Die Fragestellung war, ob ein Pauschalvergütungsansatz auf Breitbandanschlüsse ein Baustein für ein gerechteres, modernes Urheberrecht, für angemessene Vergütung für die UrheberInnen und einen gesellschaftlichen Interessensausgleich sein kann. Das umfassende und detailreiche Gutachten leistet einen wesentlichen Beitrag zur Diskussion um die Zukunft des Urheberrechts, die in Zeiten des globalen Internets in praktisch jedem Land geführt wird. Es wird vollumfänglich der Öffentlichkeit zugänglich gemacht, damit die Ergebnisse von allen Interessierten genutzt und weiterentwickelt werden können. Prof. Spindler zeigt in seinem Gutachten auf, dass ein Pauschalvergütungsansatz verfassungsrechtlich zulässig und ein attraktives Modell zur angemessenen Vergütung für Kreative sein kann. Für die Situation der NutzerInnen bietet er eine geeignete Alternative zu repressiven und gesellschaftlich höchst konfliktträchtigen Formen der Rechtsdurchsetzung. Gleichzeitig wird aber auch auf gewichtige Schwierigkeiten und Hürden bei der Umsetzung eines solchen Modells hingewiesen.     Abstract: The Internet and the proceeding digitalisation of content - such as music, videos and written texts - have led to profound and complex challenges in the field of Copyright Law, especially with regard to questions of enforcement as well as adequate compensation of right holders. In recent years, several alternative compensation schemes have been proposed, seeking to solve these issues. In Germany, the discussion still focuses on the so-called "cultural flatrate", that is, in a nutshell, a limitation to copyrights which would legalize sharing of content online. Every holder of a broadband connection to the Internet would have to pay a monthly fee which would be used to remunerate the right holders.This advisory opinion was compiled on behalf of the parliamentary group of the German political party "Bündnis 90/DIE GRÜNEN". The author comprehensively analyses the feasibility of the described alternative compensation scheme under German and European law, discussing both legal and economic obstacles and possible impacts based on a variety of different economic prerequisites

    Abstract: This text about the ambivalence of fieldwork, rituals, actors, and stories thematizes the relationship between the researcher and his informants and interlocutors (usually also the performers of a cultural practice), and it reveals dynamic processes at the same time. In the chapter "Texts and Realities" the author uses the carnival tradition known as škoromatija to decode a palimpsest structure and syncretic understanding of reality. The second chapter focuses on the production of local identity: a motif that is characteristic for today's production of ritual practices and cultural heritage. The chapter "Illusions of Harmony" thematizes discourse on the relationship between the views and conceptions of the researcher and performer, whereby the author especially problematizes the search for and repeated discovery of golden eras. "The Timing of Verbalization" is a narrative about time as one of the most important categories of structuring a narrative. V poglavju Besedila in resničnosti avtor na primeru pustovanja (škoromatije) razbira palimpsestne strukture in sinkretično dojemanje resničnosti. V drugem poglavju se osredotoča na produkcijo lokalne identitete~motiv, značilen za današnjo produkcijo ritualnih praks in kulturne dediščine.     Abstract: The monograph presents different names of Piran Bay (Slo. Piranski zaliv) over time. Despite the leading onomastic topic, the publication is designed as a regional-geographic review of Piran Bay and its hinterland, where all the main physical- and socio-geographical characteristics are presented. This book describes the basic hydro-geographic characteristics of Piran Bay as a part of Gulf of Trieste and the Adriatic Sea. The monograph talks about the historical development, salt making in Sečovlje salt pans and the circumstances that led to the now more than two decades-long border dispute between Slovenia and Croatia. A significant chapter is dedicated to the presentation of the different naming of the Bay of Piran through time. According to the chronological order, 104 different cartographic sources present the name changes of the Piran Bay through time and when a certain specific geographic name appeared. Based on media analysis, one of the chapters describes the relation between the names Savudrijska vala or Savudrijski zaljev (Savudrija Bay) and Piranski zaliv or Piranski zaljev (Piran Bay)
