    Abstract: This book provides the first comprehensive analyses of the challenges all European welfare systems have been facing since 2007, combining in-depth country-based studies and comparative chapters. It identifies four main challenges for European welfare systems: 1) the economic and financial crisis, 2) demographic change, 3) the balance between avoiding risks and opening up opportunities in social policy, and 4) legitimacy. It shows that European welfare systems tend to face the same challenges but in different ways and that, accordingly, their responses to those challenges differ considerably. Although the EU also plays a part in shaping national welfare systems, it becomes evident that European welfare systems are by no means converging: in terms of social policy, national diversity within Europe is still a major factor that will shape future developments in European welfare systems

    Abstract: Are judges supposed to be objective? Citizens, scholars, and legal professionals commonly assume that subjectivity and objectivity are opposites, with the corollary that subjectivity is a vice and objectivity is a virtue. These assumptions underlie passionate debates over adherence to original intent and judicial activism. Douglas Edlin challenges these widely held assumptions by reorienting the entire discussion. Rather than analyze judging in terms of objectivity and truth, he argues that we should instead approach the role of a judge's individual perspective in terms of intersubjectivity and validity. Drawing upon Kantian aesthetic theory as well as case law, legal theory, and constitutional theory, Edlin develops a new conceptual framework for the respective roles of the individual judge and of the judiciary as an institution, as well as the relationship between them, as integral parts of the broader legal and political community

Drawing on recent feminist theories of nonhuman life and politics, Miller shows that reproduction and flourishing are not antithetical to contemplation and sensitivity. After demonstrating processes of life and processes of thought are indistinguishable, Miller finds that four menacing accumulations of matter and information--global surveillance, stored embryos, human clones, and reproductive trash--are politically productive rather than threats to democratic politics. As a consequence, she questions the usefulness of individual rights such as privacy and dignity, contests the value of the rational metaphysics underlying human-centered political participation, and re-evaluates the gender relations that derive from this type of participation. Ultimately, in place of these human-centered structures, Miller posits a more meditative mode of democratic engagement. Miller's argument has shattering implications for the debates over the proper use and disposal of embryonic tissue, alarms about data gathering by the state and corporations, and other major ethical, social, and security issues"--

    Abstract: This book provides a comparative perspective on one of the most intriguing developments in law: the influence of basic rights and human rights in private law. It analyzes the application of basic rights and human rights, which are traditionally understood as public law rights, in private law, and discusses the related spillover effects and changing perspectives in legal doctrine and practice. It provides examples where basic rights and human rights influence judicial reasoning and lead to changes of legislation in contract law, tort law, property law, family law, and copyright law. Providing both context and background analysis for any critical examination of the horizontal effect of fundamental rights in private law, the book contributes to the current debate on an important issue that deserves the attention of legal practitioners, scholars, judges and others involved in the developments in a variety of the world’s jurisdictions. This book is based on the General Report and national reports commissioned by the International Academy of Comparative Law and written for the XIXth International Congress of Comparative Law in Vienna, Austria, in the summer of 2014.

The homicide rates increased 900 percent from 1960s-2000, and then dropped relatively quickly to 1970s levels over the next decade. While the author finds the Brazilian military government and rise of para-military police forces to be a major factor in the rise of homicide rates in Brazil, research on violent crime trends has demonstrated that it is generally due to the intersection of many factors (for example changes in policing, social or political structures, availability of weapons, economic influences) rather than a single cause. This work integrates individual, neighborhood, and structural dynamics at play in both the rise and drop in homicide rates, and provides a framework for understanding similar phenomena in other regions, particularly in the developing world. This book will be of interest to researchers in criminology and criminal justice, as well as political science, and international relations, particularly with an interest in South America. The methodology includes both qualitative and quantitative analysis

His is currently a postdoctoral fellow at the Center for the Study of Violence at USP. He completed his master's degree and doctorate in the department of political science at the University of São Paulo, where he researched the rise and fall of homicides in São Paulo. He is the author of the book The X Man - A story about the soul of the killer SP which won the Premio Vladimir Herzog best book report 2006.

