    Abstract: Should court officers cause damage to third parties in performance of their duties, these damages are often claimed as public law cases in which the responsibilities are transferred to the state. The liability of public authorities according to § 839 section 1 sentence 1 German Civil Code in conjunction with Art. 34 sentence 1 German Basic Law is part of state liability law. However, public liability law is a Janus-faced area of legal material. Systematically, it belongs to administrative law, and by that to public law. Nonetheless, a government liability suit is a civil courts domain. When it comes to public liability suits, there are many intrinsic issues arising from special rules of civil courts jurisdiction in these matters. The examination at hand enlightens - by no means exhaustive - questions prior to public liability cases and specific problem constellations in matters of admissibility and merits of legal action for public liability claims
    Abstract: Verursachen Amtswalter in Ausübung ihres Dienstes Schäden für Dritte, geht die Verantwortlichkeit für die Schäden als Amtshaftung in vielen Fällen auf den Staat über. Der Amtshaftungsanspruch gemäß § 839 Abs. 1 S. 1 BGB i. V. m. Art. 34 S. 1 GG ist ein Teil des Staatshaftungsrechts. Das Amtshaftungsrecht hingegen ist eine janusköpfige Rechtsmaterie. Denn systematisch gehört es zum Verwaltungsrecht und damit zum öffentlichen Recht, gleichwohl ist der Amtshaftungsprozess eine Domäne der Zivilgerichte. Im Amtshaftungsprozessrecht gibt es eine Vielzahl spezifischer Fragen und Probleme, die nicht zuletzt vor dem Hintergrund der besonderen Zuständigkeit der Zivilgerichte für diese Materie herrühren. Die vorliegende Untersuchung beleuchtet, ohne freilich einen Anspruch auf Vollständigkeit zu erheben, die im Vorfeld eines Amtshaftungsprozesses sich stellenden Fragen sowie spezifische Problemkonstellationen bei der Zulässigkeit und Begründetheit einer Amtshaftungsklage

    Abstract: Die jüngsten Entwicklungen im Strafverfahrensrecht sind durch die strafprozessuale Auslegungsdoktrin der Beschleunigung, Effektivierung und Verbilligung geprägt. Vor dem Hintergrund dieser Entwicklung werden die Vorschriften der §§ 154, 154a StPO als bedeutende Ausformung der verfahrensrechtlichen Beschleunigungsmaxime einer umfassenden rechtsstaatlichen und verfahrensrechtlichen Analyse unterzogen. Die Normen der §§ 154, 154a StPO begrenzen das strafprozessuale Legalitätsprinzip aufgrund von Opportunitätserwägungen und dienen der Konzentration des Verfahrensstoffes. Das öffentliche Interesse an einem prozessökonomischen und ressourcenschonenden Strafverfahren ?ndet seine Grenze jedoch dort, wo das Beschleunigungsstreben zu einer Verletzung des Beschuldigten in seinen prozessordnungsgemäßen Rechten und der Rechtsstaatlichkeit führt. Es stellt sich daher die Frage, ob diese Praxis den rechtsstaatlichen und verfahrensrechtlichen Anforderungen an das Strafverfahren genügt oder gerade keine Berechtigung dafür besteht, dass ? bildlich in den Worten von Peters (StV 1981, 411 (412)) gesprochen ? ?die Justiz zwar den guten Tropfen (Verfahrensbeschleunigung, Entlastung, möglicherweise, wenn auch sicherlich die Ausnahme: Umgehung eines Freispruchs) genießt, den bösen Tropfen (Unschuldsvermutung, Ausschaltung des ausgesonderten Teils bei der Restbeurteilung) jedoch nicht schlucken will?

    Abstract: This book, which originated from the broadly held view that there is a lack of Rule-of-law in Mexico, and from the emphasis of traditional academia on cultural elements as the main explanation, explores the question of whether there is any relationship between the system of constitutional review ― and thus the ‘law’ as such ― and the level of Rule-of-law in a given state. To do so, it elaborates a theoretical model for achieving Rule-of-law and compares it to the constitutional review systems of the United States, the Federal Republic of Germany, and Mexico. The study concludes that the two former states correspond to the model, while the latter does not. This is fundamentally due to the role each legal system assigns to ordinary jurisdiction in carrying out constitutional review. Whereas the US and Germany have fostered the policy that constitutional review regarding the enforcement of basic rights is the responsibility of ordinary courts, Mexico has relied too heavily on the specialized constitutional jurisdiction. .

