    Kurzfassung: Class action lawsuits--allowing one or a few plaintiffs to represent many who seek redress--have long been controversial. The current controversy, centered on lawsuits for money damages, is characterized by sharp disagreement among stakeholders about the kinds of suits being filed, whether plaintiffs' claims are meritorious, and whether resolutions to class actions are fair or socially desirable. Ultimately, these concerns lead many to wonder, "Are class actions worth their costs to society and to business? Do they do more harm than good?" To describe the landscape of current damage class action litigation, elucidate problems, and identify solutions, the RAND Institute for Civil Justice conducted a study using qualitative and quantitative research methods. The researchers concluded that the controversy over damage class actions has proven intractable because it implicates deeply held but sharply contested ideological views among stakeholders. Nevertheless, many of the political antagonists agree that class action practices merit improvement. The authors argue that both practices and outcomes could be substantially improved if more judges would supervise class action litigation more actively and scrutinize proposed settlements and fee awards more carefully. Educating and empowering judges to take more responsibility for case outcomes--and ensuring that they have the resources to do so--can help the civil justice system achieve a better balance between the public goals of class actions and the private interests that drive them

    Kurzfassung: Main description: On the basis of a study of reproach activities ('in situ reproaches', 'mock reproaches' and reconstructions of previous reproach interactions in 'complaint stories') the monograph examines prosodic, grammatical, rhetorical/stylistic processes and their functions in everyday usage. Following an analysis of the constitution of these reproach genres the study charts the consequences for a theory of communicative practice and discusses aspects such as the genre-specific function of grammatical structures, the interaction between prosodic and syntactic procedures in the production of communicative meaning, and the role of indexical signs in the negotiation of meaning.

    Kurzfassung: The years 1989/1990 saw the fall of the Iron Curtain. Following forty years of significant restrictions, legal and non-bureaucratic travel from East-Central and Eastern European countries was once again possible and travelling and returning to those countries became just as easy. Immediately following the end of the East-West conflict, people from East-Central and Eastern European countries took advantage of their new freedom of travel. Many sought to emigrate to Western countries. However, when faced with such immigration, the euphoria which met the end of the political divisions in the West evaporated quickly. Several polls and surveys, projections and prognoses served to unsettle people more than the reality of immigration. This gave rise to a sometimes blind and specious – yet nevertheless politically effective – fear of a new mass migration of peoples. Now, more than ten years after the fall of the Iron Curtain, the actual scale and development of the East-West migration in Europe be clearly evaluated. This book attempts to do just that, including a comprehensive overview and eleven country-specific chapters. Each chapter includes a historical review, an account of the most important changes since 1989/1990 and a forecast of future migration developments. 1989/90 fiel der Eiserne Vorhang. Nach mehr als 40 Jahren erheblicher Einschränkungen wurde die legale und unbürokratische Anreise aus den Staaten Ostmittel- und Osteuropas wieder möglich. Genauso leicht wurde die Ein- und Rückreise dorthin. Unmittelbar nach Ende des Ost-West-Konflikts begannen die Bürger Ostmittel- und Osteuropas, von dieser neuen Reisefreiheit Gebrauch zu machen. Etliche versuchten, in ein westliches Land auszuwandern. Angesichts solcher Zuwanderung verflog die Euphorie über das Ende der politischen Spaltung Europas im Westen relativ rasch. Mehr noch als die tatsächliche Migration beunruhigten aber diverse Umfragen, Hochrechnungen und Prognosen die öffentliche Meinung. Es entstand eine teilweise unreflektierte und vordergründige, aber politisch höchst wirksame Angst vor einer neuen Völkerwanderung in Europa. Mehr als zehn Jahre nach dem Fall des Eisernen Vorhangs können nun tatsächliche Größe und Entwicklung der Ost-West-Wanderung in Europa klar abgeschätzt werden. Damit befasst sich dieses Buch. Differences in average achievement levels across states are mainly traceable to differing family characteristics. However, students from similar families also score differently across states. These differences are related to differences in resource levels and in how resources are spent. States with high spending per pupil, lower pupil-teacher ratios, higher participation in public prekindergarten and higher reported teacher resources have higher achievement. Disadvantaged children are the most sensitive to low resource, and additional resources could substantially their scores. Between-state, rather than within-state, differences in resources appear to be the main reason for inequitable resource levels for students of lower socioeconomic status. The conclusion is that significant math gains are occurring across most states that cannot be traced to resource changes, that the rate of gain varies significantly by state, and that reform efforts are the likely cause of these gains. The results certainly challenge the traditional view of public education as "unreformable

