    Abstract: This book explores and challenges common assumptions about gender, conflict, and post-conflict situations. It critically examines the gendered aspects of international and transitional justice processes by subverting traditional understandings of how wars are waged, the power dynamics involved, and the experiences of victims. The book also highlights the gendered stereotypes that underpin the (mis)perceptions about gender and war in order to reveal the multi-dimensional nature of modern conflicts and their aftermaths. Solange Mouthaan is Associate Professor of Law at the University of Warwick. Her research interests focus on the gendered experiences of children affected by armed conflict and the restrictive interpretation of international criminal law in this area. Olga Jurasz is a Senior Lecturer in the Law School at the Open University and works in the fields of international law, human rights, gender-based violence and gender and post-conflict reconstruction.

    Abstract: To what extent are global rule-of-law norms, which external actors promote in post-conflict states, localized? Who decides whether global standards or local particularities prevail? This book offers a new approach to the debate about how the dilemma between the diffusion of global norms and their localization is dealt with in global politics. Studying the promotion of children's rights, access to public information, and an international commission against impunity in Guatemala, Lisbeth Zimmermann demonstrates that rule-of-law promotion triggers domestic contestation and thereby changes the approach taken by external actors, and ultimately the manner in which global norms are translated. However, the leeway in local translation is determined by the precision of global norms. Based on an innovative theoretical approach and an in-depth study of rule-of-law translation, Zimmermann argues for a shift in norm promotion from context sensitivity to democratic appropriation, speaking to scholars of international relations, peacebuilding, democratization studies, international law, and political theory.

    Abstract: From its earliest days, Christianity has viewed Judaism and Jews ambiguously. Given its roots within the Jewish community of first-century Palestine, there was much in Judaism that demanded Church admiration and praise; however, as Jews continued to resist Christian truth, there was also much that had to be condemned. Major Christian thinkers of antiquity - while disparaging their Jewish contemporaries for rejecting Christian truth - depicted the Jewish past and future in balanced terms, identifying both positives and negatives. Beginning at the end of the first millennium, an increasingly large Jewish community started to coalesce across rapidly developing northern Europe, becoming the object of intense popular animosity and radically negative popular imagery. The portrayals of the broad trajectory of Jewish history offered by major medieval European intellectual leaders became increasingly negative as well. The popular animosity and the negative intellectual formulations were bequeathed to the modern West, which had tragic consequences in the twentieth century. In this book, Robert Chazan traces the path that began as anti-Judaism, evolved into heightened medieval hatred and fear of Jews, and culminated in modern anti-Semitism.

    Abstract: This is a study of law, wrongdoing and justice as conceived in the minds of the ordinary people of England and Wales from the later eighteenth century to the First World War. Official justice was to become increasingly centralised with declining traditional courts, emerging professional policing and a new prison estate. However, popular concepts of what was, or should be, contained within the law were often at variance with its formal written content. Communities continued to hold mock courts, stage shaming processions and burn effigies of wrongdoers. The author investigates those justice rituals, the actors, the victims and the offences that occasioned them. He also considers the role such practices played in resistive communities trying to preserve their identity and assert their independence. Finally, whilst documenting the decline of popular justice traditions this book demonstrates that they were nevertheless important in bequeathing a powerful set of symbols and practices to the nascent labour movement. This book will be of interest to scholars and students of legal history and criminal justice as well as social and cultural history in what could be considered a very long nineteenth century.     Abstract: Scholars from various disciplines have long debated why western Europe in general, and England in particular, led the transition from feudalism to capitalism. The decline of serfdom between c.1300 and c.1500 in England is centralto this "Transition Debate", because it transformed the lives of ordinary people and opened up the markets in land and labour. Yet, despite its historical importance, there has been no major survey or reassessment of decline of serfdom for decades. Consequently, the debate over its causes, and its legacy to early modern England, remains unresolved. This dazzling study provides an accessible and up-to-date survey of the decline of serfdom in England, applying a new methodology for establishing both its chronology and causes to thousands of court rolls from 38 manors located across the south Midlands and East Anglia. It presents a ground-breaking reassessment, challenging many of the traditional interpretations of the economy and society of late-medieval England, and, indeed, of the very nature of serfdom itself. Mark Bailey is High Master of St Paul's School, and Professor of Later Medieval History at the University of East Anglia. He has published extensively on the economic and social history of England between c.1200 and c.1500, including Medieval Suffolk (2007).

