    Abstract: This volume in honour of Stephen Ellis is a follow-up to the public presentation of his book on the history of organised crime in Nigeria This Present Darkness (Hurst, 2016) at the University of Lagos, Nigeria on 28 October 2016. In addition to four papers, and a book review presented at this colloquium, other contributions about crime in Nigeria have been added, written by Nigerian authors. In July 2015 Stephen died, and he has worked on This Present Darkness almost to his last moments, as a senior researcher of the African Studies Centre in Leiden.     Abstract: "Since 1970 the Law in Context series has been at the forefront of the movement to broaden the study of law. It has been a vehicle for the publication of innovative scholarly books that treat law and legal phenomena critically in their social, political and economic contexts from a variety of perspectives.     Abstract: Since the turn of the century, South American governments and regional organisations have adopted the world's most open discourse on migration and citizenship. At a time when restrictive choices were becoming increasingly predominant around the world, South American policymakers presented their discourse as being both an innovative and exceptional 'new paradigm' and part of a morally superior, avant-garde path in policymaking. This book provides a critical examination of the South American legal framework through a historical and comparative analysis. Diego Acosta uses this analysis to assess whether the laws are truly innovative and exceptional, as well as evaluating their feasibility, strengths and weaknesses. By analysing the legal construction of the national and the foreigner in ten South American countries during the last two centuries, he demonstrates how different citizenship and migration laws have functioned, as well as showing why states have opted for certain regulation choices, and the consequence of these choices for state- and nation-building in the continent.     Abstract: Memory is as central to modern politics as politics is central to modern memory. We are so accustomed to living in a forest of monuments, to having the past represented to us through museums, historic sites, and public sculpture, that we easily lose sight of the recent origins and diverse meanings of these uniquely modern phenomena. In this volume, leading historians, anthropologists, and ethnographers explore the relationship between collective memory and national identity in diverse cultures throughout history. Placing commemorations in their historical settings, the contributors disclose the contested nature of these monuments by showing how groups and individuals struggle to shape the past to their own ends. The volume is introduced by John Gillis's broad overview of the development of public memory in relation to the history of the nation-state.     Note: Liberalism and our modern allegiance to human rights rest on a foundational commitment to moral equality. But why, given our differences, must we always treat one another as equals? Most who have attempted to answer this question have appealed to the idea of dignity, the idea that all human beings possess an intrinsic worth--grounded in capacities, for example, to reflect, reason, or love--that raises us up in the order of nature. In Humanity without Dignity, Andrea Sangiovanni rejects this predominant view and offers a radical alternative. He argues that, to understand our commitment, we must begin with a consideration not of equality but inequality. Rather than search for a chimerical value-bestowing capacity possessed to an equal extent by each one of us, we ought to ask: Why and when is it wrong to treat others as inferior? He comes to the conclusion that our commitment to moral equality is best explained by a rejection of cruelty rather than a celebration of rational capacity. He then traces the impact of this fundamental shift for our understanding of human rights, and the place of anti-discrimination norms in that understanding.

    Abstract: This interdisciplinary study engages law, history, and political theory in a first attempt to crystallize the lessons the global 'refugee crisis' can teach us about the nature of international law. It connects the dots between the actions of Jewish migrants to Palestine after WWII, Vietnamese 'boatpeople', Haitian refugees seeking to reach Florida, Middle Eastern migrants and refugees bound to Australia, and Syrian refugees currently crossing the Mediterranean, and then legal responses by states and international organizations to these movements. Through its account of maritime migration, the book proposes a theory of human rights modelled around an encounter between individuals in which one of the parties is at great risk. It weaves together primary sources, insights from the work of twentieth-century thinkers such as Hannah Arendt and Emmanuel Levinas, and other legal materials to form a rich account of an issue of increasing global concern.

