    Abstract: "This book introduces students to the anthropology of magic, witchcraft, and supernatural belief. It takes a new approach to this area within the anthropology of religion, demonstrating that the bases for these beliefs and alleged practices are instinctual, inherent in human cognition and psychology, and are likely rooted in our evolutionary biology. It shows how magic and magical thinking are regular elements in people's daily activities, and that understanding the components of the witchcraft complex offers surprisingly important insights into patterns of thinking and social behavior. The book reviews the many meanings of "magic" and "witchcraft," explains why they are inadequate, and introduces the anthropological meanings of the terms. The components of these beliefs are timeless and universal; this fact, and recent advances in the brain sciences, suggest that the principles of magic are derived from basic processes of human thinking, and the attributes of the witch derive from neuro-biologically based fears and fantasies. Such beliefs had adaptive significance in the evolutionary development of the human species; they are inherently human. This book is intended to focus anew on the core concepts of magic, witchcraft, and the supernatural, while also serving as a valuable introduction to the anthropology of religion for undergraduate and graduate-level courses

    Abstract: In recent years, Bengali Muslims in India have faced harassment and scapegoating as the trope of the illegal Bangladeshi has gained political currency. India's Bangladesh Problem explores the experience of Bengali Muslims on the Indian side of the India-Bangladesh border in the context of neoliberal policies, unequal bilateral relations, labor migration, contested citizenship, and increasingly xenophobic government rhetoric. Drawing on extensive research in the borderlands and hinterlands of both countries, Navine Murshid argues that ever-deepening neoliberal policies across the border have shaped how certain ethnic groups are valued and have reconfigured social hierarchies. She provides new insights into the strategic inclusion, exclusion, and invisibility that characterizes Bengali Muslims' lives, rendering them a group susceptible to manipulation by virtue of their ethnic kinship to the majority of Bangladeshis. In turn, Bengali Muslims simultaneously resist and utilize received neoliberal ideas to sustain their lives and livelihoods at a time when neoliberal development has largely bypassed them

    Abstract: This book explores and addresses body search practices in prison environments from different angles (criminology, sociology, human rights and law) and discusses such practices in different national contexts within Europe. Body searches are widely used in prison systems across the globe: they are perceived as indispensable to prevent forbidden substances, weapons or communication devices from entering the prison. However, these are also invasive and potentially degrading control techniques. It should not come as a surprise, then, that body searches are deeply contested security measures and that they have been widely debated and regulated. What makes theses control measures problematic in a prison context? How do these practices come to be regulated in an international and European context? How are rules translated into national law? To what extent are laws and rules respected, bent, circumvented and denied? And what does the future hold for body searches? Tom Daems is Professor of Criminology at the Leuven Institute of Criminology (LINC), KU Leuven, Belgium. At LINC, he coordinates the research line on ‘Punishment and Control’. Daems has published widely on punishment and prisons, in particular from a European perspective. With Palgrave, he previously published Electronic Monitoring: Tagging Offenders in a Culture of Surveillance (2020) and Europe in Prisons: Assessing the Impact of European Institutions on National Prison Systems (2017, co-edited with Luc Robert). .

    Abstract: This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective. On the basis of the distinction between organizational and individual deviance, it could be shown across national boundaries that the unwritten rules of the organization make a decisive contribution in explaining organizational wrongdoing, as well as their containment. Implications for effective prevention derived from this are also pointed out.     Abstract: 'Another India' tells the story of the world's biggest religious minority. Weaving together vivid biographical portraits of a wide range of Indian Muslims--elite and subaltern, secular and clerical, activist and apolitical--it brings the experience of the country's Muslims under a single focus; and, by throwing light on the Indian Muslim condition during the first thirty years of independence, reflects on the true character of democratic India. What we have here is a rather different picture from received accounts of the 'world's largest democracy'. Challenging traditional histories of Nehru's India, Pratinav Anil shows that minority rights were neglected right from independence. Despite its best intentions, the Congress regime that ruled for three decades was often illiberal, intolerant and undemocratic. Muslims had to contend with discrimination, disadvantage, deindustrialisation, dispossession and disenfranchisement, as well as an unresponsive leadership. Anil demonstrates how the Muslim elite encouraged depoliticisation, taking up seemingly noble but largely inconsequential causes with little bearing on the lives of ordinary members of the community. There was no room for mass protests or collective solidarity in this version of Muslim politics. Another India explores this elite betrayal, whose consequences are still felt by India's 200 million Muslims today

    Abstract: This book offers a comprehensive analysis of the legal questions that arise for the legislative branch when implementing the crime of aggression into domestic law. Despite being the “supreme international crime” that gave birth to international criminal law in Nuremberg, its ICC Statute definition has been incorporated into domestic law by fewer than 20 States. The crime of aggression was also omitted in the rich debate held among German scholars in the early 2000s regarding the legislative implementation of other ICC Statute crimes. The current inability of the International Criminal Court to respond to the Russian aggression towards Ukraine invites the continuation of these academic debates without neglecting the particularities of the crime of aggression. The fundamental issues discussed in this volume include the obligation to criminalize aggression, the core wrong of the crime, the normative gaps under domestic law and the jurisdictional gaps under the ICC Statute. To facilitate the operationalization of domestic implementation, the book explores the technical options for incorporating the definition into domestic law, the geographical ambit of domestic jurisdiction—most notably universal jurisdiction—as well as legal challenges such as immunities. The book is aimed primarily at researchers and States with an interest in the domestic implementation of international criminal law but those already working in the field should also find much of interest contained within it. Dr. Annegret Hartig is Program Director of the Global Institute for the Prevention of Aggression and worked as a researcher at the University of Hamburg where she obtained her doctoral degree in international criminal law.