    Abstract: Toby Matthiesen traces the politics of the Shia in the Eastern Province of Saudi Arabia from the nineteenth century until the present day. This book outlines the difficult experiences of being Shia in a Wahhabi state, and casts new light on how the Shia have mobilised politically to change their position. Shia petitioned the rulers, joined secular opposition parties and founded Islamist movements. Most Saudi Shia opposition activists profited from an amnesty in 1993 and subsequently found a place in civil society and the public sphere. However, since 2011 a new Shia protest movement has again challenged the state. The Other Saudis shows how exclusionary state practices created an internal Other and how sectarian discrimination has strengthened Shia communal identities. The book is based on little-known Arabic sources, extensive fieldwork in Saudi Arabia and interviews with key activists. Of immense geopolitical importance, the oil-rich Eastern Province is a crucial but little known factor in regional politics and Gulf security.

    Abstract: This book responds to the often loud debates about the place of Muslims in Western Europe by proposing an analysis based in institutions, including schools, courts, hospitals, the military, electoral politics, the labor market, and civic education courses. The contributors consider the way people draw on practical schemas regarding others in their midst who are often categorized as Muslims. Chapters based on fieldwork and policy analysis across several countries examine how people interact in their everyday work lives, where they construct moral boundaries, and how they formulate policies concerning tolerable diversity, immigration, discrimination, and political representation. Rather than assuming that each country has its own national ideology that explains such interactions, contributors trace diverse pathways along which institutions complicate or disrupt allegedly consistent national ideologies. These studies shed light on how Muslims encounter particular faces and facets of the state as they go about their lives, seeking help and legitimacy as new citizens of a fast-changing Europe.

    Abstract: The concept of toleration plays a central role in pluralistic societies. It designates a stance which permits conflicts over beliefs and practices to persist while at the same time defusing them, because it is based on reasons for coexistence in conflict - that is, in continuing dissension. A critical examination of the concept makes clear, however, that its content and evaluation are profoundly contested matters and thus that the concept itself stands in conflict. For some, toleration was and is an expression of mutual respect in spite of far-reaching differences, for others, a condescending, potentially repressive attitude and practice. Rainer Forst analyses these conflicts by reconstructing the philosophical and political discourse of toleration since antiquity. He demonstrates the diversity of the justifications and practices of toleration from the Stoics and early Christians to the present day and develops a systematic theory which he tests in discussions of contemporary conflicts over toleration.

    Abstract: A new theory of ethnic cleansing based on the most terrible cases (colonial genocides, Armenia, the Nazi Holocaust, Cambodia, Yugoslavia, Rwanda) and cases of lesser violence (early modern Europe, contemporary India, and Indonesia). Murderous cleansing is modern, 'the dark side of democracy'. It results where the demos (democracy) is confused with the ethnos (the ethnic group). Danger arises where two rival ethno-national movements each claims 'its own' state over the same territory. Conflict escalates where either the weaker side fights because of aid from outside, or the stronger side believes it can deploy sudden, overwhelming force. Escalation is not simply the work of 'evil elites' or 'primitive peoples'. It results from complex interactions between leaders, militants, and 'core constituencies' of ethno-nationalism. Understanding this complex process helps us devise policies to avoid ethnic cleansing in the future.

    Abstract: The Killing Trap, first published in 2005, offers a comparative analysis of the genocides, politicides and ethnic cleansings of the twentieth century, which are estimated to have cost upwards of forty million lives. The book seeks to understand both the occurrence and magnitude of genocide, based on the conviction that such comparative analysis may contribute towards prevention of genocide in the future. Manus Midlarsky compares socio-economic circumstances and international contexts and includes in his analysis the Jews of Europe, Armenians in the Ottoman Empire, Tutsi in Rwanda, black Africans in Darfur, Cambodians, Bosnians, and the victims of conflict in Ireland. The occurrence of genocide is explained by means of a framework that gives equal emphasis to the non-occurrence of genocide, a critical element not found in other comparisons, and victims are given a prominence equal to that of perpetrators in understanding the magnitude of genocide.

    Abstract: In the aftermath of colonial mission, Christianity has come to have widespread acceptance in Southern Tanzania. In this book, Maia Green explores contemporary Catholic practice in a rural community of Southern Tanzania. Setting the adoption of Christianity and the suppression of witchcraft in a historical context, she suggests that power relations established during the colonial period continue to hold between both popular Christianity and orthodoxy, and local populations and indigenous clergy. Paradoxically, while local practices around the constitution of kinship and personhood remain defiantly free of Christian elements, they inform a popular Christianity experienced as a system of substances and practices. This book offers a challenge to idealist and interpretative accounts of African participation in twentieth-century religious forms, and argues for a politically grounded analysis of historical processes. It will appeal widely to scholars and students of anthropology, sociology and African Studies; particularly those interested in religion and kinship.

