation and resources of anti-corruption bodies. The book further studies the different forms of specialisation which exist in different countries and describes 14 anti-corruption agencies from around the world, including preventive, law-enforcement and combined or multipurpose agencies. Analysis of key factors which can lead anti-corruption bodies to success or failure, together with a rich body of country specific information, practical facts and contact details will make this book a useful tool for those policy-makers who seek to strengthen anti-corruption institutions in their countries.

    Abstract: Bei dem vorliegenden Band handelt es sich um eine Studienausgabe der von Hans Kelsen im Jahre 1934 vorgelegten »Reine[n] Rechtslehre«. Dieses Werk gehört zweifelsohne zu den rechtstheoretischen Schlüsselschriften des 20. Jahrhunderts. In ihm entwickelt Kelsen erstmals im systematischen Zusammenhang seine einerseits das Recht von der Moral, andererseits die Norm vom Faktum konsequent scheidende Rechtstheorie. Wer auf der Höhe der Zeit über Struktur und Geltung von Recht und die Eigenart von Rechtswissenschaft, kurz: wer über das Rechtliche am Recht nachdenken will, kommt an der »Reine[n] Rechtslehre« nicht vorbei. Gleichviel, ob und inwieweit man dem ideologiekritischen Positivismus der »Wiener Schule der Rechtstheorie« zuzustimmen geneigt ist oder nicht, gibt diese erste Gesamtdarstellung von Kelsens Rechtslehre ein Reflexionsniveau vor, hinter welches der rechtstheoretische Diskurs nicht zurückfallen sollte.Die Erstauflage der »Reine[n] Rechtslehre«, die weltweit in rund ein Dutzend Sprachen übersetzt worden ist, wurde in deutscher Sprache mehrfach nachgedruckt, ist indes derzeit vergriffen. Sie wird hier in Gestalt einer mit einer ausführlichen Einleitung versehenen Studienausgabe vorgelegt, die am Studium des Rechts Interessierte zum Hineinlesen ermutigen und zum kritischen Nach- und Weiterdenken einladen möchte.
    Abstract: Hans Kelsen's »Pure Theory of Law«, which was published in 1934, is one of the key works on legal theory in the 20th century. In it, Kelsen presents a theory in which he separates the law from morality on the one hand and on the other hand from proven fact, a theory which was also critical of ideologies. Anyone wanting to think about the structure and the validity of the law and the characteristics of jurisprudence, in short, anyone wanting to think about the normativity of the law, will inevitably have to deal with the »Pure Theory of Law.« The first edition of this work, which has been translated into approximately a dozen languages, was reprinted several times in German, but is currently out of print. It is now available as a student edition, which is intended to encourage those interested in the law to read through it and to give it their careful and critical consideration.

    Abstract: There is a veritable gold rush mentality in the life science world as scientists, entrepreneurs and multinationals are staking claims to the ‘code of life’ embodied in the world’s current stock of plants, animals, microbes and human populations. In response, the communities that see themselves as the custodians of both that traditional knowledge and specific genetic resources have demanded greater recognition of their role in creating and conserving this resource, access to any resulting improvements and a share of the benefits arising from their patrimony. This has precipitated a widespread effort-in local communities, in the marketplace, in many developing and developed countries and at the talks in the Doha Round of the WTO-to reconcile the interests and concerns of the two opposing groups. This edited volume explores the legal, economic and political context for the debate about intellectual property rights for traditional knowledge and genetic resources and critically analyses the theory and practice of access and benefits sharing efforts around the world. The book also investigates the current flashpoints-the David and Goliath battle between Monsanto and Percy Schmeiser over farmers’ rights; the dispute over coexistence of GM and organic production; and the ownership and control of human genetic materials stored in human gene banks around the world

    Abstract: This publication deals with the European dimension of tort law. It provides a critical analysis of the acquis communautaire, asking if and to what extent the provisions and case law in the field of tort law are based on a conclusive system and are in accord with the national legal systems. It thus evaluates whether the acquis communautaire form the beginning of a comprehensive and coherent EC tort law or if the single directives and regulations are contradictory and lack a general concept that is yet to be found. To gain an overview of 'EC Tort Law' certain provisions and decisions were analysed by a group of authors under thirteen elements that form the basis of tort law e.g. fault/strict liability, causation, damage, damages and limitation of actions. An analysis of these aspects was then undertaken by another group of authors each focusing on their respective legal families within the European Union. The publication also contains a section on terminological issues in EC tort law.