    Abstract: Monografija predstavlja različna poimenovanja Piranskega zaliva skozi čas. Kljub vodilni imenoslovni tematiki je publikacija zasnovana tudi kot regionalnogeografski prikaz Piranskega zaliva in njegovega zaledja, pri čemer so predstavljene tako poglavitne naravnogeografske kot družbenogeografske značilnosti. Posebej so izpostavljene temeljne hidrogeografske poteze Piranskega zaliva kot dela Tržaškega zaliva in Jadranskega morja. Precejšen poudarek je namenjen zgodovinskemu razvoju, pri čemer je izpostavljeno solinarstvo s Sečoveljskimi solinami. Podrobneje so osvetljene tudi okoliščine, ki so privedle do zdaj že več kot dve desetletji trajajočega mejnega spora med Slovenijo in Hrvaško.     Abstract: Iz vremskih in kozinskih plasti so predvsem iz paleoekološkega in deloma iz biostratigrafskega stališča raziskani štirje profili iz neposredne okolice Škocjanskih jam. Namen raziskave je bil proučevanje okolja sedimentacije plasti z giroplevrami v vremskih plasteh in tistega dela kozinskih plasti, kjer se pojavljajo haraceje in polži. Školjke iz rodu Gyropleura, Apricardia in morda še druge školjke so v apnencih vremskih plasti na drugotnem mestu~školjke so živele v plitvi vodi nedaleč od obale, na drugotno mesto so jih prinesli valovi in tokovi~odsotnost rapidionin v horizontih z giroplevrami potrjuje trditev, da so bile lupine nametane proti obali, saj so rapidionine živele v izrazito lagunskem okolju. Na plitvo okolje sedimentacije kažejo tudi laminiti~pri haracejah iz kozinskih plasti imamo primere flore na mestu in primere presedimentiranih delov haracej (oogonijev)~oogonije so vodni tokovi prenašali proti globljim delom sedimentacijskega bazena. Skupaj z nepresedimentiranimi haracejami se pogosto pojavljajo tudi polži, s kemično analizo kisikovih in ogljikovih izotopov v vzorcih pa je bil ugotovljen večkraten vpliv sladke vode na morsko okolje

    Abstract: The Triglav Glacier lies on the southeast edge of the Alps, in the Julian Alps below Mount Triglav, Slovenia's highest peak. Its upper edge lies at 2,500 m. The glacier has been regularly measured, observed, and studied since 1946 by the Anton Melik Geographical Institute at ZRC SAZU. When measurements began it covered 14.4 ha, but today it covers less than half a hectare. The glacier no longer has all glacial features. Thus one may only speak of a glacier because of its past, when it clearly had the basic features of an alpine glacier. Analysis of the geomorphic forms of the Triglav Mountains allows reconstruction of past glaciation. Moraine deposits above the upper edge of Mount Triglav's North Wall indicate the glacier's extent during the Little Ice Age. When this ended in the nineteenth century, visits to the Triglav Mountains started increasing, and so there are many written and pictorial sources available from this time
    Abstract: Triglavski ledenik od leta 1946 redno merijo, opazujejo in preučujejo sodelavci Geografskega inštituta Antona Melika ZRC SAZU. Na začetku meritev je bila njegova površina 14,4 ha, do danes pa se je skrčil na slabo polovico hektarja. Zdaj ledenik nima več vseh ledeniških značilnosti. O ledeniku lahko govorimo le še zaradi njegove preteklosti, na osnovi analize geomorfnih oblik Triglavskega pogorja ter pisnih in slikovnih virov iz 19.in 20. stoletja. Obdobje meritev z vidika kolebanja ledenika kronološko delimo na štiri dele. Prva leta do leta 1964 je zaznamovalo krčenje ledenika. Leta 1952 je bil ledenik prvič geodetsko izmerjen. Na podlagi teh meritev smo lahko izračunali tudi prostornino ledenika. Drugo obdobje od leta 1965 do leta 1982 je zaznamovala stagnacija v krčenju ledenika.     Abstract: Monografija obravnava interpretacijo okolja, ki je eden od najbolj učinkovitih, a hkrati zahtevnih in kompleksnih procesov informiranja ter ozaveščanja obiskovalcev in lokalnih prebivalcev na (za)varovanih območjih. Na primeru Ljubljanskega barja smo z različnih vidikov osvetlili odnos med človekom in naravo ter predstavili možen pristop interpretacije te kulturne pokrajine, ki je bila leta 2008 zavarovana kot Krajinski park Ljubljansko barje. S podrobnejšo analizo smo na primeru porečja Iške prikazali, kako lahko z več različnimi interpretacijskimi orodji ponudimo interpretacijo okolja tako realnim kot virtualnim obiskovalcem različnih starostnih skupin.     