In the 20th century this modernist movement declined, to be replaced by another cultural episode, characterized by the growing power of Islamic fundamentalism.     Abstract: Class action lawsuits--allowing one or a few plaintiffs to represent many who seek redress--have long been controversial. The current controversy, centered on lawsuits for money damages, is characterized by sharp disagreement among stakeholders about the kinds of suits being filed, whether plaintiffs' claims are meritorious, and whether resolutions to class actions are fair or socially desirable. Ultimately, these concerns lead many to wonder, "Are class actions worth their costs to society and to business? Do they do more harm than good?" To describe the landscape of current damage class action litigation, elucidate problems, and identify solutions, the RAND Institute for Civil Justice conducted a study using qualitative and quantitative research methods. The researchers concluded that the controversy over damage class actions has proven intractable because it implicates deeply held but sharply contested ideological views among stakeholders. Nevertheless, many of the political antagonists agree that class action practices merit improvement. The authors argue that both practices and outcomes could be substantially improved if more judges would supervise class action litigation more actively and scrutinize proposed settlements and fee awards more carefully. Educating and empowering judges to take more responsibility for case outcomes--and ensuring that they have the resources to do so--can help the civil justice system achieve a better balance between the public goals of class actions and the private interests that drive them

    Abstract: Main description: On the basis of a study of reproach activities ('in situ reproaches', 'mock reproaches' and reconstructions of previous reproach interactions in 'complaint stories') the monograph examines prosodic, grammatical, rhetorical/stylistic processes and their functions in everyday usage. Following an analysis of the constitution of these reproach genres the study charts the consequences for a theory of communicative practice and discusses aspects such as the genre-specific function of grammatical structures, the interaction between prosodic and syntactic procedures in the production of communicative meaning, and the role of indexical signs in the negotiation of meaning.

    Abstract: The years 1989/1990 saw the fall of the Iron Curtain. Following forty years of significant restrictions, legal and non-bureaucratic travel from East-Central and Eastern European countries was once again possible and travelling and returning to those countries became just as easy. Immediately following the end of the East-West conflict, people from East-Central and Eastern European countries took advantage of their new freedom of travel. Many sought to emigrate to Western countries. However, when faced with such immigration, the euphoria which met the end of the political divisions in the West evaporated quickly. Several polls and surveys, projections and prognoses served to unsettle people more than the reality of immigration. This gave rise to a sometimes blind and specious – yet nevertheless politically effective – fear of a new mass migration of peoples. Now, more than ten years after the fall of the Iron Curtain, the actual scale and development of the East-West migration in Europe be clearly evaluated. This book attempts to do just that, including a comprehensive overview and eleven country-specific chapters. Each chapter includes a historical review, an account of the most important changes since 1989/1990 and a forecast of future migration developments. 1989/90 fiel der Eiserne Vorhang. Nach mehr als 40 Jahren erheblicher Einschränkungen wurde die legale und unbürokratische Anreise aus den Staaten Ostmittel- und Osteuropas wieder möglich. Genauso leicht wurde die Ein- und Rückreise dorthin. Unmittelbar nach Ende des Ost-West-Konflikts begannen die Bürger Ostmittel- und Osteuropas, von dieser neuen Reisefreiheit Gebrauch zu machen. Etliche versuchten, in ein westliches Land auszuwandern. Angesichts solcher Zuwanderung verflog die Euphorie über das Ende der politischen Spaltung Europas im Westen relativ rasch. Mehr noch als die tatsächliche Migration beunruhigten aber diverse Umfragen, Hochrechnungen und Prognosen die öffentliche Meinung. Es entstand eine teilweise unreflektierte und vordergründige, aber politisch höchst wirksame Angst vor einer neuen Völkerwanderung in Europa. Mehr als zehn Jahre nach dem Fall des Eisernen Vorhangs können nun tatsächliche Größe und Entwicklung der Ost-West-Wanderung in Europa klar abgeschätzt werden. Damit befasst sich dieses Buch. These differences are related to differences in resource levels and in how resources are spent. States with high spending per pupil, lower pupil-teacher ratios, higher participation in public prekindergarten and higher reported teacher resources have higher achievement. Disadvantaged children are the most sensitive to low resource, and additional resources could substantially their scores. Between-state, rather than within-state, differences in resources appear to be the main reason for inequitable resource levels for students of lower socioeconomic status. The conclusion is that significant math gains are occurring across most states that cannot be traced to resource changes, that the rate of gain varies significantly by state, and that reform efforts are the likely cause of these gains. The results certainly challenge the traditional view of public education as "unreformable

