    Kurzfassung: "Genocide is a problem: not only the terrible fact of mass death, but also how the relatively new idea and law of genocide organises and distorts our thinking about civilian destruction. Taking the normative perspective of civilian immunity from military attack, this book argues that the implicit hierarchy of international law, atop which sits genocide as the "crime of crimes," blinds us to other types of humanly caused civilian death, like bombing cities, the "collateral damage" of missile and drone strikes, blockades, and sanctions. In other words, talk of genocide functions ideologically to detract from systematic violence against civilians perpetrated by governments. The Problems of Genocide also contends that this violence is the consequence of "permanent security" imperatives: the striving of states, and armed groups seeking to found states, to make themselves invulnerable to threats. To solve the problems of genocide, this book proposes replacing it with permanent security, which should be criminalized"--

From the perspective of law alone, business falls within the general sphere of private law, further broken down into discrete sub-spheres, particularly corporate law and commercial law. The human rights component is situated in constitutional and international law. If law were simply approached from a compartmentalized perspective, business would be of no relevance to human rights and vice versa.     Kurzfassung: "This book has been brought to life in a period where transnational solidarity and cooperation seemed to be moving backwards rather than forwards. This was among others reflected in the so called refugee crisis in Europe in 2015. After the Brexit referendum in the United Kingdom in June 2016, and presidential elections in the US later the same year, the political agenda took a turn towards focusing primarily on the internal national perspective in relation to areas such as environmental protection, aid to countries in the Third World and trade with the outside world. It still remains to be seen when and how the United Kingdom will be leaving the European Union. In general, the EU has experienced a number of crises, among others an economic and financial crisis and later the refugee crisis, during the past years. These crises have challenged transnational solidarity in Europe. This development in Europe and the World stresses the question, whether and how transnational solidarity is possible. This book is motivated by these developments and discusses and attempts to answer this question. Our main presumption is that solidarity can create stability and sustainability (social, economic, environmental, peace etc.), within states, regions and globally, why it is crucial to gain more knowledge about it. Realization of the UN Sustainability Goals 2017 and 2030 go hand in hand with solidarity at both local, regional and global levels. The New Conscientious Objection versus the Old The new generation of conscience based objections differs sharply from its predecessors in that it involves claims that are interventionist and intrusive as opposed to claims aimed at withdrawal and absence from discrete areas of mainstream collective undertakings. Typical of the past, are conscientious objectors who sought to be excused from serving in the military or from going to war, or else from pledging allegiance to their country's flag in public gatherings. In contrast, today's most notorious conscientious objectors seek exemption from generally applicable laws requiring employers to provide contraception coverage in the medical insurance benefits they must extend to their women employees; or from providing services offered to the general public, such as cakes or flowers for wedding celebrations or hotel rooms with large beds, to individuals belonging to sexual minorities; or from issuing marriage or civil union licenses in their capacity as state employees to same-sex couples"--

Human Rights in Thick and Thin Societies uncovers the original intentions of the drafters of the Universal Declaration of Human Rights, finds inspiration from early leaders in the field like Eleanor Roosevelt, and examines the implications of recent advances in cultural psychology for understanding difference. The case studies included illustrate the need to vary the application of human rights in differing cultural environments, and the book suggests a new framework: a flexible universalism that returns to basics-focusing on the great evils of the human condition. This approach will help the human rights movement succeed in a multipolar era.

    Kurzfassung: Joseph Weiler's The Transformation of Europe is one of the most influential works in the history of European studies. Twenty-five years after its original publication, this new collection of essays pays tribute to Weiler's legacy by discussing some of the most pressing issues in contemporary European Union law, policy and constitutionalism. The book does not intend to be a simple expression of intellectual esteem for Weiler's seminal work; instead, the collection honours it by critically engaging with some of its assumptions and theses. Overall, it shows how a study of 1991 can still be fundamental to the present and future of the EU, including the challenges of Brexit and Eurozone crises

Silvana Sciarra, a leading judge and scholar of EU employment law, considers how solidarity regimes have been shaken by the crisis. She brings together existing European policies in social and employment law, to enhance synergies and developments in a post-crisis discourse. She looks at reactions of national constitutional courts to austerity measures and of international organizations in re-establishing respect of fundamental workers' rights.     Kurzfassung: European Labour Law explores how individual European national legal systems, in symbiosis with the European Union, produce a transnational labour law system that is distinct and genuinely European in character. Professor Brian Bercusson describes the evolution of this system, its national, transnational and global contexts and its institutional and substantive structures. The collective industrial-relations dimension of employment is examined, and the labour law of the EU as manifested in, for example, European works councils is analysed. Important subjects which have traditionally received little attention in some European labour law systems are covered, for example, the fragmentation of the workforce into atypical forms of employment. Attention is also given to the enforcement of European labour law through administrative or judicial mechanisms and the European social dialogue at intersectoral and sectoral levels. This new edition has been extensively updated, as the EU's influence on this area of social policy continues to grow

    Kurzfassung: This is the first English translation of the first work of Otto von Gierke, arguably the greatest historian of ideas of the nineteenth century. Community in Historical Perspective includes much of the first volume of Das Deutsche Genossenschaftsrecht, originally published in 1868, and the texts translated here have become essential reading for anyone interested not only in the history of ideas and alternatives to conventional socialism and liberalism, but also, as recent experience has shown, contemporary European affairs. Von Gierke's represented an unparalleled attempt to justify a political programme of structural pluralism, and to interpret the entire course of European history from the Dark Ages onwards as a progressive interaction between 'fellowship' (or 'comradeship') and 'lordship' (or 'sovereignty'). This interaction was to generate a polity of autonomous associations within a constitutional state based upon consent and federal unity, and von Gierke here laid the basis for a distinctively Germanic programme of federalism and quasi-pluralism, with a strongly nationalist emphasis upon the unique capacity of Germans, despite long periods of absolute rule, for corporate self-management