    Abstract: This volume critically discusses the relationship between democracy and constitutionalism. It does so with a view to respond to objections raised by legal and political philosophers who are sceptical of judicial review based on the assumption that judicial review is an undemocratic institution. The book builds on earlier literature on the moral justification of the authority of constitutional courts, and on the current attempts to develop a system on “weak judicial review”. Although different in their approach, the chapters all focus on devising institutions, procedures and, in a more abstract way, normative conceptions to democratize constitutional law. These democratizing strategies may vary from a radical objection to the institution of judicial review, to a more modest proposal to justify the authority of constitutional courts in their “deliberative performance” or to create constitutional juries that may be more aware of a community’s constitutional morality than constitutional courts are. The book connects abstract theoretical discussions about the moral justification of constitutionalism with concrete problems, such as the relation between constitutional adjudication and deliberative democracy, the legitimacy of judicial review in international institutions, the need to create new institutions to democratize constitutionalism, the connections between philosophical conceptions and constitutional practices, the judicial review of constitutional amendments, and the criticism on strong judicial review.

    Abstract: This book examines the concept of meaning and our general understanding of reality in a legal and philosophical context. Starting from the premise that meaning is a matter of linguistic and other forms of articulation, it considers the inherent philosophical consequences. Part I presents Klages’, Derrida’s, Von Hofmannsthal’s and Wittgenstein’s explorations of silence as a source of articulation and meaning. Debates about 20th century psychologism gave the attitude concept a pivotal role; it illustrates the importance of the discovery that a word is globally qualified as ‘the basic unit of language’. This is mirrored in the fact that we understand reality as a matter of particles and thus interpret the real as a component of an all-embracing ‘particle story’. Each chapter of the book focuses on an aspect of legal semiotics related to the chapter’s theme: for instance on the meaning of a Judge’s ‘Saying for Law’, on law students training in varying attitudes or on the ties between law and language. Part II of the book illustrates our general understanding of reality as a matter of particles and partitioning, and examines texts that prove that particle thinking is basic for our meaning concept. It shows that physics, quantum theory, holism, and modern brain research focusing on human linguistic capabilities, confirm their ties to the particle story. In contrast, the book concludes that partitions and particles are neither a fact in the history of the cosmos nor a determinant of knowledge and the sciences, and that meaning is a process: a constellation rather than a fixation. This is manifest once one understands meaning as the result of continuously changing attitudes, which create our narratives on cosmos and creation. The book proposes a new key for meaning: a linguistic occurrence anchored in dimensions of human narrativity

    Abstract: This book explores the constitutional, legally binding dimension to legisprudence in the light of the German Federal Constitutional Court´s approach to rational lawmaking. Over the last decades this court has been remarkably active in applying legisprudential criteria and standards when reviewing parliamentary laws. It has thus supplied observers with a unique material to analyse the lawmakers’ duty to legislate rationally, and to assess the virtues and drawbacks of this strand of judicial control in a constitutional democracy. By bringing together legislation experts and public law scholars to elaborate on ‘legisprudence under review’, this contributed volume aspires to shed light on the constitutionalisation of rational lawmaking as a controversial trend gaining ground in both national and international jurisdictions. The book is divided into five parts. Part I frames the two key issues pervading the whole collection: the intricate relationship between judicial review and democracy, on the one hand, and the possibility of improving and rationalizing the task of legislation under the current circumstances of politics, on the other. Part II provides an overview of the judicial review of rational lawmaking, laying special emphasis on the duty of legislative justification imposed on lawmakers by the German Constitutional Court. Part III is devoted to the review of the systemic rationality of legislation, in particular to the requirements of legislative consistence and coherence as developed by this court. Contributions in Part IV revolve around the judicial scrutiny of the socio-empirical elements of rational lawmaking, with the control of legislative facts and impacts and the problem of symbolic laws being the central topics. Finally, Part V draws on the German case law to discuss the links between rational lawmaking, balancing and proportionality, and the interdependence between process review and substantive review of legislation.

    Abstract: This book is about power and freedoms in our technological world and has two main objectives. The first is to demonstrate that a theoretical exploration of the algorithmic governmentality hypothesis combined with the capability approach is useful for a better understanding of power and freedoms in Ambient Intelligence, a world where information and communication technologies are invisible, interconnected, context aware, personalized, adaptive to humans and act autonomously.     Abstract: This book examines the success of Frederick Schauer’s efforts to reclaim force as a core element of a general concept of law by approaching the issue from different legal traditions and distinct perspectives. In discussing Schauer’s main arguments, it contributes to answering the question whether force, sanctions and coercion should (or should not) be regarded as necessary elements of the concept of law, and whether legal philosophy should be concerned at all (or exclusively) with necessary or essential properties. While it was long assumed that legal norms are essentially defined by their force, it was H.L.A. Hart who raised doubts about whether law and coercion are necessarily connected, referring to the empowering, or more generally enabling, character exhibited by some legal norms. Prominent scholars following and refining Hart’s argument built an influential case for excluding force as a necessary element of the concept of law. Most recently, however, Frederick Schauer has made a strong case to reaffirm the force of law, shedding new light on this essential question. This book collects important commentaries, never before published, by prominent legal philosophers evaluating Schauer’s substantive arguments and his claims about jurisprudential methodology.

