    Abstract: This book is a collection of Nai Xia’s quintessential works on Silk Road studies. A key resource in the field of Silk Road Archaeology, it features in-depth content, a broad range of material, careful textual research, and meticulous analysis. With thorough investigations of foreign coinage, silk textiles, and artifacts with foreign styles excavated in different parts of China, it explores the exchange between ancient China and Central Asia, Western Asia, and Europe. In particular, this book provides detailed descriptions of the economic and cultural ties between ancient China, Pre-Islamic Arabia, the Sasanian Empire, and the Byzantine Empire.     Abstract: The rapid pace of economic development and urbanization in Asia have led to several major problems such as greenhouse gas emissions, mass consumption, and depletion of natural resources. These problems pose a major threat to a sustainable future for Asia and are hindering many Asian countries' goal of becoming carbon-neutral by the middle of this century. Solving these problems requires a comprehensive understanding of the nature of energy consumption, exploitation of natural resources, and deterioration of the environment. To accelerate the green energy transition and promote efficient resource use in Asia, a range of policy options and joint efforts among Asian countries will be required, including carbon pricing, resource tax reform, the expansion of transition finance, support for the development of low-carbon, and resource-efficient social infrastructure. However, Asia is home to many countries, each in a different stage of economic development and with its own culture and customs. Practical implementation of these policies will require bringing together researchers, policymakers, and citizens to share their knowledge and engage in discussions to generate policy ideas that are appropriate for each country. The purpose of this book is to share theoretical and empirical knowledge and convey policy implications that can be expected to accelerate energy transition and resource use effectiveness toward a sustainable future in Asia. .

    Abstract: This book concerns how China's legal institutions promoted its economic growth and demonstrates that the law has played different roles at various stages of China's economic transformation, a signal of legal paradigm shifts in reaction to the changing political and economic pursuits. By decomposing the role of law in the process, the author argues that while the Chinese economy was transforming from a planned economy to a market-oriented one, the law also made its adjustment as a response—the Chinese legal system was evolving from the one consisting of primarily substantive laws to the one filled with high-level formal laws by the end of the last century. The above observation of legal formalization is further consolidated by introducing the particularities of China's legal education in those years—a topic rarely dealt with yet of significance to comprehensively understand the Chinese legal system in practice. Overall, the present book argues against the modernization theory and determinism that would anticipate a similar developmental path globally and shows that the relationship between law and economic development is contingent. Therefrom, this study weighs in the law and development debate and breaks a perception of static law in the economy by rejecting the conventional perception of established legal institutions as a precondition of modernity. Hence, this book could appeal to legal scholars and sociologists interested in reevaluating western theories of free economy and its relationships to the law. In addition, scholars interested in research methodology would find the perspective of paradigm shifts in interpreting China's transformations a helpful analytical framework in research. Moreover, policymakers and legislators concerned about the characteristics of law for economic results would also find the book useful.

    Abstract: This book aims at explaining romantic love between straight adults through literary texts of the western canon from the nineteenth and twentieth century. Each chapter comes with a multidisciplinary approach in which protagonists are mutilated in their quest for loving as alternative to annihilation. The book emphasizes love as an obsession, thus as an exploration of the mind. From the passion-myth of Tristan and Isolde to the nihilist modernist representations, the western world has created a perverse concept of love. A love for nothingness, for death. Narcissistic and at times destructive, love is gained by overcoming obstacles. If without obstacles there is no love, then love becomes love for obstacles. Within this masochistic frame, love, falling in love, being loved always stand at the edge of pathology. At its core this book narrates a love story, more precisely a story of loves, the haunting evocation of a desire that by its very nature cannot be fulfilled. Inherent in the nature of love is a subtle dialectical activity between presence and absence, between creation and destruction, reality and void. Accordingly, the narrative raises questions that the past two centuries were incapable of answering. Does love only last the time of a kiss? Is its promise fatally destined to dissolve? What about violence? Physical, emotional, temporal. Is it an ineliminable part of love or its most extreme profanation? And what is the mystery that accompanies loves that know how to last without resigning themselves to the death of desire? It is to answer some of these questions that I wrote this text. Love is an unconscious process that dominates reason and destroys it when reason cannot be a mode of communication. Hence, the amorous romance is madness and this text is written as a loud reminder.     Abstract: This book presents an original explanation of the stark contrast between two very different Chinese foreign policy patterns. On the one hand, there is Beijing’s hard power actorness related, among others, to territorial disputes and ‘wolf warrior’ intimidating maneuvers. On the other hand, there are China’s peaceful and cooperative actions, well-illustrated by the Belt and Road Initiative. This book shows that this situation is best understood as a consequence of the coexistence of two different Chinese identities respectively associated with the concepts of nineteenth-century-style territorial empire, and twenty-first-century-style postmodern global power. The book contends that in China’s case, they form a virtuous circle—characterized by a specific division of labor—as both identities are instrumental to the construction of a new, Chinese-led international order.     Abstract: This book is based on Stephen Hill’s direct experience working in the United Nations for many years as consultant and over a decade as full time Member of Staff—based in Indonesia and part-time in Paris, serving as United Nations Regional Director for Science for Asia and the Pacific as well as Principal Director and Ambassador of the United Nations Agency UNESCO (the UN Educational, Scientific, and Cultural Organization) across South East Asia. It was not always a quiet life. Stephen had to handle the negotiations and aftermath of two of his own UN staff taken hostage in 1996 for five months by freedom fighters into the jungles of West Papua; the May 1998 Revolution in Indonesia where he had to escape his house at 2.00am through mobs and fires while his own security staff had changed into civilian clothes and run off down the street to escape, then evacuate everyone else, but stay to report to the UN Security Council and liaise with the incoming Transition Government. In the early 2000s, Stephen needed to escape Indonesia, under UN Security instruction, from the terrorist organisation, Abu Sayyaf from Mindanao, the Southern Philippines, when they sent a Hit Squad down through Manado and across Sulawesi towards Jakarta to assassinate him in Jakarta because of his collaborative work throughout Mindanao’s previous fundamentalist Islamic conflict zones, amongst other things, bringing literacy to 7,000 villagers, mainly women, building nine radio stations with community support across religious lines, and introducing basic education into Islamic Schools previously teaching only the Koran and Arabic. This book captures all of this rather exciting life but delivers a message from experience—the Power of Community and Cultural Empowerment in successful United Nations Action to bring positive change into the world.

