    Abstract: Zugang zu Land ist begehrt und umkämpft. Das verdeutlichen Konflikte, die weltweit im Zusammenhang mit land grabbing auftreten. Wie aber lassen sich Entstehung und Verlauf dieser Konflikte erklären? Dieser Frage nähert sich Sarah Kirst in einer Fallstudie zu zwei Konflikten um Zugang zu Land im Kontext der Umsetzung agrarindustrieller Vorhaben in Ghana. Aus machtkritischer Perspektive beleuchtet sie die Rolle traditioneller Autoritäten, die zentrale Akteur*innen in diesen Konflikten sind. Ihre Analyse entschlüsselt die Bedeutung unterschiedlicher Machtformen für Konfliktentstehung und -verlauf und zeigt soziale Ungleichheitsverhältnisse im Kontext von land grabbing auf

In A Queer New York, Jen Jack Gieseking highlights the historic significance of these spaces, mapping the political, economic, and geographic dispossession of an important, thriving community that once called certain New York neighborhoods home.Focusing on well-known neighborhoods like Greenwich Village, Park Slope, Bedford-Stuyvesant, and Crown Heights, Gieseking shows how lesbian and queer neighborhoods have folded under the capitalist influence of white, wealthy gentrifiers who have ultimately failed to make room for them.     Abstract: How did Africans become 'blacks' in the Americas? Becoming Free, Becoming Black tells the story of enslaved and free people of color who used the law to claim freedom and citizenship for themselves and their loved ones. Their communities challenged slaveholders' efforts to make blackness synonymous with slavery. Looking closely at three slave societies - Cuba, Virginia, and Louisiana - Alejandro de la Fuente and Ariela J. Gross demonstrate that the law of freedom - not slavery - established the meaning of blackness in law. Contests over freedom determined whether and how it was possible to move from slave to free status, and whether claims to citizenship would be tied to racial identity. Laws regulating the lives and institutions of free people of color created the boundaries between black and white, the rights reserved to white people, and the degradations imposed only on black people

Dadurch bleibt vielen Menschen, wenn sie nicht Staatsbürger_innen eines Landes sind, in der nationalstaatlichen Praxis das Recht auf politische Mitgestaltung vorenthalten. 70 Jahre nach der Verabschiedung der Allgemeinen Erklärung der Menschenrechte ist daher eine kritische Revision des Menschenrechtsverständnisses dringend erforderlich. Franziska Martinsen erläutert aus radikaldemokratietheoretischer Perspektive, dass Menschenrechte erst dann, wenn sie weniger als humanitäre denn als originär politische Rechte verstanden werden, ihr ermächtigendes Potenzial weltweit entfalten können

    Abstract: This book analyses the extent and the modalities of the securitization of asylum-seekers and refugees in the EU. Itargues that the development of the EU asylum policy, far from 'securitizing' asylum-seekers and refugees, has led to the strengthening and codification of several rights for these two categories of persons. However, the securitization of terrorism and the links that have been constructed between asylum, irregular migration and terrorism in the wake of the various terrorist attacks that have taken place in Europe in the last few years have had a significant impact on the ability of asylum-seekers to gain access to asylum systems in the EU. From a theoretical point of view, the book develops an original analytical framework that draws upon and further develops security studies- more precisely securitization theory- by connecting it to the literature on policy venues and venue-shopping. It therefore makes a significant contribution to the debates on both securitization and migration. Empirically examining the entire development of the EU's policy towards asylum-seekers and refugees, from its origins in 1993, this book will be of great interest to students of European and EU politics, refugees, migration, security, terrorism and counter-terrorism, security studies and International Relations