    Abstract: This book considers the intellectual property protection of clinical test data that has been submitted to governments, in particular through test data exclusivity rights. It focuses on how these intellectual property rights first emerged in the early 1980s, how they have globalised over the past four decades, and what impact they have had upon access to medicine. This book makes a number of significant and original contributions to the literature around the protection of submitted test data. First, the book draws upon the theory of regulatory globalisation to provide an explanation of how intellectual property rights in submitted pharmaceutical test data have become nearly ubiquitous in the legal systems of most major economies. Second, through a comprehensive analysis and synthesis of provisions on the protection of submitted test data in free trade agreements, as well as a comparison of a range of national approaches to the protection of submitted test data, it reveals the broader global regulatory pattern that has given rise to these intellectual property rights. Third, by analysing data on drug approvals in the US, it provides an empirical insight into the impact of test data exclusivity in national pharmaceutical markets. Fourth, the book covers a number of developments regarding test data exclusivity that have occurred as a result of responses to the COVID-19 pandemic, both at the national level as well as at the World Trade Organisation (WTO). This book will appeal to academics researching the intersection of intellectual property and the life sciences, civil society activists working to promote access to medicines, and students (particularly those at the post-graduate level) studying the relationship between intellectual property and medicine.

    Abstract: This proceedings volume combines chapters derived from papers presented at the 4th and 5th Annual Conferences on the Future of the Commercial Contract in Scholarship and Law Reform. This ongoing research project brings together scholars from all over the world at an annual international conference in London. The book focusses on technology in commercial contract law as well as on sustainability in commercial contracts. The latter theme was inspired by the United Nations' climate conference that was to take place in Glasgow in the United Kingdom that same year.     Abstract: This book explores the impact of 'Fintech' on the information asymmetry between the financial regulator and the markets. It details the growing regulatory mismatch and how Fintech exacerbates the “pacing problem”, where the regulator struggles to keep up with innovation.     Abstract: This book explores the issue of leadership criminality from a new angle by comparing two highly relevant modes of responsibility. By contrasting individual criminal responsibility for ordering international crimes with indirect perpetration through an organisation, it shows the doctrinal weaknesses of the latter and outlines the much-overlooked advantages of the former. The volume analyses the development of both forms of responsibility, looking at their origins, and their reception in academia and practical use in jurisprudence. The history of indirect perpetration through an organisation (Organisationsherrschaft) is portrayed from its German academic origin, through German jurisprudence to the reception of the doctrine at the International Criminal Court. By comparing the doctrine’s stages of evolution, the book sheds light on the different aspects of the various models of indirect perpetration through an organisation and carves out general and fundamental criticism of it. The characteristics of ordering liability are explored in depth through an analysis of jurisprudence of the Nuremberg subsequent trials, the ad hoc tribunals and the International Criminal Court. This historic and doctrinal comparison reveals a well-defined and to-date much neglected mode of responsibility with enormous potential for the adjudication of leadership figures in the ambit of international criminal law and only one conclusion can follow from this analysis: it calls for practitioners and academics to leave the well-trodden paths of national criminal law doctrine and embrace truly international modes of liability such as the ordering of a crime. This volume in the ICJ series provides practitioners, researchers and students with a detailed account of forms of leadership liability and an innovative approach to the topic’s most discussed issue. Dr. Johannes Block is a criminal lawyer specializing in international criminal law, responsibility of leadership figures, questions of perpetration and participation in crime as well as the national-socialists’ crimes. He studied in Münster, Germany and Bogotá, Colombia and obtained his Dr. iur. from the University of Cologne, where he also worked and taught as a research assistant for several years.     Abstract: "If anyone still questions the power of visual images to propel political action, the constant stream of videos circulating on social media-police killings of Black men and women, prisoners at the Guantanamo Bay prison camp, celebrating participants in the January 2021 Capitol uprising-have captured the attention of a nation. But exactly what those videos purport to show is often a matter of dispute. Interpretation is in the eyes and mind of the beholder. Deep disagreement to the point of physical violence both reflects the contested events these videos depict and threatens to further entrench political and social divisions. Visual images amplify, accelerate, and even generate vastly different storylines; they show us who and what we are. Whether we can or should believe what we see in visual media is a quandary as old as media itself. Because what we think we see "moves" us-emotionally and ethically-the stakes have always been high. Those stakes are, if anything, even higher now given the impact of our visually saturated media landscape, created by the confluence of digital technologies, smart phones equipped with digital cameras, and social-media platforms. Seeing and Believing focuses on the challenges and opportunities that this complex media landscape presents to us. It examines how these technologies are deliberately designed to influence what we see and how we interpret it. Seemingly godlike-all-seeing-in its reach and persuasive power, we underestimate our own power to resist.