Abstract: The scientific monograph Rudolf Badjura - Life and Work was co-written by eleven experts from different fields, which shows that Rudolf Badjura was an extremely versatile person. He was born on 17th April 1881 in Litija. Between 1903 and 1905, after graduating from secondary school in Ljubljana, he performed military service in the infantry regiment of that time. In 1905 he attended a secondary school leaving examination course at the German trade academy in Prague, where he also joined the local mountaineering group. On his return to Ljubljana, he was first employed at the farmers' savings bank ("Kmetijska posojilnica"), and he later worked in the accountancy department of the wood dealer Hieng. Until his retirement, he was employed at the Carniola regional council. His work formed an integral part of his life, especially with regard to skiing and leisure activities in nature. In addition, he wrote tourist guides and collected folk terminology and geographical names, with particular focus on Slovene culture. Badjura's life was also heavily influenced by the first world war and his military career. His bibliographic opus consists of more than 60 units
    Abstract: Znanstvena monografija Rudolf Badjura - življenje in delo je plod soavtorstva enajstih strokovnjakov različnih področij. To kaže, da je bil Rudolf Badjura zelo vsestranska osebnost. Rodil se je 17. aprila 1881 v Litiji. Po maturi v Ljubljani je pri takratnem 27. pešpolku v letih 1903-1905 služil vojaški rok. Leta 1905 je v Pragi, kjer se je vključil tudi med tamkajšnje planince, na nemški trgovski akademiji obiskoval abiturientski tečaj. Po vrnitvi v Ljubljano se je najprej zaposlil v Kmetijski posojilnici, sledila je računovodska služba pri lesnem trgovcu Hiengu, pozneje pa se je zaposlil pri Kranjskem deželnem odboru, kjer je delal do upokojitve. Njegovo delo in življenje sta bila tesno povezana predvsem s smučanjem, preživljanjem prostega časa v naravi, pisanjem turističnih vodnikov, zbiranjem ljudskega izrazja in imen ter s skrbjo za slovenstvo. Pomemben pečat pa je Badjurovemu življenju vtisnila tudi prva svetovna vojna in njegova vojaška kariera. Njegov bibliografski opus šteje preko 60 enot

Vodnik zaključuje prispevek o obnovi furlanskih naselij po uničujočih potresih v letu 1976, ki so vzeli skoraj 1000 življenj. Upravljanje ogroženih vodnih virov v urbanih okoljih zahteva celosten pristop in stalne aktivnosti. S pomočjo računalniških orodij znamo sisteme simulirati in tako pridobiti dodatna védenja o njihovem delovanju. Ta so v pomoč pri dolgoročnih odločitvah ali na primer ob okoljskih nesrečah.     Abstract: Research represent in this monograph (Incomplete Solution Of Carbonate Rocks In Karst Caves Of Slovenia) was dedicated to incomplete solution of limestones and dolomites in karst caves~that is to occurrence of thick, soft weathered zones of "soluble" residue of carbonate rocks. With field and laboratory analyses I have tried to find out what is happening within the carbonate rocks during weathering and why they do not dissolve completely. Solution penetrates into the rock along various textures and structures. Results of analysis have shown that during weathering limestones and dolomites become purer~Mg, Sr and U are leached out, structure of the rock becomes more porous. In the cases when surface of weathered rock come in contact with flowing water, the water tears exposed particles and transports them away. If water does not flow over the exposed particles fast enough, they remain attached to the wall of the cave. The ratio between corrosion and the mechanical erosion of carbonate rocks on cave passages walls is more significant for the formation of roughness and rocky relief on the wall than for the growth of the passage. Microorganisms are present in the processes, but it is not yet known if they contribute to the weathering. From research follows that zones of white porous rock on cave walls are a product of weathering and are not precipitated secondary minerals