    Abstract: Urban Sustainability and Justice presents an innovative yet practical approach to incorporate equity and social justice into sustainable development in urban areas, in line with the commitments of the UN’s Sustainable Development Goals and the New Urban Agenda. This open access work proposes a feminist reading of just sustainabilities' principles to reclaim sustainability as a progressive discourse which informs action on the ground. This work will help the committed activist (whether they are on the ground, working in a community, in a non-governmental organization (NGO), in a business, at a university, in any sphere in government) to connect their work to international efforts to deliver environmental justice in cities around the world. Drawing on a comparative, international analysis of sustainability initiatives in over 200 cities, Castán Broto and Westman find limited evidence of the implementation of just sustainabilities principles in practice, but they argue that there is considerable potential to develop a justice-oriented sustainability agenda. Highlighting current successes while also assessing prospects for the future, the authors show that just sustainabilities is not merely an aspirational discourse, but a frame of reference to support radical action on the ground.     Abstract: "In Asia, there are a growing number of gigantic megalopolises, accompanied by a series of speculative and extravagant megaprojects. Amid the fast-paced urban and development challenges, many Asian developing countries have started to search for successful Asian development models. South Korea and its capital city Seoul are frequently referenced models. South Koreas "economic miracle" of the late twentieth century, however, has been mostly studied through an economic policy lens. This book revisits the development of South Korea by looking at its urban dimension and exploring the city of Seoul as a developmental megaproject. Offering an alternative to the focus on economic policies when it comes to explaining South Koreas development successes, Joo looks at the urbanization that took place under the guidance of the strong developmental state. She provides empirical evidence of the "property state" at work, both complementing and supporting the developmental state. She also analyses why and how Seoul was able to emerge as an important Asian global city and a global front-runner in terms of ambitious and pioneering urban investments, despite its relatively recent history marked by massive slums and urban poverty. This book provides an analytical framework for studying South Koreas modern development under capitalism, as a precursor to the East Asian urbanism and development.     Abstract: Jakob Weissinger nähert sich der zentralen rechtstheoretischen Frage nach einem Begriff subjektiver Rechte, indem er fundamentale Strukturelemente normativer Praxis und deren Verflechtungen analysiert. Darauf aufbauend entwickelt er einen eigenen Begriff, der bewährte Ansätze grundlegend in Frage stellt.
    Abstract: Just what is a right? Jakob Weissinger approaches this central problem of jurisprudence by critically examining the purpose of such normative concepts and carefully analysing the fundamental elements of normative practice like actions, decisions, the logic of norms and values as well as the plurality of normative practice. Interlinking the insights won, he outlines a stand-alone theory of rights which emphasises the empowering dimension of rights in the process of justifying (legal) rules. Not only does he question well-established theories, such as Hohfeld's famous analysis of legal conceptions, but aspires to set future debates in legal theory, especially those surrounding rights such as the long-standing dispute between interest and choice theories of rights, on new and more solid meta-theoretical ground.

    Abstract: As the power and sophistication of of 'big data' and predictive analytics has continued to expand, so too has policy and public concern about the use of algorithms in contemporary life. This is hardly surprising given our increasing reliance on algorithms in daily life, touching policy sectors from healthcare, transport, finance, consumer retail, manufacturing education, and employment through to public service provision and the operation of the criminal justicesystem. This has prompted concerns about the need and importance of holding algorithmic power to account, yet it is far from clear that existing legal and other oversight mechanisms are up to the task. This collection of essays, edited by two leading regulatory governance scholars, offers a critical0exploration of 'algorithmic regulation', understood both as a means for co-ordinating and regulating social action and decision-making, as well as the need for institutional mechanisms through which the power of algorithms and algorithmic systems might themselves be regulated. It offers a unique perspective that is likely to become a significant reference point for the ever-growing debates about the power of algorithms in daily life in the worlds of research, policy and practice.     Abstract: "Customary law and traditional authorities continue to play highly complex and contested roles in contemporary African states. Reversing the common preoccupation with studying the impact of the post/colonial state on customary regimes, this volume analyses how the interactions between state and non-state normative orders have shaped the everyday practices of the state. It argues that, in their daily work, local officials are confronted with a paradox of customary law: operating under politico-legal pluralism and limited state capacity, bureaucrats must often, paradoxically, deal with custom - even though the form and logic of customary rule is not easily compatible and frequently incommensurable with the form and logic of the state - in order to do their work as a state. Given the self-contradictory nature of this endeavour, officials end up processing, rather than solving, this paradox in multiple, inconsistent and piecemeal ways. Assembling inventive case studies on state-driven land reforms in South Africa and Tanzania, the police in Mozambique, witchcraft in southern Sudan, constitutional reform in South Sudan, Guinea's long durée of changing state engagements with custom, and hybrid political orders in Somaliland, this volume offers important insights into the divergent strategies used by African officials in handling this paradox of customary law and, somehow, getting their work done."--Provided by publisher