    Abstract: This volume surveys 150 law books of fundamental importance in the history of Western legal literature and culture. The entries are organized in three sections: the first dealing with the transitional period of fifteenth-century editions of medieval authorities, the second spanning the early modern period from the sixteenth to the eighteenth century, and the third focusing on the nineteenth and twentieth centuries. The contributors are scholars from all over the world. Each ‘old book’ is analyzed by a recognized specialist in the specific field of interest. Individual entries give a short biography of the author and discuss the significance of the works in the time and setting of their publication, and in their broader influence on the development of law worldwide. Introductory essays explore the development of Western legal traditions, especially the influence of the English common law, and of Roman and canon law on legal writers, and the borrowings and interaction between them. The book goes beyond the study of institutions and traditions of individual countries to chart a broader perspective on the transmission of legal concepts across legal, political, and geographical boundaries. Examining the branches of this genealogical tree of books makes clear their pervasive influence on modern legal systems, including attempts at rationalizing custom or creating new hybrid systems by transplanting Western legal concepts into other jurisdictions

    Abstract: This volume analyses the legal grounds, premises and extent of pecuniary compensation for violations of human rights in national legal systems. The scope of comparison includes liability regimes in general and in detail, the correlation between pecuniary remedies available under international law and under domestic law, and special (alternative) compensation systems. All sources of human rights violations are embraced, including historical injustices and systematical and gross violations. The book is a collection of nineteen contributions written by public international law, international human rights and private law experts, covering fifteen European jurisdictions (including Central and Eastern Europe), the United States, Israel and EU law. The contributions, initially prepared for the 19th International Congress of Comparative law in Vienna (2014), present the latest developments in legislation, scholarship and case-law concerning domestic causes of action in cases of human rights abuses. The book concludes with a comparative report which assesses the developments in tort law and public liability law, the role of the constitutionalisation of the right to damages as well as the court practice related to the process of enforcement of human rights through monetary remedies. This country-by-country comparison allows to consider whether the value of protection of human rights as expressed in international treaties, ius cogens and in national constitutional laws justifies the conclusion that the interests at stake should enjoy protection under the existing civil liability rules, or that a new cause of action, or even a whole new set of rules, should be created in national systems.

    Abstract: The discourse on the human right to water presents deliberations on the concept, content and rationale for the right, with little attention to the practical question of translating the right into reality. This book aims to fill this void by focusing on ‘realization’ of the right by its holders, examining how effective the mechanisms are for ‘implementing’ the right in enabling its universal realization. In a quest to answer this question, the book draws a conceptual differentiation between ‘implementation’ and ‘realization’ of the right, arguing that unlike implementation - which is an objective process of creation - and implementation of measures such as legal frameworks, institutional structures or policy and action guidelines, realization of the right is a subjective process that extends much beyond. It takes shape within specific contextual settings which may include varied situations, yet remains neglected in the related academic and action forums. This book attempts to address this void by discussing some of the most significant contexts and the underlying problems and concerns that strongly influence realization of the human right to water. It contends that if the right is to be truly realized, these different contexts - which can be further classified as 'objective' and 'subjective' - must be understood, analysed and appropriately addressed before framing and implementing relevant action. The book further situates the human right to water discourse in a broader interdisciplinary perspective, expanding its scope beyond the narrower legal dimensions, linking it to the wider field of water resources management/governance. Through the novel ideas it proposes, the book makes an innovative and unique contribution in the field of human right to water which is of great scientific value

    Abstract: Die Dissertation wird von dem Anliegen getragen, den Umgang der Gesellschaft mit gefährlichen Straftätern mit den Mitteln des Strafrechts (rechtsvergleichend für Deutschland und Korea) zu analysieren. Im Fokus steht hierbei insbesondere die Sicherungsverwahrung als Maßregel der Besserung und Sicherung, wobei zu Beginn der Arbeit die Einbettung selbiger in das zweispurige System in den Blick genommen wird, am Ende der Schrift dann auch mögliche Alternativen beleuchtet werden. Im Ergebnis wird die Zweispurigkeit des Strafrechts und die Aufnahme der Maßregeln der Besserung und Sicherung in das koreanische Strafgesetzbuch befürwortet, aber zugleich betont, dass der Schwerpunkt der strafrechtlichen Behandlung von gefährlichen Straftätern auf einer erfolgreichen Therapie und Resozialisierung liegen muss und dass insoweit nicht freiheitsentziehende Alternativen Vorrang besitzen sollten
    Abstract: The thesis analyzes a treatment of dangerous criminals on society with viewpoint of comparative criminal law in Germany and South Korea. In particular, with a focus on "preventive detention" as a "measure of improving and security", at first, basic theory of the Measure of Improving and Security is referred for the analysis of Preventive Detention. At the end of the thesis possible alternatives to Preventive Detention are reviewed. As a result, duality of the criminal law and Measure of Improving and Security will have to be acceptable to the Criminal Code, but the focus of the criminal treatment of dangerous criminals should also be successful treatment and re-socialization, alternatives that do not deprive of freedom emphasized to hold a dominant position

