    Abstract: This essay asks how oral narratives can come to constitute customary law. I will argue that they can and should be understood as legal texts, but that such an understanding both requires and generates a rethinking of law itself: oral narratives are not just law, and they are law in ways profoundly different from European law. 2 Rather than proposing yet another definition of law under which to subsume oral narratives, however, I propose to "listen" for what ideas about law the narrative itself might contain. This approach allows us to think through oral narratives as law without rigidly defining them as such, thus generating a responsive, dialogical, and open-ended way of identifying customary law. Firstly, I suggest that customary law should be understood as an ascriptive concept whose boundaries are shifting and historically contingent. In doing so, I move away from questions about what law is, towards questions about what it means to claim something as law in the (settler-)colonial context. Secondly, I examine how court proceedings on aboriginal title in Canada have provoked reconceptualisations of both oral tradition and law. Finally, I turn to the genre of Otjiherero praise-poetry, showing why and how we can study them as legal texts without positing a definition of law.

    Abstract: Throughout the world, human rights have grown in prominence over the years. Despite this feat, numerous global events in the past and in recent times, especially those driven by political interests, show that respect for the ideals of human rights are far from being realised in practice. With approaches largely state-centred in nature, these events fundamentally point to a marked gap between human rights norms and practice. What is unfortunately and clearly afforded a low priority or no priority at all in these state-based and politically vested contestations are missing links between international human rights norms and cultural or traditional belief systems and practices. Specifically, this thesis argues that when it comes to beliefs in witchcraft and its practices, there remains a sizeable gap between theory and practice, and this creates the thorny and contentious issue of the unpleasant conflict between international human rights and specific cultural belief systems, practices, norms and values. With a view to analysing the dichotomy between culture and human rights, this dissertation positions, explores and indeed questions beliefs in and practices of witchcraft in Ghana, and particularly Ghana`s alleged witches` camps, within the framework of international human rights.     Abstract: This book presents an ethnography of dispute processing by non-state forums and actors in rural India. As such it sheds light on a much neglected and contested topic. Arising in the context of recent legal and political debates that question the legitimacy of non-state actors engaged in dispute processing, the book explores the nature, form, and functioning of such forums and actors in two locations in rural India. Focusing on a fishermen's community belonging to the caste of Hindu Machimar Kolis in coastal Maharashtra and an agrarian community in Uttarakhand with members from the Pandit, Thakur, Bhotia, and Harijan caste groups, this study shows the manner in which non-state forums and actors engage with state law and its regulatory systems.

    Abstract: This book examines the relationship between inequalities and identities in the context of an unprecedented state advocacy of human rights with a distinct emphasis on (ethnic) group rights in post-civil war Ethiopia. The analysis is set against the background of a dramatic state remaking by a rebellion movement (the Ethiopian People's Revolutionary Democratic Front - EPRDF) that seized control of the Ethiopian state in 1991, after a decisive battlefield victory over an unpopular regime. The new government of former rebels pledged to institute a new system of ethnic self-government that celebrated ethnic diversity with a firm pledge to guarantee basic human rights. After nearly three decades in office, however, the Ethiopian government is challenged by the resilience of identity-based inequalities it ostensibly sought to end, and by protests against its own policies and practices that intensified inequality. The events in Ethiopia, reverberating throughout the Horn of Africa, have inspired heated and often polarized debates between academics, policy experts, political activists, and the media. Data D. Barata contributes to this debate through a nuanced ethnographic analysis of why identities with distinct notions of inequality persist, even after relentless interventions and ideological repudiations. The contestations and struggles over political representation, local governance, cultural identities, land and religion that the book examines are shaped, one way or another, by the global human rights discourse that has inspired millions of Africans to confront entrenched structures of power. This book will be of interest to scholars and students in the fields of anthropology, African studies, political science, sociology and cultural studies.

    Abstract: Along with whatever belongings they carry, migrants and refugees always bring their laws, cultures, and contextually specific experiences (feuds, state failures) in some form to their host countries. Various migrants? identities may include law as a dimension that belongs to specific collectives (tribes, religious communities) beyond the nation-state. In contrast to the juridical notion of law as a dimension of the nation-state, legal systems within countries such as Afghanistan are sometimes classified as "legal systems based on reciprocity?, or "horizontal legal systems?. Encounters of judges and other legal experts in the Czech Republic with such legal systems within the framework of international civil trials are driven by an official imperative that the foreign law must be understood as the law truly applied in the country of origin. Such a situation unsettles deep-rooted notions of the state, generates uncertainty about conventional understandings of the law, and indicates the necessity of employing legal-ethnological conceptual tools. Drawing on empirical cases involving Afghan law in the form of foreign law in international civil trials, this paper investigates the difference between a legal understanding of Afghan law in the Czech legal framework, achieved mostly through the concept of state law, and an ethnological understanding of law in Afghanistan based on Pospíšil?s analytical concepts. Finally, it suggests the relevance of applying the analytical distinction between legal sodalities and legal modalities. (Abstract)