    Abstract: Raziskave, predstavljene v monografiji, so bile posvečene nepopolnemu raztapljanju apnencev in dolomitov v kraških jamah~to je pojavljanju debelih, mehkih con »topnega« ostanka karbonatnih kamnin. S terenskimi in laboratorijskimi analizami sem skušala spoznati, kaj se dogaja v karbonatnih kamninah med preperevanjem in zakaj se popolnoma ne raztopijo. Raztapljanje prodira v kamnino po različnih strukturah in teksturah. Rezultati analiz so pokazali, da se tako apnenec kot dolomit med preperevanjem čistita~izlužijo se Mg, Sr in U, struktura kamnine pa obenem postaja vedno bolj porozna. V primerih, ko je površina preperele kamnine v stiku s tekočo vodo, voda z njene površine trga izpostavljene delčke in jih odnaša. Če voda ne teče dovolj hitro čez izpostavljene delčke, ostanejo na steni rova. Razmerje med korozijo in mehansko erozijo karbonatne kamnine v steni jamskega rova je bolj pomembno za oblikovanje hrapavosti in različnih skalnih oblik na stenah kot pa za samo rast rova. Mikroorganizmi so prisotni, ne vemo pa še ali sodelujejo pri preperevanju. Iz raziskav sledi, da so cone bele porozne kamnine na jamskih stenah produkt preperevanja in ne izločanja sekundarnih mineralov

    Abstract: The book ('Geography and plant succession. Selected examples from Slovene regions') is dealing with ecological succession which is one of three kinds of changes in vegetation. The other two are regeneration (or the result of necrosis and regrowth of organisms) and fluctuation (or changes in biomass in longer and shorter time cycles-also seasonal changes). Ecological succession or ecological sequence can be understood as a temporal-spatial clarification of the evolutionary development of a community from bare soil to a stable community which is balanced with its environment. The book is divided in two parts. In the first part, succession is presented on a theoretical basis. The development of the concept of succession through history, its mechanisms and processes carried on in it are clarified. Different types of succession as well as pioneer species and climax societies as the starting and final point of the process under consideration are described. In separated chapters, invasive species and soils as well as their role in succession are discussed. In the second part, individual selected environments (gravel pits in rivers, screes, rockfall areas, fire areas and construction pits) where the two major types of succession are prevailing are presented

    Abstract: V knjigi so predstavljeni taksonomija in sistematika čebel (Anthophila) in njihova biologija: zbiranje in prenašanje hrane, vedenje izbirčnih čebel, ki so vezane na določene hranilne rastline, načini gnezdenja, kukavičje čebele, ki odlagajo jajčeca v gnezda drugih vrst, vedenje in prilagoditve samcev. V poglavju o raznovrstnosti divjih čebel so opisane spremembe v slovenski favni. Po avtorjevem mnenju so predvsem posledica sprememb podnebja in izjemnih vremenskih razmer. Večji del knjige obravnava družbeno življenje čebel, predvsem prvotnejše socialne oblike, ki nam olajšujejo razumevanje razvoja družbenih skupnosti. V poglavju Poti in stranpoti evolucije avtor opisuje dolgoročno prednost vrst z družbenimi ali simbiontskimi povezavami pred vrstami, pri katerih se zaradi prevlade najmočnejših in največjih osebkov v medsebojnem boju povečuje velikost osebkov in zmanjšuje njihovo število.     Abstract: Snow season 2012/13 in SloveniaSlovenia is also among the countries which are endangered by avalanches. They cause on a yearly average 1-2 victims, mainly in the highlands. Once, the victims were mostly locals, but within the last decades, it is now predominantly mountaineers. To avoid avalanche accidents, prevention measurements are very important. Their consistent part is also the flashback of each snow season. Since there is no avalanche service in Slovenia - its annual task is also the preparation of such an overview, we decided do it within the frame of a project NH-WF/Natural Hazards without Frontiers. In this, between years 2012 and 2014, we regularly prepared and published an experimental local avalanche bulletin for Middle Karavanks (northern Slovenia). Along with the work on this bulletin, we realized, how important cooperation is between the different stakeholders within the field of avalanche protection. This edition is the first complete overview of avalanche events and incidents in the snow season - from a weather review, through all the overall characteristics of snow seasons and avalanche events, as well as a methodically unified analysis of all fatal incidents. We added, at the end, a reflection about the season, made by an avalanche practitioner and a short presentation of a NH-WF project
