In this 2003 study, John Bowen explores this struggle, through archival and ethnographic research in villages and courtrooms of the Aceh Province, Sumatra, and through interviews with national religious and legal figures. He analyses the social frameworks for disputes about land, inheritance, marriage, divorce, Islamic History and, more broadly, about the relationships between the state and Islam, and between Muslims and non-Muslims. The book speaks to debates carried out in all societies about how people can live together with their deep differences in values and ways of life. It will be welcomed by scholars and students across the social sciences, particularly those interested in anthropology, cultural sociology and political theory

    Abstract: Limiting Institutions examines the security threats in Eurasia and the role of institutions in the post-Cold War international environment. It looks at both the crucial aspect of foreign policy as well as a theoretical area of security studies and its impact in the former Soviet States including Russia, Belarus, Armenia, the Ukraine and Moldova. The first section addresses the important and varied range of security threats to this area of the world, and examines the range of responses open to European countries and to the United States. Threats such as ethnic conflict, transnational crime, and environmental and energy security issues are examined in depth. The second section addresses an important theoretical issue, namely the role that international institutions can perhaps play as arbiters of conflict and facilitators of cooperation in a region abutting the European political space. The role of the OSCE, NATO, the European Union, the Commonwealth of Independent States and the Black Sea Economic Cooperation Council are consequently examined closely. The contributors are scholars with solid international reputations, and the book will be of benefit to students of international relations and conflict analysis

Die Autorin analysiert diese Praktiken der Fremdsetzung, die sich von der alltäglichen Etikettierung und Stigmatisierung bis hin zu wissenschaftlichen Praktiken des »Othering« erstrecken: Rekonstruiert werden sowohl Simmels »Händler«, Parks »Mulatte«, Schütz' »Emigrant«, Meads »signifikanter/verallgemeinerter Andere« als auch ethnografische Praktiken der »Ver-Anderung« des Fremden. Dabei wird der Blick immer wieder von den vertrauten Bildern des Fremden hin zu ihren subtilen Herstellungsprozessen und Resonanzen gelenkt, was es möglich macht, von den Konstruktionen des Fremden auf die Konstruktionen des Eigenen zurückzuschließen.

    Abstract: Privatisierung ist ein Zeichen tiefreichender Wandlungsprozesse im Verhältnis von Staat und Gesellschaft sowie in den Bereichen des öffentlichen und des Privatrechts. Verbreitet ist die Hoffnung, der unter seinen Kompetenz- und Finanzlasten schwerfällig gewordene Staatskoloß könne wieder 'schlank' werden, wenn er sich zugunsten gesellschaftlicher Kräfte aus Tätigkeitsbereichen zurückziehe. Wichtige Privatisierungsimpulse gehen nach wie vor von den Wettbewerbsbestimmungen des Europäischen Gemeinschaftsrechts aus. Auf kommunaler Ebene ist die 'Organisationsprivatisierung' verbreitet. Mit der Novellierung der Kommunalverfassungen versuchen die Landesgesetzgeber, dem Trend zur kommunalen Eigengesellschaft Einhalt zu gebieten, verletzen jedoch mitunter die Vorgaben des Gesellschaftsrechts. Jörn Axel Kämmerer weist nach, daß sich der Staat im Zuge des Privatisierungsprozesses keineswegs ganz zurückzieht. Vielmehr nimmt der Staat seine grundlegenden verfassungsrechtlichen Aufgaben auch in der 'Privatisierungsfolgenphase' weiterhin wahr – wenn auch nicht mehr durch eigene Leistungen, sondern als Garant und Regulator. Dabei wächst der Spielraum für 'private Grundrechtseingriffe', und die Grundrechte selbst wandeln sich zu Schutzpflichten. Zugleich bringt 'Organisationsprivatisierung', die Begründung privatrechtlich organisierter Wirtschaftsunternehmen der öffentlichen Hand ohne öffentlich-rechtliche Befugnisse, die Grenzen zwischen Staat und Gesellschaft zum Verschwimmen. Letztlich hat der Staat eine Gratwanderung vor sich, bei der er weiterhin als ausgleichende Instanz für eine komplexe, zur Selbstregulierung unfähige, aber in den transnationalen Bereich ausgreifende Gesellschaft agieren können muß, ohne in ihr aufzugehen.

    Abstract: There is an emerging consensus concerning a new strategic mode for spatial policy. In the past, planning resulted in zoned land uses characterised by a rigid separation of housing from leisure and workplaces. This strongly sectoral approach is breaking down under the pressure of environmental problems, technological innovations, and a societal demand for a higher quality of life. Spatial planning will increasingly involve broad framework policies at the national level, and strong partnerships at the local and regional level.     Abstract: The years 1989/1990 saw the fall of the Iron Curtain. Following forty years of significant restrictions, legal and non-bureaucratic travel from East-Central and Eastern European countries was once again possible and travelling and returning to those countries became just as easy. Immediately following the end of the East-West conflict, people from East-Central and Eastern European countries took advantage of their new freedom of travel. Many sought to emigrate to Western countries. However, when faced with such immigration, the euphoria which met the end of the political divisions in the West evaporated quickly. Several polls and surveys, projections and prognoses served to unsettle people more than the reality of immigration. This gave rise to a sometimes blind and specious – yet nevertheless politically effective – fear of a new mass migration of peoples. Now, more than ten years after the fall of the Iron Curtain, the actual scale and development of the East-West migration in Europe be clearly evaluated. This book attempts to do just that, including a comprehensive overview and eleven country-specific chapters. Each chapter includes a historical review, an account of the most important changes since 1989/1990 and a forecast of future migration developments.

Nach mehr als 40 Jahren erheblicher Einschränkungen wurde die legale und unbürokratische Anreise aus den Staaten Ostmittel- und Osteuropas wieder möglich. Genauso leicht wurde die Ein- und Rückreise dorthin. Unmittelbar nach Ende des Ost-West-Konflikts begannen die Bürger Ostmittel- und Osteuropas, von dieser neuen Reisefreiheit Gebrauch zu machen. Etliche versuchten, in ein westliches Land auszuwandern. Angesichts solcher Zuwanderung verflog die Euphorie über das Ende der politischen Spaltung Europas im Westen relativ rasch. Mehr noch als die tatsächliche Migration beunruhigten aber diverse Umfragen, Hochrechnungen und Prognosen die öffentliche Meinung. Es entstand eine teilweise unreflektierte und vordergründige, aber politisch höchst wirksame Angst vor einer neuen Völkerwanderung in Europa.     Abstract: Class action lawsuits--allowing one or a few plaintiffs to represent many who seek redress--have long been controversial. The current controversy, centered on lawsuits for money damages, is characterized by sharp disagreement among stakeholders about the kinds of suits being filed, whether plaintiffs' claims are meritorious, and whether resolutions to class actions are fair or socially desirable. Ultimately, these concerns lead many to wonder, "Are class actions worth their costs to society and to business? Do they do more harm than good?" To describe the landscape of current damage class action litigation, elucidate problems, and identify solutions, the RAND Institute for Civil Justice conducted a study using qualitative and quantitative research methods. The researchers concluded that the controversy over damage class actions has proven intractable because it implicates deeply held but sharply contested ideological views among stakeholders. Nevertheless, many of the political antagonists agree that class action practices merit improvement. The authors argue that both practices and outcomes could be substantially improved if more judges would supervise class action litigation more actively and scrutinize proposed settlements and fee awards more carefully. Educating and empowering judges to take more responsibility for case outcomes--and ensuring that they have the resources to do so--can help the civil justice system achieve a better balance between the public goals of class actions and the private interests that drive them