    Abstract: Anthropology of Law in Muslim Sudan analyses the hybridity of law systems and the plurality of legal practices in rural and urban contexts of contemporary Sudan, shedding light on the complex relation between Islam and society. It is the outcome of the international research program ANDROMAQUE ( Anthropologie du Droit dans les Mondes Musulmans Africains et Asiatiques), funded by the French ANR ( Agence National de la Recherche) between 2011 and 2014. Crossing two disciplinary perspectives, anthropology and law, the present volume contains original fieldwork data on contemporary urban and rural Sudan. Focusing on two major domains, land property and courts, several case studies demonstrate the relevance of an approach based on "legal practices" to underline, first, the plurality and hybridity of law systems and the relative role of the Islamic reference in Sudanese society, and, secondly, the reshaping of legal behaviors and norms after the breaking point of South Sudan's independence in 2011.

    Abstract: How do ordinary Muslims deal with and influence the increasingly pervasive Islamic norms set by institutions of the state and religion? Becoming Better Muslims offers an innovative account of the dynamic interactions between individual Muslims, religious authorities, and the state in Aceh, Indonesia. Relying on extensive historical and ethnographic research, David Kloos offers a detailed analysis of religious life in Aceh and an investigation into today's personal processes of ethical formation. Aceh is known for its history of rebellion and its recent implementation of Islamic law. Debunking the stereotypical image of the Acehnese as inherently pious or fanatical, Kloos shows how Acehnese Muslims reflect consciously on their faith and often frame their religious lives in terms of gradual ethical improvement. Revealing that most Muslims view their lives through the prism of uncertainty, doubt, and imperfection, he argues that these senses of failure contribute strongly to how individuals try to become better Muslims. He also demonstrates that while religious authorities have encroached on believers and local communities, constraining them in their beliefs and practices, the same process has enabled ordinary Muslims to reflect on moral choices and dilemmas, and to shape the ways religious norms are enforced. Arguing that Islamic norms are carried out through daily negotiations and contestations rather than blind conformity, Becoming Better Muslims examines how ordinary people develop and exercise their religious agency.

    Abstract: Based on extensive ethnographic research, Religioscapes in Muslim Indonesia examines three major Islamic practices found in Indonesia through exemplary case studies. It considers the historical and contemporary contexts which frame these practices, it traces their networks and connections and the ways people relate to them in their daily lives. The first case study provides a deep historical grounding in the mystic Islam found in Yogyakarta. The second case study explores the mixture of local and Hadhrami influences in the Islamic practice of South Sumatra, while the third case study examines an `imported` form of reform Islam in an area of recent settlement. The analysis shows that Islam in Indonesia is pluriform, and that it is influenced by translocal transfers of ideas, practices, texts as well as embedment in local cultural contexts. Islam`s entanglement as a global religion with local sets of practices can be opened up by the concept of the religioscape. The analysis further illustrates that different variants of local Islam, as opposed to the idea of a universal Islam, have not lost their significance in Indonesia. This means that the plural and moderate Islam prevalent in Indonesia is not on the decline, and that rather than Islamization, a piousization can be observed to be taking place.

In native title, when Indigenous relationships with country are viewed through the lens of a Western property rights regime, this complexity is seriously magnified.     Abstract: Svan people of the Georgian lowlands proudly talk about their traditional law and stress that it continues to be practiced in their new villages. While this is not wrong, Svan legal concepts are not only invoked with reference to conflict resolution and social order. In the new villages, traditional law rather represents a cultural narrative and a strategy of social localisation for people who were forced to migrate from their highland home to the south of the country. The practice of traditional law in Georgia has been described mostly for the mountain regions. A Georgian-German research team investigated how former mountain dwellers who were relocated from Svaneti to southern Georgia rely on local legal conceptions in everyday life. Research showed that traditional law is still practiced, but only rarely used as a legal frame of reference. In the lowlands Svan traditional law should rather be described in terms of cultural narratives and a strategy of social localisation. In their individual papers the researchers discuss the practice of traditional law in Soviet times, blood feuding, concepts of honour and shame in gender relations and the spatial dimension of cultural narratives.

