The LGBTQ community in America comprises approximately 3.4 percent of the US population, or roughly 9 million citizens. Regardless of the size of the population, this book argues, all US citizens deserve the same rights granted under the US constitution - i.e. in addition to marriage equality, LGBTQ citizens deserve equal protection in employment, housing, medical decisions, military service, and adoption - to name but a few. Using social equity theory and intersectionality but written in an accessible style, this book demonstrates some of the ways in which LGBTQ citizens have been marginalized for their identity, and argues that the field of public administration has a unique responsibility to prioritize social equity. Discrete categories utilized by the US Census Bureau (male or female, heterosexual or homosexual), for example, must shift to a continuum to accurately capture demographic characteristics and citizen behavior. Evidenced based outcomes and disparities between heterosexual and LGBTQ populations are carefully delineated to provide a legal rationale for a compelling governmental interest, and policy recommendations are provided - including overdue federal legislation to prohibit discrimination based on sexual orientation. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse.     Abstract: "Colonial rule distorts a colony's economy and its society, and British rule was no exception. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it. Thanks to the rule of law - another important British legacy -- the U.S. is much farther along than many former colonies in making progress. By highlighting the history of the interplay of two fundamental concepts, the divided society and the rule of law, and briefly contrasting the experiences of other former colonies, this book shows how the United States has made significant long-term progress, although incomplete, and ways for this to continue today"--

    Abstract: "In light of the growing climate crisis, the "sustainable city" has emerged as one of the key goals of both environmentalism and urbanism. Because the city is so central to economic development and greenhouse gas emissions, and because an ever-growing majority of the world's population now lives in cities, the question of how to make cities more sustainable and resilient in the face of climate change has become ever more urgent. The climate crisis thus poses a corresponding crisis of democracy, as cities rely on an array of civic associations, grassroots movements, democratic processes, and institutional systems to advance environmental justice. Sustainable Cities in American Democracy explores the history of these efforts to transform cities in the United States since World War II (1946-2016). Drawing on work in sociology, urban planning, public policy, and democratic theory, Carmen Sirianni examines how civic and professional associations, such as the League of Women Voters and the Natural Resources Defense Council, developed an institutional field of sustainable cities over a seventy-year period through battles over clean water, clean air, and land use. Over time these efforts resulted in new networks and associations that promoted smart growth, new urbanism, and community engagement. But despite this progress, the work of sustainability, like that of democracy, remains decidedly incomplete, as patterns of unequal power and unjust practices continue.     Abstract: In der rechtsvergleichenden Studie arbeitet der amerikanische Historiker heraus, in welch starkem Umfang die rassistischen Gesetze des NS-Staates durch die Einwanderungsgesetzgebung der USA und die rassistischen Gesetze der US-Südstaaten beeinflusst wurden. Rezension: Mit dieser sehr gut lesbaren, sorgfältig gearbeiteten rechtsvergleichenden Spezialstudie liefert der amerikanische Rechtshistoriker eine kleine Sensation. In einer sehr differenzierten Argumentation arbeitet Whitman heraus, dass die Rassengesetzgebung des NS-Staats in erheblicher Weise durch amerikanische Vorbilder, die auch einem Zeitgeist entsprachen, beeinflusst wurde. Die gegen die schwarze Bevölkerung gerichtete Gesetzgebung der US-Südstaaten wurde von massgeblichen NS-Juristen ebenso aufmerksam studiert wie die diskriminierenden Einwanderungsgesetze, die besonders Ost- und Südeuropäer betrafen. Whitman, der sein möglicherweise überraschtes (amerikanisches) Publikum immer wieder direkt anspricht, zieht Parallelen und zeigt Verbindungslinien auf, arbeitet jedoch auch deutlich die Unterschiede heraus: In den USA mündeten die rassistischen Gesetze eben nicht in einen Genozid und der liberale Rechtsstaat setzte ihnen Grenzen.     Abstract: Hardly known twenty years ago, exclusion from public space has today become a standard tool of state intervention. Every year, tens of thousands of homeless individuals, drug addicts, teenagers, protesters and others are banned from parts of public space. The rise of exclusion measures is characteristic of two broader developments that have profoundly transformed public space in recent years: the privatisation of public space, and its increased control in the 'security society'. Despite the fundamental problems it raises, exclusion from public space has received hardly any attention from legal scholars. This book addresses this gap and comprehensively explores the implications that this new form of intervention has for the constitutional essentials of liberal democracy: the rule of law, fundamental rights, and democracy. To do so, it analyses legal developments in three liberal democracies that have been at the forefront of promoting exclusion measures: the United Kingdom, the United States, and Switzerland.