    Abstract: The international character of today's most pressing environmental problems has become a key challenge for environmental policy making. As regulation by a supranational authority is not a realistic option at present, policymakers have to rely on decentralized approaches to the management of international environmental resources.     Abstract: This study focuses in detail on the environmental compliance/competitiveness relationship with respect to the regulation of packaging waste. An important and innovative feature of the study is its emphasis on backward and forward linkages. An entire supply chain is considered: packaging manufacturers and suppliers, food processors and the food retail sector, to study the competitive effects of environmental standards on manufacturing companies and the vertical links and supply responses. A variety of regulatory regimes is represented by including within the study companies from Germany, Italy, the Republic of Ireland and the United Kingdom. While it is of note that the relatively strong regulation in Germany has indeed had effects on company behaviour, there is no evidence that environmental regulations hindered companies from achieving competitive performance. Analyses consider: the response of individual firms to different levels of regulation; the cost of compliance; impact on employment; the influence of the supply chain on environmental and competitive performance; the importance of firm size and ownership; and the impact of regulation on competitiveness, and firm competitiveness on the efficiency of adjustment to regulation

    Abstract: The role of the stock market in the recent global financial crisis has led many to question the way in which the modern international financial system operates. This highly topical book offers important insights into the stock market, contrasting the speculative explanation of stock market fluctuations with the conventional efficient markets hypothesis. After summarising economists' views on stock market behavior from the classical period to the present day, the authors focus on two particular explanations of stock price fluctuations. They examine in detail the mainstream neo-classical theory with its emphasis on the efficient markets hypothesis. They then compare this with the theories of Veblen, Galbraith and Keynes who consider markets as being inherently prone to speculation and crisis, in contrast to the neo-classical approach which largely ignores the instability of stock markets and particularly the crashes that have recently occurred. The authors go on to develop a speculative model to account for stock market fluctuations which provides a useful and realistic explanation of how stock price expectations are formed.     Abstract: The chapters of this volume apply the tools of public choice theory to the types of questions which economic historians have traditionally addressed. By adding the insights of public choice economists to the traditional tools used to understand economic actors and institutions, the authors are able to provide fresh insights about many important issues of American history. Each contribution analyzes an episode in American economic history within a public choice framework of rational maximization. Agents or interest groups are interpreted as either responding in predictable ways to economic incentives put in play by government policy or attempting to influence government policy. Public Choice Interpretations of American Economic History includes eight essays that examine: Why states contributed to the national government under the Articles of Confederation. The major nineteenth-century transitions in the source of state revenues away from fees and investments and toward the property tax, and from state to local government funding of infrastructure. Three economic failures from the American West in the late nineteenth and early twentieth century: overgrazing of the northern plains, despoliation of the Yellowstone Basin, and low productivity of Indian communal lands. This collection documents social development in the Asian countries of China, Hong Kong, Taiwan, South Korea, Thailand and India and concludes that social development has lagged behind economic development. This has given rise to `distorted development' in many countries. Serious development problems of poverty and inequalities have lingered even in these economically advanced countries of Hong Kong, Taiwan, and Singapore. These problems have been exacerbated in the wake of the Asian economic crisis. In order to harmonize social development with economic growth, Asian states ought to be more proactive in their development agendas. As a text on social development in Asia, this book is primarily intended for practitioners and students of social work, social administration, and social policy. It is also relevant for students and practitioners of sociology, economics, and public policy

    Abstract: This Handbook of Democratic Government is the first compact and comprehensive data collection which simultaneously provides comparative and complete information on the composition of governments between 1945 and 1998 in 48 countries across the democratic world. Parties, ministries, competences, ministers and parliamentary support are listed, as well as duration, type of government and reasons for termination. This information is provided for 48 parliamentary democracies, covering the whole period 1945-1998. Also included is additional comparative information on institutions and governance, based on the countries' constitutions and related basic laws. The data are organised in such a manner that every researcher can use them as a basic data set, ready to be transformed according to the particular needs dictated by the research undertaken. Various levels of analysis are possible, both cross-nationally and across time, ranging from individual ministers and separate ministries to specific parties, governments or countries. This data collection will save researchers in the field of comparative politics valuable time and resources as it can be utilised in connection with, or in addition to, other data sources

    Abstract: This work analyzes the implementation of controversial public policy. A single, overarching model provides the framework for testing competing theories, ranging from Max Weber's bureaucracy theory and Woodrow Wilson's theory of administration to more recent ideas on how the legislature controls the bureaucracy. The model combines ideas about policy implementation drawn from different disciplines: political science, public administration, sociology and economics. The author uses a novel empirical test design to measure agency performance and deviations from political decisions taken in three Dutch local authorities. In contrast to more conventional implementation studies, this work adopts a `few variables, many cases' approach. The model and empirical tests, which are fully clarified in the book, together offer a novel framework for the analysis of complex implementation processes. A previous version of the book (written in Dutch) was awarded the prestigious Van Poelje prize of the Dutch Association for Public Administration and the 1996 annual award of the Dutch Political Science Association