    Abstract: Non-state law is playing an increasing role in both public and private ordering. Numerous organizations have emerged alongside the nation-state, each purporting to provide their members with rules and norms to govern their conduct and organize their affairs. The nation-state increasingly finds itself sandwiched, between two broad and contrasting categories of non-state law. The first - law above the state - captures legal systems that function across the territorial borders of nation-states. The second category - law below the state - includes forms of local customary, religious, and indigenous law. As these forms of non-state law persist and proliferate alongside the nation-state, the relationship between state and non-state law becomes more complex, multifaceted, and tense.     Abstract: This book deals with the property and inheritance system of the matrilineal Minangkabau of West Sumatra in the context of legal pluralism. The author proposes a new anthropological approach to law, property and inheritance. After the description of the Minangkabau socio-political organization and the development of legal and administrative pluralism, three chapters are devoted to property and inheritance proper. First the ideal legal systems are described. Then he illustrates how the Minangkabau actually handle their property and inheritance affairs, and how the various regulating mechanisms have changed through history. Finally the different agents creating and changing legal conceptions are treated in historical perspective. In his conclusions the author shows how the traditional system of common holding and distributing of property by matrilineal descent groups is slowly being undermined through an increasing monetarization and consequent individualization of property relationships which finds its expression in the form of new legislation. This development is reflected in the conceptual system where the formerly predominant diachronic dimension of property relationships is slowly abolished and where property rights are increasingly reified.     Abstract: Law and law-like institutions are visible in human societies very distant from each other in time and space. When it comes to observing and analysing such social constructs historians, anthropologists, and lawyers run into notorious difficulties in how to conceptualize them. Do they conform to a single category of 'law'? How are divergent understandings of the nature and purpose of law to be described and explained? Such questions reach to the heart of philosophical attempts to understand the nature of law, but arise whenever we are confronted by law-like practices and concepts in societies not our own. In this volume leading historians and anthropologists with an interest in law gather to analyse the nature and meaning of law in diverse societies. They start from the concept of legalism, taken from the anthropologist Lloyd Fallers, whose 1960s work on Africa engaged, unusually, with jurisprudence. The concept highlights appeal to categories and rules. The degree to which legalism in this sense informs people's lives varies within and between societies, and over time, but it can colour equally both 'simple' and 'complex' law. Breaking with recent emphases on 'practice', nine specialist contributors explore, in a wide-ranging set of cases, the place of legalism in the workings of social life. The essays make obvious the need to question our parochial common sense where ideals of moral order at other times and places differ from those of modern North Atlantic governance. State-centred law, for instance, is far from a 'central case'. Legalism may be 'aspirational', connecting people to wider visions of morality; duty may be as prominent a theme as rights; and rulers from thirteenth-century England to sixteenth-century Burma appropriate, as much they impose, a vision of justice as consistency. The use of explicit categories and rules does not reduce to simple questions of power. The cases explored range from ancient Asia Minor to classical India, and from medieval England and France to Saharan oases and southern Arabia. In each case they assume no knowledge of the society or legal system discussed. The volume will appeal not only to historians and anthropologists with an interest in law, but to students of law engaged in legal theory, for the light it sheds on the strengths and limitations of abstract legal philosophy.

Weibliche Schönheit in Form von Femininität gilt als modern. Moderne Weiblichkeit, die ihren Ausdruck in einem schönen Körper findet, wird durch ein komplexes Bündel von Diskursen und Praxen lokaler, nationaler und globaler Provenienz konstituiert. Ausgehend vom Körper, der als die vermittelnde Instanz zwischen Diskursen und Praxen verstanden wird, analysiert die Verfasserin die Komplexität des Themas Schönheit und Modernität aus Perspektive der Akteurinnen. Welche Ziele verfolgen sie mit der strategischen Aneignung des Ideals der modernen Weiblichkeit? Wie strukturieren soziale Positionen die jeweiligen Aneignungsprozesse? Die Verfasserin zeigt, wie die zunehmende Bedeutung von Schönheit mit Transformationen im Bereich der Geschlechterverhältnisse, des Konsums und der sozialen Differenzierung verknüpft ist. Moderne Weiblichkeit konstituiert sich an der Schnittstelle ästhetischer, aber vor allem auch sozialer, ökonomischer, kultureller, religiöser und moralischer Diskurse. Das zentrale Motiv der Akteurinnen für die Aneignung von als modern erachteten Schönheitsidealen stellt die Erweiterung der eigenen Handlungsfähigkeit in der patrilinearen Gesellschaft der Karo Batak dar. Die jeweiligen sozialen Positionen führen zu unterschiedlichen Formen der Aneignung, die in verschiedenen Formen moderner Weiblichkeit resultieren. Am Beispiel von Frauen der städtischen Mittelschicht, jungen Frauen vom Land und waria, Menschen mit weiblicher transgender-Identität, werden diese Aneignungsprozesse und ihre gesellschaftlichen Bedeutungen vergleichend diskutiert. Die Globalisierung von Schönheit, so lässt sich resümieren, bringt - selbst auf begrenzter lokaler Ebene - verschiedene moderne Weiblichkeiten hervor.