    Abstract: In Indonesia, the world's largest Muslim-majority country, Muslims struggle to reconcile radically different sets of social norms and laws, including those derived from Islam, local social norms, and contemporary ideas about gender equality and rule of law. In this 2003 study, John Bowen explores this struggle, through archival and ethnographic research in villages and courtrooms of the Aceh Province, Sumatra, and through interviews with national religious and legal figures. He analyses the social frameworks for disputes about land, inheritance, marriage, divorce, Islamic History and, more broadly, about the relationships between the state and Islam, and between Muslims and non-Muslims. The book speaks to debates carried out in all societies about how people can live together with their deep differences in values and ways of life. It will be welcomed by scholars and students across the social sciences, particularly those interested in anthropology, cultural sociology and political theory.

    Abstract: Andreas Wimmer argues that nationalist and ethnic politics have shaped modern societies to a far greater extent than has been acknowledged by social scientists. The modern state governs in the name of a people defined in ethnic and national terms. Democratic participation, equality before the law and protection from arbitrary violence were offered only to the ethnic group in a privileged relationship with the emerging nation-state. Depending on circumstances, the dynamics of exclusion took on different forms. Where nation building was 'successful', immigrants and 'ethnic minorities' are excluded from full participation; they risk being targets of xenophobia and racism. In weaker states, political closure proceeded along ethnic, rather than national lines and leads to corresponding forms of conflict and violence. In chapters on Mexico, Iraq and Switzerland, Wimmer provides extended case studies that support and contextualise this argument.

    Abstract: In this book, Thomas Buoye examines the impact of large-scale economic change on social conflict in eighteenth-century China. He draws upon a large body of actual, documented homicide cases originating in property disputes to recreate the social tensions of rural China during the Qianlong reign (1736–1795). The development of property rights, a process that had begun in the Ming dynasty, was accompanied by other changes that fostered disruption and conflict, including an explosion in the population growth and the increasing strain on land and resources, and increasing commercialization in agriculture. Buoye challenges the 'markets' and 'moral economy' theories of economic behaviour. Applying the theories of Douglass North for the first time to this subject, he uses an institutional framework to explain seemingly irrational economic choices. Buoye examines demographic and technological factors, ideology, and political and economic institutions in rural China to understand the link between economic and social change.

    Abstract: This book provides a distinctive account of Edward Said's critique of modern culture by highlighting the religion-secularism distinction on which it is predicated. This distinction is both literal and figurative. It refers, on the one hand, to religious traditions and to secular traditions and, on the other hand, to tropes that extend the meaning and reference of religion and secularism in indeterminate ways. The author takes these tropes as the best way of organizing Said's heterogeneous corpus - from Joseph Conrad and the Fiction of Autobiography, his first book, to Orientalism, his most influential book, to his recent writings on the Palestinian question.     Abstract: Eliz Sanasarian's book explores the political and ideological relationship between non-Muslim religious minorities in Iran and the state during the formative years of the Islamic Republic to the present day. Her analysis is based on a detailed examination of the history and experiences of the Armenians, Assyrians, Chaldeans, Jews, Zoroastrians, Bahais and Iranian Christians, and describes how these communities have responded to state policies regarding minorities. Many of her findings are constructed out of personal interviews with members of these communities. While the book is essentially an empirical study, it also highlights more general questions associated with exclusion and marginalization and the role of the state in defining these boundaries.     Abstract: In this book, Julia Ching offers a magisterial survey of over four thousand years of Chinese civilisation through an examination of the relationship between kingship and mysticism. She investigates the sage-king myth and ideal, arguing that institutions of kingship were bound up with cultivation of trance states and communication with spirits. Over time, these associations were retained, though sidelined, as the sage-king myth became a model for the actual ruler, with a messianic appeal for the ruled. As a paradigm, it also became appropriated by private individuals who strove for wisdom without becoming kings. As the Confucian tradition interacted with the Taoist and the Buddhist, the religious character of spiritual and mystical cultivation became more pronounced. But the sage-king idea continued, promoting expectations of benevolent despotism rather than democratisation in Chinese civilisation.

    Abstract: The contributors to this book believe that something can be done to make life in American cities safer, to make growing up in the urban ghettos less risky, and to reduce the violence that so often permeates urban childhoods. They consider why there is so much violence, why some people become violent and others do not, and why violence is more prevalent in some areas. Both biological and psychological characteristics of individuals are considered. The authors also discuss how the urban environment, especially the street culture, affects childhood development. They review a variety of intervention strategies, considering when it would be appropriate to use them and towards whom they should be targeted. Drawing upon ethnographic commentary, laboratory experiments, historical reviews, and program descriptions, this book presents a variety of opinions on the causes of urban violence and the changes necessary to reduce it.