    Abstract: Taking a critical attitude of dissatisfaction towards rights, the central premise of this book is that rights are technologies of governmentality. They are a regulating discourse that is itself managed through governing tactics and techniques - hence governing (through) rights. Part I examines the 'problem of government' (through) rights. The opening chapter describes governmentality as a methodology that is then used to interrogate the relationship between rights and governance in three contexts: the international, regional and local. How rights regulate certain identities and conceptions of what is good governance is examined through the case study of non-state actors, specifically the NGO, in the international setting; through a case study of rights agencies, and the role of experts, indicators and the rights-based approach in the European Union or regional setting; and, in terms of the local, the challenge that the blossoming language of responsibility and community poses to rights in the name of less government (Big Society) is problematised. In Part II, on resisting government (through) rights, the book also asks what counter-conducts are possible using rights language (questioning rioting as resistance), and whether counter-conduct can be read as an ethos of the political, rights-bearing subject and as a new ethical right. Thus, the book bridges a divide between critical theory (ie Foucauldian understandings of power as governmentality) and human rights law

    Abstract: Abstoßung und Anreiz, Verbieten und Verschweigen, Thematisierung und Dethematisierung - dem Tabu wohnen Ambivalenzen inne, die auf besondere Weise für historische Beobachtungen produktiv gemacht werden können. Seit der kreativen Neuentdeckung durch Freud steht das Tabu im Zeichen einer Beobachtung eigener Kultur und zielt auf die Entdeckung von verborgenen gesellschaftlichen Vektoren. Die Beiträge des Bandes gehen den Spuren dieser produktiven Ambivalenz in Texten und Artefakten vergangener und gegenwärtiger Verhältnisse nach. Dabei stehen die politischen ebenso wie die ästhetischen und epistemischen Dimensionen des Tabus im Mittelpunkt.     Abstract: "The right of indigenous peoples to Free Prior and Informed Consent (FPIC) in relation to natural resource extraction in their territories is a principle that is increasingly recognised by intergovernmental organizations, international bodies, conventions and international human rights law as well as in the domestic law of some States. This book offers a comprehensive overview of the status of Free Prior and Informed Consent under international human rights law, considering the main controversies, obstacles and challenges associated with its recognition and implementation. The book examines the relationship between Free Prior and Informed Consent and territorial, resource and governance rights. The historical basis for FPIC is considered as well as the legitimacy of the dominant doctrines of exclusive State ownership of subsoil resources. The book argues that FPIC constitutes an emerging norm of international law with a tipping point having been reached in terms of the requirements recognition, both within and beyond the human rights regime. It draws on emerging jurisprudence from around the world, as well as evolving industry standards and policies, to illustrate the growing recognition of the fact that respect for the consent requirement is fundamental to securing indigenous peoples self-governance and territorial rights"--

    Abstract: The language of human rights is the most prominent 'people-centred' language of global justice today. This textbook looks at how human rights are constructed at local, national, international and transnational levels and considers commonalities and differences around the world.     Abstract: "Entsetzt verfolgen viele Menschen die Meldungen über die Gräueltaten des Terror-Regimes IS in Syrien und im Irak. Insofern erscheint der Titel von Guido Steinbergs neuem Werk durchaus angemessen: "Kalifat des Schreckens." Das Buch ist keines, das man nach der Lektüre einfach zur Seite legt. Sein Inhalt schreckt auf, beunruhigt, fordert eine Reaktion heraus. (...) "Kalifat des Schreckens" zielt darauf, ein breiteres Publikum anzusprechen IBM anders noch als Steinbergs vorangegangenes Buch "al-Qaidas deutsche Kämpfer". Es ist deutlich kürzer und einfacher geschrieben. Dennoch wären weniger Zeitsprünge, weniger Fakten und Informationen, dafür mehr Analyse zum besseren Verständnis des schwierigen Themas hilfreich gewesen. Dass der Autor das spielend beherrscht, ohne dabei an Qualität einzubüe︢n, hat er in seinen vielen Medienauftritten hinlänglich unter Beweis gestellt. (Deutschlandfunk, 03.03.2015)