    Abstract: Designations of large Particularly Sensitive Sea Areas (PSSAs) triggered a controversial debate within the International Maritime Organisation (IMO) concerning the legal basis of PSSAs, the relationship between the IMO’s PSSA guidelines and UNCLOS, as well as the competency of IMO to adopt mandatory protective measures in these areas. As a result, IMO conducted a review process which led to substantially updated guidelines adopted in late 2005. This book provides a detailed analysis of the PSSA guidelines and protective measures available in PSSAs. Emphasis is placed on their legal basis and the implications for coastal states' jurisdiction over vessel-source pollution.

    Abstract: The concept of individual criminal responsibility for core international crimes is, by now, a well-established principle in international criminal law. However, while the general principle behind the concept is by and large unproblematic, its practical application underscores its complexity. The aim of this book is to examine three pertinent issues relating to the concept of individual criminal responsibility for core international crimes: (i) The joint criminal enterprise doctrine, (ii) The defining criteria of international criminal courts, for the purposes of an evaluation of the lifting of state official immunity for core international crimes, in the light of the findings of the ICJ in the Arrest Warrant case, and (iii) The imposition of individual criminal responsibility for terrorism as a crime against humanity, both in international law and in relation to the ICC Statute.

    Abstract: The European Tort Law Yearbook provides a comprehensive overview of the latest developments in tort law in Europe.     Abstract: "The cultivation of genetically modified (GM) crops in the EU may lead to cases, in which traditional agricultural products contain detectable traces of GMOs. On the one hand, such admixture may result from inadequate application of segregation measures by farmers. On the other hand, as agriculture is an open process that does not allow the complete isolation of individual fields, a certain degree of admixture between neighbouring crops is unavoidable in practice. The presence of GMOs in traditional products may lead to their devaluation, which would entail an economic damage to the producer of the traditional products. For instance, due to the presence of the GMO the traditional product may require to be labelled as GM. GMOs and products containing or produced from GMOs have to be labelled according to Community legislation, in particular Directive 2001/18/EC, Regulation (EC) No. 1829/2003, and Regulation (EC) No. 1830/2003. For the case of adventitious or technically unavoidable presence of GMOs in non-GM products, Regulation 1829/2003 provides for a threshold of 0.9% below which such presence in food or feed does not require labelling. For seeds, Directive 2001/18/EC provides for the possibility of adopting thresholds, below which the adventitious or technically unavoidable presence of GM seeds does not require the labelling of conventional seed lots. Such thresholds have not yet been adopted. The presence of GMOs in a product above the labelling threshold also triggers the need for traceability of GM products according to Regulation 1830/2003, which may cause additional costs for the operators concerned. In the EU, crops may only be commercially cultivated after having been authorised for the purpose of cultivation under Community legislation (i.e. Directive 2001/18 or Regulation 1829/2003). The labelling thresholds only apply for the presence of authorised GMOs. Products containing detectable traces of unauthorised events can not be legally marketed in the EU. According to part B of Directive 2001/18, an individual Member State may grant authorisation for a non-commercial release of a GMO, for instance for the purpose of experimental field testing. As a result of such experimental cultivation, GMOs not authorised under part C of Directive 2001/18 or under Regulation 1829/2003 may be present in traditional crops. This presence could cause economic damage as food and feed could not be marketed if it contains detectable traces of such GMOs. The admixture of GMOs may also have specific implications for organic products. Regulation (EEC) No. 2092/91 on organic production of agricultural products specifies that GMOs may not be used in organic production, with the exception of certain veterinary products. Therefore, products that require labelling as GM could not be used in organic farming. This implies that GMO presence in organic input materials (such as seed or feed) could have implications beyond the necessity of labelling alone. Further economic implications may result for farmers producing non-GM crops, if specific requirements concerning GMO presence, which go beyond the provisions in Community legislation, are laid down in contracts with the retailers or other operators further down the food or feed production chain. Such conditions may also apply for products produced under quality schemes. In addition to the economic implications resulting from the actual presence of a GMO in a traditional product, costs may also occur due to sampling and testing of products, either on a basis of routine controls or in cases, where relevant GMO admixture may be suspected. In many cases, the presence of GMOs and their quantity could not be assessed without the use of laboratory analyses, which may cause significant costs. Furthermore, economic implications for traditional producers that may relate to the presence of GM crop production in a region, and which could enlarge the risk of GMO admixture, could not be ruled out. For instance, food or feed producers may preferentially purchase crops from certain regions, where no GM crop production may take place. If the cultivation of GM crops will become more widespread, the issue of liability in relation to GMO admixture could gain further importance in the EU. Compared to other cases of economic damage resulting from neighbouring activity, GMO admixture may pose specific difficulties because the admixture may initially remain undetected and become known at later stages of the food or feed production chain. Furthermore, the causal link between the damage and the operator responsible for it may not always be apparent as there may be different sources of admixture (e.g., seed impurities, outcrossing with neighbouring crops, volunteers from previous GM crop cultivation). Liability in the case of economic damage that may result from the presence of GMOs in other crops is a case of civil law. Generally, civil law is in the responsibility of the Member States. In Recommendation 2003/556/EC on guidelines for the development of national strategies and best practices to ensure the coexistence of genetically modified crops with conventional and organic farming, the Commission states that: ""The type of instruments [to achieve co-existence] adopted may have an impact on the application of national liability rules in the event of economic damage resulting from admixture. Member States are advised to examine their civil liability laws to find out whether the existing national laws offer sufficient and equal possibilities in this regard. Farmers, seed suppliers and other operators should be fully informed about the liability criteria that apply in their country in the case of damage caused by admixture. In this context, Member States may want to explore the feasibility and usefulness of adapting existing insurance schemes, or setting up new schemes."" Member States may develop national or regional approaches to ensure the co-existence of GM crops with conventional or organic agriculture. According to Article 26a of Directive 2001/18: ""Member States may take appropriate measures to avoid the unintended presence of GMOs in other products."" In the context of national or regional co-existence legislation Member States may also adopt specific provisions for liability in cases of GMO admixture, and develop compensation schemes, such as insurance systems or compensation funds. Liability has to be seen in the context of measures to segregate GM crop production from traditional non-GM production in order to achieve co-existence between these different forms of agriculture. The approach taken by the Member States to allocate the responsibility for developing and implementing these segregation measures among the operators concerned has significant implications on liability."