    Abstract: In recent decades, religion's traditional distinctiveness under the First Amendment has been challenged by courts and scholars. As America grows more secular and as religious and nonreligious convictions are increasingly seen as interchangeable, many have questioned whether special treatment is still fair. In its recent decisions, the Supreme Court has made clear that religion will continue to be treated differently, but we lack a persuasive account of religion's uniqueness that can justify this difference. This book aims to develop such an account. Drawing on founding era thought illumined by theology, philosophy of religion, and comparative religion, it describes what is at stake in our tradition of religious freedom in a way that can be appreciated by the religious and nonreligious alike. From this account, it develops a new framework for religion clause decision making and explains the implications of this framework for current controversies regarding protections for religious conscience

    Abstract: Um das westliche Bündnis im Ost-West-Konflikt nach innen zu stabilisieren, setzten die USA auf auswärtige Kultur- und Informationspolitik. In der Bundesrepublik wandten sich etwa 20 Amerikahäuser und Deutsch-Amerikanische Institute an die westdeutsche Bevölkerung, um Sympathien für die Politik und die Werte der USA zu erzeugen. Sie waren jedoch nicht nur Mittler im amerikanischen Auftrag, sondern durch vielfältige Beziehungen fest in der westdeutschen Kulturlandschaft verankert. In der Öffentlichkeit standen sie als symbolische Orte für "Amerika" – im positiven wie im negativen Sinne. Reinhild Kreis analysiert die Strukturen, Zielvorgaben und das Instrumentarium der amerikanischen Kultur- und Informationspolitik in der Bundesrepublik, Themenkarrieren und -konjunkturen sowie die Amerikahäuser und DAI in ihren lokalen Beziehungsgefügen. An der Schnittstelle von USA und Bundesrepublik, Außen- und Kulturpolitik, Regierung und Öffentlichkeit zeigt die Untersuchung der Amerikahäuser und Deutsch-Amerikanischen Institute die Gestaltung, Dynamiken und Spannungen der transatlantischen Beziehungen seit den 1960er Jahren unterhalb der diplomatischen Ebene.

    Abstract: Hauptbeschreibung Die Autorin befasst sich mit zur Kriminalprävention eingesetzten polizeilichen Videoüberwachungen an öffentlich zugänglichen Orten. Sie vergleicht die praktische Anwendung und rechtliche Problematik dieser zunehmend eingesetzten Maßnahme in Deutschland und in den USA. Ziel dabei ist es, Parallelen und Unterschiede aufzuzeigen und durch den Rechtsvergleich neue Aspekte für die rechtliche Beurteilung solcher Videoüberwachungen in Deutschland, auf der der Schwerpunkt der Untersuchung liegt, zu gewinnen. Beleuchtet werden zunächst u. a. die Entwicklung der Videoüberwachung im öffentlichen Raum in Deutschland und in den USA sowie Gründe für deren zunehmende Anwendung. Die Erörterung der rechtlichen Problematik hat die Darstellung des verfassungsrechtlichen Privatsphären- und Persönlichkeitsschutzes in Deutschland und in den USA zum Ausgangspunkt. Eingehend erläutert und verglichen werden die unterschiedlichen Ansätze zur verfassungsrechtlichen Bewertung von Videoüberwachungen in den beiden Ländern, und es werden die ersten Ansätze einer Normierung in den USA vorgestellt. Die durch die einzelnen deutschen Bundesländer geschaffenen Ermächtigungsnormen werden genauer betrachtet und auf ihre Verfassungsmäßigkeit hin untersucht. Hier wird zum einen der Frage der Gesetzgebungskompetenz betreffend der Videoüberwachung als doppelfunktionaler Polizeimaßnahme (insbesondere dem umstrittenen Problem der Gesetzgebungskompetenz im Rahmen der Strafverfolgungsvorsorge) nachgegangen. Wegsperren als Lösung sozialer Probleme? Dieses Buch liefert einen wichtigen Beitrag zur Analyse von Staat und Gesellschaft im Zeitalter des neoliberalen Siegeszugs.     Abstract: In the early twentieth century, America was transformed from a predominantly agricultural nation to one whose population resided mostly in cities. Yet rural areas continued to hold favored status in the country's political life. For prominent figures in the social sciences, city planning, and real estate who were anxious about the future of cities, this obsession with the agrarian past inspired a new campaign for urban reform. They called for ongoing programs of natural resource management to be extended to maintain and improve cities. The author finds in the rise and fall of the American conservation movement a new understanding of the history of urban renewal in the United States. The professionals she examines came to view America's urban landscapes as ecological communities requiring scientific management on par with forests and farms.
