    Abstract: Dynamics of Caste and Law breaks new ground in understanding how caste and law relate in India's democratic order. Caste has become a visible phenomenon often associated with discrimination, inequality and politics in India and globally. India's constitutional democracy has had a remarkable goal of creating equality in a context of caste. Despite constitutional promises with equal opportunities for the lower castes and outlawing of untouchability at the time of independence, recurring atrocities and inadequate implementation of law have called for rethinking and legal change. This book sheds new light on why caste oppression persists by using new theoretical perspectives as well as Bhimrao Ambedkar's concepts of the caste system. Focusing on struggles among India's Dalits, the castes formerly known as untouchables, the book draws on a rich material and explains, among other things, mechanisms of oppression and how powerful actors may gain influence in institutions of law and state.

    Abstract: In this book, renowned anthropologists Jean and John L. Comaroff make a startling but absolutely convincing claim about our modern era: it is not by our arts, our politics, or our science that we understand ourselves it is by our crimes. Surveying an astonishing range of forms of crime and policing from petty thefts to the multibillion-dollar scams of too-big-to-fail financial institutions to the collateral damage of war they take readers into the disorder of the late modern world. Looking at recent transformations in the triangulation of capital, the state, and governance that have led to an era where crime and policing are ever more complicit, they offer a powerful meditation on the new forms of sovereignty, citizenship, class, race, law, and political economy of representation that have arisen. To do so, the Comaroffs draw on their vast knowledge of South Africa, especially, and its struggle to build a democracy founded on the rule of law out of the wreckage of long years of violence and oppression. There they explore everything from the fascination with the supernatural in policing to the extreme measures people take to prevent home invasion, drawing illuminating comparisons to the United States and United Kingdom. Going beyond South Africa, they offer a global criminal anthropology that attests to criminality as the constitutive fact of contemporary life, the vernacular by which politics are conducted, moral panics voiced, and populations ruled. The result is a disturbing but necessary portrait of the modern era, one that asks critical new questions about how we see ourselves, how we think about morality, and how we are going to proceed as a global society.

    Abstract: When Eritrea gained independence in 1991, hopes were high for its transformation. In two decades, however, it became one of the most repressive in the world, effectively a militarised "garrison state". This comprehensive and detailed analysis examines how the prospects for democracy in the new state turned to ashes, reviewing its development, and in particular the loss of human rights and the state's political organisation. Beginning with judicial development in independent Eritrea, subsequent chapters scrutinise the rule of law and the court system; the hobbled process of democratisation, and the curtailment of civil society; the Eritrean prison system and everyday life of detention and disappearances; and the situation of minorities in the country, first in general terms and then through exploration of a case study of the Kunama ethnic group. While the situation is bleak, it is not without hope, however: the conclusion focuses on opposition to the current regime, and offers scenarios of regime change and how the coming of a second republic may yet reconfigure Eritrea politically.     Abstract: Analysing both fraud and religion as social constructs with different functions and meanings attributed to them, this book raises issues that are central to debates about the limits of religious toleration in diverse societies, and the possible harm (as well as benefits) that religious organisations can visit upon society and individuals. There has already been a lively debate concerning the structural context in which abuse, especially sexual abuse, can be perpetrated within religion. Contributors to the volume proceed from the premise that similar arguments about ways in which structure and power may be conducive to abuse can be made about fraud and deception. Both can contribute to abuse, yet they are often less easily demonstrated and proven, hence less easily prosecuted. With a focus on minority religions, the book offers a comparative overview of the concept of religious fraud by bringing together analyses of different types of fraud or deception (financial, bio-medical, emotional, breach of trust and consent). Contributors examine whether: fraud is necessarily intentional (or whether that is in the eye of the beholder); certain structures may be more conducive to fraud; followers willingly participate in it. The volume includes some essays focused on non-Western beliefs (Juju, Occult Economies, Dharma Lineage), which have travelled to the West and can be found in North American and European metropolitan areas.

    Abstract: Focusing on colonial Kenya, this book shows how conflicts between state authorities and Africans over witchcraft-related crimes provided an important space in which the meanings of justice, law and order in the empire were debated. Katherine Luongo discusses the emergence of imperial networks of knowledge about witchcraft. She then demonstrates how colonial concerns about witchcraft produced an elaborate body of jurisprudence about capital crimes. The book analyzes the legal wrangling that produced the Witchcraft Ordinances in the 1910s, the birth of an anthro-administrative complex surrounding witchcraft in the 1920s, the hotly contested Wakamba Witch Trials of the 1930s, the explosive growth of legal opinion on witch-murder in the 1940s, and the unprecedented state-sponsored cleansings of witches and Mau Mau adherents during the 1950s.     Abstract: Hawai`i and Fiji share strikingly similar histories of colonialism and plantation sugar production but display different legacies of ethnic conflict today. Pacific Island chiefdoms colonized by the United States and England respectively, the islands` indigenous populations were forced to share resources with a small colonizing elite and growing numbers of workers imported from South Asia. Both societies had long traditions of chiefly power exercised through reciprocity and descent; both were integrated into the plantation complex in the nineteenth century. Colonial authorities, however, constructed vastly different legal relationships with the indigenous peoples in each setting, and policy toward imported workers also differed in arrangements around land tenure and political participation. The legacies of these colonial arrangements are at the roots of the current crisis in both places.Focusing on the intimate relationship between law, culture, and the production of social knowledge, these essays re-center law in social theory. The authors analyze the transition from chiefdom to capitalism, colonizers` racial and governmental ideologies, land and labor policies, and contemporary efforts to recuperate indigenous culture and assert or maintain indigenous sovereignty. Speaking to Fijian and Hawaiian circumstances, this volume illuminates the role of legal and archival practice in constructing ethnic and political identities and producing colonial and anthropological knowledge.