    Kurzfassung: The international character of today's most pressing environmental problems has become a key challenge for environmental policy making.     Kurzfassung: This book uses an institutional-evolutionary approach to analyse economic problems associated with developments in capitalism during the second half of the twentieth century. It argues that economics should centre on institutions - the durable fabric of the economy over time. Drawing on the foundations of Marxist and institutional political economy, the book traces the lineages of institutional themes, as well as considering feminist, post-Keynesian, holistic economics and Schumpeterian perspectives. The nature of institutions in the growth and instability of capitalism is then explored with reference to social structures of accumulation. Particular reference is given to the world economy, the family, the Keynesian welfare state and neo-liberalism, Fordism, the flexible mode of accumulation, and financial regulation and deregulation. The author concludes, using institutional-evolutionary themes of political economy, that the evolution of modern capitalism is likely to be unstable as we move into the next century

    Kurzfassung: This study focuses in detail on the environmental compliance/competitiveness relationship with respect to the regulation of packaging waste. An important and innovative feature of the study is its emphasis on backward and forward linkages. An entire supply chain is considered: packaging manufacturers and suppliers, food processors and the food retail sector, to study the competitive effects of environmental standards on manufacturing companies and the vertical links and supply responses. A variety of regulatory regimes is represented by including within the study companies from Germany, Italy, the Republic of Ireland and the United Kingdom. While it is of note that the relatively strong regulation in Germany has indeed had effects on company behaviour, there is no evidence that environmental regulations hindered companies from achieving competitive performance. Analyses consider: the response of individual firms to different levels of regulation; the cost of compliance; impact on employment; the influence of the supply chain on environmental and competitive performance; the importance of firm size and ownership; and the impact of regulation on competitiveness, and firm competitiveness on the efficiency of adjustment to regulation

    Kurzfassung: The role of the stock market in the recent global financial crisis has led many to question the way in which the modern international financial system operates. This highly topical book offers important insights into the stock market, contrasting the speculative explanation of stock market fluctuations with the conventional efficient markets hypothesis. After summarising economists' views on stock market behavior from the classical period to the present day, the authors focus on two particular explanations of stock price fluctuations. They examine in detail the mainstream neo-classical theory with its emphasis on the efficient markets hypothesis. They then compare this with the theories of Veblen, Galbraith and Keynes who consider markets as being inherently prone to speculation and crisis, in contrast to the neo-classical approach which largely ignores the instability of stock markets and particularly the crashes that have recently occurred. The authors go on to develop a speculative model to account for stock market fluctuations which provides a useful and realistic explanation of how stock price expectations are formed.     Kurzfassung: Conventional economic analysis of property rights in natural resources is too narrow and restrictive to allow for effective comparisons between alternative institutional structures. In this book, a conceptual framework is developed for the analysis of these structures with illustrative application to the allocation of water resources. Ray Challen introduces and develops a model for the analysis of the problems involved in institutional choice that takes into account constraints in institutional change imposed by history and the value of maintaining options in an uncertain future. The emphasis of institutional analysis shifts from assessing the benefits of particular property rights regimes in isolation to considering the distribution of property rights between levels of governments, communities and individuals in an institutional hierarchy. Conceptual developments in institutional theory are illustrated by using a case study of institutional change in the regulation of water use in irrigated agriculture

Immediately following the publication of Keynes's General Theory, Kalecki recognized that the theory of tax had to be re-thought, as aggregate income could no longer be thought of as fixed with respect to tax-induced changes in aggregate demand. To this day, orthodox tax policy analysis continues to ignore aggregate demand effects. The authors consider this orthodox approach to be deficient, and show how tax policies can promote growth without having a negative impact on equity.     Kurzfassung: This unorthodox book derives and tests a simple theory of economic time series using several well-known empirical economic puzzles, from stock market bubbles to the failure of conventional economic theory, to explain low levels of inflation and unemployment in the US. Professor Stanley develops a new econometric methodology which demonstrates the explanatory power of the behavioral inertia hypothesis and solves the pretest/specification dilemma. He then applies this to important measures of the world's economies including GDP, prices and consumer spending. The behavioral inertia hypothesis claims that inertia and randomness (or 'caprice') are the most important factors in representing and forecasting many economic time series. The development of this new model integrates well-known patterns in economic time series data with well-accepted ideas in contemporary philosophy of science. Academic economists will find this book interesting as it presents a unified approach to economic time series, solves a number of important empirical puzzles and introduces a new econometric methodology.     Kurzfassung: En matière d’investissement dans les infrastructures de transport, les études d’impact sur l’environnement sont essentielles à la prise de décision. En effet, les méthodes utilisées par le passé pour rendre compte de répercussions plus vastes que celles des projets pris isolément se sont avérées inefficaces ; l’évaluation environnementale stratégique a donc été conçue pour répondre à la nécessité d’analyser les effets à grande échelle, qu'il s'agisse de ceux du trafic sur l’ensemble des réseaux ou bien de ceux qui concernent le changement climatique et la biodiversité, ainsi que pour comparer les effets des décisions des pouvoirs publics à ceux de projets isolés. Ce rapport passe en revue les travaux récemment menés pour perfectionner l'évaluation environnementale au niveau international et formule des recommandations visant à maximiser l’efficacité de ce nouvel instrument.