The volume is also a tribute to the work of Gerti Hesseling (1946-2009), a Dutch Africanist with a successful career as a scholar of constitutional and land law, focusing on West Africa.

    Abstract: This collection of essays provides insights into the complex process of economic decolonization in Indonesia from a variety of perspectives. The emancipation from Dutch colonialism in the economic sphere is linked to the unique features of the new nation-state emerging in newly independent Indonesia. This included a key role in business for the military. A key part was also played by indigenous Indonesian business firms that were shaped by the Japanese occupation and the Indonesian Revolution. The analysis embraces two types of comparisons. Different experiences of economic decolonization across regions are illustrated by events unfolding in the agricultural estate areas of Deli in North Sumatra and Jember in East Java. Here the focus is on confrontations between private Dutch capital and Indonesian labour unions. In addition, the overall experience of Indonesia is offset against similar processes at work in other former European colonies in Asia, in particular neighbouring Malaysia. The international comparison shows how dramatic and difficult economic decolonization was and also how profound its consequences were.     Abstract: Poverty in developing countries is a result of various factors which affect people's well being. This study analyses parameters surrounding gender biased access to land in investigating the phenomena of poverty in Lindi district, south east Tanzania. Of particular importance are gendered rights of land use, access, ownership and control. In this study, gender as a tool of analysis has been used throughout and this has broadened the perspective of women's land rights in a village (rural) setting. Since Tanzania is an agrarian country, land can be considered as one of the fundamental factors in analysing poverty. While few people in rural Tanzania enjoy other modes of survival, for example wage employment, many Tanzanians are mostly engaged in farming activities. However, little is known about the increasing insecurity of women over land matters. Most of the country's land tenure systems give women access to land not in their own right. Their right is widely determined by their relationship with men, in particular as wives. In this sense, land tenure systems have affected women and men differently. Consequentially, the relative distribution of poverty between women and men differs significantly. The study addresses women's disadvantages in land matters and establishes a connection to their poor socio-economic situation. This study establishes a close relationship between marriage and women's land rights. This suggests that gender role is a major factor influencing women's land rights at household level. It has increased women's land tenure insecurity and hence increased their vulnerability to poverty. The main focus of this study is directed towards gender related aspects of land tenure rights. In addition, the study analyses the kind of land rights that societies in Tanzania (represented by the Nyangao case study) accord to women on their own capacity. Other specific objectives are: 1. to analyse local views on poverty 2. to assess the conditions under which women acquire and control land 3. to identify factors which either facilitate or constrain women's efforts towards poverty reduction as far as ownership and control over land is concerned in a male dominated socio-economic framework 4. to assess the gender division of labour and household decision making. The findings from this study shows that women's vulnerability to poverty in Nyangao village is a result of both socio-cultural and socio-economic factors. Those findings point to the fact that women heads of households in Nyangao village enjoy land tenure rights through allocation by the village government. Furthermore, the findings report that there is an increase in the number of female-headed households who were allocated land by their parents. This is contrary to the patriarchal orientation (currently followed by societies in south-east Tanzania) and poses a challenge to that system as it encourages the evolution of land transfers beyond patriarchially defined procedures. The study also reveals that the Nyangao women?s land holding status is threatened by the agrarian reforms as influenced by the Structural Adjustment Programmes (SAPs) and economic liberalization. In this, land allocation provided by parents which were beneficial to women especially single mothers are increasingly being threatened by land privatisation and commoditization. Furthermore the findings reveal that the relatively gender sensitive intra-household redistribution of land and the encouraging new direction (as obtained from the respondents views) towards equal inheritance rights between female and male children suggests that this may lead to the eventual creation of women's economic independence. Women's access and control over land may create welfare, efficiency, equity and empowerment. This is expected to reduce gender inequality which is an important mechanism for poverty reduction. This study is based on the qualitative and quantitative data, collected between August and December 2003. The primary emphasis is placed on qualitative data due to the nature of the study. Both primary and secondary sources of data collection were consulted. A case study of Nyangao village located in Lindi rural district, Lindi region, south-east Tanzania was selected and used as a source of primary data. The qualitative data were collected through Focus Group Discussions (FGDs), in-depth interviews, life histories and observation. The study also used structured questionnaires. A total of 180 sampled respondents from 180 sampled households were selected. While quantitative data was analysed by using the SPSS package, the qualitative data was manually processed and interpreted. (Verlagsangaben)

