    Abstract: This volume represents the first attempt to systematically compare organised crime concepts, as well as historical and contemporary patterns and control policies in thirteen European countries. These include seven ‘old’ EU Member States (Denmark, France, Germany, Italy, The Netherlands, Spain and the United Kingdom), two ‘new’ members (the Czech Republic and Poland), a candidate country (Turkey), and three non-EU countries (Albania, Russia and Switzerland). Based on a standardised research protocol, thirty-three experts from different legal and social disciplines provide insight through detailed country reports. On this basis, the editors compare organised crime patterns and policies in Europe and assess EU initiatives against organised crime.     Abstract: Launch activities performed by private entities deal with a complex legal environment. The Space Treaties provide a general liability framework. Launch participants are subject to regulatory or institutional control, and to domestic liability laws. Specific contractual practice has developed due to insurance limitations, the inter-participants' waivers of liability and claims. This book synthesizes information on the norms of play, to allow the grasp of their relative weight and interactions in the assessment of liability risk for launch activities. It reveals a legal framework presently lacking sufficient predictability for an efficient liability risk management: the waivers of liability suffer weaknesses as do all such clauses, and lack uniformity and reliability; and the Space Treaties contain ambiguous terms preventing predictable determination of the States responsible for authorizing and supervising launch activities and for damage compensation, and do not reflect the liability of launch operators. This book offers suggestions of new approaches for: harmonizing waivers of liability to improve their consistency, validity and flow-down; and improving the Space Treaties for their implementation to non-governmental launch activities. In the launch community, the need for lawmaking is less compelling than in fields such as aviation. Nevertheless, adjustments to the present framework are proposed through model clauses and an international instrument, for further thinking and contribution by those sharing the opinion that creative lawmaking is needed now to prepare for tomorrow's endeavors.

    Abstract: Die Arbeit befasst sich mit dem mandatum iuris gentium und der völkerrechtlichen Treuhand. Im ersten historischen Teil werden die rechts- und ideengeschichtlichen Wurzeln beider Institute nachvollzogen. Im zweiten Teil werden problematische Fälle des modernen Völkerrechts dargestellt, in denen das Mandats- bzw. Treuhandrecht in völkerrechtlichen Streitfragen besondere Relevanz hatte und z. T noch hat, z.B. Südwestafrika/Namibia, Israel/Palästina und Nauru. Im dritten und letzten Teil wird die Zukunft der völkerrechtlichen Treuhand untersucht, insbesondere in besonders aktuellen Fällen wie Kosovo, Afghanistan und Ost-Timor, die de facto mit der völkerrechtlichen Treuhand vergleichbar sind. In diesem Teil werden auch Vorschläge zu Wiederbelebung des UN-Treuhandsystems, auch im Umweltvölkerrecht, und ähnliche Vorschläge aus der Völkerrechtslehre diskutiert. Insgesamt wird festgestellt, dass der Treuhandgedanke seit seiner Entstehung im Völkerrecht nicht an Aktualität eingebüßt hat.

In this book she gives an overview of the history of legal anthropology and at the same time urges anthropologists, lawyers, and activists to recognize the centrality of law in social change. Nader traces the evolution of the plaintiff's role in the United States in the second half of the twentieth century and argues that the atrophy of the plaintiff's power during this period represents a profound challenge to justice and democracy. Taking into account the vast changes wrought in both anthropology and the law by globalization, Nader speaks to the increasing dominance of large business corporations and the prominence of neoliberal ideology and practice today. In her discussion of these trends, she considers the rise of the alternative dispute resolution movement, which since the 1960s has been part of a major overhaul of the U.S. judicial system. Nader links the increasing popularity of this movement with the erosion of the plaintiff's power and suggests that mediation as an approach to conflict resolution is structured to favor powerful--often corporate --interests

    Abstract: "International business transactions are heavily influenced by culture,practice and rule. The pursuit of business relationships within nation-states can be subject to differences in the generation of norms and the processing of disputes, but these conflicts are magnified many times over in cross-border transactions where nation-state control and support is weak or absent. This book seeks different explanations of the ways in which business people and their legal advisers try to minimise the effect of these magnified difficulties. At the outset the editors suggest four sources through which the international business community might be considered to have supplemented nation-state conflict prevention and dispute resolution institutions - an international legal order; the development of a private normative order based on common business practices (denominated the lex mercatoria); through the efforts and work product of internationalised law firms, and by means of extensive, thick personal relationships often referred to by their Chinese term guanxi.     Abstract: Netwar-like cyberwar-describes a new spectrum of conflict that is emerging in the wake of the information revolution. Netwar includes conflicts waged, on the one hand, by terrorists, criminals, gangs, and ethnic extremists; and by civil-society activists (such as cyber activists or WTO protestors) on the other. What distinguishes netwar is the networked organizational structure of its practitioners-with many groups actually being leaderless-and their quickness in coming together in swarming attacks. To confront this new type of conflict, it is crucial for governments, military, and law enforcement to begin networking themselves.

    Abstract: There is widespread concern that the growth of the Internet is exacerbating inequalities between the information rich and poor. Digital Divide examines access and use of the Internet in 179 nations world-wide. A global divide is evident between industrialized and developing societies. A social divide is apparent between rich and poor within each nation. Within the online community, evidence for a democratic divide is emerging between those who do and do not use Internet resources to engage and participate in public life. Part I outlines the theoretical debate between cyber-optimists who see the Internet as the great leveler. Part II examines the virtual political system and the way that representative institutions have responded to new opportunities on the Internet. Part III analyzes how the public has responded to these opportunities in Europe and the United States and develops the civic engagement model to explain patterns of participation via the Internet.

    Abstract: In this book, Thomas Buoye examines the impact of large-scale economic change on social conflict in eighteenth-century China. He draws upon a large body of actual, documented homicide cases originating in property disputes to recreate the social tensions of rural China during the Qianlong reign (1736–1795). The development of property rights, a process that had begun in the Ming dynasty, was accompanied by other changes that fostered disruption and conflict, including an explosion in the population growth and the increasing strain on land and resources, and increasing commercialization in agriculture. Buoye challenges the 'markets' and 'moral economy' theories of economic behaviour. Applying the theories of Douglass North for the first time to this subject, he uses an institutional framework to explain seemingly irrational economic choices. Buoye examines demographic and technological factors, ideology, and political and economic institutions in rural China to understand the link between economic and social change

    Abstract: In order to distinguish between those who may and may not enter or leave, states everywhere have developed extensive systems of identification, central to which is the passport. This innovative book argues that documents such as passports, internal passports and related mechanisms have been crucial in making distinctions between citizens and non-citizens. It examines how the concept of citizenship has been used to delineate rights and penalties regarding property, liberty, taxes and welfare. It focuses on the US and Western Europe, moving from revolutionary France to the Napoleonic era, the American Civil War, the British industrial revolution, pre-World War I Italy, the reign of Germany's Third Reich and beyond.     Abstract: The authors of Informal Politics in East Asia, first published in 2000, argue that political interaction within the informal dimension (behind-the-scenes politics) is at least as common and influential, though not always as transparent or coherent, as formal politics, and that this understudied category of social interaction merits more serious and methodical attention from social scientists. This book is a pioneering effort to delineate the various forms of informal politics within different East Asian political cultures and to develop some common theoretical principles for understanding how they work. Featured here are contributions by political scientists specializing in the regions of China, Taiwan, Japan, the Korean peninsula, and Vietnam.
