    Abstract: "Custom was fundamental to medieval legal practice. Whether in a property dispute or a trial for murder, the aggrieved and accused would go to lay court where cases were resolved according to custom. What custom meant, however, went through a radical shift in the medieval period. Between the twelfth and thirteenth centuries, custom went from being a largely oral and performed practice to one that was also conceptualized in writing. Based on French lawbooks known as coutumiers, Ada Maria Kuskowski traces the repercussions this transformation - in the form of custom from unwritten to written and in the language of law from elite Latin to common vernacular - had on the cultural world of law. Vernacular Law offers a new understanding of the formation of a new field of knowledge: authors combined ideas, experience and critical thought to write lawbooks that made disparate customs into the field known as customary law"--

    Abstract: In an increasingly complex world, it is more crucial than ever to have a full picture of how international peacekeeping can be a force for good, but can also have potentially negative impacts on host communities. After thirteen years of presence in Haiti, the highly controversial United Nations Stabilization Mission in Haiti has now withdrawn. The UN's legacy in Haiti is not all negative, but it does include sexual scandals, the divisive use of force to 'clean up' difficult neighbourhoods as well as a cholera epidemic, brought inadvertently by Nepalese peacekeepers that killed more than 8,000 Haitians and infected more than 600,000. This book presents a unique multi-disciplinary analysis of the legacy of the mission for Haiti. It presents an innovative account of contemporary international peacekeeping law and practice, arguing for a new model of accountability, going beyond the outdated immunity mechanisms to foreground human rights.

    Abstract: "This book concerns a set of problems that arise from the distinctive conceptual and practical tension in the first period after a new constitution has been adopted. We shall argue that at a very general level, a new constitution must manage a balance or tension between two forces.     Abstract: To what extent are global rule-of-law norms, which external actors promote in post-conflict states, localized? Who decides whether global standards or local particularities prevail? This book offers a new approach to the debate about how the dilemma between the diffusion of global norms and their localization is dealt with in global politics. Studying the promotion of children's rights, access to public information, and an international commission against impunity in Guatemala, Lisbeth Zimmermann demonstrates that rule-of-law promotion triggers domestic contestation and thereby changes the approach taken by external actors, and ultimately the manner in which global norms are translated. However, the leeway in local translation is determined by the precision of global norms. Based on an innovative theoretical approach and an in-depth study of rule-of-law translation, Zimmermann argues for a shift in norm promotion from context sensitivity to democratic appropriation, speaking to scholars of international relations, peacebuilding, democratization studies, international law, and political theory.

    Abstract: Local Space, Global Life engages with the expansive, ground-level and intertwined operations of international law and the development project by discussing the current international focus on local jurisdictions. Since the mid-1980s, and through the discourse of decentralization, municipalities and cities in emerging nations have become the preferred spaces in which to promote global ideals of human, economic and environmental development. Through an ethnographic study of Bogotá's recent development experience and the city's changing relation to its illegal neighbourhoods, Luis Eslava interrogates this rationale and exposes the contradictions involved in the international turn to the local. Attentive to historical and current transformations, norms and praxis, and both ideology and materiality, he provides an innovative reading of the nature of international law and the development project, and reveals their impact on local spaces and lives at the urban periphery of today's world order.

    Abstract: The standard approach to regulating working hours rests on gendered assumptions about how paid and unpaid work ought to be divided. In this book, Ania Zbyszewska takes a feminist, socio-legal approach to evaluate whether the contemporary European working time regimes can support a more equal sharing of this work. Focusing on the legal and political developments surrounding the EU's Working Time Directive and the reforms of Poland's Labour Code, Zbyszewska reveals that both regimes retain this traditional gender bias, and suggests the reasons for its persistence. She employs a wide range of data sources and uses the Polish case to assess the EU influence over national policy discourse and regulation, with the broader transnational policy trends also considered. This book combines legal analysis with social and political science concepts to highlight law's constitutive role and relational dimensions, and to reflect on the relationship between discursive politics and legal action.

This textbook looks at how human rights are constructed at local, national, international and transnational levels and considers commonalities and differences around the world. Through discussions of key debates in the interdisciplinary study of human rights, the book develops its themes by considering examples of human rights advocacy in international organisations, national states and local grassroots movements.     Abstract: The concept of toleration plays a central role in pluralistic societies. It designates a stance which permits conflicts over beliefs and practices to persist while at the same time defusing them, because it is based on reasons for coexistence in conflict - that is, in continuing dissension. A critical examination of the concept makes clear, however, that its content and evaluation are profoundly contested matters and thus that the concept itself stands in conflict. For some, toleration was and is an expression of mutual respect in spite of far-reaching differences, for others, a condescending, potentially repressive attitude and practice. Rainer Forst analyses these conflicts by reconstructing the philosophical and political discourse of toleration since antiquity. He demonstrates the diversity of the justifications and practices of toleration from the Stoics and early Christians to the present day and develops a systematic theory which he tests in discussions of contemporary conflicts over toleration.

    Abstract: Whether we are black, gay, Republican, women, or deaf, our associations - whether voluntary or assigned - constitute crucial and inescapable elements of our identities. Both voluntary and involuntary groups have been important in American history - more important than is generally recognized. But these groups have never been adequately addressed by law, which has as its primary focus the relationship between the individual and the state. The company we keep, says constitutional law scholar Aviam Soifer, is presumed to be each person's own business, and generally beyond notice of the law. But as America becomes a more varied country and issues arising out of multiculturalism threaten to divide us, it becomes essential, Soifer argues, to recognize rights under the First Amendment that will protect the crucial roles of groups and communities within the larger national community

    Abstract: The difference between French and German definitions of citizenship is instructive - and, for millions of immigrants from North Africa, Turkey, and Eastern Europe, decisive. Brubaker explores this difference - between the territorial basis of the French citizenry and the German emphasis on blood descent - and shows how it translates into rights and restrictions for millions of would-be French and German citizens. Why French citizenship is territorially inclusive, and German citizenship ethnically exclusive, becomes clear in Brubaker's historical account of distinctive French and German paths to nation-statehood. Two fundamental legal principles of national citizenship emerge from this analysis, leading Brubaker to broad and original observations on the constitution of the modern state

    Abstract: This book is a 1990 account of the ways in which young Aborigines were at a disadvantage before laws and legislation had been introduced, intended to improve their position. Aboriginal Youth and the Criminal Justice System focuses on South Australia, where detailed statistics are available, in a sophisticated analysis of the exact nature of the discrimination experienced by young Aborigines. Fay Gale, Rebecca Bailey-Harris and Joy Wundersitz examine the criminal justice system in operation; from the initial intervention by a police officer, through the process of screening and assessment to the final outcome - which all too often is a criminal record. The research clearly shows that at every point where discretion was exercised within this system, Aboriginal youths received the harsher option. Thus disadvantage is heaped on disadvantage until young Aboriginals were imprisoned at 23 times the rate of other young Australians. Even for those who escaped detention, participation in the criminal justice system was often such an ordeal that it became a form of punishment in itself. Discretion, though preferable to inflexible rules could operate against a group whose lifestyle and values differed from mainstream society.