    Abstract: Justice, equity, and fairness are central concerns of everyday life, whether we are assessing the fairness of individual acts, social programmes, or institutional policies. This book explores how the distribution of costs and benefits determine our intuition about fairness and why individual behaviour sometimes deviates from normative theories of justice. To make any comparison, one must first state how fair distributions of resources or burdens should be made. Here, competing theories, such as utilitarianism and economic efficiency, are discussed.     Abstract: Francisco Vitoria was the earliest and arguably the most important of the Thomist political philosophers of the Counter-Reformation. Not only did he write important essays on civil and ecclesiastical power, but he became celebrated for his defence of the new world Indians against the imperialism of his own master, the King of Spain.     Abstract: Among the Berti of Northern Darfur (Sudan), as among many Muslim societies, the formal religious practices are predominantly the concern of men, while local, unorthodox customary rituals are performed mainly by women. It is usual to dismiss such local, popular practices as pre-Islamic survivals, but Professor Holy shows that the customary rituals constitute an integral part of the religious system of the Berti. Carefully analysing the symbolic statements made in Berti rituals, Professor Holy demonstrates that the distinction between the two classes of rituals is an expression of the gender relationships characteristic of the society. He also examines the social distribution of knowledge about Islam, and explains the role of the religious schools in sustaining religious ideas. The work is not only an ethnographic study of ritual, belief and gender in an African society. It also makes a significant contribution to current anthropological discussion of the interpretation and meaning of rituals and symbols.

    Abstract: This book is a 1990 account of the ways in which young Aborigines were at a disadvantage before laws and legislation had been introduced, intended to improve their position. Aboriginal Youth and the Criminal Justice System focuses on South Australia, where detailed statistics are available, in a sophisticated analysis of the exact nature of the discrimination experienced by young Aborigines. Fay Gale, Rebecca Bailey-Harris and Joy Wundersitz examine the criminal justice system in operation; from the initial intervention by a police officer, through the process of screening and assessment to the final outcome - which all too often is a criminal record. The research clearly shows that at every point where discretion was exercised within this system, Aboriginal youths received the harsher option. Thus disadvantage is heaped on disadvantage until young Aboriginals were imprisoned at 23 times the rate of other young Australians. Even for those who escaped detention, participation in the criminal justice system was often such an ordeal that it became a form of punishment in itself. Discretion, though preferable to inflexible rules could operate against a group whose lifestyle and values differed from mainstream society.

    Abstract: This book is about change in the Roman Catholic community in England and Wales. It argues that in the post-war years of economic growth and expanded educational opportunities, Catholics born in Great Britain achieved rates of upward social mobility comparable to those of the general population. In so doing there arose a 'new Catholic middle class', likely to be crucial for the future of Roman Catholicism in England and Wales. However, since one quarter of English Catholics were first-generation immigrants who had experienced some downward mobility, it could not be said that English Catholics generally had experienced a 'mobility momentum' relative to the rest of the population. Apart from the effects of social change, post-war Catholicism was also transformed as a result of the religious reforms legitimated by the Second Vatican Council in the early 1960s. The net effect of these social and religious forces on English Catholicism was the dissolution of the boundaries which had formerly defended a 'fortress' church in a hostile world. The book identifies this, inter alia, in the widespread heterodoxy of belief and practice, and in the decline of marital endogamy and communal involvement.

    Abstract: In this work the authors present a general theory of bureaucracy and use it to explain behaviour in large organizations and to explain what determines efficiency in both governments and business corporations. The theory uses the methods of standard neoclassical economic theory. It relies on two central principles: that members of an organization trade with one another and that they compete with one another. Authority, which is the basis for conventional theories of bureaucracy, is given a role, despite reliance on the idea of trade between bureaucracies. It is argued, however, that bureaucracies cannot operate efficiently on the basis of authority alone. Exchange between bureaucrats is hampered because promises are not enforceable. So trust and loyalty between members of bureaucratic networks play an important part. The authors find that vertical networks promote efficiency while horizontal ones impede it.

    Abstract: This book examines in detail the process of change in 240 city, county and state public bureaucracies responsible for local finance administration. Using the longitudinal method of analysis, the data show organizational structures to be much less stable than conventional stereotypes have suggested. Variables such as organizational leadership, claims to domain, and survival (as opposed to replacement or reorganization) were found to mediate environmental effects on bureaucracies. The book also discusses traditional theories of bureaucracy, theories emphasizing the importance of environment for organizational theory is possible.