    Abstract: When EU leaders signed the Lisbon Treaty in late 2007, it seemed that the constitutional process in Europe was finally close to fruition. For many, the seemingly imminent conclusion of this lengthy process, which had started in 2000 or even earlier and which had absorbed much of the Unions capacity for policy and compromise, came as a great relief. Although the results of the Irish referendum have led to some disillusion, it is evident that whatever the final outcome might be for the time being the Lisbon "constitution" is as good as it gets in an EU of 27 or more states.Against that backdrop, this volume presents several works by renowned EU lawyers discussing the consequences of "Lisbon" in various policy fields (External Relations, Justice and Home Affairs, Economic Policy, etc.) as well as the pros and cons of the Unions "constitution" as it stands with the Lisbon Treaty.     Abstract: The formulation of efficient laws (i.e., legal rule formulation) is a central issue in the study, practice and implementation of laws since efficient laws have profound positive social, economic political and welfare effects. This book has developed a new approach to the formulation of efficient laws with an illustrative application to electronic fund transfer regulation in Australia. Fragmented approaches to the formulation of laws such as ‘comparative law analysis’ and ‘welfare economic analysis of laws’ exist in the existing literature which are affected by laws is necessary in formulating efficient (socially desirable) laws. In this book, an integrated approach that embeds these 2 approaches as well as other considerations of other dimensions of human welfare is developed. This approach can be applied to formulate efficient laws, irrespective of social, political and economic organisations of the country under study, which maximise social welfare of the country.

    Abstract: This comprehensive reference work presents an in-depth analysis on the juvenile justice systems of 19 different countries, both in EU-member states (old and new) and in the United States and Canada. The book is the result of research conducted by a group of outstanding scholars working in the field of juvenile justice. The book reflects a collective concern about trends in juvenile justice over the past two decades; trends that have begun to blur the difference between criminal and juvenile justice.     Abstract: "This comprehensive reference work presents an in-depth analysis on the juvenile justice systems of 19 different countries, both in EU-member states (old and new) and in the United States and Canada. The book is the result of research conducted by a group of outstanding scholars working in the field of juvenile justice. The book reflects a collective concern about trends in juvenile justice over the past two decades, trends that have begun to blur the difference between criminal and juvenile justice. The last chapter highlights similarities and differences between the various systems, identifying three clusters of countries with a similar approach to juvenile justice. In particular, differences are found between the Anglo-Saxon countries, and continental Europe.