    Abstract: This book examines the corpus of status quo environmental legal regime, geographical issues and redundant “stakeholder claims,” which persist in the Arctic. It examines multifarious theories relating not only to conflicting and opposing interests, but also to parties to whom the shipping industry should be accountable. The unique aspect of this book is the Corporate Social responsibility analysis pertaining to the Arctic and alternatives that strike a balance between the increased commercialization of the shipping industry and the laws and concepts of ocean governance. The book relevantly puts forward the concept of “ocean governance” and to what extent it can be addressed in terms of the Arctic. What distinguishes this book from others is the fact that it is not limited to examining the effects of climate change and how it is reshaping the way scholars assume the Arctic will be in the near future. Rather it creates a transparent nexus between opposing claims and increasing commercial interests and proceeds to scrutinize the efforts of the Arctic Council and individual Arctic coastal states. In this context, the book follows a given equation based on initial theories and how the opposing claims and increasing commercialization side of the equation can be balanced with the appropriate legal norm. It also reflects on the critical aspects of “hard law and soft law” which are two opposite ends of the legal pole and core elements of any legal spectrum. The book, after reflecting on those two elements, finally proposes a new Arctic legal regime, which is intricate and detailed and is basically a hierarchy based on logic and reasoning.     Abstract: This work deals with the temporal effect of judicial decisions, and more specifically, with the hardship caused by the retroactive operation of overruling decisions. By means of a jurisprudential and comparative analysis, the book explores several issues created by the overruling of earlier decisions. Overruling of earlier decisions, when it occurs, operates retrospectively with the effect that it infringes the principle of legal certainty through upsetting any previous arrangements made by a party to a case under long standing precedents established previously by the courts. On this account, in the recent past, a number of jurisdictions have had to deal with the prospect of introducing in their own systems the well-established US practice of prospective overruling whereby the court may announce in advance that it will change the relevant rule or interpretation of the rule but only for future cases. However, adopting prospective overruling raises a series of issues mainly related to the constitutional limits of the judicial function coupled with the practical difficulties attendant upon such a practice. This book answers a number of the questions raised by this practice. It makes use of the great reservoir of foreign legal experience that furnishes theoretical and practical ideas from which national judges may draw their knowledge and inspiration in order to be able to advise a rational method of dealing with time when they give their decisions

    Abstract: Common European Legal Thinking emanates from the existence of a shared European legal culture as especially reflected in the existence of a common European constitutional law. It denotes a body of individual constitutional principles - written and unwritten - that represent the common heritage of the constitutions of the Member States. Taking into account the two major European organisations, the Council of Europe and especially the European Union, the essays of this Festschrift discuss a range of constitutional principles, including the rule of law, democracy, and the exercise of political power in a multilevel system which recognises fundamental rights as directly applicable and supreme law. Other essays examine the value of pluralism, the commitment of private organisations to uphold public values, principles or rules, and the objectives and methods of a transnational science of administrative law. These articles highlight the fact that the Ius Publicum Europaeum Commune is “politically” in the making, which can often be seen in the shape of general legal principles. The publication recognises the role of Albrecht Weber as a forerunner of Common European Legal Thinking

    Abstract: This book examines the EU accession to the ECHR from a systemic perspective as well as from the specific perspective of the 2013 draft accession agreement negotiated between the relevant body of the Council of Europe and the EU Commission. It mainly follows a legal positivist approach to examining the nature and scope of obligations that will regulate the new relationship between EU law and European Convention on Human Rights law, concentrating specifically on the issue of jurisdictional interface between the Strasbourg and Luxembourg courts. The book offers an in-depth examination of the core mechanisms of the draft accession agreement, taking into account the remarks in Luxembourg's Opinion 2/13, focusing especially on the issue of attribution of responsibility when a violation of ECHR has been jointly committed by the EU and its Member States, the inter-party procedure and the prior involvement mechanism. The work basically argues that EU accession to the ECHR will have a constitutional impact on the EU legal order, and may also have certain implications for the jurisdictional interface between the Strasbourg and Luxembourg courts. It also questions the mode of interaction between some normative aspects of ECHR law and EU law, offering certain arguments as to the interaction between the Charter of Fundamental Rights and ECHR from overlapping and accommodative perspectives post-accession. The book concludes that with the EU accession to the ECHR - as it stands right now with the draft accession agreement - the macro relationship between the Strasbourg and Luxembourg courts will change significantly, while their constitutional roles will become vertically accommodated and better specialized