    Abstract: Slovenija je tudi med tistimi državami, ki jih ogrožajo snežni plazovi. V povprečju povzročijo plazovi 1-2 žrtvi na snežno sezono, večinoma v vzpetih pokrajinah, zlasti visokogorskih. Če so bili nekdaj med žrtvami domačini, pa so v zadnjih desetletjih med njimi predvsem obiskovalci gora. Za preprečevanje lavinskih nesreč je zato izjemnega pomena preventiva, katere sestavni del sta tudi pregled vsakokratne sezone. Ker pri nas ni lavinske službe, katere vsakoletna temeljna naloga je tudi priprava takšnega poročila, smo se za to odločili v okviru projekta NH‑WF/Naravne nesreče brez meja. Tu smo med letoma 2012-14 med drugim pripravljali in objavljali tudi poskusni krajevni lavinski bilten za Srednje Karavanke. Ob tem smo spoznali, kako pomembno je sodelovanje deležnikov, ki se ukvarjajo s problematiko varstva in zaščite pred snežnimi plazovi. Publikacija predstavlja prvi celoviti pregled snežne sezone - od sezonskega pregleda vremena, prek splošnih značilnosti snežne sezone in lavinskih dogodkov ter metodološko poenotene analize vseh usodnih nesreč. Na koncu smo dodali še razmišljanje lavinskega praktika po sezoni 2012/13 in kratko predstavitev projekta NH-WF

    Abstract: This volume analyzes two natural landscape typologies of Slovenia using quantitative methods and data layers. Based on two existing manually outlined typologies, several modeled natural landscape typologies were then produced using selected data layers and different geo-information tools. The main part of the analysis is focused on studying the compatibility of the modeled and original natural landscape typologies and on how successfully the original typologies can be reproduced using numerical models. By comparing the models and originals, it was also possible to establish the locations of the types that have been classified (confirmed) the same by different methods and those that have not been confirmed by any model. In conclusion, the volume presents findings on the use of GIS for identifying natural landscape types in Slovenia and proposes specific procedures for classifying Slovenia or other areas into natural landscape types and procedures for their evaluation. This volume also presents examples of various regionalizations and typologies, and lists available digital data layers and geo-information tools that can be used to make various typologies
    Abstract: V monografiji je predstavljena analiza dveh obstoječih naravnopokrajinskih tipizacij Slovenije z različnimi kvantitativnimi metodami in podatkovnimi sloji. V praktičnem delu raziskave smo s štirimi podatkovnimi sloji in različnimi geoinformacijskimi orodji na podlagi dveh obstoječih, ročno začrtanih tipizacij izdelali več modeliranih naravnopokrajinskih tipizacij. Osrednji del analize je namreč osredotočen na preučevanje usklajenosti modeliranih in izvirnih naravnopokrajinskih tipizacij oziroma na vprašanje, kako uspešno lahko izdelavo izvirnih tipizacij ponovimo s številskimi modeli. S primerjavo modelov in izvirnikov smo ugotovili, kje v Sloveniji so območja posameznih tipov, ki so po različnih metodah klasificirana (potrjena) enako, in kje so območja tipov, ki jih ni potrdil noben model. Na koncu so navedene tudi ugotovitve o uporabi GIS-ov za določanje naravnih pokrajinskih tipov Slovenije ter predlagani postopki tipizacije Slovenije ali drugih območij na naravne pokrajinske tipe in postopki za njihovo vrednotenje.     Abstract: Tako kot biološki genom določa našo biološko pojavnost, kulturni genom določa našo kulturno pojavnost. To je skupek spoznanj o delovanju sveta in iz njih izpeljanih pravil. Ko ljudje ta spoznanja ubesedijo v pripoved, nastane mitična zgodba. Mitična pokrajina je tista oblika kulturne pokrajine, ki so jo ljudje oblikovali v skladu s svojimi mitičnimi predstavami, da bi z njeno pomočjo obvladali sile narave. Avtor iz posameznih struktur besedilnih odlomkov slovanskega folklornega izročila sestavi povezano pripoved v številnih različicah, ki pojasnjuje mehanizem prenavljanja in opisuje ciklične spremembe narave. To pripoved so ljudje uporabljali kot miselni model in ga v prostoru materializirali v prostorske ideograme. Te z nekaj primeri raziskuje naslednji del. Zaključek pridobljena spoznanja primerja z zgodnjesrednjeveškim Zbruškim idolom iz Ukrajine in ugotovi popolno strukturno ujemanje. Zbruški idol kaže prostorsko ureditev vesolja s tremi svetovi, mehanizme nadzora teh svetov in vrstenje naravnih in življenjskih sprememb