    Abstract: This volume examines the property transformations in post-communist Central Eastern Europe (CEE) and focuses on the role of restitution and privatisation in such transformations. It argues that the theorisation of ‘restitution’ in post-communist CEE is incomplete in the transitional justice scholarship and in the literature on correction of historical wrongs. The book also argues that, for a more complete theorisation of (post-communist) restitution, the transformations of property in post-communist societies ought to be studied in a more holistic way. The main legal vehicles used for such transformations, privatisation and restitution, should not be studied separately and in abstract, but in their reciprocal relationship, and in connection to the dimension of justice which each could achieve.     Abstract: This volume illustrates to the public, and legal experts, the basic principles of the field of neuroscience, that commonly goes under the name of Neurolaw. First, it illustrates the relationship between neuroscience, natural sciences and social sciences. Furthermore, it highlights numerous problems concerning the fundamental philosophical concepts used by Neurolaw and evaluates the validity of the method and the limits of a neuroscientific approach to the problems of law and justice. The volume explores the possibility of application of these concepts on the fundamentals of the general theory of law and legal dogmatics. It also examines the main problems of Neurolaw in relation to public, private, criminal and procedural law. In conclusion, the book follows a systematic method that makes it an thorough manual for the introduction to Neurolaw.

    Abstract: Auf Basis einer Mehrmethoden-Untersuchung aller empirischen Fälle in der Periode von 1960 bis 2007 entwickeln die Autoren dieses Bandes ein Modell der Ursachen von Staatskollaps. In 43 Fallstudien von Kollapsfällen und Vergleichsfällen werden verbreitete quantitative Indikatoren für fragile Staatlichkeit durch die Erhebung qualitativer Faktoren ergänzt. Der Vergleich mittels QCA ermöglicht dadurch erstmals die Überprüfung vieler gängiger Hypothesen. Durch die Ergänzung der QCA-Analysen mit Prozessanalysen können neben der Entwicklung des Kausalmodells neue Risikofaktoren identifiziert, bekannte Konzepte neu formuliert und Wirkungszusammenhänge zwischen Faktoren aufgedeckt werden. Auf diese Weise trägt das Buch zu einem besseren Verständnis von Staatskollaps und seinen Ursachen bei und erschließt bislang unberücksichtigte konzeptionelle und methodische Ansätze für die Forschung.     Abstract: This edited book is the first of its kind to systematically address the intersection of e-democracy and European politics. It contributes to an improved understanding of the role that new media technologies play in European politics and the potential impact that Internet-based political participation processes may have on modern-day representative democracy in Europe. A unique, holistic approach is taken to examine e-democracy’s current state and prospects in Europe from three, partially overlapping and interlocking perspectives: e-public, e-participation and e-voting. The authors provide both theory-inspired reflections on e-democracy’s contribution to the formation of the European public sphere, as well as rich empirical analyses of contemporary e-participation phenomena such as the European Citizens’ Initiative or e-voting practices in Estonia. Based on the presented findings, the concluding chapter combines a prospective outlook with recommendations for future paths towards meaningful integration of e-democracy in European politics and governance.