Anti-corruption is one of the preeminent issues in the modern global commercial order, and is tackled with the help of criminal law and contract law in different ways in different countries. The reports included in this volume, from very diverse parts of the world, represent a unique and rich compilation of court decisions, doctrinal discussions and a pool of suggested solutions. The central theme is the enforceability of three problematic types of contracts: the bribe agreement, whereby a bribe payer promises the agent of his business partner a personal benefit in exchange for favourable contract terms; the agreement between a bribe payer and an intermediary (a “bribe merchant”), where the latter offers his expertise to help funnel bribes to agents of the business partner; and, finally, the contract between the bribe payer and his business partner which was obtained by means of bribery. The analysis is tailored toward commercial contracts, which can also include contracts with state-owned enterprises. The examination and comparison of international and national initiatives included in this volume advance the discussion on the most appropriate remedies in corruption cases, and show how to get past the boundaries of criminal, private and contract law

    Abstract: This volume presents global and comparative perspectives on the perpetual pendular movement of family law between status and contract. It contributes to the topical academic debate on ‘family law exceptionalism’ by exploring the blurred lines between public law, private law and family law, and sheds light on the many shades of grey that exist. The contributions focus on both substantive and procedural family law on parents and children and on life partners, with particular attention for contractual arrangements of family formations and of conflict resolution. The hypothesis underlying all contributions was the trend towards contractualisation of family law. A convergent research outcome resulting from the comparison of national reports was the ambivalent position of family law in legal systems worldwide. That comparison shows that, whereas family law is clearly moving towards contract with regard to old family formations, the contrary is true for new family formations. The movement towards contract is rarely considered to be contractualisation pur sang, with civil effect. The movement towards status, finally, does not necessarily witness ‘family law exceptionalism’ vis-à-vis private law, in view of the increasing State interventionism in private law relations in general. In sum, as the volume shows, the high permeability of the demarcations between the State, the family and the market impedes a categorial approach. This volume is based on the general and selected national reports on the topic “Contractualisation of Family Law” that were presented at the XIXth International Congress of Comparative Law in Vienna in July 2014

    Abstract: This text collates and examines the jurisprudence that currently exists in respect of blood-tied genetic connection, arguing that the right to identity often rests upon the ability to identify biological ancestors, which in turn requires an absence of adult-centric veto norms. It looks firstly to the nature and purpose of the blood-tie as a unique item of birthright heritage, whose socio-cultural value perhaps lies mainly in preventing, or perhaps engendering, a feared or revered sense of ‘otherness.’ It then traces the evolution of the various policies on ‘telling’ and accessing truth, tying these to the diverse body of psychological theories on the need for unbroken attachments and the harms of being origin deprived. The ‘law’ of the blood-tie comprises of several overlapping and sometimes conflicting strands: the international law provisions and UNCRC Country Reports on the child’s right to identity, recent Strasbourg case law, and domestic case law from a number of jurisdictions on issues such as legal parentage, vetoes on post-adoption contact, court-delegated decision-making, overturned placements and the best interests of the relinquished child. The text also suggests a means of preventing the discriminatory effects of denied ancestry, calling upon domestic jurists, legislators, policy-makers and parents to be mindful of the long-term effects of genetic ‘kinlessness’ upon origin deprived persons, especially where they have been tasked with protecting this vulnerable section of the population