    Abstract: Frau Natascha Garvin Barba hat im Rahmen ihrer Feldforschung für die Magisterarbeit in Guatemala ein Thema gewählt, das in zwei zentrale Gegenstandsbereiche der Ethnologie eingebettet ist: In die Rechtsethnologie und die Politische Ethnologie, aus denen sie einige Schlüsselkonzepte in ihrem einleitenden theoretischen Kapitel kritisch darstellt, insbesondere das des Rechtspluralismus. Nach der notwendigen Beschreibung der regionalen Gegebenheiten und der Forschungssituation stellt sie die Gemeinde vor, in der sie ihre Untersuchung durchgeführt hat, diskutiert das Rechtssystem der Maya Guatemalas und führt uns durch den Wandel, den die Institutionen lokaler Autoritäten von der prä-hispanischen Epoche bis in die Gegenwart durchlaufen haben. Hierbei bleibt auch der aktuelle soziopolitische Kontext in Guatemala nicht unberücksichtigt, insbesondere die Maya-Bewegungen und ihre Bestrebungen hinsichtlich einer Revitalisierung der indigenen Kultur sowie die nationale Diskussion über Dezentralisierung und Justizreformen. Die Frage nach der Verankerung der Corporación Auxiliar Pueblo Viejos in der indigenen Kultur und ihre gleichzeitige Einbettung ins nationale Verwaltungs- und Justizsystem bildet den zentralen Gegenstand des empirischen Teils der Arbeit, der auf einer breiten Basis äußerst sorgfältig ausgewerteter qualitativer und quantitativer Daten beruht. Im einzelnen werden Organisation, interne Struktur und Funktionen der Corporación Auxiliar geschildert, wobei ein besonderes Augenmerk der Rolle gilt, die die Corporación Auxiliar bei der Lösung von Konflikten innerhalb der Dorfgemeinschaft spielt. Diese Rolle wird auf eindrucksvolle Weise mit Hilfe detaillierter Fallbeschreibungen, einer Typologie der auftretenden Konflikte und einer Analyse der Häufigkeiten der einzelnen Konflikttypen untersucht. Neben Funktionen und Organisation der Corporación Auxiliar wird dargestellt, wie der Alcalde Auxiliar und seine Mitarbeiter zu ihren Ämtern gelangen, und welche Kriterien Amtsträger erfüllen müssen. Hier findet sich ein sehr interessantes Beispiel für eine Regelung, mit deren Hilfe die Erfüllung kultureller Normen und der Umgang mit praktischen Notwendigkeiten miteinander verbunden werden. Darüber hinaus wird die Einbettung der Corporación Auxiliar in die lokale Autoritätsstruktur sowie die Stellung der Corporación innerhalb der Dorfgemeinschaft diskutiert. Als letzter Teil der Arbeit folgt schließlich die Analyse des Einflusses der staatlichen Verwaltung und des nationalen Justizsystems auf die Corporación Auxiliar in Pueblo Viejo, wodurch der Bezug zu der im theoretischen Teil diskutierten Thematik des Rechtspluralismus deutlich wird.     Abstract: This study offers a reconstruction of the social, cultural and legal history of the Middle Horde Kazakh steppe within the Russian Empire in the 19th century. Using largely untapped archival records from Kazakhstan and Russia, as well as contemporary ethnographic research, administrative reports, the provincial press and scholarly analyses, it explores the cross-cultural encounter of laws, customs and judicial practices in the process of Russian empire-building at the local level. Through the imposition of imperial laws and settlement of nomadic lands, Russian colonialism sought to control the ways that Kazakh nomads could practice their judicial customs (adat). Middle Horde Kazakhs actively accommodated, manipulated and rejected these Russian imperial designs, and continued to find meaning in their own legal-cultural norms for ensuring justice, resolving disputes, and upholding clan honour. This study contributes both to current understanding of the history of Russia as an empire and of the Muslim, Turkic Kazakhs who were integrated into that empire over the course of the 19th century, and thus to an understanding of the identity of Kazakhstan today.