    Abstract: The book deconstructs the interplay between governance, migration, international relations, and security as a complex and constantly evolving dynamic that has significant implications for individuals, societies, and nations around the world. This book shows that the connections between governance, migration, international relations, and security have become increasingly significant for several reasons. First, it unpacks how globalization has led to an unprecedented level of interconnectedness between nations, resulting in a need for increased understanding of how governance frameworks, migration patterns, and international relations impact security both within and between nations. Second, it shows that the movement of people across borders has become a significant challenge, with more people on the move now than at any time in human history. Third, it highlights the increasingly complex and interdependent nature of international relations, which requires a nuanced understanding of how different actors, including governments, international organizations, and non-state actors, interact and influence each other.     Abstract: This book challenges the definition of a new approach for integrating protection and enhancing the Chinese heritage category of “Traditional Villages”. By applying a specific case study in the Hancheng context, Shaanxi Province, which lacks sound studies, the book formulates new theoretical prerequisites for future re-searches, an in-depth knowledge path, and sound methodological principles. By working in a multiple scales approach, the object of preservation and enhancement is first of all redefined in its ontology as a unity formed by the courtyard type, the morphology of the village, and the related landscape structures. All these three levels of study have been deeply investigated, put into the relationship and resulting in a new methodology which overcomes the inadequacy and ineffectiveness of the notion of “setting” deriving from conservation Charters, to embrace the structural notion of “context” and a knowledge approach to rural settlements’ form. The innovative and original features of this book are both in the reading villages in their landscape dimension, which in turn is studied as a context made of several interrelated structures. Another original feature of the book is the integration of Italian historic-structural and morphological methodologies with specific Chinese cultural aspects. The author’s work dug deeply and interdisciplinary in all those dimensions to account for the complex issues that are related and embodied in both the physical and intangible meaning of human settlements, opening a novel scientific methodology for Chinese studies as a sound base to define three key integrated project actions: what, why, how to preserve, enhance, develop.

    Abstract: The books aims to discuss and present an alternative epistemology of human rights, against the background of the globalization from below. The interdependent network of transnational networks, ranging from social movements, NGOs, and other groupings, questions the neoliberal paradigm and a particular set of human rights. This book wishes to transform this discourse on human rights and amplify the subaltern voices. The book also aims to highlight alternative practices of freedom that decenter human rights as a liberation discourse. Following Julia Suarez-Krabbe in “Race, Rights and Rebels”, the authors aim to amend to practices of freedom that center different orders of knowledge on subjectivity and agency. The proposed book, first, situates the problem of representation of the marginalized voices in contemporary legal and political discourse. Second, it offers critiques in theory, and, third, followed by alternative practices that emanate from marginalized localities. In particular, this book wishes to reflect upon alternatives rooted in legal and non-legal responses to address human rights grievances. In the end, this book envisages, along the lines of Frantz Fanon, to vision the possibility of the human by a new concept, addressing the concerns in various ways: As Fanon argued for “a new start”, “a new way of thinking”, and for the creation of a “new man”, it is pertinent to trigger a human rights project from the below.