    Abstract: This study traces the activities of the European Commission in the natural gas sector from 1990 to 2016, by concentrating on market liberalisation and infrastructure development as the main pillars of the European gas security architecture. By building on previous literature, the Commission’s policymaking is analysed along its formal and informal powers in different energy security environments. In order to get a better understanding of the European energy market context, the reader is introduced into the historical development of the European energy policy in Chapter 2 and the literature on the European Union policymaking in Chapter 3. The analysis of the Commission’s activities in the liberalisation (Chapter 4) and infrastructure (Chapter 5) sectors suggests that the Commission was able to effectively utilise networked governance during times when the demand for coordinated energy policies was low.     Abstract: This is the first book to explore ways of conceptualizing Germany’s ongoing energy transition. Although widely acclaimed in policy and research circles worldwide, the Energiewende is poorly understood in terms of social science scholarship. There is an urgent need to delve beyond descriptive accounts of policy implementation and contestation in order to unpack the deeper issues at play in what has been termed a 'grand societal transformation.' The authors approach this in three ways: First, they select and characterize conceptual approaches suited to interpreting the reordering of institutional arrangements, socio-material configurations, power relations and spatial structures of energy systems in Germany and beyond.     Abstract: Craig Berry assesses UK economic policy in the wake of the financial crisis through the lens of the austerity agenda, focusing on monetary policy, economic rebalancing, industrial and regional policy, the labour market, welfare reform and budgetary management. He argues that austerity is geared towards a resurrection of financialisation and the UK’s pre-crisis economic model, through the transformation of individual behaviour and demonisation of the state. Cutting public spending and debt in the short term is, at most, a secondary concern for the UK policy elite. However, the underlying purpose of austerity is frequently misunderstood due to its conflation with a narrow deficit reduction agenda, not least by its Keynesian critics. Berry also demonstrates how austerity has effectively dismantled the prospect of a centre-left alternative to neoliberalism

    Abstract: This work examines violence in the age of the terror wars with an eye toward the technologies of governance that create, facilitate, and circulate that violence. In performing a rhetorical cartography that explores the rise of the US armed drone program as well as moments of resistive violence that occurred during the Arab Spring directed at generating a counter-hegemony by Muslim populations, Hayes argues that the problem of the global terror wars is best addressed by a rhetorical understanding of the ways that governments, as well as individual subjects, turn to violence as a response to, or product of, the post September 11th terror society. When political examinations of terrorism are facilitated through understandings of discourse, Hayes argues, clearer maps emerge of how violence functions to offer mechanisms by which governing bodies, and their subjects, evaluate the success or failure of the “War on Terror.” This book will be of interest to public policymakers and informed general readers as well as students and scholars in the fields of rhetoric, political theory, critical geography, US foreign relations/policy, war and peace studies, and cultural studies

    Abstract: This book presents a study of the relationship between Cabinet-level Ministers and top civil servants in Ireland. The nature of this relationship can potentially have far-reaching effects on people’s lives as it can influence the type of public policy agreed at top levels of government. A total of sixteen interviews were carried out for the research, eight with retired Cabinet-level Ministers and eight with retired Secretaries General of Irish government departments. Anonymity, not just for the participants but also for the government departments in which they had served, was vital to the success of the research. Also vital was the fact that only retirees were interviewed as this removed the fear for participants that their careers might suffer if they spoke too frankly. The result is a collection of interviews containing frank and open views on the relationship between Ministers and their officials and on how this relationship influences public policy development. Aodhán Mac Cormaic was born in Dublin and is a graduate of the London School of Economics and Political Science, UK, and Dublin City University, Ireland. He was awarded a Doctorate in Governance by Queen’s University Belfast, Northern Ireland, in 2015. He has worked for almost 30 years in the Irish civil service, for most of that time in the Department of Arts, Heritage and the Gaeltacht. Aodhán has worked closely with numerous Government Ministers, including Éamon Ó Cuív and Síle De Valera, both grandchildren of Éamon De Valera. He also worked for a time with President of Ireland, Michael D. Higgins, during his term as Minister for Arts, Culture and the Gaeltacht

