    Abstract: The European Tort Law Yearbook provides a comprehensive overview of the latest developments in tort law in Europe. It contains reports on most EU Member States, including the new Member States the Czech Republic, Estonia, Hungary, Latvia, Lithuania, Poland, Slovakia and Slovenia. Furthermore, the Yearbook provides contributions from Norway and Switzerland, an overview of the developments in the field of EU law as well as a paper on Romanian tort law. In conclusion, a comparative summary reviews the essential aspects of all reports, which are written by scholars from the respective jurisdictions. Focusing on the year 2006, the authors critically report on important court decisions, present new legislation and provide a literature overview. In addition to the national reports, several essays on key topics in the field of tort law are included, most of which focus on questions of wrongful death.

    Abstract: This publication deals with the European dimension of tort law. It provides a critical analysis of the acquis communautaire, asking if and to what extent the provisions and case law in the field of tort law are based on a conclusive system and are in accord with the national legal systems. It thus evaluates whether the acquis communautaire form the beginning of a comprehensive and coherent EC tort law or if the single directives and regulations are contradictory and lack a general concept that is yet to be found. To gain an overview of 'EC Tort Law' certain provisions and decisions were analysed by a group of authors under thirteen elements that form the basis of tort law e.g. fault/strict liability, causation, damage, damages and limitation of actions. An analysis of these aspects was then undertaken by another group of authors each focusing on their respective legal families within the European Union. The publication also contains a section on terminological issues in EC tort law.

    Abstract: Inspired by developments mirroring shifts in the legal basis for compensating damage from civil law to public funding and vice versa, this book examines the developments in compensation systems for damage arising from work-related injuries and diseases. The shifts which have occurred in this area in Germany, England, Belgium and the Netherlands are the subject of this volume. The shifts in the legal doctrine, legislation and the case law of these countries will first be mapped from a historical and comparative perspective, with the aim of discovering the precise nature of the given shifts. Subsequently the shifts will be analysed and explained on the basis of the legal history so as to comprehend the reasons behind the shifts. Finally, the effects of the shifts will be examined. Did the shifts have the desired effects or did other, perhaps unexpected, effects arise and if so why and in what form?     Abstract: This volume examines the shifts in the compensation of environmental damage between private and public systems. Recent developments at both the European and international level are presented with a focus on the shifts relating to the compensation of oil pollution, damage arising as a result of nuclear accidents and soil pollution in particular legal systems (Belgium, the Netherlands, Germany and the U.S.A.). Attention is also paid to shifts between various levels of government as far as compensation for environmental damage is concerned. The authors discuss the nature of the particular shift and examine whether the shift is always from private law to public funding. The reasons for the introduction of the shifts and their effects are also examined as well as the consequences of the various shifts in the oil pollution regime from an economic perspective. New developments, such as the shift towards voluntary compensation schemes and environmental damage insurance, are presented and critically discussed.

    Abstract: This is the first comprehensive account of the modern international law of treaty interpretation expressed in 1969 Vienna Convention, Articles 31-33. As stated by the anonymous referee, it is the most theoretically advanced and analytically refined work yet accomplished on this topic. The style of writing is clear and concise, and the organisation of the book meets the demands of scholars and practitioners alike.
    Abstract: In the practice of modern international law, disputes as to the meaning of specific treaty provisions are a frequent occurrence. It is the assumption underlying any such dispute that in a process of interpretation a distinction has to be made between the legally correct and incorrect interpretation result. The legal correctness of an interpretation result is determined by reference to the relevant international law, as reflected in the 1969 Vienna Convention on the Law of Treaties (VCLT), Articles 31-33. The result of an interpretation process is correct when it can be successfully defended as being in accordance with the provisions of VCLT Articles 31-33. The result is incorrect when it cannot be so defended. Traditionally, the substance of Articles 31-33 has been described by reference to the various means of interpretation enumerated in said provisions, and little more than that. As argued in this book, more detail is required. On closer inspection, not only does the Vienna Convention provide information on the interpretation data (or means of interpretation) to be used by appliers when interpreting a treaty provision. It also instructs the appliers how, by using each datum, they shall argue to arrive at a conclusion about the meaning of the interpreted provision, and, to some extent, it determines the weight that different data of interpretation shall be afforded when appliers discover that, depending on the specific datum they bring to bear on the interpretation process, the conclusion arrived at will be different. Hence, the regime laid down in VCLT Articles 31-33 will have to be described as a system of rules. This book investigates the contents and structure of this system. By importing knowledge from linguistics, and pragmatics in particular, a model is established giving representation to the concept of a rule of interpretation. Drawing on this model, the book then proceeds to reconstruct the contents of the various rules of interpretation. To facilitate reference, the conclusions suggest a list of 44 rules, all of which can be invoked by appliers citing VCLT Articles 31-33.

    Abstract: "The accession of eight post-communist countries of Central and Eastern Europe (and also of Malta and Cyprus) to the European Union in 2004 has been heralded as perhaps the most important development in the history of European integration so far. While the impact of the enlargement on the constitutional structures and practices of the EU has already generated a rich scholarly literature, the influence of the accession on constitutionalism, democracy, human rights and the rule of law among the new member states has been largely ignored. This book fills this gap, and addresses the question of the consequences of the ""external force"" of European enlargement upon the understanding and practice of democracy and the rule of law and among both the main legal-political actors and the general public in the new member-states. A number of leading legal scholars, sociologists and political scientists, both from Central and Eastern Europe and from outside, address these issues in a systematic and critical way.     Abstract: Challenging the conventional wisdom that constitutional courts are the best device that democratic systems have for the protection of individual rights, Wojciech Sadurski examines carefully the most recent wave of activist constitutional courts: those that have emerged after the fall of communism in Central and Eastern Europe. In contrast to most other analysts and scholars he does not take for granted that they are a "force for the good", but rather subjects them to critical scrutiny against the background of a wide-ranging comparative and theoretical analysis of constitutional judicial review in the modern world. He shows that, in the region of Central and Eastern Europe, their record in protecting constitutional rights has been mixed, and their impact upon the vibrancy of democratic participation and public discourse about controversial issues often negative. Sadurski urges us to reconsider the frequently unthinking enthusiasm for the imposition of judicial limits upon constitutional democracy. In the end, his reflections go to the very heart of the fundamental dilemma of constitutionalism and political theory: how best to find the balance between constitutionalism and democracy? The lively, if imperfect, democracies in Central and Eastern Europe provide a fascinating terrain for raising this question, and testing traditional answers.