    Abstract: This book examines the ways in which North American Indigenous identity has been (re)imagined, represented, and negotiated in German, Croatian, Italian, Polish, and Czech culture. Employing a cross-disciplinary and comparative approach and drawing on a range of media—from literature, comics, and film to photography, painting, and the performative arts—across different historical and cultural backgrounds, it aims to both contribute innovative scholarship on Indigenous studies in Europe and open a new avenue in the field by focusing on Central European settings that have received little or no critical attention to date. The book’s novelty also comes from its focus on the latest developments in the field, including the “Ravensburger/Winnetou controversy,” which swept across Europe in 2022, echoing the 2017 Canadian debate over Indigenous appropriation and free speech. It seeks to provide a sound reference and lay the groundwork for future scholarship by opening up a conversation on how Indigenous identities have been portrayed in Central European literature and media texts. To this end, it not only addresses generalized expectations about North American Indigenous people underlying (Central) European public discourse and imagination but also questions whether and to what extent some of the ingrained stereotypical views and practices, such as hobbyism, have been challenged in the face of Indigenous resurgence, rapidly changing media and information-sharing realities, and global cultural shifts. The closing interview with Métis playwright, actor, and director Bruce Sinclair underscores one of the book’s key goals—to spark an informed cross-cultural dialogue that will reveal the mechanisms of, as well as the contradictions and tensions inherent in, the politics of Indigenous representation in (Central) European cultural industries and encourage (Central) Europeans to confront their own cultural assumptions and attitudes. .

    Abstract: This open access book aims to emphasize the potential for Japan, Europe and Indo-Pacific countries including the US to respond to shared domestic and international challenges on finding joint ways to uphold and develop the liberal international order (LIO) in the Asian Pacific region and the world. It explores how these countries and the region (the EU) can work together to promote solidarity and cooperation to advance democratic standards and rules-based norms globally. The US understands the LIO in a political sense and centers its focus on democracy, aiming to build a coalition of democracies opposed to China and Russia which represent a kind of authoritarian axis. The US aims both to defend the LIO and respond to the China challenge and to build a coalition of countries that will do both. In contrast European countries aim at defending the “rules-based order”—a term preferred because they fear that the concept of the LIO might alienate or antagonize non-democratic countries. They face a dilemma between working with China to reform the LIO or, in seeking to defend it from China, excluding China. Germany and France differ regarding whether to play a passive or active role in the Indo-Pacific, the former choosing to preserve peace and stability for continued exports, and, until recently, doing little to contribute to security. Its views echo those of the ASEAN countries, which are unable or unwilling to take an active role in protecting the LIO. On the contrary France, along with the UK, actively carries out presence operations in the Indo-Pacific. Rather than upholding US dominance, France supports a multipolar order that will also reduce China’s influence in the region, with France acting as a balancing power and offering an alternative to the choice between China and the United States. Japan and India show interest in European views with the former leaning more toward its allies, the US and AUKUS, and the latter seeing Europe less as an alternative to the status quo and more as a complement of QUAD. This book concludes that the US needs to build coalitions rather than forcing allies and neighbors to choose sides, while Japan, Asian countries, and Europeans should more actively reform the LIO.

    Abstract: This book focuses on Chinese cases on the CISG decided by Chinese courts of all levels, focusing on 2011 to 2012. During this period, the number of cases grew fast compared to 2006 to 2010. The total number of cases remained relatively low, the reasons of which might be the following: parties were not familiar with the CISG and therefore decided to opt out of it; in addition, the case collection and report systems in China at that time were not as developed as now, rendering many cases inaccessible. This book provides a comprehensive and detailed analysis of selected cases. The analysis of those cases is on a case-by-case basis. For each case, an English summary of the judgment is provided. In the comment, the People’s Courts’ approach to the interpretation and application of the CISG is emphasized. Comments of the individual case are written either by scholars or judges or lawyers from international and comparative perspective to discuss the successes and pitfalls of the interpretation and application of the CISG.

    Abstract: This book presents research in the field of housing and urban analysis in Japan. It features carefully selected English translations of peer-reviewed articles published in journals in Japan, especially by authors involved in the laboratory supervised by Professor Yasushi Asami. The topics covered include economic analysis of the housing market, analyses of residential environment and human behaviour/psychology, analyses related to urban policies such as intermunicipal cooperation, teleworking and solar photovoltaics installation, spatial analyses of urban entities and effective visualization. Housing and urban analysis has developed using theory and methods in the fields of economics, regional science, geography, statistics, spatial psychology and urban sociology. Even though the methods of analysis differ from chapter to chapter, the ultimate goal of the research is the same. Namely, the target of the research is a better understanding of urban phenomena and effective improvement of urban space and society. The academic contributions in this collection of work are helpful for academics, practitioners and policy makers not only in Japan but also in other Asian countries. .

