While some works have treated such issues regionally, the Encyclopedia of Law and Religion is unique in its breadth, covering all independent nations and jurisdictions as well as the major international organizations, treating the relation between law and religion in its various aspects, including those related to the role of religion in society, the relations between religion and state institutions, freedom of religion, legal aspects of religious traditions, the interaction between law and religion, and other issues at the junction of law, religion, and state.

    Kurzfassung: "In Urban Rituals in Sacred Landscapes in Hellenistic Asia Minor, Christina G. Williamson examines the phenomenon of monumental sanctuaries in the countryside of Asia Minor that accompanied the second rise of the Greek city-state in the Hellenistic period. Moving beyond monolithic categories, Williamson provides a transdisciplinary frame of analysis that takes into account the complex local histories, landscapes, material culture, and social and political dynamics of such shrines in their transition towards becoming prestigious civic sanctuaries. This frame of analysis is applied to four case studies: the sanctuaries of Zeus Labraundos, Sinuri, Hekate at Lagina, and Zeus Panamaros. All in Karia, these well-documented shrines offer valuable insights for understanding religious strategies adopted by emerging cities as they sought to establish their position in the expanding world"--

    Kurzfassung: 'Devotional Sovereignty' investigates the shifting conceptualization of sovereignty in the South Indian kingdom of Mysore during the reigns of Tipu Sultan (r. 1782-1799) and Krishnaraja Wodeyar III (r. 1799-1868). Tipu Sultan was a Muslim king famous for resisting British dominance until his death; Krishnaraja III was a Hindu king who succumbed to British political and administrative control. Despite their differences, the courts of both kings dealt with the changing political landscape by turning to the religious and mythical past to construct a royal identity for their kings. Caleb Simmons explores the ways in which these two kings and their courts modified and adapted pre-modern Indian notions of sovereignty and kingship in reaction to British intervention.

This book presents an interpretation of how religion and human rights interrelate in the legal context, and how this relationship might be reconceived to make this relationship somewhat less fraught. Litigating Religions, an essay adapted by Christopher McCrudden from the Alberico Gentili Lectures given at the University of Macerata, Italy, examines how the resurgent role of religion in public life gives rise to tensions with key aspects of human rights, in particular freedom of religion and anti-discrimination law, and how these tensions cannot be considered as simply transitional. The context for the discussion is the increasingly troubled area of human rights litigation involving religious arguments, such as wearing religious dress at work, conscientious objections by marriage registrars, admission of children to religious schools, prohibitions on same-sex marriage, and access to abortion. Christopher McCrudden argues that, if we wish to establish a better dialogue between the contending views, we must address a set of recurring problems identifiable in such litigation.     Kurzfassung: This book provides an account and explanation of a fundamental dilemma facing secular states: the "legitimacy gap" left by the withdrawal of religion as a source of legitimacy. Legitimacy represents a particular problem for the secular state. The "secular" in all its manifestations is very much linked to the historical rise of the modern state. It should not be seen as a category that separates culture and religion from politics, but rather as one that links these different dimensions. In the first part of the book, Depaigne explains how modern constitutional law has moved away from a "substantive" legitimacy, based in particular on natural law, towards a 'procedural' legitimacy based on popular sovereignty and human rights. Depaigne examines three case studies of constitutional responses to legitimacy challenges which articulate the three main sources of "procedural" legitimacy (people, rights, and culture) in different ways: the "neutral model" (constitutions based on the "displacement of culture"); the "multicultural model" (constitutions based on diversity and pluralism); and the "asymmetric model" (constitutions based on tradition). Even if secularization can be considered European in its origin, it is best seen today as a global phenomenon, which needs to be approached by taking into account the particular cultural dimension in which it is rooted. Depaigne's detailed study shows how secularization has moved either towards "nationalization" linked to a particular national identity (as in France and, to some extent, in India)-or towards "de-secularization", whereby secularism is displaced by particular cultural norms, as in Malaysia --Front flap of book

    Kurzfassung: "East and West in the Roman Empire of the Fourth Century examines the (dis)unity of the Roman Empire in the fourth century from different angles, in order to offer a broad perspective on the topic and avoid an overvaluation of the political division of the empire in 395. After a methodological key-paper on the concepts of unity, the other contributors elaborate on these notions from various geo-political perspectives: the role of the army and taxation, geographical perspectives, the unity of the Church and the perception of the Divisio Regni of 364. Four case-studies follow, illuminating the role of concordia apostolorum, antique sports, eunuchs and the poet Prudentius on the late antique view of the Empire. Despite developments to the contrary, it appears that the Roman Empire remained (to be viewed as) a unity in all strata of society.     Kurzfassung: Olivier Roy, world-renowned authority on Islam and politics, finds in the modern disconnection between faith communities and socio-cultural identities a fertile space for fundamentalism to grow. Instead of freeing the world from religion, secularization has encouraged a kind of holy ignorance to take root, an anti-intellectualism that promises immediate, emotional access to the sacred and positions itself in direct opposition to contemporary pagan culture. The secularization of society was supposed to free people from religion, yet individuals are converting en masse to fundamentalist faiths, such as Protestant evangelicalism, Islamic Salafism, and Haredi Judaism. These religions either reconnect adherents to their culture through casual referents, like halal fast food, or maintain their momentum through purification rituals, such as speaking in tongues, a practice that allows believers to utter a language that is entirely their own. Instead of a return to traditional religious worship, we are now witnessing the individualisation of faith and the disassociation of faith communities from ethnic and national identities. Roy explores the options now available to powers that hope to integrate or control these groups; and whether marginalisation or homogenisation will further divide believers from their culture.

    Kurzfassung: Inspired by a critical reconsideration of current monolithic approaches to the study of Greek religion, this book argues that ancient Greeks displayed a disquieting capacity to validate two (or more) dissonant, if not contradictory, representations of the divine world in a complementary rather than mutually exclusive manner.