    Abstract: Die vorliegende Untersuchung setzt sich mit neuen Adressaten des Strafrechts auseinander, deren Konstruktion im Strafrechtsdiskurs zunächst an Transformationen des Rechtsstaatskonzeptes denken lassen könnte.     Abstract: Endanger law ('Gefährdungsrecht') is a criminal law which is seeking security – and thereafter fighting ‘risks’ and ‘dangers’ – as its main objective and which is acting on the basis of risk patterns developed by this law itself. Individuals who fit these characteristics are being fought against as endangerers, that means, as high risky figures – and not as offenders. In this work it is presented this figure which has been constructed by the criminal policies and system in Germany during recent years, and has been co-constructed by the Constitutional Court in at least two cases: in the case of the acoustic home surveillance and in the case of the subsequent incapacitation order. Genau in jener Destruktionsenergie liegt die Magie der Vetorechte begründet. Es verwundert daher nicht, dass von diesem Terminus seit jeher reger Gebrauch gemacht wird und selbst das Blockadepotential der ständigen Mitglieder im UN-Sicherheitsrat aber auch das exekutive Durchgriffsrecht des amerikanischen Präsidenten als Vetorecht firmiert. Solch reger Einsatz dieser Begrifflichkeit ist in juristischen wie in nichtjuristischen Bereichen zu verzeichnen. Auch für das deutsche Verfassungssystem lässt sich der Gebrauch der Vetoformulierung eruieren. Die vorliegende Dissertation kapriziert sich auf die Begutachtung damit einhergehender Fragestellungen. Rechtshistorische Herleitungen und eine definitorische Exegese des Vetobegriffs tragen dazu bei, das Bewusstsein für die mit dem Vetoeinsatz einhergehende Machtausübung zu schärfen. Es werden dabei Antworten gegeben auf Fragen wie: Woher kommt diese Macht? Welche Formen kann sie annehmen? Welche Möglichkeiten wohnen ihr inne, wo liegen ihre Grenzen? Darüber hinaus dient diese Studie dazu, für den demokratischen Rechtsstaat Bundesrepublik Deutschland nach der Einpassung von Vetorechten in die grundgesetzlichen Parameter zu fragen. All diesen Facetten der Vetorechte, erweitert um den Spannungsbogen der politischen Dimension, geht diese Dissertation nach

    Abstract: The study presented in this book is a direct response to the needs for defining and registering criminal and judicial data on the European level. Based upon work done in creating the European Sourcebook of Crime and Criminal Justice Statistics (ESB), the project results will improve and complement the standards developed so far for definitions and statistical registration in four fields (police, prosecution, courts, prison), in order to contribute to the picture of criminal justice in Europe. Possibilities to optimize the offence definitions used so far in the ESB context were explored. Also, further crime types, especially those subject to EU-harmonized definition, were tested and introduced. Apart from this, the prosecution chapter of the ESB questionnaire was changed and expanded. Data collection possibilities regarding compulsory measures in the investigatory stage were tested, and a more sophisticated approach for recording sanctions and measures as well as prison data was developed. The study explored how far national statistics can provide such data and developed a concept for collation on European level. It was funded by the European Commission under the AGIS 2006 program

    Abstract: Die Untersuchung befasst sich mit den Regelungen des Niedersächsischen Justizvollzugsgesetzes über den Vollzug der Untersuchungshaft. Mit dem Niedersächsischen Justizvollzugsgesetz, das zum 01.01.2008 in Kraft getreten ist, hat der niedersächsische Gesetzgeber den grundrechtssensiblen Bereich des Untersuchungshaftvollzuges erstmalig in der deutschen Rechtsgeschichte auf eine detaillierte gesetzliche Grundlage gestellt. Ausgewählte Regelungen des niedersächsischen Gesetzes über den Vollzug der Untersuchungshaft werden sowohl einer verfassungsrechtlichen als auch einer verfahrensrechtlichen Analyse unterzogen. Verfassungsrechtliche Vorgaben, verfahrensrechtliche Bedürfnisse und tatsächliche Gegebenheiten werden berücksichtigt, um die bislang überwiegend abstrakten Vorgaben der Verfassung an die gesetzliche Normierung des Untersuchungshaftvollzuges zu konkretisieren und die Regelungen des Niedersächsischen Justizvollzugsgesetzes über den Vollzug der Untersuchungshaft einer ersten Bewertung zuzuführen. Hierbei wird insbesondere überprüft, inwieweit es dem niedersächsischen Gesetzgeber gelungen ist, das Spannungsverhältnis zwischen den Bedürfnissen einer funktionsfähigen Strafrechtpflege und den Freiheitsrechten des Untersuchungsgefangenen auszugleichen

    Abstract: In den letzten Jahren hat die Debatte um den freien Willen an Intensität gewonnen und nicht nur in den Feuilletons ihren Niederschlag gefunden. Die Phase der hitzigen Auseinandersetzung ist inzwischen einem stärker sachbezogenen, vom Bemühen um Verstehen und Vermittlung geprägten interdisziplinären Diskurs gewichen. Doch noch immer bestehen Missverständnisse, Fehlannahmen oder Unklarheiten, die zuweilen flankiert sind von einer Haltung der Diskursverweigerung.     Abstract: In recent years, the debate about the free will has gained intensity. The phase of the heated debate has become a more pertinent and interdisciplinary. But still there are misunderstandings, misconceptions or ambiguities, which are sometimes accompanied by an attitude of denial discourse. This volume helps to highlight the self-perceptions and views of the concerned disciplines: Philosophy and Neuroscience, criminal science and criminal law practice, and not least the Forensic Psychiatry. The book does not claim to present definitive answers but provides clarifications that allow the interested reader to form an reflected opinion.