    Abstract: This book describes the disability rights movement that started in the USA and its influence on the disability rights movement in Lebanon, which has led to the endorsement of the Lebanese Disability Act 220/2000. The book introduces the reader to the Lebanese Disability Act 220/ 2000, its definition of disability, and its relation to the medical and social models of disabilities and then articulate the Act articles. Then, it defines the inclusive design paradigm that acknowledges the needs of all people at each stage of their life cycle and presents the difference between inclusive design and accessibility and disability notions. Moreover, the book reviews the different international accessible design standards (American and French) that are adopted in Lebanon with the absence of a nationalized Lebanese design standard and its effect on eliminating barriers and enhancing accessibility at university buildings. Besides, the book presents students' experiences and their satisfaction with the university built environments. 6 university buildings case studies at the American University of Beirut are assessed and analysed to check whether they adopt the inclusive design approach and then propose inclusive design solutions for both heritage and modern university buildings. What makes the book unique is its combination of empirical and theoretical application of inclusive design. The last section, reflects the author’s inclusive design teaching pedagogy. In this section, the author shares samples of students’ class design project and provides recommendations and guidelines for teaching inclusive design so it becomes mainstream.

    Abstract: This book sheds light on the fact that the proclamation of an emergency can be a legitimate constitutional method to take prompt preventative measures in protecting the interests of the society in times of grave crises. However, the exercise of emergency powers should not undermine a nation’s commitment to democratic values, such as maintaining the rule of law and upholding fundamental human rights. The COVID-19 pandemic has posed grave threats to the lives and health of individuals. However, since the constitutions of South Asian nations do not permit the proclamation of an emergency on health grounds, executives of these nations were constrained to rely, among other things, on ordinary legislation to tide over the threats posed by the pandemic. Although these statutes entrust the executive with extensive emergency powers, they do not simultaneously stipulate any safeguards subjecting the exercise of such powers to a reliable system of checks and balances. Accordingly, this book critically examines the exercise of emergency powers in the South Asian nations to tide over threats posed by the COVID-19 pandemic, which had a profoundly adverse impact on the human rights of individuals. Such exercise of powers was consistent with the general tendency demonstrated by succeeding generations of the executives in these nations to use emergency situations as the convenient means for imposing long-lasting limitations on the rights of individuals. Consequently, this book identifies the flaws, deficiencies, and lacunae of the legal framework in these nations, which permit the executive to assume unfettered power in the exercise of emergency measures at the expense of the liberty of individuals. Consequently, based on these findings, recommendations will be put forward for initiating reforms in these nations aimed at ensuring the maintenance of a delicate balance between the necessity to respond to grave threats and to simultaneously prevent undue intrusion on the fundamental human rights of individuals.

    Abstract: The standard forms of intellectual property protection, namely, copyright, patents, trademarks and trade secrets, have a long history and are well regulated in the legislative systems of most jurisdictions. However, there are specific kinds of subject matter that, due to their characteristics, cannot be adequately protected by these standard forms of intellectual property instruments. At the same time, these categories of subject matter require legal protection in order to ensure the balance between the public's access to these creations and the creators' rights. For these reasons, many jurisdictions introduce a special form of intellectual property protection, namely, sui generis regime, i.e., intellectual property legal regime “of its own kind”, designed to serve the specific needs of a particular subject matter. This book analyzes the intellectual property protection regimes in the EU and the U.S. available for three categories of subject matter that are often considered as requiring sui generis protection, namely, databases, designs and plant varieties. One of the main objectives is to evaluate whether the chosen subject matter in fact requires sui generis intellectual property protection and whether the introduced sui generis regimes have proved to be successful over time.     Abstract: This book is a collection of academic essays that examines the representation, esthetics and dichotomy of the notions of grief and melancholy in East–West exchanges and cultural dialogues. It explores the topic in the dimensions of individual behaviors under specific social norms and cultural products such as literature, film and any other forms of arts/genres, etc. In his 1917 work Mourning and Melancholia (Trauer und Melancholie), Sigmund Freud connected the grief of loss with melancholic emotions which may give rise to acts of mourning. He suggested that “[i]n mourning it is the world which has become poor and empty; in melancholia it is the ego itself” (Freud, 1917: 246). Inspired by Freud’s stance and with the goal of providing up-to-date intellectual resources for academics, researchers and students with ardent interests in the varying exemplifications of grief and melancholy in Sino-Western contexts, the book serves more than a discussion over the pragmatic and ritualistic connections of grief and melancholy in relation to the inner self and the external world.