    Abstract: This book analyzes the externalization of the EU’s immigration and asylum practices towards non-member transit countries and the consequences of this process. Selected policy areas of externalization (border management, visa policy, readmission agreements and asylum policy) are applied to Turkey and Morocco as two main migration transit countries within two different institutional cooperation mechanisms: Turkey as an EU candidate country within the EU’s enlargement policy; Morocco without membership prospect within the EU’s neighborhood policy.     Abstract: This book compares the trajectories and effects of local public sector reform in Europe and fills a research gap that has existed so far in comparative public administration and local government studies. Based on the results of COST research entitled, ‘Local Public Sector Reforms: an International Comparison’, this volume takes a European-scale approach, examining local government in 28 countries. Local government has been the most seriously affected by the continuously expanding global financial crisis and austerity policies in some countries, and is experiencing a period of increased reform activity as a result. This book considers both those local governments which have adopted or moved away from New Public Management (NPM) modernization to ‘something different’ (what some commentators have labelled ‘post-NPM’), as well as those which have implemented ‘other-than-NPM measures’, such as territorial reforms and democratic innovations. Sabine Kuhlmann is Full Professor of Political Science, Administration and Organization at the University of Potsdam, Germany. Since 2011, she has been a member of the National Regulatory Control Council of the German Federal Government and, since 2012, Vice-President of the European Group for Public Administration (EGPA) and Chair of the COST-Action LocRef.     Abstract: This book traces a dialectic relationship between “politics” and “antipolitics,” the first, as used here, being akin to philosophy as an activity of open inquiry, plural democracy, and truth-finding, and the latter in the realm of ideology, technocracy, and presupposed certainties. It returns back to the emergence of a New Left movement in the 1960s in order to follow the history of this relationship since then.     Abstract: This book explores the impact on EU member states of intensified European cooperation in the field of vocational education and training. By employing the Varieties of Capitalism approach as an analytical framework, it seeks to bridge diverging views from an innovative standpoint: While many experts argue that EU policies liberalize national training systems in spite of being ‘soft law’, Varieties of Capitalism argues that these polices do not produce a convergence of national institutions. The book maintains that European instruments such as the European Qualifications Framework and the European Credit System for Vocational Education and Training are indeed biased towards liberal training regimes. On the basis of case studies on Germany, the Netherlands and England, it shows that the initiatives were implemented in line with national training systems. Thus, European soft law does not lead to a convergence of training regimes – or, as the book posits, of welfare states in general. .

    Abstract: Focusing on the Karen people in Burma, Thailand and the United Kingdom, this book analyses how global, regional and local developments affect patterns of learning. It combines historical and ethnographic research to explore the mutual shaping of intergenerational relations and children’s practical and formal learning within a context of migration and socio-political change. In this endeavour, Pia Jolliffe discusses traditional patterns of socio-cultural learning within Karen communities as well as the role of Christian missionaries in introducing schooling to the Karen in Burma and in Thailand. This is followed by an analysis of children’s migration for education in northern Thailand where state schools often encourage students’ aspirations towards upward social mobility at the same time as schools reproduce social inequality between the rural Karen and urban Thai society. The author draws attention to international humanitarian agencies who deliver education to refugees and migrants at the Thai-Burma border, as well as the role of UK government schools in the process of resettling Karen refugees. In this way, the book analyses the connections between learning, migration and intergenerational relations in households, schools and other institutions at the local, regional and global level

    Abstract: This book provides a comparative analysis of how two radical left parties achieved government participation and their subsequent political experiences. In the face of the most severe and most prolonged crisis in the history of capitalism, it would be expected for radical left parties to seize the opportunity to promote their political agenda. Although reality has often confounded prognosis, two particular radical left parties - the Greek SYRIZA and the Cypriot AKEL - were elected to the highest government office. The author uses these two examples to engage with the broader question of what to expect when left-wing radicals achieve governance. This question is now of particular importance given the emergence of radical leftists in other parts of Europe, including Corbyn in the UK and Podemos in Spain. Yiannos Katsourides is Adjunct Lecturer in the Department of Social and Political Sciences at the University of Cyprus. He has also taught at the European University Cyprus. His previous book, The History of the Communist Party in Cyprus: Colonialism, Class and the Cypriot Left, was published in July 2014. Dr Katsourides has been awarded fellowships from the Institute of Commonwealth Studies of the University of London and the Hellenic Observatory of the London School of Economics

    Abstract: This book takes stock of the lessons to be learned from the experiences of different countries on their way to a transition into a unified Europe. It demonstrates how the project of a unified Europe is a social pilot project that is unique in human history, both with respect to the sheer number of people involved and with respect to the cultural diversity it aims to turn into a progressive advantage. With no historical experience at hand, the transition into a unified Europe is an exploratory process, often risky but sometimes also surprisingly successful. To improve the chances of establishing a successful unification it is particularly important that we learn from the mistakes made so far; and that we learn rapidly, since the forces working against the pilot project of Europe will gain power very fast if the unification success slows down. And as the recent developments in Greece show, the vision of the final goal itself can well change during this exciting quest. Apart from providing the pieces of a mosaic on which a more general theory can be built, this book can be read as a collection of experiences – mistakes as well as triumphs – which should help the European learning process. The structure of the book mirrors Europe’s diversity: specific country studies are combined with more general chapters, and quantitatively oriented econometric work is combined with qualitatively oriented sociological studies.