    Kurzfassung: Over the last decade, labour market policy in the United States has been undergoing a period of significant restructuring. In the face of welfare reform initiatives, persistent unemployment and declines in real income among some groups (particularly the less skilled), and continued economic expansion, there is pressure on the public employment service (PES) to improve effectiveness. But, it must also come to terms with resource limitations. How have reforms fared so far -- what seems to be working well or not so well? Which of the new approaches may require revision in the event of an economic downturn? Where might adjustments lead to improved effectiveness? While considering such questions, this publication provides an in-depth look at the PES and recent policy initiatives in the United States. Areas of concern about recent reforms are outlined and options for making policies more effective are presented.

    Kurzfassung: NGOs have moved out of the "amateur" world in which they were once confined into, in many cases, highly professional activities. This statistical analysis demonstrates that there are thousands of development NGOs in European countries with as much as 7.3 billion at their disposal. Supported by a large number of tables and graphs, as well as detailed, individual country surveys, the author provides the first-ever such study of what has become a late-twentieth, early twenty-first century phenomenon.     Kurzfassung: Depuis un quart de siècle, les États-Unis jouent un rôle de pionnier dans le domaine de la réforme de la réglementation à l'échelle mondiale. Contrairement à l'opinion courante, les États-Unis ne sont pas moins réglementés que les autres pays mais ils sont réglementés différemment eu égard à l'orientation favorable à la concurrence des régimes réglementaires fédéraux, et à l'ouverture et à la contestabilité des processus de réglementation. Une déréglementation économique de grande envergure associée à des efforts pour améliorer la qualité de la réglementation sociale ont contribué à l'édification de l'une des économies les plus innovantes, les plus flexibles et les plus ouvertes de la zone OCDE, tout en maintenant des normes relativement élevées dans les domaines de la santé, de la sécurité et de l'environnement. Pourtant, d'importants problèmes liés à la réglementation persistent aux États-Unis. Un défi fondamental pour assurer sa qualité consiste à améliorer le rapport coût-efficacité et la performance de réglementations sociales et de formalités publiques coûteuses. En un mot, il s'agit moins de réglementer plus que de bien réglementer. Les États-Unis sont un des premiers pays à avoir demander à l'OCDE de procéder à un examen général de ses pratiques réglementaires et des réformes de la réglementation menées à l'échelon national. Cet ouvrage est le fruit de l'évaluation approfondie menée par l'OCDE et d'un examen par ses pays Membres. Il présente une évaluation sans équivalent de la réforme de la réglementation dans des domaines aussi essentiels que le contexte macro-économique, la qualité du secteur public, la politique de la concurrence et sa mise en oeuvre, ainsi que l'intégration des principes d'ouverture du marché dans les processus réglementaires et dans des secteurs tels que l'électricité et les télécommunications. Les politiques recommandées offrent un plan d'action équilibré à court et à plus long terme fondé sur les meilleures pratiques réglementaires à l'échelon international.     Kurzfassung: In 1997 the U.S. Federal Communications Commission ordered sharp reductions in international settlement rates (bilaterally negotiated rates for telecom traffic between pairs of countries) for telecom traffic between the United States and the rest of the world. Even the very poorest countries, with the least developed telecommunications networks, must slash rates for traffic to the United States by 2003. Will this, by reducing telecom revenues in developing countries, reduce investments in those countries' telecom sectors?

    Kurzfassung: In many industries, competition is far from perfect and managerial efficiency (or a fixed cost) varies among firms. However, traditional measurement of technological progress assumes perfect competition and no fixed cost. This paper incorporates these two factors in the technological-progress measurement and investigates the biases caused by their omission. We show that if capital growth exceeds non-capital-input growth and that firms earn a positive pure profit, then traditional measurement underestimates the true technological progress. We apply this methodology to Japanese and US industries, and find that imperfect competition and managerial efficiency are important. However, the magnitude of the bias is not large ...

    Kurzfassung: The School for the Physical City was built in an office building in the central business district of Manhattan for 500 students, in grades 7 through 12, who use the city’s infrastructure as a vehicle for studying traditional academic disciplines. It is one of the new, small theme schools inaugurated in 1993/94 by the New York City (NYC) Board of Education with support from four nonprofit organisations, initiated under the New Visions School Programme by the federal government.

Diese Frage wird anhand eines umfangreichen Korpus authentischer Gesprächsaufzeichnungen aus den Jahren nach der deutschen Wiedervereinigung beantwortet. "Ost-" und "Westdeutsch" sind dabei die sozialen Kategorien, anhand derer empirisch erarbeitet wird, wie Personen zu Gruppen zugeordnet und wie damit und darüber hinaus gruppenspezifische Eigenschaften und Verhaltensweisen zugeschrieben und bewertet werden. Das Hauptergebnis der Studie ist ein linguistischer Beschreibungsrahmen für soziale Kategorisierungen in Gesprächen und Texten , Main description: The study proceeds from an inquiry into the way in which affiliation to social groups is signalized communicatively. The question is examined on the basis of a large corpus of authentic verbal exchanges (conversations) recorded in the years following German reunification. 'East German' and 'West German' are the social categories forming the basis for the empirical elaboration of how individuals are allocated to group(ing)s and how - both on the basis of that allocation and beyond it - group-specific characteristics and behaviours are ascribed and evaluated.     Kurzfassung: This conference proceedings defines transport benchmarking, analyzes its usefulness to policy makers and discusses what lessons can be drawn at the national and international level for policy makers. The first part examines the different methodological aspects raised by benchmarking methods. The conference clarified the multiple concepts included in this type of mechanism and identified different practices which range from the simple statistical tool to a genuine policy lever. The second part describes several concrete examples of benchmarking applications in the transport sector. These examples relate in particular to topics such as road safety, rail transport, the environment, public and urban transport, seaports and air cargo, etc. Each chapter of this publication may be read independently. A fundamental message, common to all the examples presented, emerges: it is essential to improve the quality of statistics in order to ensure more reliable transport benchmarking results.

The integration of transport markets is a fundamental condition for the development of trade relations and economic activity.This book is an essential tool for all transport professionals. It looks at the most recent transport and investment trends. It then examines the pan-European process of legal harmonisation and adjustment of transport systems and analyses emerging trade and transport links between Europe and Asia. Obstacles at border crossings for international road and rail goods transport are also dealt with along with ways of combating crime in transport. Lastly, the topical issue of public-private partnerships in transport infrastructure financing is tackled and conclusions are presented.

    Kurzfassung: China's remarkable growth in recent years has been often rather arbitrarily ascribed to a number of politico-economic factors. In this volume, the specific effect of foreign direct investment (FDI) inflows is measured quantitatively and estimated on a regional basis. The authors find that there is a much more complex relationship between such flows and growth overall than had hitherto been supposed.     Kurzfassung: Environmental impact assessments are an essential component of making decisions on transport infrastructure investments. Traditional procedures have proved ineffective for impacts that go beyond the scope of projects in isolation. Strategic environmental assessment has emerged in response, to address large scale effects including impacts on traffic across networks, impacts on climate change and biodiversity and the impacts of policy decisions as opposed simply to individual projects. This report examines recent experience in developing environmental assessment internationally and makes recommendations on maximising the effectiveness of this new tool.

    Kurzfassung: Pollution from transport is being cut substantially through exhaust emissions regulations and vehicle manufacturers’ investments in cleaner technologies. The benefits of these improvements, however, are delayed as car fleet renewal takes a decade on average in Europe. Car scrappage schemes can be used to accelerate the uptake of new, cleaner vehicles. This publication analyses the effectiveness of these programmes in protecting the environment and reviews the schemes introduced to date in Europe and North America. Three complementary issues are addressed to help make pragmatic recommendations:- What are the effects of scrapping schemes on the car market and the national economy?- What are the effects of these programmes on the environment?- And can scrappage schemes be useful in former socialist countries?
